But wouldn't it still be extreme cruelty if the ME said he would be incapacitated after the first shot. Wouldn't the stabbing be the same as shooting him after stabbing him. Even if Flores' testimony was off the ME said he would be incapacitated after the shot. (I'm just trying to understand the whole legal side of it.)

i think thats the problem -cuz if the shot came first - he wasn't incapacitated, he has definsive wounds on his hands, all the blood on the sink - where he would have to be standing, the struggle all the way down the hall - til she slit his throat and then drug him back to the shower - and that gives them the argument she was struggling w/ him the entire time, rather than putting a bullet after he was dead or just barley alive and unconscious - the me said if he was incapacitated - he couldn't have even lifted his arms to get the defensive wounds

I was re watching trial day 3 earlier and tried to work out if the ME was saying he would be incapacitated with the shot. Surely he would have been?! Also regardless of which came first he was clearly fighting for his life.

It just broke on Insession that The Arizona Supreme Court has denied a stay in the death penalty portion of the Arias' trial

am i understanding this right??? they denied the emergency stay on the death penalty portion so court resumes on monday, but the still have to rule on whether they will or will not remove the DP as a possible penalty???

At times, Nurmi was smirking too. I think part of him loved it that Jodi was giving Martinez such a hard time. Nurmi loathes Martinez...deeply loathes him.



I think we will see her skip back and forth between the two. Especially when Martinez is grilling her about the murder details.



Sometimes he did. I watched a lot of it again last night. I think Nurmi looks most pissed when Martinez is going after Jodi. I think Nurmi loves that his role is the big white knight in shining armor. Martinez going after his "damsel in distress" messes with his intended image.



I know that really pissed off Nurmi and Willmott too. But, Martinez can say that over and over again (and I believe he will too), as long as he doesn't use the word "murder." Jodi has admitted to "killing" Travis. The defense's claim is that is was a "killing in self defense," not a "cold blooded, premeditated murder."



I don't think so. But, who knows! Crazier things have happened.

Even if "Matt the liar" gets up there and lies his butt off, which we all know he will, and Martinez makes mincemeat out of him, the defense might believe it will still benefit Jodi if the jury hears his lies. You can't "un-hear" something. The defense is praying that there is at least one really dumb juror up there whom they can confuse enough.



That is a great screenshot. You should send it to the Maricopa County Jail. I'm pretty sure Arpaio would have a fit if one of his deputies passed anything to Jodi. Hopefully the deputy in the screenshot is smart enough to realize that and didn't indulge the crazy Donovan "lady."

I got information about this note from another site. There was someone snoring loudly during testimony. Many of the trial watchers were annoyed because they couldn't hear. Donovan's not was for court officials to have the snoring man stop snoring...lol

Thank you! I saw a post where she had lunch with a man whose brother was a murder victim in a similar case. She said they were both crying while sharing stories, so I wasn't sure if she knew him.
