    The Osceola County Sheriff's Office is looking for a woman last seen in St. Cloud, and her disappearance is being called suspicious.

    Nicole Montalvo was last seen Monday evening. Deputies say she was dropping off her 8-year-old son with his father and grandparents on Hixon Avenue in St. Cloud.

    Deputies said Montalvo was supposed to pick up her son Tuesday from Harmony School, but she never showed up.

    On Thursday evening, investigators began searching a five-acre property on Hixon Avenue they say is related to Montalvo. They also said they found her gold 1999 Honda, which was abandoned, on Big Sky Boulevard off Neptune Road.

    Her estranged husband, Christopher Otero-Rivera, is under probation and house arrest, according to deputies. They say he is not a suspect or person of interest at this time, but he's not cooperating with them, either.

    Deputies also said Otero-Rivera has also had domestic violence issues with Montalvo in the past.

    Montalvo was last seen wearing blue jeans and a gray shirt. Deputies said her cell phone has been turned off.

    The estranged husband of missing Osceola woman Nicole Montalvo has been named a person of interest in her disappearance, according to the Osceola County Sheriff's Offce.

    Christopher Otero-Rivera's father has also been named a person of interest. They both have been arrested on unrelated charges.

    Possible human remains were found Friday in a search on a St. Cloud property for clues into the missing-persons case of Montalvo, who was last seen there Monday dropping off her 8-year-old son.

    Osceola County Sheriff Russ Gibson said investigators "uncovered the possible remains of a human being" on the 5-acre property, where they began digging Thursday evening. He said the remains were found in the back of the property on Hixon Avenue in St. Cloud.

    The Medical Examiner's Office also was called to the scene.

    We are having a heat wave down here right now. Heat indexes are about where they usually are in July and August. Plus we've had a ton of rain, so I could see that any remains would decompose super fast right now. It feels like a jungle outside.

    Investigators have confirmed Otero-Rivera has a history of domestic violence against Montalvo.

    Otero-Rivera is scheduled to face a judge Monday. He remains at the Osceola County Jail.

    Authorities brought Rivera to the hospital after his arrest, when he complained of shortness of breath, according to Osceola County Sheriff’s Lt. Justin Boutilier. Rivera’s first appearance in court is scheduled for Monday, but is dependent on his release from the hospital.

    Osceola and Orange County deputies have begun to search a second location for a missing St. Cloud woman.

    Deputies said the new location is about a block away from the property where Nicole Montalvo was last seen.

    Osceola deputies said Friday evening that an estranged husband of Montalvo and his father have been named persons of interest in her disappearance.

    Deputies said Montalvo's estranged husband, Christopher Otero-Rivera, and his father, Angel Luis Rivera, have been arrested on charges unrelated to Montalvo's disappearance.

    Maj. Jacob Ruiz, of the Osceola County Sheriff's Office, said Otero-Rivera was arrested for violation of probation and violation of domestic injunction, and his father, Rivera, was arrested on violations of condition of a registered felon.

    They were both transported to the Osceola County Jail.

    Otero-Rivera went before a judge Saturday morning but was told to come back Sunday because a warrant for his arrest was not available.

    On Sunday, the judge issued a $25,000 bail for violation of domestic injunction and no bail for violation of probation. Rivera did not appear before a judge because he is in a hospital for chest pains and shortness of breath.

    Osceola County Sheriff Russ Gibson said Friday afternoon that possible human remains have been found on a five-acre property where Montalvo was last seen.

    The remains were discovered along Hixon Avenue near Deer Run and Canoe Creek roads, not far from St. Cloud, Gibson said.

    Investigators said they are unsure if the remains are those of a man or a woman.
    Investigators had searched the property -- including a construction shed, recreational vehicle and trailers -- for Montalvo or evidence relating to her disappearance.

    "There's a wooded area and a pond in that property, and so we are going to comb the entire property," Ruiz said.

    On Sunday, deputies said they have searched 50% of the property for Montalvo. Deputies said they began draining a large pond on the property Saturday and continue to drain it Sunday.

    The human remains recovered from the yard of a St. Cloud home are of Nicole Montalvo, who had stopped by there Monday night to drop off her son and hadn't been seen since, the Osceola County Sheriff said Sunday.

    The investigation into the disappearance of Montalvo now has turned from a missing person's case to a murder investigation, Sheriff Russ Gibson said during a brief news conference.

    Deputies and investigators are searching a second potential scene on Henry J Avenue in St. Cloud, Gibson said. They've obtained a search warrant for that location.

    As the tight-knit community of Osceola County, Florida mourns last week’s brutal murder of Nicole Montalvo, Sheriff Russ Gibson is left wondering if and how the justice system failed the young mother and longtime victim of domestic violence.

    The state of the body, he said, is in one of the worst conditions he has ever seen and the cause of death is still yet to be determined.

    “I’m so angry what these people have done to this sweet woman, at a time in her life when she felt as though she had finally broken free (from the relationship) and was so happy to have made her first month’s rent,” Gibson told Fox News in an exclusive interview on the case. “Many times, victims of domestic violence don’t know how to break free, but she was out there on her own getting it done. Now she is dead.”

    The 33-year-old, a smiling employee at Broadway Pizza Bar in downtown Kissimmee, was reported missing last Wednesday after having dropped their 8-year-old son Elijah off at his father's home in St. Cloud on Monday, but did not return to collect him. Investigators discovered human remains at a property belonging to Montalvo’s in-laws on Friday; authorities confirmed the identity of the remains as Montalvo two days later.

    Montalvo’s estranged husband and the father of their son, Christopher Otero-Rivera, 31, and his father Angel Luis Rivera, 63, were arrested that same day on unrelated charges. After the grim confirmation on Sunday, the men were charged with premeditated murder and are currently being held at the Osceola County Jail without bond.

    According to Gibson, the remains – which are still being examined by the coroner – were "disassembled", and the situation so far marks the worst he has seen in his 32 years as a homicide detective and sheriff.

    “When this autopsy is done, people are going to be horrified,” he continued, noting that autopsy results are expected next week.

    But this was hardly the first allegedly savage encounter Montalvo had faced at the hands of Otero-Rivera, with whom she had filed for divorce. According to court filings, Montalvo sought the help of law enforcement on numerous occasions, and incidences of violence had escalated over several years.

    She is said to have first filed for a restraining order in June 2016, alleging that her husband attacked their son, who was 5 years old at the time.

    Photos of Montalvo sporting bruises and a neck brace were also included in court petitions, according to the Orlando Sentinel. The paper also reported that Montalvo had indicated in filings that Otero-Rivera had previously been involuntarily committed to hospital under the state’s Baker’s Act, which allows a 72-hold for those believed to be a danger to themselves or others.

    Yet the worst incident came in October 2018. Montalvo told law enforcement that Otero-Rivera texted her about an urgent breakdown with his truck and that he needed a ride. However, he then led her to a barren area where another car with an awaiting female – identified as Toni Rocker and known to Montalvo – pulled up.

    Montalvo was subsequently dragged from her vehicle and thrown to the ground. After her husband purportedly stuffed a cloth in her mouth and attempted to break her neck, Rocker was accused of holding a knife to her throat and threatening to kill her if she told anyone about the attack.

    The pair were arrested.

    Rocker, 31, went to trial on charges of kidnapping, robbery, and aggravated assault with a deadly weapon but was acquitted by a jury in April. According to Gibson, she is not a suspect in Montalvo’s murder and has cooperated with investigators.

    Meanwhile, Otero-Rivera pled no contest to hindering a witness’s ability to communicate with law enforcement, unlawful possession of a credit or debit card, and battery. The more serious charges of kidnapping, robbery, and aggravated assault were dropped in the agreement.

    After serving just eight months behind bars, he was released on two years of probation – which included wearing an ankle bracelet for monitoring.

    Moreover, Otero-Rivera was banned from communicating with Montalvo except for in a parenting cellphone application but has since been charged with violating a no-contact order after admitting to calling her. His father, a convicted felon, was initially apprehended Friday on charges of unlawful weapons and ammunition possession.

    “This is a person who already tried to snap Nicole’s neck, and he took this plea deal,” Gibson lamented. “Domestic violence should not be a misdemeanor; they should be a felony. If weapons are used, they can be enhanced to a felony. But anything domestic violence-related should be moved to a felony.”

    The mother-in-law of a murdered woman, whose dismembered body was found on two properties owned by her estranged husband, has been arrested.

    Osceola County Sheriff Russ Gibson held a press conference Friday, confirming to reporters that Wanda Nereida Rivera, 59, faces charges of tampering with evidence and providing false statements during the commission of a felony crime in connection with the death of 33-year-old Nicole Montalvo.

    Gibson said Rivera was “emotional” after her arrest and was not cooperating with authorities, according to Fox News.

    Rivera’s arrest comes less than a week after her son, Montalvo’s estranged husband Christopher Otero-Rivera, 31, and 61-year-old Angel Luis Rivera, the estranged husband’s father, were charged with premeditated murder.

    Another of Rivera’s sons, Nicholas Rivera, 28, was arrested on Friday on 8 counts of child pornography and is now considered an additional “person of interest” in Montalvo’s murder, Osceola County Sheriff Russ Gibson said at a press conference Monday.

    “We once spoke with him, and we were able to obtain his cellphone, and that’s how we got the information for the current charges of the child pornography,” Gibson said.

    Montalvo’s body was recovered on October 25 from a St. Cloud property where Rivera and the two men were living.

    That land had been searched two days earlier, with police finding no sign of Montalvo.
