    Joe Boever (55) hit and killed by SD Attorney General

    Victor Nemec knew something was wrong when he went to pick up his cousin Joe Boever Sunday morning at his home in Highmore.

    The two had planned to go fix Boever's truck, which had been damaged when Boever hit a hay bale in the ditch the night prior. Victor said his cousin had told him he went off the road while reaching for his tobacco. But when Nemec arrived, Boever's house was unlocked with all the lights on.

    His cousin was nowhere to be found. Concerned, Nemec called the Hyde County Sheriff.

    Twelve hours later, he and his brother Nick Nemec were in a Highmore funeral home identifying Boever's body.

    Boever, 55, was killed in an accident late Saturday involving South Dakota Attorney General Jason Ravnsborg.

    It was announced in a Sunday evening press release from Gov. Kristi Noem that Ravnsborg had been involved in a fatal wreck, though few details were released.

    The South Dakota Highway Patrol confirmed that Ravnsborg was involved in the crash that killed Boever Saturday night, according to a news release Monday. Ravnsborg initially reported the crash to the Hyde County Sheriff's Office that he thought he had hit a deer.

    Boever's body was not discovered until Sunday morning, the release states.

    The investigation is ongoing and being led by the Highway Patrol.

    But in Victor Nemec's eyes, it's a simpler story.

    "The attorney general hit my cousin as he was walking down the side of the road and killed him," he said.


    Victor said he and his cousin planned to fix Boever's white Ford pickup Sunday morning, but at some point in the evening, Boever decided not to wait and began walking to his truck.

    That's when he was killed while walking along Highway 14 west of Highmore. Nick Nemec, Victor's brother, is a former Democratic state legislator and party delegate who ran unsuccessfully for the Public Utilities Commission in 2012.

    Tony Mangan, spokesperson for the Highway Patrol, said at the direction of the governor, the Highway Patrol is leading the investigation. The attorney general's office said investigators from North Dakota are also in South Dakota and assisting in the crash investigation due to the conflict created by Ravnsborg's role overseeing the South Dakota Division of Criminal Investigation.

    Tim Bormann, chief of staff in the attorney general's office, told the Argus Leader via email Monday that Ravnsborg was traveling alone at the time of the crash. He was uninjured.

    Ravnsborg "placed the call to 911 right after the accident, my understanding is that he called from the location of his vehicle," Bormann wrote.

    Ravnsborg was not in the office Monday, but "is performing his duties as attorney general and is available for such."

    Ravnsborg was elected to his post in 2018 with 55 percent of the vote, defeating Democratic opponent Randy Seiler. He succeeded Marty Jackley as attorney general.

    South Dakota's attorney general reported hitting a deer Saturday night but actually hit and killed a man whose body wasn't discovered until the next morning, the Department of Public Safety said Monday morning.

    Gov. Kristi Noem said at a Sunday afternoon press conference in Sioux Falls that Attorney General Jason Ravnsborg had been involved in a fatal crash around 10:30 p.m. Saturday near the East River town of Highmore. No other details were released.

    What follows is from the DPS news release:

    Ravnsborg, a 44-year-old from Pierre, was driving a sedan westbound on U.S. Highway 14 on Saturday night. He told the Hyde County Sheriff;s Office that around 10:30 p.m. he hit a deer a mile west of Highmore.

    The release does not say if Ravnsborg stopped to confirm that he hit a deer or inspect his vehicle for damage. It also doesn't say if Ravnsborg called 911, the non-emergency line or someone from the office. The Journal has requested audio recordings of this call and all other calls related to the crash.

    The body Joe Boever, a 55-year-old from Highmore, was discovered the next morning. The release does not say where Boever was found and who found him.

    All information is preliminary at this point and the Highway Patrol continues to investigate the crash.

    South Dakota's Division of Criminal Investigation, which is part of the Attorney General's Office, will not be investigating the crash in order to avoid the appearance or actual conflict of interest, spokesman Tim Bormann told the Journal.

    Inspectors from the North Dakota Bureau of Criminal Investigation " the equivalent of DCI " will be helping instead.

    The attorney general had been driving home to Pierre after attending the Spink County Lincoln Day Dinner in Redfield, Bormann said. The event was hosted at Rooster's Bar and Grill from 5 p.m. to 8:30 p.m., according to the website of the South Dakota GOP.

    Ravnsborg was not hurt in the crash, Bormann said.

    I'm pretty sure he had had about 6 too many at Rooster?s Bar & Grill and needed to buy some time. I'm also willing to bet he was flying low... So you report you hit a deer and deal with getting the accident report tomorrow. Maaaybe he thought he hit a deer, but maybe he knew or suspected the dreadful truth and just wanted a chance to sober up before answering questions. And then, he has the bad luck to hit someone who's related to someone who can make a stink. I'm sure, if he knew it was a person, he was hoping it was a transient or a native or someone who wouldn't have people making a fuss.

    It is not known at what speed Ravnsborg was driving but the Argus Leader reports Ravnsborg was ticketed six times from 2014 to 2018 for speeding. He also has other auto-related citations, including driving without a seat belt.

    The speeding tickets range from January 2014 to September 2018, just before he was elected to office.

    Among the infractions:

    Ravnsborg pleaded guilty and paid a $19 fine and $68 in court costs for speeding in Beadle County in September 2018.
    He pleaded guilty to and paid a $59 fine and a $66 court fee for speeding in Pennington County in April 2018.
    Ravnsborg was cited for speeding on a four-lane road in a rural area in Clay County in 2017. He pleaded guilty and paid a $19 fine and $66 in court costs in June 2017.
    He paid a $79 fine and $66 in court costs for speeding in May 2015 in Faulk County.
    Speeding in Douglas County in April 2015 resulted in a $39 fine and $66 in court costs.
    The first infraction on record was in January 2014, speeding in Yankton County. Ravnsborg paid a $19 fine and $66 in court costs.

    KELOLAND News has confirmed the name of the victim in the fatal car -pedestrian crash involving South Dakota Attorney General Jason Ravnsborg on Saturday night.


    His family says 56-year-old Joe Boever of Highmore was killed in the crash.

    Former South Dakota legislator Nick Nemec and his brother, Victor, were asked to identify the body of their cousin 22 hours after the crash.

    Nick Nemec tells KELOLAND News that Boever ran his pickup into the ditch one mile west of Junction 14 and 47 at Highmore, hitting a bale of hay early Saturday evening. Boever called Victor, who gave Boever a ride back to the victim?s home at about 8:30 p.m., telling Boever they would go to try to straighten out the bumper and get the pickup out Sunday morning.

    The next morning, Victor drove by where the Ravnsborg crash happened, which was about a fourth of a mile west of where Boever?s pickup was in the ditch.

    Victor alerted the Hyde County Sheriff that his cousin was missing. Finally 22 hours after the crash involving Ravnsborg occurred, Victor and Nick were asked to identify Boever?s body.

    The Nemecs don?t know why Boever had apparently tried to return to his pickup Saturday night.

    Victor tells KELOLAND News that he questions whether or not a 911 call was made because no sirens of emergency vehicles were heard leaving Highmore Saturday night.

    The Nemecs say the scene was teaming with law enforcement and emergency vehicles for hours on Sunday.

    ?My worst fear is that they?re trying to get ducks in a row to absolve the attorney general of any wrongdoing,? Nick Nemec said.

    Governor Kristi Noem announced Ravnsborg, 44, involvment in a deadly crash during a Sunday evening news conference.

    According to a Facebook post about his plans for Saturday evening, Ravnsborg was in Redfield for a Spink County GOP event.

    He issued the following statement about the crash following Noem?s news conference.

    I am shocked and filled with sorrow following the events of last night. As Governor
    Noem stated, I am fully cooperating with the investigation and I fully intend to
    continue do so moving forward. At this time I offer my deepest sympathy and
    condolences to the family.

    On Monday, the South Dakota Department of Public Safety said Ravnsborg reported hitting a deer with his 2011 Ford Taurus to the Hyde County Sheriff?s Office after the crash at 10:30 p.m. Saturday.

    SIOUX FALLS, S.D. (KELO) ? We are getting our first look at what?s believed to be the car South Dakota?s Attorney General was driving when he hit a man in Hyde County.

    A viewer sent us pictures of a red Ford Taurus in a state highway maintenance lot off of Highway 14. If you look closely, it appears the windshield is broken on the passenger side.

    The viewer tells us people appeared to be testing the acceleration and the brakes on the vehicle. He also tells us the car had a military sticker on the license plate.

    Here?s a photo from Attorney General Jason Ravnsborg?s Facebook page in 2017, when he posted about just getting his car fixed because he planned to spend a lot of time traveling the state.



    There are still a lot of unanswered questions surrounding the fatal crash involving Ravnsborg.

    But we now know the South Dakota Highway Patrol, which is leading the investigation, will also be getting some outside help.

    The governor and the Department of Public Safety held a news conference Tuesday afternoon to talk about the investigation into the crash that killed 55-year-old Joe Boever of Highmore over the weekend.

    The attorney general had been attending a Spink County Lincoln Day Dinner in Redfield on Saturday night.

    In a statement, he says he did not drink any alcohol at the event.

    While on his way back to Pierre that night, he says he hit what he thought was a deer along Highway 14 near Highmore.

    That?ll be part of the investigation that?s being handled by the South Dakota Highway Patrol and the North Dakota Bureau of Criminal Investigation.

    ?This is a case we would typically ask our South Dakota Division Criminal of Investigation, to assist us with and of course since they work for the attorney general we thought it was in the best interest to ask an independent out of state investigative agency that has a ton of credibility in North Dakota Bureau of Criminal Investigation to assist us with this process,? Secretary of Public Safety Craig Price said.

    The governor says she has confidence the public?s questions will be answered once the investigation is complete.

    ?Because in this situation, we offer every situation the same standard of investigative procedures that we would any other person, but we are adding an extra level of transparency and accountability I think is necessary in this case,? Governor Noem said.

    In his statement, Ravnsborg says he is cooperating with the investigation.

    The medical examination of Boever?s body is being conducted in Ramsey County Minnesota because the state?s pathologist wasn?t available.

    The state also hired an accident reconstruction specialist out of Wyoming.

    The governor says once the investigation is complete, it?ll be made public to include the 911 call.

    That's right.

    Apparently, after the accident the sheriff loaned the AG his car as AG's car wasn't drivable. AG came back to return the car accompanied by a staff member who was going to drive him back home. They stopped at the crash site and wallah.

    Joe Boever 55, passed away in an accident on Saturday, September 12, 2020. His Memorial Mass will begin at 10:30 a.m. on Thursday, September 24, 2020 in St. Mary Catholic Church, Dell Rapids. There will be a Rosary prayed at 10:00 a.m. prior to the mass. Inurnment will be in the St. Mary Cemetery, Dell Rapids.

    Joseph Paul Boever was born on October 1, 1964 in Brookings, SD to John W and Dorothy Boever. He was the fourth of seven siblings, but because of his precociousness, he was never lost in the crowd. Joe grew up on a farm near Brookings and graduated from Brookings High School in 1982. He went on to college at the University of South Dakota and graduated with a nursing degree. Joe was united in marriage to Jennifer Mohr in 2017.

    Over the years, Joe worked at various nursing homes. His gentle personality allowed him to make a special connection with the elderly. In addition to nursing, he worked as a handyman. Like his grandfathers, Joe was a talented gardener and could grow just about anything. He propagated many Jade plants for his family and rescued neglected plants wherever he went. Joe always had an insatiable curiosity. He loved learning and was a voracious reader. In fact, Joe taught himself how to read at the age of five; something his family discovered when they found him reading encyclopedias. Joe had a quick wit and dry humor that he would use when least expected. He loved his wife and family as we loved him and his passing leaves a hole in all our hearts.

    Joe is survived by his wife Jennifer, mother Dorothy; siblings Larry, Ann (Bob), Katie (Steve), Jane (Nic), Will (Cathy), and Tony (Holly); many aunts, uncles, nieces, nephews, and cousins. He is preceded in death by his father, John W., his grandparents John P. & Geraldine Boever and Joseph & Ruth Seiler; and many aunts & uncles.

    This asshole KNEW that he hit a person. I have no doubt in my mind. He was coming from a fundraiser so I'm almost positive he was drunk and took off.

    I'm pretty sure he knew too. I'm sure he was driving way to fast and distracted. I'm not as certain as I once was that he was drunk. If I were the sheriff I'd have found him a ride home rather than lending my car if he were obviously impaired. But I could be convinced either way.

    I honestly wouldn't be surprised since Sheriffs themselves have been caught driving drunk. He actually wouldn't have had to be all that impaired visually in order for it to affect his driving anyway, but there's no way it could ever be proven at this point.

    I do know this. When you hit a deer, you know it. Anyone that lives or has lived in areas where it happens a lot could tell you that. And when you hit a deer, you definitely stop and get out of the car to see the damage or locate the deer. This guy is lying through his teeth for sure IMHO.

    Yes. And the car was undriveable, so they got out and had to have seen... I'm told the body was in 8 inch high grass and not far off the road. I think they had to have seen it. Just bad luck, for him, that the dead guy has a powerful family from the other party. One of them was a state senator and no doubt has most of the reporters in the state on speed dial. He's well respected and his family are well known... It's not like he ran over some nobody...

    Ravnsborg said in the 911 call that night that what he hit was "in the middle of the road." The Highway Patrol diagram shows Boever was not in the middle of the road, he was in the shoulder.

    The South Dakota Attorney General was "distracted" when he crashed his car into and killed a man walking on the shoulder of a road with a flashlight, according to the secretary of the Department of Public Safety.

    Secretary Craig Price shared the information during a Monday morning news conference with Gov. Kristi Noem in Pierre.

    Price said Highway Patrol and other agencies are still investigating how Attorney General Jason Ravnsborg was distracted when he hit and killed Joe Boever around 10:30 p.m. on Sept. 12 just outside of Highmore on U.S. 14. He also shared the accident report and a photograph of Ravnsborg's vehicle taken after the crash.

    The photograph shows that a large piece of the car fell off between the bumper and right front wheel. There is a large dent above that and a broken windshield.

    The accident report says that Ravnsborg was distracted and failed "to keep in proper lane" when he hit Boever, who was walking on the shoulder of the road.

    That's quite a bit of damage to the car and quite a lot Not Applicables on the accident report, where I feel they should have answers.

    So when it talks about the distractions it says they are still trying to figure out what the distractions were. So what does Joe say they were? Was he texting, did he have his hand down his pants, or what?

    Also, what is the likelihood that he became distracted and swerved just at the one place where this pedestrian was walking....as opposed to, oh I don't know, say swerving all over the road from drinking too much for the entire drive home???

    All good questions. From the sketch it looks like he'd been driving down the shoulder for quite a ways. But who knows. Pedestrian was apparently carrying a flash light, and so few deer carry them. He says he wasn't drinking, but doesn't have much else to say about what might have distracted him. His phone maybe? But at any rate. Many questions remain.

    I love (not) the fact that we had this press conference the day before the election, hoping no doubt to bury the whole thing in election news.

    Most of the NAs Were because the "other driver" was a pedestrian. So DL is NA because he wasn't driving.

    Joe was the victim and so has nothing to say. Jason Ravnsborg was the driver. He also has nothing to say apparently.

    The report says the airbag didn't deploy. That surprises me cause there must have been quite a jolt when you hit someone going 65 mph.

    Duh, I got the names mixed up.

    It surprises me too that the airbag didn't deploy with that damage.

    Charges:

    -Driving while using cell phone
    -Driving outside of lane when it wasn't safe
    -Careless driving

    All misdemeanor charges. No hit-and-run or second-degree manslaughter.

    Sovell says Ravnsborg was on his phone BEFORE the crash, not during it. She says he was driving outside the lane during the crash.

    Sovell said his action didn't meet the definition of "reckless" needed for second-degree manslaughter, which is a higher standard than "negligence."

    Sovell said vehicular homicide doesn't work since Ravnsborg wasn't intoxicated.

    Attorney Emily Sovell states that all 3 charges for @SDAttorneyGen
    Ravnsborg are misdemeanor and have a maximum of 30 days in county jail and/or a $500 fine.
