    .25 ACP will incapacitate someone with one shot only 49% of the time.

    I think she wanted to use the knife first so she could unleash her rage on him. She took a chance, but knew she had the gun as a backup if needed.

    i think you just go by oppostite of what jodi says - she talked about making cookies for their trip - travis talks about how he made the cookies for the trip on his blog - she says travis forced her to have anul - darryl said they had it - so it wasn't her first time - the list goes on, basically reverse every thing she says, and you know what the truth is

    I can't imagine the hatred Jodi must have felt towards Travis to literally stab him in the heart. The amount of energy that would take, and the feeling when the knife actually entered his body - I could never do something like that. She should get the DP, 50/50 she actually will.

    OK, the ME says it was the stabbing first and the gunshot last. I have theorized that because she talked of a gun jam during the ninja lie she was actually talking about what happened. I see the theory of gun first stabbing second is not viewed as true by many. So what I want to hear people talk about is OK, she went to kill him. We know that with the car, the gas cans, the lies. OK. We are clear on that. So what I want to hear is how she could have done all that premeditation and have not thought about the mess of the crime scene with a stabbing and the 'where's your sign' idiot thought that he could have been brutally stabbed by anyone? I know the theory is stab first shoot second. Why would she do that with the risk of the crime scene evidence?

    Here are two excerpts of transcripts of interviews with the ME in this case- the first between ME and Defense, the second between ME and Prosecutor. - They are from WebSleuths - I would post links but so far when I do this, my posts say they are being moderated and never get posted... maybe because I just joined? Don't know- anyway - from this transcript I am not seeing the ME say with certainty that the gun shot came last. At most, he states that it came after defensive wounds to hands.

    From Websleuths -

    Defense: Isn't it true that at some point you told Det Flores that you thought the first wound was the shot to the head?

    ME: I don't recall ever saying that

    Defense: So you think you never told Detective Flores that?

    ME: I don't think that's consistent with the evidence that I have, I don't remember ever saying anything like that

    Defense: Ok so what your testimony is, I just want to be clear is that you never told Detective Flores that the gunshot wound was the first wound

    ME: I don't believe I ever said that, no

    Defense: And do you remember telling Detective Flores that you knew this because the gunshot wound would not have completely incapacitated somebody

    ME: I don't recall saying that either

    Defense: Is that something you think you would have never said to Detective Flores?

    ME: I think I've said it here in court that I don't think it would immediately incapacitate him or kill him. But it would be a serious injury, but I don't recall telling Detective Flores that, no.

    Defense: Ok, so, let me back up for a second, so you are saying the gunshot wound is not immediately incapacitating?

    ME: I would say not immediately fatal

    Defense: I'm not talking about fatal, I'm just talking about incapacitating

    ME: I think...yes, it would be incapacitating, passing through his brain, so yes

    Defense: So...and that's assuming it was passing through his brain, you would say it is incapacitating.

    ME: I'm saying it did pass through his brain

    Then, here is with Prosecutor --

    Prosecutor (JM): Alright, did you talk to them about the sequencing of the injuries?

    ME: Yes

    Prosecutor (JM): And...and at anytime did you stop the interview and say "no I don't want to talk to you about the sequencing of the injuries"

    ME: No (sounding quiet, almost defeated? or upset)

    Prosecutor (JM): And...were you asked about the sequencing of the injuries?

    ME: Yes

    Prosecutor (JM): And what did you tell them about the interview that you had with THEM?

    ME: I felt that the gunshot wound may have been last but at any event...um,
    the gunshot wounds and the wounds to the neck would have had to have come after the defensive wounds of the hands.

    Prosecutor (JM): And is that what you told us today?

    ME: yes

    She's not that smart. I think she thought she could stab him in the shower and contain the blood there and wash it all away. She didn't plan on him stumbling out of the shower and trying to get away.

    We may never know every detail. I hope the jury doesn't let that keep them from seeing the ultimate truth. Jodi killed Travis in cold blood and should be found guilty in the first degree.


    I've got to jump off the revolving door argument of what came first. No offense to you at all. You are always respectful of other opinions. For my own sanity I need to stop debating this. Lol.

    Given the stab wounds on the top of his head, I guess I can see the beginning of the attack starting there, with him sitting in the shower.

    And maybe after sheer frustration and all of that struggle that he would not die, she finally shot him.

    It just seems weird to me for her to bring a gun into the middle of this brutal knife attack, but I suppose I shouldn't attempt to apply any logic to a situation like this one.

    Those stab wounds to his head always make me cringe. She was just so heartless and brutal. A total monster.

    Yep. We will never know the details. We weren't there and she is such a liar that we can't believe a word she says. Hopefully the jury is seeing it that way too. What we do know is that she killed him 3 ways like Juan says, after seeing the crime scene and autopsy photo's I honestly don't care what came first either way he suffered greatly, and she deserves not only a guilty verdict but the death penalty as well. People who can do what she did and smirk on the stand don't deserve to suck their next breath IMO.

    It just doesn't make sense with all the premeditation that even if she WASHED OFF the stab wounds there's no changing stab wounds. Stab wounds are usually from an angry jealous person so she is really stupid or really thought there were would be more suspects.

    This may be a no big deal topic but it actually is. You guys gotta realize that her death penalty has a lot to do with did she shoot then stab or stab then shoot? If she shot then stabbed he won't have died a bad death. If she stabbed then shot he would have had a bad drawn out death. I firmly believe it doesn't matter she is guilty send her to the shooting squad. I just hope the defense won't try to show what I have shown which can lead a jury to believe that he COULD have been shot first. Does it matter in terms of her being guilty? No. She is. Does it matter in terms of the death penalty vs. life where we pay taxes for her food and bed and tampax? Yes!

    I actually hope my theory of shot being first and stab being second is not true. But I'm telling you guys, this can be argued and the defense is desperate.

    Thank you Rockabillychick - I couldn't agree more!!! Let the punishment fit the crime. I wish someone would inflict the same exact number, location and type of wounds onto her, as she did to Travis. But.....I guess I'll have to be satisfied with the good ol' lethal injection.

    If the gunshot was from right to left and down, then if he was sitting in the shower, with his back against the opposite wall in which they found him against, it seems that would be a perfect angle for Jodi to make her first shot against him. He then got up, ran to the sink and bled all over it, and then the knife fight started.

    I know the ME says the gunshot was not first, but I just have a hard time with that.

    For a few reasons. If she had a gun, why would she start with a knife when the gun would theoretically be more fatal?

    If she stabbed him first, I think he could have wrestled her to the ground or given her a massive shove out of the way.
    I don't know why this post made me think of this... Jodi is left handed yes? Would that not have had something to do with the angle and trajectory of the shot?

    Ugh. I'm afraid you might be right. They are going to delay her cross examination as long as possible.

    Here is a question...does anyone think she will say she called Searcy on the night of the murder? I know Creepy Gus is saying she called him. I wonder if she will attest to that.

    The judge already addressed this I think. Didn't she basically say that either way he suffered? We know that because of the awful defensive wounds. So, if he was shot first and didn't die, he was still coherent enough to try to stop her stabs with his bare hands. Those wounds on his hands are horrific.

    The defense wants to convince the jury that she shot him and he died. That all of the other wounds were after he was at least brain dead and therefore didn't suffer. They might have been able to pull that off if Travis didn't have the defensive wounds on his hands. These are key.

    If I recall right, the judge referenced the defensive wounds on his hands in her judgement. The hand wounds prove that either way, Travis was coherent and lucid enough WHILE getting stabbed to feel the pain and try to protect himself from it. That is the reason the judge allowed the death penalty option to stand.

    I will say I think that at 5:20pm she was packed and ready to go. Her visit was over. Travis was taking a shower to wash off all the sex and get ready for his conference call. Jodi knew the roommate was due back soon. She had her athletic comfy pants and sneakers on for the drive. She took her purse in the bathroom, with the knife, camera, and gun, to "say goodbye". That was all the window of opportunity she needed and she made the most of it.
