    11.05 − First-Degree Premeditated Murder
The crime of first-degree premeditated murder requires proof that the defendant:
    1. caused the death of another person; and
    2. intended or knew that [he] [she] would cause the death of another person; and
    3. acted with premeditation.
?Premeditation? means that the defendant intended to kill another human being or knew [he] [she] would kill another human being, and that after forming that intent or knowledge, reflected on the decision before killing. It is this reflection, regardless of the length of time in which it occurs, that distinguishes first-degree murder from second degree murder. An act is not done with premeditation if it is the instant effect of a sudden quarrel or heat of passion. [The time needed for reflection is not necessarily prolonged, and the space of time between the intent or knowledge to kill and the act of killing may be very short.]
but if the gun just went off than it was an accident and she didnt intend to kill him... then if she became rageful and blacked out she could have killed him without knowing/meaning it.

I am actually very pissed that we spent more time hearing about her phone sex then the murder. Days on emails but thirty minutes on the murder, so one minute per wound?

That is only a SMALL part of 308 pages . Look up - arizona raji criminal jury instructions

The jury would have to first believe her crock of shit that the gun just went off. Good luck on that one.

There is more to just self defense law because there are additional instructions when a Def claimes domestic abuse self def.

Oh I think if you stabbed someone once, there's a chance you might not have meant it. If you accidentally shoot them, then stab them 27 Times and cut their throat, I think you'd remember meaning it. And remember, it was Travis who was in a RAGE, not Jodi, according to her testimony today.

Jodi claims she can in Arizona not only purchase it, but BIG quantities so it could build up in her blood.

Do you really believe the gun went off by accident?

yes, that's why i dont think it was premeditated anymore. I really think it was an accident, at least the gun... stll trying to decide if she doesnt remember ANY of the stabbing, but i think it still could be possible. but the accidental gun thing, i really do believe.

Even if what she was is true -- which I don't believe for a minute -- we're supposed to believe that Travis kept a gun in the bathroom closet, but had no bullets? How does one defend themselves with no ammo?

No, it doesn't make sense. What does make sense is that someone brought the gun and ammo and took it with them when they left. I.E., Jodi.

I have to say though, right now on JVM, they are shooting a video from Dave Hall, showing Travis shooting Dave Hall's gun.

Since Travis is shown shooting what looks to be a semi-auto rifle, why would he have a puny low-caliber gun in his home?

If he was shooting guns, he knew something about them and their firepower. He wouldn't have something that ineffective for self-defense. And he wouldn't bother taking it "sport shooting" as again, he was firing semi-auto rifles with Dave Hall. After that, a .25 cal is nothing.

If he was super-interested in guns, he would have had something like a .45 or a 9mm. Or something remotely effective.

A few questions, if you don't mind?

If you believe the gun went off by accident, do you believe Jodi when she said the gun belonged to Travis?

Do you believe she had time to climb up the shelves and get the gun, within seconds, with Travis supposedly chasing her? His bathroom was pretty big, but it was not that big that she had the time to do that, imo.

If you don't believe the gun was Travis', and instead you believe Jodi brought it with her, then why do you think she brought it?

And finally, don't you think it's a pretty big coincidence that a gun with the exact same caliber was "stolen" from the house Jodi lived in, less than a week before she murdered him?

I am glad he did. The judge allows wayyyyyyy too much from Nurmi. Seems Nurmi thinks he is the water and the judge. He'll, sometimes he even thinks he's the witness. He testifies in his questioning. Bet he wishes he could be the jury as well!

Guys, I think what I brought up is important: She confessed to burglary (taking the gun), and this nullifies her justification defense whether it's true or not. She's got automatic LWOP just like an unarmed driver in a gang-related drive-by shooting. You didn't actually think she was gonna get the DP did you? It's over.

No broken bones, no bruises, no nothing.
She claimed he "body Slammed" her into the tile. Personally I'm saying she was never body slammed by an almost 200# man and was able to 'run' immediately way from it and remained so agile she could climb shelves like a effing monkey.

I call bullshit on Jodi's ridiculous claims that she intended to commit suicide. Being a survivor of suicide (my husband, many years ago), having a daughter who is a psychologist, and being involved in Samaritans suicide prevention groups....if someone gets into the "zone" where they are suicidal, they do not come in and out of that fog at will. They make darned sure that they will succeed in what they set out to do. I am not saying that everyone succeeds, or that suicidal persons don't find the reasons to keep on going in life....I am living proof of that. But Jodi describes her "plans" in a way that is unreal and pure fantasy. She "made a cut, like a paper cut....and it stung really bad" so she stopped? I thought, ironically, how Travis must have felt as Jodi sliced and diced him to ribbons....yet, Jodi had tears in her eyes as she described how badly her cut hurt? WTF?!

Yes, isn't Jodi a frail little girl? How is a frail little girl "bodyslammed" by a 200lb man, and then able to jump right up and run to the closet?

The entire murder -- 27 fucking stab wounds, a throat slit to the hilt and a shot to the head, all happened in about 5 minutes. How are we to believe that all of that happened after/while Travis is menacing her?

I can't wait till the prosecution gets their crack at her. Martinez is going to tear through her like a rabid dog.

She's complete borderline. I wonder if they did a psych evaluation in prison on her. I'm sure they would have to do something after the supposed "suicide attempt." I have a borderline family member and it's difficult to deal with.

Jodi has impulsive behavior (random road trips, converting to mormonism, sexual behavior) as well as complete abandonment issues. She mentioned that things were good until she was about 7 or so? Was that when her little sister was born? I wonder if she had some jealousy issues no longer being the only girl in the family. I know she loves her sister and all, but I can see some intense jealousy because she needs attention.

She actually probably believes now that she was victimized and what she did to Travis was "right" in her eyes. I'm going to get all school like and even say in Millon's Subtype she is capricious/borderline.

Somehow I don't beleive the two are equal. Domestic violence isn't in the first one. Whole new game when she puts that in. DP, no, never thought she'd get it. She's a woman.
Our society therefore our Juries hold extra special rules for female killers. Not legal rules, unconscious preconception, prejudice rules. We still hear, 'how could they hurt their own child' centuries after we know woman kill them all the time.
If the gender roles were switched, the male would fry and the dialog would have been a lot different.

I asked about Advil being available for prisoners to buy in American jails. Kristinella gave me a link to the Commissary of a few prisons, and it's definitely available in the prisons on the link. No California jail's on it btw. I'm totally shocked it's available to purchase in ANY prison.

Don't get me wrong, we have a way too lenient justice system in the UK. This (UK) country's so up it's own arse re human rights, the victim's often lost sight of. Believe it or not, over here a life sentence for murder can constitute 25 years. Not saying that would be so in this kind of case, but it does happen. I digress. An inmate cannot purchase any kind of medication, not even for cramps, it would have to be 'given out' by a medical officer. I find it all really interesting, the comparisons.

**Thanks for the link Kristinella. The comparisons of different countries, not to mention states, are really interesting.
