    A woman who shot and killed her estranged husband at her home in northwest Pensacola had previously been arrested ' and cleared ' of threatening her husband to sign divorce papers at gunpoint.

    Millanie Sherbrook, 45, was first arrested Oct. 15, 2019, after the Escambia County Sheriff's Office was called to her home on Mossy Creek in reference to a domestic dispute.

    According to her ECSO arrest report, Sherbrook's estranged husband, Jeffrey Sherbrook, told investigators that his wife had threatened him at gunpoint to sign divorce papers, which he did. He then locked himself in a bathroom with a gun of his own and called 911.

    Sherbrook was arrested on an aggravated assault charge.

    As part of her pretrial agreement, Sherbrook was required to give up her firearms and passport, according to court documents.

    However, prosecutors ultimately dismissed the case less than two months later and all charges were dropped.

    Assistant State Attorney John Molchan said charges were dropped in that case due to a lack of evidence.

    "One person had said one thing and another person said another thing, and one person who was also there had said they didn't see anything at all," Molchan said.

    Sherbrook's attorney, Barry Beroset, told the News Journal on Thursday that Sherbrook had not yet retrieved the firearm she surrendered to the court.

    "She hasn't even picked up the firearm yet," he said.

    At around 9:30 p.m. Tuesday, Millanie Sherbrook shot and killed Jeffrey Sherbrook as he entered her home, according to ECSO. Authorities have not yet released the circumstances of the shooting or how many shots were fired.

    Four days earlier, on Valentine's Day, Jeffrey Sherbrook had filed a motion to voluntarily dismiss the pending divorce.

    The ECSO is working with the State Attorney's Office to determine if the case should be considered lawful under Florida's "stand your ground" laws. Per Florida statute, a person has a right to exercise justifiable deadly force if they fear for their life or the life of another person.

    Beroset said his client had previously tried to get a domestic violence injunction against Jeffrey Sherbrook but it was denied. He said Jeffrey Sherbrook had been told multiple times not to come to the house on Mossy Creek.

    He said his client had been cooperating with authorities, but he declined to go into further detail about the investigation.

    "We feel that when the investigation is done, she will be cleared and there will be no charges filed," Beroset said. "It's very unfortunate that this happened."

    Molchan said investigators were working through the evidence to determine whether or not the case could be considered a justifiable use of force.

    "We are aware of the prior circumstances," he said. "Basically, the investigation will entail looking at everything, and all relationships, and any kind of interaction between the two."

    No charges have been filed in the case.
