TMZ obtained an AOL Instant Message exchange yesterday between Anna Nicole Smith and Larry Birkhead. Anna Nicole made it clear that she's not going to submit to a DNA paternity test without a fight.

The following is a precise transcript, complete with spelling and grammatical errors (but the user names have been changed):

The deadline for the paternity test was today. We've learned Smith's lawyers were in Los Angeles County Superior Court this morning trying to block the test. The judge has not issued a definitive ruling on Smith's motion and so far the DNA test has not happened.


* I think it's safe to say we are dealing with mental midgets at this point. It's kinda like a carwreck, you just can't help but watch. 
I hope that the baby isn't his and not Howards...........

Judge Halts Anna Nicole Smith's Paternity Test

LOS ANGELES  —  A judge in the Anna Nicole Smith baby dispute temporarily blocked an order forcing her daughter to undergo paternity testing, an attorney said.

A Tuesday deadline had been set for the test sought by Larry Birkhead, who claims he is the father of Dannielynn Hope Marshall Stern. She was born Sept. 7 in the Bahamas.

Ronald A. Rale, an attorney for the 39-year-old former Playboy playmate, questioned the legality of the test, saying Bahamian authorities needed to grant work permits before an American doctor could conduct the test.

The judge granted a stay pending a Feb. 7 hearing, Rale said.

Birkhead's attorney, Debra Opri, called Rale's request "a delay tactic."

She claimed the test was scheduled between 3 p.m. and 6 p.m. Tuesday but Smith never showed up.

Birkhead sued in October to get a paternity test.

Smith's longtime personal lawyer, Howard K. Stern, maintains he is the baby's father.

Sorry, but Dannielyn looks like she was born with a methadone and crack addiction, or whatever cocktail of narcotics her mom was chugging down every day. They should also check the baby for drugs and alcohol. i don't trust that bitch....

The photojournalist fighting Anna Nicole Smith over the paternity of her baby girl Dannielynn has sensationally revealed the actress/model miscarried their first child. Larry Birkhead and his attorney Debra Opri appeared on CNN show Larry King Live on Friday night to update the ongoing paternity battle, which was delayed earlier in the week when Smith was granted the opportunity to fight demands for a DNA test on her baby.

Smith's partner Howard K. Stern also used the nightly news show to state he was the biological father last year. Birkhead refutes that claim and now reveals he and his ex-girlfriend had been planning to have a child for some time.

He told King, "It was a long-term plan that we have had together, you know, to have a child. And we tried once before... It was unsuccessful. It resulted in a miscarriage. So we talked again about having a child... and I had made plans and preparations for this child and went to the doctors appointments and... helped her through morning sickness and shopped for baby items. I don't think it's going to be anything that complicated. I think perhaps he was jet lagged or something and couldn't sleep and howard slipped him one of anna's methadone. It's going to be some stupid mistake.
Her public appearances and television show are fairly good evidence that she has a drug issue of some sort. and the slurred speach etc, are good indicators of opate abuse. Especially if Howard were obsessed with her, in no way would he endanger or harm her son.

This of course is just my opinion........ 8-) 8-) 8-)
