    I'm pretty confidant that Juan presented a good murder 1 case. Who decides the sentencing? Is it the judge? I can't decide if the DP will stick or not.... I'm going to stay with murder 1 LWOP

    I believe if the jury decides against the death penalty, (assuming they give M1 Verdict), then the judge will then decide on either LWOP or LWP

    Hate to think about it, but I think there is at least one juror who will not go for the DP. LWOP is the only satisfactory outcome from someone with this view in my opinion.

    Supposedly when they filled out their juror questionnaire during jury selection, there was a question about whether they would be willing to give the DP sentence or not. I think if they said no, they were released.

    I wondered about that. I still don't see her getting the DP. I'm a skeptic though. So, my guess is going to be M1 with the possibility of parole. I don't want it to be that, but like I said...I'm skeptical.

    My guess has been LWOP. I want death row for her but I'm not sure it'll happen.

    I found this interesting. But, let's say for the sake of argument that the jury decides Murder 1. Then, if they get hung up on the penalty phase, things get interesting.

    This is from NBC News, so I have no idea if it's 100% valid, but:

    Under Arizona law, all 12 jurors must agree on the death penalty. If they can't, prosecutors can empanel a second jury, or even a third, for a do-over of the penalty phase. If the third jury is hung, the judge will decide between 25 years to life or life with no possibility of parole.
    So... it looks like if the prosecution gets 3 shots at the DP being implemented, even if the original jury can't come to a unanimous decision.

    It is easier said than done. I also could see one or more of these jurors lying on the question about the death penalty. They knew this would be a big headline murder trial, they wanted to be on this jury. They get the media attention, future book deal etc.. after the trial is over.

    Yes, each juror had to be able to, if needed, be willing and able to give the DP. Your right, if they couldn't, they were released.

    Voted when this thread was opened. But wanted to add my time prediction now. Verdict of "Life" by Thursday morning.
    Then judge will give LWOP at sentencing, whenever that is.

    But if I'm wrong and she gets DP, I won't mind that for sure. I believe she deserves it.

    I say LWOP tomorrow after lunch. If there's no court tomorrow (i dont know) then Thursday after lunch.

    Although I hope she gets the death penalty because she won't die anyway, but she'll be alone in her little cell for the rest of her life.

    I think the jury will unanimously impose the death penalty. They seem too cautious to rush out a verdict today but they may surprise us yet. I'd guess by tomorrow, before lunch, they will announce that they have reached a verdict.
