WHAT IS THE DIFFERENCE BETWEEN FIRST DEGREE MURDER AND SECOND DEGREE MURDER?

The main difference between first degree and second murder is "premeditation". Under Arizona Revised Statute 13-1105, first degree murder is defined as:

"Premeditation" means that the defendant intended to kill another human being or knew [he] [she] would kill another human being, and that after forming that intent or knowledge, reflected on the decision before killing. It is this reflection, regardless of the length of time in which it occurs, that distinguishes first degree murder from second degree murder. An act is not done with premeditation if it is the instant effect of a sudden quarrel or heat of passion. [The time needed for reflection is not necessarily prolonged, and the space of time between the intent or knowledge to kill and the act of killing may be very short.]

Ex: Going for a gun when she could have ran out of the house, or continuing to stab him after he was not longer a threat, slitting his throat and not calling 911, etc.

If she gets 2nd degree, I believe they said she could be jailed for 22 years.

May 10th i believe. Does anyone remember her saying she had recorded other sex talk but deleted it on a different phone? I thought she said this one was the Helio. That would mean she had two live phones and numbers, or am i just scrambling stuff up?

This may have already been addressed at this point but remember the hours for that SLC gas station were 5 am - 1 am. She bought the gas at 3 am approximately. There is no way she bought anything other than gas at the pump at that time. Yes she's done.

In the shower pic with his eyes closed and head back under the showerhead, it looks like you can see the upper right egde of the closed metal door. I thought they all were taken with it open as well but noticed that coursing water in two pics and couldn't figure how it was doing that on him in such a different pattern than the rest of the water. Now it makes sense.

They, of course, are having a field day with the 'battery' part. I brought it to the attention of one of Travis's sisters yesterday and she gave me the explanation. Someone that Travis knows got arrested for those crimes and gave Travis's info in place of his own. Shannon Hogan,the author of Picture Perfect wrote a paragraph in her book about it: "On another occasion, Travis discovered he was being fined $515 for a conviction for robbery, contempt of court and assault and battery that he had not committed. When he called the department of corrections to learn the origin of these charges, he learned that a man using his identity had just served six months in jail. Travis’s identity had been stolen.
“I was really innocent,” he said. “I did not know what to do.”
Travis called his Prepaid Legal attorney and within an hour his record was expunged."
Travis has NO criminal record except traffic violations. (admin/Cathy)

I think she meant to either take camera with her or at least remove the memory card but in her hurry to get out of the house and throwing stuff in the washer the camera got tangled up in the towel,socks and other garments that she put in the wash. By the time she realized she didn't have either it was too late to back to the house to retrieve them.

Just read through the redacted autopsy report by Kevin Horn. It is dated 7/15/08. If the autopsy report has been discussed in the past, apologies. I remember discussion of Detective Floes, but not the actual autopsy report. As i read thru I am so sad.

Travis has serious defensive wounds consisting of 5 cuts to his hands. One to his right which cut out part of his thumbnail. The other four were to his left hand. A deep cut across the bottom part of his thumb severing the muscles and tendons. Two cuts to the webbing between his thumb and index finger. Another cut on his left thumb. These wounds would have been quite painful.

He had an abrasion to his right forearm, contusions and abrasions to his rt lower leg and knee. He had 2 abraided laceration to his left heel (cuts from a deep scrape). The wounds to his left heel might have come from being dragged.

There had to be a struggle in consideration of the wounds.

Other items of interest is there was no urine in his bladder. There was undigested food in his stomach. Last but not least, Travis was shaved...Pubic hair that is. That was a little surprise to me.
