Yep, she absolutely didn't have to resort to that level of brutality when she was claiming self-defense. The stabs to the back -- 11 in the upper back area; there's no way anyone can play that off as self-defense. Slit throat, no way to spin that as self-defense. Stab to the neck/ear and to the back and top of head? Nope not self-defense because he would've had to be in a sitting or laying down position while Jodi was above him.
The only wounds that could be argued as a possible self-defense are those on his front side; stomach and chest; imo. And even then, it's overkill 3 stomach wounds and 4 chest wounds, including one directly to the heart.
I still wouldn't believe self-defense, but if the wounds were confined to his stomach/chest, she would've had a better claim. 7 wounds to the front you could at least debate self-defense. Still wouldn't buy it though.

The state's case is so strong and the evidence is so comprehensive, they have all the tools to get the death penalty. If they don't, it can only be from their own mistakes and bad strategy.

Day 24 of Trial - Afternoon only
I am updating some of my estimates of age. I am looking at these people and kind of referencing mine and my husbands age. I am 47, he is 48. When I write the letter for each Juror, I will put both Mondays age (in parenthasis) and Weds.
Juror Question Basket I personally saw one juror put a question in the basket, but there were maybe 5 or 6 when they emptied it at the end of the day. There were none in it when I first came in, so I am assuming they empty it everytime they break.
Who I had a the best line of site of D, E, H, I , K, L, N, O, P, Q
- after the break some others in the court room changed places, so I could see less of some and more of others.
H, I, K, L, O, R, is all I had clear line of site of after the 3 o'clock break, others were only if someone in front of me moved or leaned.
All (or most that I could see)
All are seeming to pay closer attention once the testimony gets to Travis' house. Overall more attentive.
All look at Jodi as she looks at naked pictures of herself that were not shown on screen (but I understand they have been shown before. )
They did show one picture of naked Jodi on the screens. Its one of her laying on the bed whole body. All of the jurors I could see looked at the small screen except one, and I noted that below.
Most looked at the naked picture of Travis on small screen, or not at all. 4 looked at big screen. also noted below
When Jodi refers to the picture that shows "my stuff down there" (rear end view) photo most jurors look at Jodi. Not shown on the screens.
I would say all jurors I could see paid close attention to the testimony about taking her things to the car and when, several nodded when Juan said something about the heat in June, in Mesa. Off and on, I think everyone wrote at one time or another during this testimony.
A few other notes I made
The back row of the sitting area was empty, so it seems even the general spectaters are getting fatigued. Monday they were full, and many people did not get in.
The deputy was sitting in a different place, the Jodi row can no longer interact with him.
Noticed the judge just threw out "Is that a hypothetical?" when Nurmi objected to something, she didn't call them up or anything.
No juror laughed at the word "Hog tie" many spectators and media did.

I also noticed on page 13 of Flores report that he said the gunshot came from no closer than 2-3 feet away. Didn't Jodi say she was about 2 feet away from the shower when she was taking pics, so that the camera didn't get wet?
The state's case is strong, but lack of death penalty doesn't mean they failed. Acquittal means they failed. Hung jury to a lesser extent. But the reality is, when it comes to the death penalty, not everyone supports it. Heck there are lot of people who post here who are against it. And while jurors are asked whether they are capable of applying the DP before they are chosen, the reality is, there could very well be one or more people on the jury who would not want to mete out that punishment.
You can do everything right legally, but human emotions are a wild card. There are people out there who think the DP is barbaric. There are people who think "an eye for an eye" is wrong and doesn't bring the victim back. It is quite possible for someone on the jury to believe that way, regardless of whether they said prior.

When I was younger, I was fully in favor of the death penalty.
Now that I am older, I would call my self generally opposed, but not entirely opposed in all circumstances.
In a case like this one, if the family was OK with the DP, then I would be OK with it, and I base that on very strong evidence and proof that this person (Jodi) did the crime, and the extremely violent nature of the crime.
Ugh, they are talking on HLN about that sex is what draws people in. Not me, what draws me in is that not only is there a brutal slaughter, but the pictures, OMG there are pictures before and during this crime!!
Yeah, it's pretty rare -- outside of serial killers -- that a murderer "records" their actions. We're not just seeing crime scene photos. We're seeing the killer during the commission of the crime.

Dear Diary,
Just got off the stand. Nurmi is rattling on and on about who knows what. I am just hoping he doesn't start picking his nose again. What is up with that? I find it very distracting. Oh great...he just played with himself. I hope the cameras didn't catch that. He is such an embarrassment. I wish Rob Lowe could have defended me. I hear he is a really good attorney.
Today I was asked if I would classify murdering Travis as a high point, or a low point in my life. I think I said it best when I said it was a "defining moment in my life." Before this, I was not on any real path, per se. But now, I have a set destination and a goal. I can't predict the future (as I told Martinez numerous times) but if I had to guess, I would say very big and wonderful things are headed my way.
For example, I think I proved today just how talented and skilled I am as an actress. I have no doubt that I will be the star in my own made for t.v. movie. You should have seen the way I threw off my glasses and put my hands up to my face. It was so dramatic and believable. Getting those butt-ugly glasses off was key. I've been planning this for weeks. It is really important that when I am perceived as being my most vulnerable, that I am also at my most beautiful. I played the perfect damsel in distress. Who can resist that?
I will admit that it didn't all go exactly as I planned. I was planning on a huge breakdown where I shook like a chihuahua and screamed at Martinez calling him a "bully, just like Travis!" Then I was going to fake passing out. I was really getting into the role and was just about to go all out when the judge decided to call for lunch. I was like, um, are you kidding me? My second attempt at my big moment was when I was reading the beautiful email I wrote to the dead Travis. I started my version of crying, but Martinez stole the spot light and took it from me by reading the letter himself. What a jerk.
I just cannot wait for this trial to be over and for me to be set free. I am sick of living in a tiny cell that is smaller than a closet. How inhumane is that? It is pure torture. Worse than any person should ever have to suffer. Some day I will show everyone just what I am worth. I will be living in a mansion. My knife and gun storage room will be bigger than most people's living rooms.
I've started working on a list of what I think the jury will ask me when it is their turn for questions. Here is what I have come up with so far:
-Are you currently single?
-When you are set free, will you keep in touch with us?
-Do you hate Martinez as much as we do?
-Why are you so awesome?
-Can we have your autograph?
I am working on responses to all of these questions. I know I will score a touchdown with them. I just love football terminology. Makes me feel like such a cute little tomboy. I bet everyone is wishing I was wearing hot boy shorts and a football jersey. Hmmm, maybe that is what I will wear to my first press conference!
Anyway, I gotta run. The bus is here to take me back to the jail.

ex 193 is one of the autopsy photos. It is the one showing the wounds to the back of the head, I believe.
