I'm pretty sure the ME said the gunshot was last due to the lack of blood loss. He said if it would have been first Travis would have been incapacitated quickly.

He did testify that his belief is the gunshot came last....because of the fact that this injury would have caused him to lose consciousness within seconds and would have incapacitated him, greatly. Also, because of the lack of bleeding from the injury....he would expect to find bleeding within the cranium and brain, and he found none.

Yesterday Jodi explained why she didn't wait to buy cheaper gas in Nevada or Utah by saying:

HOWEVER her cell phone records show a call to Travis at 8:16 pm. She testified she told him she was coming and he said, "Really?" and that he would wait up for her.

She buys the gas at 8:46 pm ALREADY KNOWING that she will be going to Mesa on a road she is very familiar with and where the gas stations are.

There is a call to Ryan at 9 something saying she is on her way to Utah, but that would be simply another lie as she has already told Travis to expect her by morning.

Excellent point! I had not recalled the timing comparison of the gas receipts and phone call. I hope Juan points this out VERY clearly in his closing, or on the cross of her jury answers (or both).

WHAT IS THE DIFFERENCE BETWEEN FIRST DEGREE MURDER AND SECOND DEGREE MURDER?

The main difference between first degree and second murder is "premeditation". Under Arizona Revised Statute 13-1105, first degree murder is defined as:

"Premeditation" means that the defendant intended to kill another human being or knew [he] [she] would kill another human being, and that after forming that intent or knowledge, reflected on the decision before killing. It is this reflection, regardless of the length of time in which it occurs, that distinguishes first degree murder from second degree murder. An act is not done with premeditation if it is the instant effect of a sudden quarrel or heat of passion. [The time needed for reflection is not necessarily prolonged, and the space of time between the intent or knowledge to kill and the act of killing may be very short.]

Ex: Going for a gun when she could have ran out of the house, or continuing to stab him after he was not longer a threat, slitting his throat and not calling 911, etc.

The actual revised statute #13-1105, Definition of first degree murder from the AZ.gov website:

A person commits first degree murder if:

1) Intending or knowing that the person's conduct will cause death, the person causes the death of another
person, including an unborn child, with premeditation or, as a result of causing the death of another
with premeditation, causes the death of an unborn child.

That's it. Nothing in the statute defines what premeditation is...all the other stuff you quoted is I'm assuming what the attorney added as his interpretation on his website.

If anyone knows better please correct me...I have no legal experience and am just going by what I can find online.

Arizona's law that allows juror questions rocks!

I've read that Arizona is one of only three states that allow this! I have never heard of it, personally, and my state is not one of the three. But, I agree....I love it! Especially in this case.....these jurors need to ask questions so that they have all they need when heading in to deliberate.

That's part of the reason I don't think she shot him first... I simply don't think it would be satisfying enough for her, not enough to quell her rage/jealousy/hate/whatever.

That's the only problem I have with the recreation. Once she slit his throat, he was done. He would not have put up any fight. I think he may have let out a 'death rattle', which she mistook for Travis breathing.

I agree. Poor Travis. He was too young to die.

No he didn't. He couldn't speculate order, but said that given the lack of hem. around the entrance wound it is likely that it occured after the neck slash since most of the blood would be out of his head at that point...

Of course that's what he said! It's my head that's on last this morning. Sorry for misleading anyone. Brain thinking one thing, fingers typing another!! ME testified that, in his opinion, gunshot came last. There!! I do recall him saying that it passed through the front of Travis's brain and would have rendered him helpless very quickly.

RE: the drive from LA to Mesa... it's not scary at all. It's mostly desert, but there are tons of gas stations along the way. It's a straight shot down the I-10, a major interstate. I've driven it many times, and so had Jodi when she was living in palm springs and coming to Mesa to visit Travis. The drive to Vegas is a lot dicier.

I haven't driven to Mesa, but I have driven from SoCal to Vegas and I will agree it's a bit of a chore.

I'm not from that area but have visited a few times...I remember driving across Death Valley once watching my gas gauge drop lower and lower w/no gas stations in sight. I was so scared! Then finally one appeared. That experience has stuck with me ever since so that's why I could sort of relate to what she was saying. Of course like I said I'm not from around there so I'll defer to those of you who are.

I have to agree. I lived in the Mojave Desert for a few years (in Las Vegas) and we often traveled to California via that route, passing through both Barstow and Baker. So desolate that I was terrified during the entire trip. We had extra water and fuel, but there is nothing but desert for mile upon mile.

I have never been scared driving the I-10 that route. I don't even really think about gas that much, you notice you're low on gas and boom, there's a gas station.

I did get scared on the way to Las Vegas once, was low on gas and didn't run into a station until I was running on fumes. The highway is not a major interstate and at times, there are just two lanes and nothing around for miles and miles.

yep - and i know its dumb - but she keeps saying the wrong hwys all the time - like saying she was taking the 60 to arizona one time - its just irritating - she just thinks she knows it all and is a "right fighter" - but which is prolly why she will be found guilty - so i guess its good

To be fair, she probably did get on the 60 to get to Mesa, but that is in town and she'd only have to be on it for maybe 15 miles before getting off on a side street to get to Travis's house.
