    Sheriff?s deputies fatally shot a Black man following a struggle outside a hotel in San Clemente Wednesday afternoon, authorities said.

    Two deputies with the department?s homeless outreach team made contact with the man outside Hotel Miramar, at 2222 S. El Camino Real, at about 1:12 p.m., according to Orange County sheriff?s spokesperson Carrie Braun.

    The shooting occurred roughly three minutes later, Braun said.

    A physical altercation broke out while deputies were speaking to the man, and surveillance video shows the man tried to ?gain control of one of the deputies? guns,? Braun said.

    At least one deputy opened fire, striking him.

    Braun said the department is not releasing the surveillance footage.

    A witness told the Orange County Register the man appeared to have both hands in the air while a deputy took aim at him. She then saw deputies tackle the man on the other side of the street, and heard gunshots moments later.

    ?I heard two shots, and it was after he was on the ground,? the woman, Chloe Miller, said.

    It was unclear what prompted deputies to speak with the man in the first place, and how the situation turned violent.

    No further details about the shooting or the man?s identity were available Wednesday, Braun said.

    Orange County District Attorney?s Office will investigate the deadly use of force.

    Defund the police. Let the actual professionals that have more than a HS education handle this stuff.

    Sadly its too common if you are non-white, have mental disabilities and poor you are labeled as thugs by President Trump and his fans you are shot by the Police and then at their deaths the President's fans labels them as thugs sadly when Black Lives Matter says the person that was killed by Police had mental disabilities. Note Some states have showed other examples where a non-white person was killed and didn't even fit the stereotype of mental disabilities and poor which is all way too common though.

    Officials in San Clemente imposed a curfew through 6 a.m. Friday "to ensure public safety and access for emergency responders" after a protest over the death of a homeless man shot by a sheriff's deputy outside a hotel turned unruly when activists tried to take over a street near the place where the killing occurred.

    The news came hours after Orange County Sheriff Don Barnes said he was sorry about how a deputy takedown unfolded and gave his condolences to the family of Kurt Andras Reinhold.

    According to witnesses, the 42-year-old man had been jaywalking on El Camino Real, blocking traffic Wednesday afternoon.

    Video from across the street recorded the incident as the deputies made contact with Reinhold.

    Authorities describe him as homeless and say they had tried to help him during the 30 days he had been living in San Clemente.

    "He's one of the regular homeless people here in town," said San Clemente resident Steve Bauman. "We walk the beach trail here and you see him there regularly."

    The Sheriff says both deputies involved are on leave. One has been with the department eight years, the other is a 13-year veteran. Both were assigned to the homeless outreach program in San Clemente.

    Bauman says he recently encountered Reinhold and that the 42-year-old likely struggled with mental health issues.

    "By me getting close to him he was very agitated," Bauman stated. "He was just off. It's just sad that this had to happen like this versus another way to deal with him."

    In tears, a woman says Reinhold came to her flower stand moments before the shooting. She says he was hungry. She gave him money. She didn't see the altercation.

    Nancy Jarvis said she saw the confrontation that ended with two shots being fired.

    "He tripped and that's when they attacked him," she said. "He reached for the officer's gun and then that's when the shots were fired."

    The sheriff confirms one deputy shot twice as Reinhold allegedly reached for a deputy's weapon. The sheriff says it is unclear whether the gun ever came out of the deputy's holster.

    The shooting sparked protests Thursday. About 50 people blocked traffic as they rallied against the shooting.

    The protesters walked back and forth near the Hotel Miramar where they stopped to remember Reinhold.

    It took deputies two hours to clear the streets.

    SAN CLEMENTE, Calif. (KABC) -- Surveillance and cellphone video shows the struggle between a homeless Black man and homeless outreach deputies with the Orange County Sheriff's Department in San Clemente before the man was shot and killed.

    On Wednesday afternoon, the deputies approached the man, identified as Kurt Andras Reinhold, outside of the Hotel Miramar and a physical altercation occurred.

    During a Thursday afternoon press conference, Sheriff Don Barnes said the video shows the man grabbed one of the deputy's weapons and apparently tried to pull it out of its holster.

    "You'll see it was significant struggle with Mr. Reinhold that went on for some time. The deputy did state four different times 'He's got my gun'," he added.

    One of the deputies fired two shots, killing the 42-year-old.

    The deputies involved were an 8-year and a 13-year veteran of the department.

    Barnes also urged everyone to reserve judgment until the investigation is complete.

    "Given the current climate of police community relations, I understand that this conversation is going to be a difficult one around this incident," Barnes said. "I'd ask that those who are entering the narrative to please let the course take its place. Let the investigation conclude."

    Barnes said Reinhold had been in the San Clemente area for the past 30 days, during which time homeless liaison deputies had tried to make contact with him several times. Reinhold had previously been offered services but was "not receptive," the sheriff added.

    Barnes declined to offer a specific reason for why the deputies had approached him, pending their official statements regarding the incident.

    Dozens gathered in the area on Thursday to protest the shooting and make their voices heard. Some demonstrators entered the street and tried to block traffic, resulting in the arrest of at least five people for disturbing the peace and some minor vandalism to a patrol car.

    "He was unarmed and he should be alive today. We want the community to finally wake up to the racism down here and bring an end to it and fight in solidarity with Black lives rather than against," said one protester named Fiona.

    Later in the afternoon, the San Clemente City Council held an emergency meeting and approved a 9 p.m. curfew for the city's downtown area and the Pier Bowl. The curfew was set to expire at 6 a.m. Friday morning.

    The Orange County District Attorney's office is investigating the deadly use of force.

    Not going to believe he went for the officer's gun until I see video proof. Why not release it, if there is nothing to hide?

    Orange County sheriff’s officials released video Wednesday in the investigation into homeless outreach deputies’ fatal shooting of a Black man they’d accused of jaywalking in San Clemente last year.

    The release includes dashcam, cellphone and motel surveillance video that capture the ordeal unfolding from the moment deputies contacted 42-year-old Kurt Andras Reinhold on the sidewalk, to the ensuing struggle and Reinhold’s shooting death.

    No body camera video was released.

    The Sept. 23 shooting, on the heels of national unrest over police violence, sparked protests that resulted in the city of San Clemente declaring a curfew in certain areas.

    The two deputies involved, an eight-year veteran and a 13-year veteran, are full-time homeless liaison officers in San Clemente. Their duties involve assisting those living on the streets and helping them access resources and services. O.C. sheriff’s officials have not released their names.

    The incident began when the deputies observed Reinhold near the corner of El Camino Real and Avenida San Gabriel as they sat in their patrol car across the street.

    “Watch this, he’s going to jaywalk,” one of them can be heard saying on the dashcam footage.

    The deputies then debate whether he’s jaywalking, with one telling the other, “Don’t make case law.”

    The deputies then pull up to Reinhold, who’s standing on the sidewalk. After that, both the deputies and Reinhold disappear from the camera’s view, but their voices are still audible.

    “Are you going to stop or are we going to have to make you stop?” one of the deputies asks Reinhold multiple times.

    Reinhold is heard asking, “For what?” The deputy tells him for jaywalking.

    “What are you talking about? I’m walking,” Reinhold replies, then shouts at the deputies to get off him.

    An argument ensues. Reinhold says he doesn’t understand why he’s being stopped and repeatedly asks the deputies to stop touching him.

    One deputy tells him he’s resisting arrest for jaywalking. “That’s ridiculous,” Reinhold says.

    The audio from deputies’ microphones becomes unintelligible as the three move away from the patrol vehicle.

    Bystander cellphone video captured the group continuing to argue as Reinhold tries to walk away from the deputies.

    One deputy begins shoving Reinhold, and both deputies soon tackle him to the ground. Sgt. Dennis Breckner says in the video release the deputies were trying to “gain control of him.”

    The motel security video — which was previously obtained by KTLA — captured the struggle that ensues, during which one deputy is heard in the video saying, “He’s got my gun,” according to the Sheriff’s Department.

    The other deputy opens fire moments later. Two shots heard, one about seven seconds after the other.

    Sheriff’s investigators had previously released a still from the footage that appears to show Reinhold’s hand near or on a deputy’s holster while he and the deputies were struggling on the ground.

    But deputies have said it’s unclear whether Reinhold was able to unholster the weapon. That remains under investigation by the Orange County District Attorney’s Office.

    The Sheriff’s Department had previously said the shooting happened roughly three minutes after deputies made contact with the man.

    Reinhold’s family, who filed a wrongful death lawsuit in the case in December, released a statement through their lawyers Wednesday saying the new video “confirms what we knew all along – the involved deputies had no reason to stop Mr. Reinhold.”

    “The OC Sheriffs Homeless Liaison Officers use pretext reasons to stop anyone for any reason they want, simply to harass the person,” attorney John C. Taylor wrote. “These officers created and escalated the confrontation with Kurt Reinhold causing his death.”

    The shooting remains under investigation, with the DA’s office yet to determine whether it believes the shooting was justified.
