    An Elizabeth man accused of stabbing his girlfriend and her employer to death in Maplewood is a flight risk and must be detained, a Superior Court judge in Essex County ruled Wednesday.

    Joseph D. Porter, 27, was charged with two counts of murder in the Aug. 3 deaths of Karen Bermudez-Rodriguez, an au pair, and her employer, David Kimowitz. Porter was arrested after he allegedly tried to flee to Mexico.

    After a detention hearing late Wednesday morning, Judge Nancy Sivilli ruled that Porter must be held without bail, agreeing with an assistant county prosecutor that not only was Porter likely to try to escape, but that there was no way to guarantee witnesses' safety if he was released.

    "In light of all that, I find there are no conditions I can impose, given the facts of the case, to ensure the safety of the witnesses as well as ensure the safety of the community at large," Sivilli said.

    Late Wednesday morning, Porter was escorted into the courtroom in handcuffs, unshaven and wearing a light-blue collared shirt, navy dress pants and black sneakers. Throughout the hearing, he stood stone-faced and did not speak, as an interpreter relayed the proceedings to him.

    Standing to the right of Porter, Assistant Prosecutor Jason Alterbaum argued that if Porter was released, he would once again try to flee and that there was no way to ensure the safety of the community and witnesses.

    "Within a span of less than four hours judge, this defendant killed two people," Alterbaum said. "That should give the court grave concern that this defendant is a danger to the community and there are no conditions that could ensure the safety of that community."

    Porter's attorney, Adrien Moncur, argued that it was Porter's first arrest and that he was a low flight risk. Sivilli pointed out that Porter was arrested trying to board a flight to Cancun.

    Anyway...

    The Elizabeth man accused of killing his au pair girlfriend and her boss in Maplewood this summer is more than likely not a United States citizen, his public defender said in Superior Court of Essex County.

    Authorities say Joseph Porter, 27, in August chased Karen Bermudez-Rodriguez, 26, down a street and stabbed her because she wanted to end their relationship. Porter is also accused of fatally stabbing her boss, well-known comedy club owner David Kimowitz, inside his Walton Road home.

    Porter pleaded not guilty on Tuesday during his arraignment on an 11-count indictment, which includes first-degree murder, kidnapping, burglary and weapons crimes. Porter is being detained pending trial.

    During the hearing, Superior Court Judge Ronald Wigler asked Porter’s lawyer if there were any “immigration issues."

    “Judge, there likely are going to be collateral consequences to discuss with an immigration attorney,” Elayna Thompson, a public defender, responded.

    When Wigler asked if her if he was not a U.S. citizen, Thompson replied, “That’s my understanding.”

    Porter, who had recently divorced his wife of six months, was later arrested at Newark Liberty International Airport to board a flight to Cancun, Mexico.
