Of course that's an area she knows well and the place she lived before the family relocated to Yreka. Salinas is quite a run from Monterey. Of course she tried to cover that up by saying she had to go over to Salinas to catch the 101 to go south (to L.A.). I don't know that route very well. How about a reality check? This trial is not about Martinez "avenging" Travis's death with aggressive questioning. His only goal is to convict on first degree murder and prove aggravating factors to bring in the death penalty. Let's review:

1. Jodi already admitted killing him
2. She offered to plead guilty to second degree murder
3. The prosecution turned down that deal and went to trial
4. Jodi has been lying and doing dumb shit before the trial even started

If he does not prove premeditation and aggravating factors, he has failed. He had second degree murder in the bag and thought he could get first degree murder WITHOUT having the gun and WITH the uncertain testimony from the ME about sequence of events. After 5 years, all of the expense, investigation, and all of the cost and time invested in the trial Martinez is not off to a good start.

Everybody knows she lied - can you prove beyond a reasonable doubt to a jury that she planned it?

Much more likely to get a conviction if the jury isn't buying Jodi's lies, don't you think?

The facts prove Jodi did things that show premeditation - the fake robbery with the missing gun, the rented car, the gas cans, taking the battery out of her phone, etc.

As for showing all of this, again this is day 1. If Martinez had rested, I would agree that he didn't get the job done. We may be in for another week of cross-examination. We simply don't know. Let's give him the benefit of the doubt, wait till he's done, then dissect his performance.

I don't know about that. Dr. Drew has his jurors aka courtroom observers and they said today that there is one woman who has seemed to try and connect with Jodi throughout the trial.

Who knows, maybe this juror is the "Jodi type" with her narcissism, jealousy, lack of personal responsibility and manipulative nature. Sadly there are lots of Jodis out there, and one could have gotten on the jury. I hope not though.

Tawnidilly went way above and beyond the call of duty for this thread. I mean, she went into the house and busted out the CSI gear. I want to ask her if the bathroom side of Travis Alexander's closet actually locks from the inside, since Jodi testified that it did.

We know this in our hearts, it is obvious she is guilty of first degree murder from outside the courtroom.

But does Martinez have the evidence to prove that in a court of law beyond a reasonable doubt? Where is the gun? Where is the knife? Is he proving aggravating factors and premeditation beyond a reasonable doubt? Mark my words, he doesn't have the evidence to do it. Her testimony has explained (poorly, but still explained) many of her suspicious actions enough to cast doubt on premeditation.

Based on the evidence, the verdict will be guilty of 2nd degree murder, just what she would have taken before the trial. I am going to put a lot of the blame on the medical examiner and Martinez letting him off the stand without truly pinning down the sequence of events.
