Well in my opinion, they can bring in a thousand experts and not one of them can justify what JA did to Travis...just to think what the last moments of his life were like and what must have been going thru his mind makes me so sad and angry at the same time. I just don't understand how someone can butcher a person they supposedly loved...I hate watching her in that courtroom smiling like nothing is wrong or getting snarky with JM like she in in the right...its almost beyond comprehension

You would think that in order to get an accurate diagnosis a professional would need to monitor the subject for an extended time period in some cases without the subject knowing it as well as having at length discussions with them. In criminal cases such as this the subject pretty much knows what boxes they need to check/circle.

But:

This guy's testimony will have no affect whatsoever on whether she gets the DP. The was it works is that once the verdict of first degree (premeditated) murder is reached, the next step in the process is the penalty phase, where the jury has to decide on the DP or LWOP. This is all spelled out in the AZ criminal code, Title 13, statute #13-751, Penalty Phase.

The jury does this by considering whether there are aggravating factors (toward DP) or mitigating factors (toward "leniency"' i.e. LWOP.)

There are 13 aggravating factors enumerated in the statute including murder committed in an "especially heinous, cruel or depraved manner" (yep, think this qualifies!) and 5 mitigating factors including age of the defendant, capacity to appreciate wronfulness ot the act, etc...none of which are whether the defendant was 'traumatized'' by the act or does/does not remember committing the murder.

The DP in given if the jury finds one or more aggravating circumstances and determines that there are no mitigating circumstances sufficiently substantial to call for leniency, i.e. LWOP.

So, I don't get the point of this guy's testimony at all...if anything I think he was damaging to the defense, both by equating Jodi to police officers and servicemen and by talking about how murderers are 'traumatized' by their crimes. Really?? We are supposed to feel sympathy for the poor traumatized murderers now??

What do you mean-was stuff stolen from JA's grandmother?

The murder weapon was stolen from grandma/grandpa, along with a dvd player and about $30 cash.

Between trips to buy gas, stabby explained she returned to Brewer's home to return a remote control. JM asked stabby why she had Brewer's remote control. Earlier in testimony, JM asked Brewer about a visit he had from Matt McCartney on stabby's behalf. We don't know where all this is going because JM hasn't tied it all together so far, but if the remote control was in fact the remote to the stolen DVD player, then it's proven Jodi committed the burglary at her grandparent's home, the stolen .25 caliber gun was in her possession prior to the murder. There is no evidence to corroborate stabby's testimony that Travis owned a gun. Neither bullets nor the holster he supposedly owned for this gun was found by police. On the other hand if stabby had some of the other items reported stolen from the burglary when she made her trip to Mesa, she most certainly also had her grandparent's gun. This would prove premeditation far beyond any reasonable doubt.

My theory is that she forgot to give the remote to McCartney along with the stolen DVD player. She gave the remote to Brewer for him to give to Matt
