"Judge, for the record, we are claiming self-defense,” Owens told Judge Michael Kraynick. “We’re utilizing the battered spouse syndrome in conjunction with that defense. Not accident as they want to allege.”
The motion filed by the State Attorney’s Office to strike that battered spouse syndrome defense theory includes statements Boone told Orange County Sheriff’s Office investigators.
“What was your motivation for leaving him in the bag?” a deputy asked Boone.
“I didn’t have any motivation,” she replied. “It was me, he and I having a great day, fooling around and being stupid and apparently me going upstairs, and going. I’m guessing, I mean, I don’t. I’m blaming it on the wine.”
Assistant State Attorney William Jay said the prosecutors are aware Boone and Torres had a history of domestic violence that was usually “fueled by alcohol,” adding “that does not make a battered spouse syndrome defense.”
