Children's chief apologises for Bulger killers comment
England's children's commissioner says she has apologised to James Bulger's mother for "hurtful" comments about his murder by two 10-year-old boys.
At the weekend, Ms Atkinson said his killers should not have been prosecuted because children under 12 did not fully understand their actions.
She has since stressed she believes serious crimes should be punished.
Her original comments had led James's mother to call for her sacking because of her "twisted and insensitive" views.
Ms Atkinson told BBC Radio 4's Woman's Hour she had sent a letter to Mrs Fergus to express sorrow for the "hurt" that resulted from her remarks.
"There's a private letter of apology from me going to Denise Fergus for the hurt that was caused by the comments," she said.
In an interview with the Times on Saturday, Ms Atkinson criticised the authorities' treatment of Jon Venables and Robert Thompson, who were 10 when they snatched two-year-old James from a Merseyside shopping centre in 1993.
They walked the toddler more than two miles to a railway line, where they beat him to death.
Ms Atkinson described James's killing as "exceptionally unpleasant", but said it was wrong that the killers, who were 10 in 1993 when they were charged with the murder, had been tried in an adult court.
Ms Atkinson suggested the age of criminal responsibility was too low and pointed to many European countries, where the age is between 14 and 16.
In England, Wales and Northern Ireland the age at which children can be tried in an adult court is 10.
In Scotland, the age is currently eight, but legislation is being passed to raise it to 12.
On Woman's Hour, Ms Atkinson moved to calm the controversy, saying she had not intended to make a "call of any sort".
"I am not saying that if a child is under the age of criminal responsibility when they commit an offence, they should not be punished," she said.
There were ways of punishing young offenders in "secure facilities" where the crimes can "be properly explained to them", she said.
Asked about how much a victim of crime - such as Mrs Fergus - should be in a position to influence policy, she said it was "not for her to say" but Mrs Fergus's opinion continued to count as it was a horrific crime on a "defenceless toddler".
Ms Atkinson's earlier comments came after James's mother met Justice Secretary Jack Straw to discuss Venables' recall to prison.
Now aged 27, he is suspected of breaching the licence under which he and Thompson were released with new identities in 2001.
Following Ms Atkinson's comments, the government confirmed it did not intend to raise the age of criminal responsibility.
A Ministry of Justice spokesman said: "It is not in the interests of justice, of victims or the young people themselves to prevent serious offending being challenged."

Jon Venables, who killed James in 1993, was released from jail in 2001 and given a new identity and anonymity for life under a special court order.
But Venables, now 27, was recalled to prison in February after allegedly breaching the terms of his licence.
He is charged with two offences under the 1978 Protection of Children Act.
Early stage
It is alleged that he downloaded 57 indecent images of children between February 2009 and February 2010.
He is secondly accused of distributing seven images between 1 and 23 February this year by allowing other people to access files on his computer through a peer-to-peer network.
The case is at a very early stage and will return to court on 23 July. That hearing will be the first opportunity for Venables to indicate whether he will be pleading guilty or not guilty to the alleged offences.
The Bulger family lawyer says there is "relief" Venables has been charged
Were he to plead not guilty, he would eventually appear before a jury under his new name. If he pleads guilty, the case will quickly move to sentencing.
Under the terms of Venables' anonymity order, the media is not allowed to report anything about his new identity and a jury would never know who he really is.
In March, the then Justice Secretary Jack Straw announced that Venables had been returned to prison but said that it was not in the interests of a fair trial to publicise what had allegedly happened.
Denise Fergus, James's mother, had called for the reason for the recall to be made public, saying as his mother she had "a right to know".
'Disaster'
Speaking outside court on Monday, Robin Makin, solicitor for James's father Ralph, attacked the Ministry of Justice for the way it had handled the case ever since Venables' recall.
"We consider that the way this has been handled since news of Jon Venables being recalled to custody has been a disaster," he said.
"The public authorities ought to behave quite differently and in due course further details are likely to emerge of the mistakes that were made. Ineptitude and incompetence spring to mind."
Venables and his friend Robert Thompson were jailed for life when, as 10-year-olds, they took two-year-old James from a shopping centre in Bootle.
The toddler's body was found on a disused railway line more than two miles away from where he had been taken.
Venables and Thompson were given new identities on their release from prison in 2001 because of the risk that they would be victims of a vigilante attack.
Media law expert Mark Stephens insisted that despite the publicity it was "almost certain" that Venables could get a fair trial.
He said: "The judge has gone to extraordinary lengths, as has the prosecution. They have worked with the defence to make sure that a fair trial can happen and that justice will out at the end of the day."

Bulger killer Venables pleads guilty to porn charges
One of the killers of toddler James Bulger has pleaded guilty to charges of downloading and distributing indecent images of children.
Jon Venables, 27, appeared by video-link at the Old Bailey and is expected to be sentenced later.
He and Robert Thompson were just 10 when they abducted and murdered two-year-old James in Bootle, Merseyside.
Both were released in 2001 with new identities, but Venables was recalled to prison in February.
Venables plead guilty to three offences under the 1978 Protection of Children Act.
The first involved downloading 57 pornographic pictures of children on to his computer between February 2009 and February 2010.
The second involved distributing indecent photographs of children in February 2010, while a third involved distributing 42 images in February 2008.
The court heard that the images were discovered after Venables called his probation officer fearing that his identity had been revealed.
When the officer arrived, Venables was trying to delete files from his computer and remove the hard drive, prosecutors said.
He was subsequently taken to a police station with the machine where it was examined by officers, they added.
Louis Mably, prosecuting, said eight of the images were at level four, the second most serious level of child pornography. Two were at level three, three were at level two, and 44 were at level one, the least serious, he added.
Court rearranged
James Bulger's mother Denise Fergus was in court on Friday to hear Venables' plea.
The BBC's Dominic Casciani, who is at the Old Bailey, said Venables appeared via video-link from an unnamed prison somewhere in the country.
In normal circumstances, the press and public can see a defendant on a video-link screen, but because of the exceptional nature of the case Mr Justice Bean rejected a media application and ruled that he alone would see the defendant, our correspondent said.
That meant Court 14 was rearranged to place a video screen directly in front of the judge so that nobody else, not even the lawyers, could see Venables, he added.
Venables and Thompson abducted two-year-old James while he was shopping with his mother at the New Strand Shopping Centre in Bootle on 12 February 1993.
The toddler was beaten with bricks and iron bars and his body left on a railway line.
His killers were detained at Her Majesty's pleasure, the usual substitute for life imprisonment for juvenile offenders.
In 2001, when they turned 18, both were freed, despite public outcry.

One of James Bulger's killers was sent back to prison today after pleading guilty to child porn charges.
Jon Venables, now 27, appeared at the Old Bailey via video link from prison to admit downloading and distributing scores of indecent images of children.
Some of the pictures involved children as young as two - the same age James was when he was killed. Sick videos Venables downloaded also showed eight-year-old girls being raped and forced to perform sex acts.
He even posed online as a married mother, offering up her own young daughter to another paedophile to be abused in return for cash.
The Old Bailey also heard Venables had been arrested over a drunken street brawl in 2008 and later that year found in possession of cocaine but was let off with a warning rather than be returned to jail.
Today's hearing was his first appearance in court since November 1993 when he and Robert Thompson were convicted for killing James in a crime that appalled the world.
The toddler's mother Denise Fergus, 42, was there to hear him enter his pleas but in a highly-unusual move only the judge Mr Justice Bean was able to see the defendant in order to protect his new identity.
The video screen was put directly in front of the judge so that even the lawyers could not catch a glimpse of the killer as he is today.
Venables spoke only to confirm his name and plead guilty to each charge. He was later sentenced to two years in prison - one fifth of the maximum term he could have received.
He released an extraordinary statement after his sentencing in which he said he thought about James' murder 'every day' and vowed to turn his life around.
The murderer said he was 'genuinely ashamed' about the child porn and promised he would 'never go back' once he is freed for a second time.
Mrs Fergus was furious at the jail term - claiming it was a second miscarriage of justice and questioning why Venables had not been reimprisoned for his offences in 2008.
'We have been in court this morning and once again we have had to sit through proceedings where justice has not been done,' she said in a statement.
'These were very serious offences and two years is simply not enough to meet the gravity of what this person did.
'We are surprised and concerned that he was not recalled under the terms of his parole licence when he committed an offence in 2008.'

Rumbled after he called police
The Old Bailey heard the murderer was only caught because he was worried his true identity had been discovered.
He rang his probation officer on February 22, 2010, to say he thought he had been found out and was worried about his safety.
The officer called police and told Venables to stay where he was, but gather his belongings, and wait for him to arrive.
Prosecutor Gavin Millar QC said: 'He arrived half an hour later and his intention was to take the defendant to a secure address.
'When he entered the flat he found the defendant sitting at his computer. The defendant told [the probation officer] he was trying to reformat the computer to delete his personal information.'
Venables then tried to use a knife and a tin opener to remove the hard drive before finally using his foot but was unsuccessful.
A Detective Inspector arrived and took Venables and his belongings away from the address. The computer was seized and experts found a total of 57 indecent images of children.
They included eight at level four - the second most serious level and featuring sexual activity involving children, the court was told.
Another prosecutor, Louis Mably, said the computer history 'indicated the defendant had an extensive history of searching for and downloading indecent images of children using the internet'.
The court heard Venables had admitted he was sexually aroused by the images. He told police in March he considered it 'breaking the last taboo'.
In a police interview on March 18, he said: 'I am responsible for downloading, viewing and deleting indecent images of children on my computer, of which I have been aware through my solicitor. The images were for my own use. I viewed the images alone. I have never shown the images to anyone else.'
When asked by officers about a video involving an eight-year-old girl, he said he had 'no intention' of having sex with a girl of that age.
Mr Mably said: 'He said he felt guilty about what he did and told himself "How can I be looking at this?".'
He posed as a 35-year-old woman
One of the charges related to distributing porn to convicted paedophile Leslie Blanchard, from Chelmsford, Essex, in February 2008.
Venables chatted to Blanchard via Google Hello - posing as a 35-year-old married woman called Dawn Smith who abused her eight-year-old daughter.
He told police in March after his arrest how he set up an e-mail account under the name 'for a laugh'.
Police were able to retrieve evidence of online conversations between 'Dawn' and Blanchard on February 23 and February 27 2008.
'Dawn said she was interested in pictures of parents abusing their children. Dawn said she and her husband abused their daughter,' Mr Mably said.
'Blanchard said he would like to met their daughter and abuse her himself. It appeared that Dawn agreed a price for selling her daughter for a few hours.'
Venables broke off contact abruptly, saying Blanchard could not see the girl, the court was told.
Venables' speaks of his shame
Jon Venables issued a statement after his sentencing in which he said he thought about the killing of James Bulger 'every day' and apologised for his latest crimes.
He realised he had 'badly let down' everyone who had tried to help him and vowed that this time he would turn his life around.
His solicitor John Gibson said: 'He puts forward no excuse for his conduct. He is genuinely ashamed, but he has and continues to express his remorse, and has come to an understanding of how children are harmed by those who have even a passing interest in such material, let alone by those who pass it on.'
Mr Gibson said the killer has accepted responsibility for James' murder and that he would have to live with the consequences forever.
'He has said that every day since what took place in 1993 he has thought about how different life might have been for all those affected, who he appreciates have also had their own reasons for reflection.'
The solicitor said the new offences were committed when Venables had been drinking heavily and suffering from the pressure of having to keep his real identity secret.
'He says that he appreciates there was no blueprint available to him, or those offering him support - he felt like a canary down a mine,' he said.
'The return to prison was something of a relief when it came. He intends to learn lessons to help him face this challenge again.
'Jon Venables knows that there are real victims to these crimes. Insofar as he can, he extends his sincere apologies to those children who have been exploited and abused.
'He accepts that a prison sentence is justified, and that once his time is served, his release is not, and cannot be, a formality or matter of routine.
'He is determined now, once and for all, to become the person he wishes to be so that when he is eventually released from prison, he will never go back.'

According to the Sun, the 35-year-old was once again arrested last week after officials found indecent material on a computer during a routine check at his home.
Venables is subject to life-long licence conditions for his role in James’s murder. A source close to the investigation told the Sun: “It’s all about protecting the public.
“We have these systems so those who could be a risk to the public are picked up. That’s what happened here.”
As reports of the arrest emerged on Wednesday night, Bulger’s mother Denise Fergus tweeted: “Here we go again.”

"Ralph would like it known on the record this has not come from him and goes against the aims he is trying to achieve of seeking greater protection for children from Jon Venables through legal channels.
"All that Ralph (along with his brother Jimmy) have and will continue to do is to take legal steps through the courts where possible.
"He has no knowledge of this source and has not had any involvement in this article."
The murdered toddler's father Ralph and uncle Jimmy launched the bid to have Venables's anonymity removed, arguing certain details about him are "common knowledge" and easily accessible online.
Venables has lived anonymously since his release from a life sentence for the kidnap, torture and murder of two-year-old James in February 1993.
Yesterday James’ mum, who was not involved in the lawsuit, wished her boy happy birthday and tweeted: “Will be spending today thinking of my beautiful son James... forever in my heart.”
