20 people were killed in a limousine accident in Schoharie, N.Y.

I hope I'm putting this in the right place. There are too many to put into "Submit A Death" but I hope someone will transfer to Article Archive. I live less than a hour from this place and I'm hoping no one I know was involved. I wish a safe journey for their souls.

The crash occurred Saturday in Schoharie. The Albany Times Union reported one of the cars involved was a limousine to be carrying a wedding party.

Police reported the crash happened just before 2 p.m. and initially they recognized there were "multiple fatalities." The accident occurred outside Apple Barrel Country Store, a popular tourist location.

Some of the injured were flown to Albany Medical Center Hospital. The National Transportation Safety Board is conducting an investigation.

Police are holding a media availability Sunday at 3 p.m. to provide more information on the accident.

JFC. I was at a wedding Saturday and missed this shit completely. This is horrifying. Oddly enough, we had to drive well over an hour to our location -- a farm in upstate Colorado -- and the whole drive back I was on pins and needles because freeway traffic is terrifying. <y heart goes out to these people. Ugh.

Janet Steenburg says her middle son Axel was never good at keeping surprises.

When he and his wife, Amy, came over for dinner three weeks ago, he told Janet excitedly that he'd rented a party bus to go to a Cooperstown brewery for Amy's 30th birthday. Axel had done the same thing for his bachelor party in June. This time, he'd invited his older brother and best friend Rich, Rich's wife, Kim, Amy's three sisters and their husbands, and a dozen other friends.

The day before the party, Rich took his stepson out of school to watch the latest Marvel comic movie — a tradition. That night, Janet stopped by Rich and Kim's house in Mayfield to pick up a carton of cigarettes he'd bought for her, but found two packs missing.

"You snooze, you lose," Rich said with a laugh. Like every Friday, he was at home playing the board game Dungeons and Dragons with his best friends.

That same night, the party bus canceled. Axel scrambled the next morning and found Prestige limousine company, based in Gansevoort, to transport the group.

Rich offered to stay home with his wife, Kim, who was recovering from a headache, but she told him to go have fun with his brother. When he left, Kim remembers with unsettling hindsight, she kept hugging and kissing him, unable to let go.

Kim was waiting for Rich to come home at 6 p.m. on Saturday, Oct. 6, when she heard a knock at the door. She thought the detective from the State Police was joking when he told her there had been a limousine crash with only one female survivor — who also died later. Rich was a joker who always kept gullible Kim guessing, and she screamed at the detective to call Rich and stop the prank. Only when she tried to reach Axel and Amy, with no response, did the nightmare turn into reality.

The limousine had crashed into the parking lot of Apple Barrel Country Store in Schoharie, killing two bystanders and 18 people inside the limo. Police found the rental receipt in Axel's name inside the limo and followed the registration plates of the cars parked at Axel and Amy's house to find Kim. She was the first family member of the 20 victims to learn about the deadliest transportation disaster in the U.S. since 2009.

"I feel horrible and I feel lucky," said Kim, who originally planned to be in the limo with her husband Rich. "He was so full of life. He could turn the crappiest day into the best day of your life. We had all these plans. It doesn't seem right."

The cause of the crash is still unknown. Police are conducting a criminal investigation into the incident, the limo company, which had state violations, and the owner, who had a checkered past.

"I have so many questions," Kim said. "I don't understand why it was so important to make a dollar that they felt they needed to put all these people in jeopardy. I can't understand how anybody would be so selfish. I'm so mad."

    "God made a mistake"

Family members remember Rich and Axel, 34 and 29, respectively, as gentle giants. Hilarious Rich always let his daughter put makeup on him. Tender-hearted Axel decided not to join the military as a weapons specialist because he said he didn't want to hurt anyone.

The pair were pranksters and best men in each others' weddings. They worked at desks side by side at GlobalFoundries and lived together in an Amsterdam apartment before they both got married.

Nearly three weeks after the crash that killed them, everyone is struggling to deal with grief in their own ways. Janet has been keeping herself busy, but has trouble sleeping. She finds herself waking up with her face wet, not even realizing she was crying in her sleep.

Kim misses good morning texts from her husband and still finds herself watching for signs he's with her. Rich's 14-year-old stepson, Owen, sometimes stares at Rich's picture then withdraws to his room, but is stepping up to support his mom and stepsister. Rich's 10-year-old daughter, Aubrie, has been having meltdowns.

"She understands he's gone," Kim said. "She doesn't understand why. She says, 'Everybody talks about God, but if he's such a good person, why would he do this to Daddy?'"

"He would have never left her if he had a choice," Janet said. "They say it was God's choice, but God made a mistake. If God had asked them, there's not one of them kids that would have left. They all had plans."

Axel and Amy had recently purchased a house in Amsterdam; Rich and Kim were scheduled to close on one in Gloversville next month. Axel and Amy were hoping to start a family next year.

"They talked about growing old together, but what's growing old, three months?" Janet said, referring to the couple's recent wedding. "To me that's the worst part, the end of what they had to offer."

    "The original love couple"

Kim and Rich met through mutual friends 14 years ago. A year later, they had their daughter, Aubrie, but then split up. They reconnected when they started working together and carpooling. This time, Kim said, everything felt right.

Two months later, Rich proposed on her birthday. In June 2016, they were married in a rose garden — the way Kim wanted — and had a barbecue in an outdoor tent for their reception — the way Rich wanted.

Rich towered at six feet tall and weighed more than 200 pounds, his burly body covered in tattoos, but he would lie on the floor and play Barbies with Aubrie. He let her braid his beard and put makeup on him. Sometimes when Janet showed up at the house, he would open the door with lipstick on. Once he went to the beach with his weightlifting buddies, his toes adorned with purple nail polish.

The couple planned a honeymoon cruise to the Bahamas in January and were closing on a house in November. Now, Kim will go on the cruise with her sisters and is figuring out how she can afford the house on her own. She said she's received offers from at least 72 people to help her move next month.

The week after Rich's death, Kim invited his best friends to come over and play Dungeons and Dragons, like they always did on Friday nights. Kim moved the urn with Rich's ashes on a stand closer to them and joked that "Rich was watching, you got a lot of pressure" — to which they all laughed.

Axel and Amy met at a friend's party. Axel thought Amy was cute, but she was the one who messaged him on Facebook later to meet up. They were together ever since their first date.

They lived together in an apartment in Amsterdam for a year before buying a house. The couple got married at a winery in June on what Janet called the "hottest day of the year" and the wedding party ran through sprinklers during the reception. Axel and Amy went on their honeymoon to Ireland and vacationed in Hawaii last year.

"They were the original love couple. They were so much alike it was scary. You could see the love pour out of them for each other, just by the way they looked at each other," Janet said.

Amy called Axel her bear and he called her his bee. When GlobalFoundries brought Axel's belongings from his desk at work to Janet, there were around 200 sticky notes among his things. They were all from Amy, put in his lunch each day, and in different ways said "I love you."

But before the brothers were best men in each others' weddings, they were best friends growing up in Gloversville.

    "A wicked team"

The brothers' bond started at birth: Janet said five-year-old Rich, who she called Richie, was thrilled when Axel arrived. The two were later joined by a younger brother Eric, now 25.

"Together they were a wicked team," Janet said. "They were just so funny together. They would feed off each other."

When they were young, the pair pretended Rich was beating Axel up on the road until cars stopped to intervene — then they made a run for the house. Rich sometimes picked Janet up and carried her into different rooms or even locked her outside as a joke.

"He was always bubbly, always smiling and laughing," Janet said. "If he thought he hurt your feelings he would be the first one to apologize."

Janet said Axel, who was sweet, followed in Rich's footsteps. The brothers got into weightlifting and set up a home gym in the basement. They both attended Gloversville schools then Fulton-Montgomery Community College, worked as direct support specialists at disability advocacy organization Liberty Arc, and as process integration technicians at GlobalFoundries.

On weekends, the brothers worked for a moving company together. After their deaths, their boss sent a message to Janet praising them for how they turned around his business and treated customers.

"I hope my kids grow up to be like them," the message read.

The day after the fatal crash, Janet reached into her purse for the last pack of cigarettes she'd gotten from Rich. It was half-empty. She said it was a poignant reminder of her sons who always made her laugh — "the last way of getting me."

Seatbelts could’ve saved lives in upstate limo crash that killed 20: report

    https://nypost.com/2019/10/02/seatbe...led-20-report/

Horrific photos showing the remains of the stretch limo involved in last year’s deadly upstate crash that killed 20 people were released Wednesday — as investigators said some of the passengers may have survived if they’d been wearing seat belts.

The never-before-seen photos revealed in the National Transportation Safety Board’s safety recommendation report showed the totally destroyed and crumpled front of the white stretch limo, a customized 2001 Ford Excursion, in the aftermath of the Oct. 6 wreck in Schoharie.

That tragic afternoon, the limo, driven by 53-year-old Scott Lisinicchia, sped through a stop sign at a T-intersection in the rural town and barreled into a small ravine, killing the driver, all 17 passengers inside, including four sisters and three of their husbands, as well as two bystanders.

The NTSB wrote in its report that despite the severe damage to the vehicle — operated by Prestige Limousine and previously modified into a stretch limo — “rear portions of the passenger compartment remained relatively intact,” so some of those in the back could have lived if the vehicle had more readily available seatbelts and if those inside had been wearing them.

“Because survival space was maintained in a portion of the passenger compartment and the passengers may have had an opportunity to ride-down the crash forces … injuries to occupants within the passenger compartment might have been mitigated by a combination of adequate seat integrity, well-designed passenger lap/shoulder belts, and proper seat belt use,” the NTSB wrote in the 15-page report.

“These were not available in the crash limousine,” the report said.

Evidence indicated that none of the passengers were wearing seat belts at the time, the report said.

Regardless, the passenger belts in the limo weren’t the original ones that came with the car, “were not properly designed for occupant crash protection” and were “under the bench seats and invisible to passengers.”

An NTSB reconstruction of the limousine after the crash in Schoharie, New York.NTSB
Lisinicchia was wearing his seatbelt at the time of the crash and the airbag in the vehicle deployed, but “the “crash was not survivable” for him, the report said.

In the days after the wreck – which was the deadliest US crash in a decade – it was revealed that the driver and limo should have never been on the road as he wasn’t properly licensed and the vehicle had failed a state safety inspection a month earlier.

The limo company’s operator, 29-year-old Nauman Hussain, has been charged with criminally negligent homicide and manslaughter in the case.

The NTSB report does not say what caused the wreck, but notesthat the probable cause will be established in its final accident report once it wraps up the investigation.

Meanwhile, the report calls for new national requirements for seating and seat belt systems on limousines.

    A 2010 photograph of the limousine’s interior.NTSB
The agency recommended that the National Highway Traffic Safety Administration require lap and shoulder belts for each passenger seating position on all new vehicles modified to be used as limousines.

It also recommended that seating systems in these vehicles meet minimum performance standards “to ensure their integrity during a crash.”

The NTSB called on the National Limousine Association to educate members on the benefits of proper seat belt use and recommended that the state Department of Transportation ensure all limousine belts are functional and accessible in its regular inspection process.

Currently in New York, limousines are not required to have seat belts for the rear passengers.

The state Senate passed a series of bills in June aimed at preventing fatal limo crashes like the one in Schoharie. Out of the nine bills passed, only one also made it through the state Assembly.

A bill that would require seat belts in any altered vehicle transporting nine or more passengers has only passed the Senate.

Following the release of the NTSB report, state Department of Transportation Commissioner Marie Therese Dominguez said the NTSB’s recommendation that the state “incorporate the inspection of seatbelts for functionality and accessibility into [the agency’s] biannual vehicle inspection process” is “something that in fact has been standard protocol in our process since the early 1990s and are incorporated into the Code of Rules and Regulations for New York State.”

Those photos are absolutely horrific. I feel so badly for the families of those who died because of the negligence of a shady business owner. This guy has been getting away with way to much for too long.

NTSB Finalizes Schoharie Report, Cites Prestige's "Disregard for Safety"

    https://spectrumlocalnews.com/nys/ce...rie-limo-crash

    UPDATED 4:48 PM ET Sep. 29, 2020 PUBLISHED 7:52 AM ET Sep. 29, 2020

The National Transportation Safety Board has ruled that Prestige Limousine's "disregard for safety" was the probable cause of the deadly 2018 limo crash in Schoharie.

The board met Tuesday morning to review and vote on their findings, probable cause, and recommendations for their final report. The preliminary NTSB report focused largely on the defects of the brakes, and it's been said that the limo should have never been out on the road in the first place.

The NTSB says the limo’s brakes were completely corroded. This is not a surprise coming out of this report, as the brake lines have been a suspected problem since that limo first crashed back in 2018.

It was also a major point of their preliminary findings; however, the federal authorities say the company that originally stretched the limo in 2001 was not licensed to do so, and never upgraded the brakes to handle the extra thousands of pounds from the alterations.

They estimated that the limo hit speeds of anywhere from 101 to 118 miles per hour that day, going down the hill near the Apple Barrel before it crashed.

They say if the limo had properly maintained brakes, it could have safely come to a stop.

Last month, the agency made public hundreds of documents it had been reviewing. Those included interviews with the family and friends of the victims along with witnesses to the crash.

The documents show one of the victims of the crash that killed 20 – 17 passengers, the driver, and two pedestrians – was texting a friend from inside the limo that day, telling her it was extremely loud and that “the limo sounds like it’s going to explode.”

Documents also show that two witnesses told state police that the vehicle pulled to the side of the road twice shortly before crashing.

The NTSB has also said that Prestige did not properly register its vehicles.

Prestige registered the limo under the DMV to avoid more rigorous inspections from the state DOT. And both groups knew that Prestige did not have the authority to operate, and had at least seven chances to stop them from operating, even having the authority to pull their limos off the road. But instead, the board said the state gave the business a “slap on the wrist,” saying both the state, and especially Prestige Limousine, failed the 20 victims.

“Did the driver know he was operating without a passenger endorsement? Yes, he did,” said NTSB Board Member Jennifer Homendy. “Did the company know? Yes, it did. So I find, I mean, their actions were egregious, with no regard with safety whatsoever for the safety of their customers, the safety of their employees, and I find they were deceptive.”

The DMV and DOT say they did everything in their power to get Prestige to stop operating, but they continually broke the law.

Prestige Limousine operator Nauman Hussain is charged with criminally negligent homicide and manslaughter in connection to the crash. What comes out of the board meeting could impact that criminal case.

Civil lawsuits have been filed by the families of victims against Mavis Discount Tire, which signed off on work on the vehicle, specifically on the brake line. Some of the lawsuits challenge the state and the specific intersection where the crash took place as being dangerous. It may have an impact in those cases as well.

The NTSB says its investigation, coming nearly two years since the crash, took so long due to the lack of cooperation from both the New York State Police and the Schoharie County District Attorney’s office; DA Susan Mallery sent a statement, saying that NTSB and her office have different responsibilities.

We have heard from victims’ families and their attorneys that there is the possibility of a plea deal for Hussain. His attorney, Lee Kindlon, says the NTSB findings don’t change his team’s defense moving forward, and says it calls into question why other parties like Mavis have not been charged criminally as well.

Limo operator in upstate 2018 crash that killed 20 avoids prison

    https://nypost.com/2021/09/02/limo-o...avoids-prison/

A former upstate limo operator avoided prison time in connection with the catastrophic 2018 crash that left 20 birthday revelers dead, after authorities found the disaster was a direct result of vehicle neglect and terrible brakes.

Nauman Hussain, 31, the former operator of Prestige Limousine, pled guilty Thursday to 20 counts of criminally negligent homicide in connection with the Schoharie, NY, tragedy. He was sentenced to five years probation and 1,000 hours of community service.

At the sentencing — which was held in a high school gymnasium to accommodate spectators under COVID-19 measures — family and friends of the victims castigated the former limousine driver.

“My son, my baby boy, was killed in a limo while trying to be safe,” said Beth Muldoon, the mother of Adam Jackson, 34, who died alongside his wife, Abigail King Jackson.

The couple, who left behind two young children, had hopped in the stretch limo with the large group to avoid drinking and driving.

“Every day I try to wrap my head around this impossible situation,” said Sheila McGarvey, whose 30-year-old son Shane McGowan and his wife, Erin, were killed.

Hussain had been charged with 20 counts each of criminally negligent homicide and second-degree manslaughter, but copped a deal to avoid a long and emotional trial. Inspectors had served Hussain with “multiple notices of violations” before the disaster, prosecutors said.

The limo, rented by Amsterdam resident Axel Steenburg to celebrate his wife Amy’s 30th birthday with family and friends in Cooperstown, careened down a hill at a speed of 100 mph after the driver lost control. The passengers were not wearing seatbelts, which were under the benches of the limo and invisible to them.

Seventeen revelers were killed, along with the driver and two bystanders. It was the deadliest US transportation accident in a decade, and inspired a 2020 limo safety bill in Albany.

Fuck this guy. Prison time shouldn't have ever been taken off the table in this case. He's responsible for every one of those deaths, all of which could have been avoided if he wasn't a shady piece of shit.

My father tells me all the time that I should have been an attorney because I like to argue my point, and I don't back down. I actually changed some of his more conservative political views with my arguments.

The reason I say this is that I would love to be the one prosecuting this case (and so many others). I want a guilty verdict so badly here.
