Today was a crazy clusterfuck. I was pleased to see Jodi trip over herself and sport a 'tude, lets hope the jury doesn't like it. JM was guns blazing all day, but the constant side bars and lulls were meh. Overall I think JM is winning, but we need more. More dirt on JA, more nooses to hang herself with, so to speak.

It was only his first day. I think with the long weekend coming, he geared his start with that in mind, not to start off with something that gives killer the weekend to dream up BS on anything he needs more time for. He hit it out of the park imo even for first one day. His style is unique, I don't think it is fabricated for Jodi. Lisa, Gus come to mind. He stays very focused. We've seen it with him many times before. Some even complained when he would raise his voice to his own witnesses. That's Juan lol
He knocked down so much in only these few hrs, I'm impressed. I just hope it doesn't end on a flat fast note like he did with his CIC.

How about a reality check? This trial is not about Martinez "avenging" Travis's death with aggressive questioning. His only goal is to convict on first degree murder and prove aggravating factors to bring in the death penalty. Let's review:

1. Jodi already admitted killing him
2. She offered to plead guilty to second degree murder
3. The prosecution turned down that deal and went to trial
4. Jodi has been lying and doing dumb shit before the trial even started

If he does not prove premeditation and aggravating factors, he has failed. He had second degree murder in the bag and thought he could get first degree murder WITHOUT having the gun and WITH the uncertain testimony from the ME about sequence of events. After 5 years, all of the expense, investigation, and all of the cost and time invested in the trial Martinez is not off to a good start.

Everybody knows she lied - can you prove beyond a reasonable doubt to a jury that she planned it?

Trial isn't over yet. He has to prove them by the end. not any given day.
Can't complain about a trial, how long it's been, investigation, costs - that's the way our system works. She's the one that wanted a trial, offered a plea that brings one. The prosecution isn't obligated to let her get off slaughtering a human being just because she wants to 'offer a deal'.

Don't need the gun, she was great in admitting there was one. Even added the felony of theft of it for you. lol Stole it and took it to the desert all on her own words.

Proving self-defense does not guarantee an acquittal. If at any point the prosecution shows that the death resulted from a burglary, self-defense is no longer a legal justification and she's guilty of first degree murder.
Whether it's true or not, she's already testified in her own words that she stole Travis Alexander's gun, his rope, and his bottle of personal lubricant!

ETA: There is no proof that Travis owned either a gun or this soft rope, but we do know that he had a bottle of personal lubricant because we can see it in the picture. It would be epic if she got put away for life simply because she swiped some KY Jelly.

I believe that Martinez has to be somewhat aggressive in his handling of Jodi. As Harlette said, Jodi tried to damage Travis in every way possible, dragging him through the mud. Martinez needs to correct that and show that it was Jodi that was the evil, lying one.

If he doesn't? Well, we don't know what the jury was thinking after Jodi's testimony for the defense. Some of them may have believed her a little bit and/or feel sorry for her. Martinez needs to show she is not a victim and Travis was not a sexual deviant/abuser/pedo.

I couldn't agree more. JM is on his way to revealing the true Jodi to the jury. I was having fits watching her disdainful behavior today, but in the end, that's really what the jury needs to see.

Dear Diary,

Wow. Just WOW. I cannot even believe how awesome I was in court today. I had Martinez on the run. You should have seen me. I could tell the jurors were really impressed with how witty and clever I was. I could not keep a smirk off of my face. I may not be a lawyer, but I know the law. And I know that when you break a law you do everything you can to keep from getting punished for it. Especially, um, lying. I am an expert at that. Martinez was so confused by me today. I was able keep the questions going round and round. The smirking was my way of letting the jury know just who was in charge.

I only had a very brief look, but I thought he might be the younger, dark haired Nathan Mendez, the Special Agent with the U.S. Dept of Interior, who was a Siskiyou County Sheriff's Detective when Arias was arrested, the one who led the search of the grandparents' home, following Travis' death.

With all her lies PLUS admitting to MURDER and three different stories and then her "self-defense" theory, is a complete joke. If any juror has a brain, they would automatically know this and know there was no abuse and NO "self-defense" because she was never abused by Travis. PERIOD.

Simply put, Martinez must appeal to the jury in the most effective way. Likability is a part of that, just as in a presidential election. After all this testimony, 12 amateurs go in a room and decide what has been proven (or not) beyond a reasonable doubt. If they "like" Martinez they are more likely to vote his way.

Gee, I don't think I can recall "likeability" being part of the Judges instructions to the the jury. If any jury member decides guilt or innocence on likeability of defence or prosecution lawyers that is pretty fucked up.

Dear Diary,

Wow. Just WOW. I cannot even believe how awesome I was in court today. I had Martinez on the run. You should have seen me. I have to say, the lessons Gus gave me are really paying off. He told me just how to handle Martinez. Or as Gus likes to call him, Fartinez. Isn't Gus just hilarious?!? I cannot get over how smart he is. He is an inventor you know. No wonder he can invent these amazingly clever words too. Maybe I will call Martinez "Fartinez" in court. I will have the jury laughing their heads off. Heads off. There is a funny, um, turn of phrase! lol I will admit that I do not look forward to, um, paying Gus for his expert advice. Let's just say that it involves more than a little KY Jelly and quite a few Toblerones.

Speaking of KY Jelly, they have not responded to my request to be a spokesperson for them. This is something they are going to really regret. I will not be ignored. I am going to start a class action lawsuit against them. I am going to claim that the overuse and consumption of KY Jelly has caused me severe selective memory problems. Then I will contact the ADA. I plan on getting a special card describing my specific memory disability. The next time Martinez asks me a question I don't want to answer, I will just hand him the card.

I was a little bummed that Flores figured out my super secret code messages in the magazine. I bet he had to have the FBI help him with that. I am working on a new secret code in case these diary entries ever get leaked out. I-a think-a that-a my-a new-a code-a will-a never-a, ever-a, be-a able-a to-a be-a cracked-a. ha ha ha Good luck deciphering that code!

Well, as always, my date card is overflowing. I am the most popular girl here. Obviously. I have found amazing and creative ways to use the items we get from commissary to fulfill all my sexual fantasy needs. Who knew nose drops, denture adhesive, and hemorrhoid cream could be so sexy and fun! Not to mention the old standbys like meat sticks and chap stick. Tonight I am going to mix things up a bit with the ben gay cream and bbq corn nuts. Things are about to get hot in here!!

Something I noticed.
Jodi can't remember her "regular, loving' sexual encounters with Travis, all she remembers are the ones that made her feel like shit. Jodi also stated that she loses memory with stressful situations.
Why in the world would she lose memory, and therefore likely be "stressed" about regular encounters, but remember the bad ones and therefore likely be "not stressed"

Martinez: "...so you can tell us for example, what type of sex you had with Mr. Alexander many years ago, but you're having trouble telling us what you said a couple of days ago?"
Arias: "When I'm under stress, yeah, it affects my memory."
Martinez: "I thought you said your relationship with Mr. Alexander was very stressful."

He should have stopped her RIGHT THERE.....and said, "It seems to me, you have ONLY recalled, in exact DETAIL...the 'stressful and traumatic' sex with Travis. We have heard no recounts of loving, tender or nice sex. So, how is it Ms. Arias, you can tell us specifically what supposedly happened to you during those moments, but other stressful instances to you, you're having difficulty remember the details, due to the stress and trauma of the situation?? Your memory lapse 'factors' are inconsistent."

Maybe he's building up all these "memory lapse" incidences and, he'll later, drive the point home that she sure has a lot of memories to drag Travis's name through the mud, for it being so scary, traumatic and stressful for her... I have faith as the days on cross continue, he's going to expose more and more about all of these tall tales she has told, and call out the liar she is!!!!!!!!!!!

much as we don't like seeing her so smug and snarky (smarky?) on the stand, the jury sees this new her too. This is more of the real Jodi than we've seen yet. She cannot help herself. She is all about herself. She thinks she's showing the State, she's really showing the jury. And I think next week she will be back on the stand more subdued and meek.

My thoughts on the sex? I think she used it to control men. I don't think she got much out of it but it fed her need to hold men. Sex wasn't a fun playtime activity or a chore, it was one way she held onto the men she wanted. She kept trying to reel them back in with sex and when it didn't work and she let her ugly out to play with weapons.

So I did a little work and cut and pasted some of Jodi's journal pages beside the messages in the magazines, obviously the writing isn't the exact same because one is hand written with pen and one is printed in pencil on glossy pages BUT I'm positive it wouldn't take much for an expert to prove the same person wrote both.

The most upset I saw Arias today was when Juan questioned her about her jealousy, she seemed to have the strongest reactions to that. Juan should keep pushing that line.
