    Judge grants change of venue request in Barry Morphew murder trial

    Accused murderer Barry Morphew and his defense team have been granted a change of venue request. The trial will now be heard in Fremont County, instead of Chaffee County, where the alleged crime occurred.

    The defense teams filed that motion because, they said, too many people in Salida and Chaffee County are familiar with the case. They say that will make it difficult to find an impartial jury.
    Morphew was arrested nearly one year after Suzanne’s disappearance and charged with her murder. He also faces the following charges in connection to the case:

    Tampering with a deceased human body
    Tampering with physical evidence
    Possession of a dangerous weapon – short rifle
    Attempt to influence a public servant
    Forgery of Public Records
    Misdemeanor Elections-mail ballot offense

    Judge: Domestic violence allegations not admissible in Morphew murder trial

    In a Freemont County courtroom Thursday, a judge decided abuse allegations against Barry Morphew presented by prosecutors will not be allowed in the upcoming trial.

    Morphew has been charged with murdering his wife Suzanne Morphew, who went missing on Mother's Day in 2020. However, he's denied any involvement in her disappearance.

    Prosecutors allege Morphew beat his wife Suzanne on multiple occasions. Prosecutors laid out several acts of alleged domestic violence in court, showing text messages Suzanne had sent to a friend about the alleged abuse.

    However, the judge overseeing the case says those allegations are going to be off-limits in the trial. The judge said that the evidence, the way it was presented Thursday, wouldn't provide a fair trial for Morphew and thus denied the motion to include the text messages as evidence.

    "Because it wasn't the victim testifying to the prior bad acts, it's the victim telling somebody else, those prior bad acts are not necessarily as reliable," legal expert Jeremy Loew explained.

    It's a big blow to the prosecution's argument that Morphew killed his wife.

    "The prosecution obviously wants prior acts of domestic violence that Mr. Morphew allegedly committed to be admitted so that the jury hears that he has potentially done this before and he's more likely to do it again," Lowe explained.

    Loew believes it's not uncommon for potential evidence to be kept out of a trial, but it is rarer with domestic violence allegations over other possible crimes.

    It's another odd twist to a murder trial that hasn't even started yet.

    "I'm surprised by nothing in this case, the fact that we've had the judge recused, we've had a change of venue, we've had evidence torn out, we've had a change of prosecutors, we've had a delay in even charging this case because there are issues," Loew said.

    Yeah. I can understand that they might not allow someone to testify that "she told me" but damn it, this isn't hearsay. This is her own words. Seems like the deck is stacked in favor of the abuser. As long as they can kill their victim so she can't testify, it's all good.

    Agree. Does anyone know how old the text messages are? Haven't seen that in any of the recent articles but wonder if that could play a part in the judge's decision. Maybe it's not recent enough for him to think it's relevant. Just guessing.

    Lawyers for murder suspect Barry Morphew are again asking a Colorado judge to drop his case, citing falsehoods from prosecutors and law enforcement, according to reports.

    Morphew was arrested in May 2021 and is charged with first-degree murder, tampering with a deceased human body, and other crimes in connection to the presumed death of Suzanne Morphew, who disappeared on Mother's Day 2020. Her body has not been found, and Morphew has maintained his innocence.

    His attorneys argue in a March 9 motion to dismiss, however, that "substantial evidence" shows "law enforcement testified falsely," and "the prosecutor presented this false testimony," the motion obtained by FOX 21 Colorado Springs states.

    "He asks the court to dismiss this case because a fair trial cannot be held under the circumstances of these falsehoods and coverups," his lawyers wrote.

    The defense team alleges that the prosecution falsified reasons for Barry Morphew's arrest, the Colorado Bureau of Investigation's support for his arrest, justification for the removal of CBI Agent Joseph Cahill, as well as court pleadings.

    The motion accuses 11th Judicial District Attorney Linda Stanley of being "responsible for the presentation of false and misleading testimony," saying she personally worked to remove Cahill, the primary investigator in the defendant's case, "because he would not testify?according to her script" regarding three Combined DNA Index System (CODIS) matches linking DNA found of the glove box of Suzanne Morphew's car to individuals other than Barry Morphew.

    Morphew's lawyers filed another motion to dismiss earlier this month, claiming a fourth CODIS match linked to the DNA found in Suzanne Morphew's vehicle, according to FOX 21.

    The sample came through a database as a partial match for "single or multiple individuals across the country involved in sexual assault cases," defense attorneys wrote in an August letter. They said the sample belongs to a sex offender living in Arizona.

    Barry Morphew's 'girlfriend' is arrested and charged with trespassing after she was caught removing a package from the home he shared with missing wife Suzanne just days after he was released on $500K bail

    The woman thought to be Barry Morphew's girlfriend has been arrested and charged with trespassing after she was allegedly caught on camera removing a package from the home he shared with missing wife Suzanne just days after he was released on bail for her murder.

    Shoshana Darke, 51, was arrested Tuesday forallegedly trespassing one day earlier at the property on Puma Path, Salida, which Morphew sold to new owners back in March.

    Home security footage captured Darke walking down the driveway Monday afternoon and leaving with a cardboard box tucked under her arm, investigators said.

    It is not clear if police have recovered the mystery package from Darke.

    Its contents, who the package was addressed to and where it ended up are currently unknown.

    The incident came just seven days after Morphew walked free from jail after posting a $500,000 cash bond ahead of his May 2022 murder trial. Morphew is now staying at another property in Salida in close proximity to the former Morphew family home, according to Darke's arrest warrant.

    Darke has also worked as a housekeeper and cleaner at that same property since 2018, the arrest warrant states.

    Darke is mentioned in Morphew's affidavit for the murder of Suzanne who vanished without a trace on Mother's Day 2020 after he claimed she had set off on a bike ride from their home.

    Several locals told investigators Darke and Morphew are in a relationship.

    The pair insisted to investigators they are just friends but they were seen leaving a hotel together on Valentine's Day this year, and Morphew was spotted on multiple occasions visiting her home late at night.

    Darke, who told cops that 'a lot of people say I resemble' Suzanne, said she had seen a 'strange vehicle' in the area around the time Suzanne went missing.

    According to Darke's arrest affidavit, the 51-year-old trespassed on the former Morphew home to collect the parcel around one hour after it was delivered in a FedEx van.

    Darke was caught on surveillance video jogging down the driveway toward the property at 3:46pm, it states.

    Photos in the arrest warrant reveal the woman dressed in trousers and a sweater walking toward the property.

    Another camera picks her up heading toward the front door of the home.

    At 3:47pm, Darke is seen walking away from the property carrying a package under her left arm, the affidavit states.

    The parcel was delivered to the home by a FedEx truck just over one hour earlier at 2.32pm.

    The property's new owners use the property as a vacation home and have installed security cameras and a 'No Trespassing' sign.

    The owner reported seeing someone trespassing on the property too police after being alerted by the surveillance feed.

    When investigators reviewed the footage, they recognized Darke as the woman in the images, the affidavit states.

    They informed the homeowner that she 'is an acquaintance of Barry Morphew'.

    The homeowner confirmed she does not know Darke and did not give her permission to enter the property and wanted to press charges.

    Darke was arrested in the Maysville area Tuesday and charged with second-degree criminal trespassing.

    During her court appearance Wednesday morning, her bond was set at $500, reported Fox 21.

    She was ordered to permanently stay away from the home and surrounding property and not to have any contact with the current homeowners.

    She will appear in court next in two weeks' time.

    The same judge - Patrick Murphy - presided over both her case and that of her alleged boyfriend.

    According to Morphew's affidavit - finally released earlier this month - investigators received a tip in December that Darke was in a romantic relationship with Morphew.

    Investigators interviewed her the following day where she denied their relationship was romantic.

    She also said she didn't know Morphew's missing wife but drew parallels with herself.

    'She's my age. She's... A lot of people say I resemble her,' she told cops, according to Morphew's affidavit.

    Morphew has also denied any romantic relationship with Darke, claiming they are friends and that his daughters are aware of their friendship.

    However, several locals told cops December 2020 and April 2021 that Darke and Morphew were in a relationship, the affidavit states.

    Investigators believe the relationship may have begun in July 2020 - two months after Suzanne disappeared.

    Surveillance carried out by the FBI also captured Morphew's truck going to and from Darke's home often late at night or staying through the night, according to the affidavit.

    Footage also captured the pair checking in to a hotel together on February 12 and then checking out on Valentine's Day - Darke clutching a bouquet of flowers.

    Morphew was released from jail September 20 after posting bond.

    He left prison arm in arm with his daughters Macy and Mallory who have stood by their father despite him being accused of their mother's murder.

    Morphew allegedly murdered his wife who was having an affair and planned to leave him. Suzanne's body has never been found.

    He is charged with first-degree murder, evidence tampering and other charges in connection to her disappearance.

    A man who was tried in connection to his wife’s disappearance pleaded guilty Thursday to submitting a fraudulent ballot on her behalf for President Trump during the 2020 election.

    Barry Morphew told law enforcement he figured “all these other guys are cheating” and that his wife Suzanne would have voted for Trump anyway, according to an affidavit acquired by KKTV Colorado.

    The defendant was arrested in May 2021, but was already in police custody because of his suspected role in his wife Suzanne Morphew’s disappearance.

    Morphew was offered a plea deal allowing charges of attempting to influence a public servant and elections offense, to be dropped if he plead guilty to the forgery charge. Now he faces a year of supervised probation for the charge.
