An Omaha woman accused of "twisting" a child's genitals has pleaded no contest to attempted child abuse with no injury, a class four felony.
Hollie Budka-Hernandez, 47, said she didn't agree to the factual basis of the case but doesn't want to put the child through a trial.
She will be sentenced on April 29. Budka-Hernandez faces probation, prison time up to two years, 12 months post-release supervision and $10,000 in fines.
According to the police report from Jan. 29, 2018, a 5-year-old boy was found to have injuries to his genitals. The child told police Budka-Hernandez had twisted his genitals because he'd wet the bed.
"It's heartbreaking. It's heartbreaking. Especially when you're closely related to the victim," the boy's uncle said during a phone interview Monday night.
The uncle said the school had noticed the boy walking differently, and that's what prompted the investigation.
The police report indicates other injuries were found on the child including marks on his neck, a scratch above his knee and faint bruises on his legs. When asked where they came from, the boy said, "I don't know."
"The mother of the child has made complaints to child protection services, but no action was ever taken because they said the complaints were unfounded," the uncle said.
The child's mother was granted a protection order against Budka-Hernandez Jan. 31, two days after the police report was filed.
The mother is not being named to protect the child's identity.
