Man Arrested in Horrific Stabbing Death of Nia Wilson; Bay Area Protesters Demand Justice

The man believed to have slit the throat of 18-year-old Nia Wilson at an Oakland BART station on Sunday night was arrested without incident Monday night.

Police apprehended 27-year-old John Lee Cowell, a paroled felon, on a BART train nearly 24 hours after he allegedly attacked sisters Nia and Letifah Wilson in a vicious stabbing at the MacArthur station in Oakland. An anonymous caller had tipped police that Cowell had boarded an Antioch-bound train, reports the San Francisco Gate.

In a news conference Monday afternoon, BART Police Chief Carlos Rojas referred to the deadly stabbing as a ?prison-style attack? that was among ?the most vicious? he had ever seen in 30 years of policing.

Letifah Wilson, 26, who was also stabbed in the neck but survived the assault, described Cowell?s demeanor immediately following the attack to ABC 7 News.

?I looked back, and he was wiping off his knife and stood at the stairs and just looked ? and from there on, I was just caring for my sister. I was in shock. ... I didn?t know I was cut because I was paying more attention to my sister. But he just stood there, like it was nothing.?

As the Washington Post reports, the Wilson sisters didn?t normally ride the BART train, but opted to take it that night on the way home from a family gathering.

Wilson?s mother, Alicia Grayson, told the East Bay Times that Nia didn?t like the BART.

?She was scared of the BART,? Grayson said through tears. ?Now I see why.?

Protesters rallied to pay tribute to Nia and to demand justice for her senseless, violent death. The racial dynamic of the killing?Cowell, a young white man, selecting two young black women to prey upon?wasn?t missed by many.

Singer and Oakland native Kehlani spoke passionately about the attack on social media, criticizing BART officials for not acting sooner to catch Cowell and referring to him as a ?white supremacist.?

Footage shared on Twitter by Lucas Guilkey, a video journalist and producer for AJ Plus, shows part of a rally where Letifah blasted a song Nia had recorded. The crowd can be seen dancing to Nia?s rapping underneath a large red and white sign that read, ?Bay Area Stands Against Hate And White Supremacy For Solidarity, Justice, and Dignity.?

Daryle Allums, Nia Wilson?s godfather and head of Oakland?s Stop Killing Our Kids group, was among the protesters who took the streets Monday night.

Allums said Wilson?s death had rattled the Bay Area, but cautioned people not to jump to conclusions about why she died.

?We don?t know if this was racist,? Allums said. ?Let?s get this information to find out what really happened. Let?s find out the right facts to then be able to deal with this situation.?

BART police previously described the attack as ?random,? but Rojas told reporters authorities ?cannot discount? that the attack was race-motivated. In the immediate aftermath of Cowell?s arrest, officers have yet to tie Cowell to ?any type of radical group or white supremacist group.?

& of course, when police arrived they managed to arrest him without tasing, shooting or otherwise injuring or humiliating him.

    - I'm not complaining because there was no police brutality here, I'm just so sick of seeing white killers copping these gentle, respectful fucking arrests when even young Black school kids who are victims of crime, are constantly being subjected to violent takedowns because "we had to take precautions because didn't know the facts yet"

That's scary. That's always been a fear of mine - some random person attacking me or my loved ones unprovoked

In the days following 18-year-old Nia Wilson's death, Hollywood stars have taken to social media with messages of sadness, solidarity and calls for justice.

Wilson, a young black woman from Oakland, was fatally stabbed by a white man at the BART MacArthur Station on Sunday evening. Her sister, Latifah Wilson, 26, was also stabbed and hospitalized for her wounds, but has since been released.

On Wednesday, Anne Hathaway posted an impassioned response to Wilson's murder on Instagram, stressing the role that white people play in violence against black people in the United States.

"White people DO NOT have equivalence for this fear of violence," Hathaway wrote. "Given those givens, we must ask our (white)selves- how "decent" are we really? Not in our intent, but in our actions? In our lack of action?"
Protests and rallies in Wilson's honor have been held in Oakland and other parts of California. In a recent analysis of homicide arrests, The Washington Post reported that black victims, who account for the majority of homicides, were the least likely of any racial group to have their killings result in an arrest.

"Tired of needing to organize rally's to convince people that our lives matter," actress Viola Davis tweeted. "To the killer...I will NOT say your name. To Nia...we will shout yours from the rooftops!!!"

Wilson was also a rapper. At a vigil on Monday, one of Wilson's sisters blasted her music for the crowd.

I meant to post this a few days ago.

He had a record like this - in addition to cutting Nia's throat & stabbing her sister - & still he was arrested gently by the same Dept who shot Shaleem Tindle in the back just a few months ago

Timeline: BART stabbing suspect's criminal record

The suspect in the BART stabbing has a criminal record with mostly petty theft and other misdemeanors. But as he grew older, his offenses became bolder. (BART)

OAKLAND, Calif. (KGO) -- The suspect in the BART stabbing, John Lee Cowell, has a criminal record with mostly petty theft and other misdemeanors -- probably nothing that would give police a reason to suspect he would commit murder. But as he grew older, his offenses became bolder.

At just 27 years old, he already has a long rap sheet. When he was 18, Cowell's adult criminal record included misdemeanor drug offenses, obstruction of a peace officer and assault. On the assault charge, Cowell was convicted and released on probation.

When he was 22, Cowell was convicted of battery. Two years later, in 2015, he had another conviction for using drugs.

Nia Wilson was just 18 years old when she was killed in an unprovoked stabbing at MacArthur BART station in Oakland. Fighting through sorrow, her friends, family, and the community at large are mourning the teenager who brightened the lives of those she knew, and has inspired many who never got the chance.

Then in 2016, there were more misdemeanor charges -- this time at the Target store in Contra Costa County. Cowell was caught shoplifting and carrying drug paraphernalia.

Contra Costa County DA spokesperson Scott Alonso says police also found him with this: "I believe he had a tear gas canister. So a wide variety of charges in that one, all misdemeanors."

In May 2016 was Cowell's most serious crime - second degree robbery at Lucky's in El Cerrito. Cowell was known to be a shoplifter here but this time, he was caught in the act. "The loss prevention officer attempted to confront him, detain him and that's when the defendant reacted with a gun, a handgun," Alonso told ABC7 News.

John Cowell is accused of killing 18-year-old Nia Wilson and injuring her sister Letifah Wilson at MacArthur BART. He was arrested Monday afternoon at a different BART station in Pleasant Hill.

It turned out to be a toy gun, but he also had a boxcutter -- a real weapon. Cowell ran from the store and police caught him at the El Cerrito Plaza BART station.

"Our prosecutors sought that felony charge. And he was ultimately sentenced to state prison for two years in October of 2016," Alonso said.

Here's everything we know about the attack that claimed the life of 18-year-old Nia Wilson.

Cowell completed his sentence and was paroled out in May 2018.

He also has a record in Contra Costa's Civil Courts.

In 2015, a Concord woman filed a restraining order against him. The following year, there was another restraining order. This one from Kaiser Hospital in Richmond, stating he had repeatedly threatened staff members.

You may be wondering -- what about his mental state?

Alonso says, " He was evaluated by a doctor in the robbery case in 2016. He was found competent to stand trial."

    ? Vic Lee (@vicleeabc7) July 25, 2018
Cowell also has several misdemeanor offenses in Alameda County -- petty thefts, vandalism and drug use.

BART authorities tell ABC7news that Cowell has deep ties to North Concord. He has tattoos on his body, which highlight those ties. One says "North Concord." Another on his neck reads "925," the area code for Concord and incidentally,a tattoo the tipster told police about when he called them. That was the tip that led to his arrest.

Now Bart has to deal with an unrelated death this time at the Dublin station.

. DUBLIN, Calif. -- A 26-year-old woman recently released from Santa Rita Jail was found dead at the East Dublin BART station Saturday morning, BART officials said.

The woman had a bump on her head, but no other signs of foul play were found, said BART spokeswoman Cheryl Stalter.

The woman's body was discovered about 5:30 a.m. near the passenger pick-up/drop-off area at the station.

This is a second reported death at the Bart station.

This is a second reported death at the Bart station.
This might end up needing to be investigated under death in custody procedures *if* she had the injury prior to her release

    (from the link)

Santa Rita Jail officials were reviewing their records to determine whether the woman had a bump on her head when she was released. In addition, BART police are pulling images from surveillance video that may be relevant to the incident, Stalter said.

A California judge has ruled that a 29-year-old parolee with a history of mental illness is fit to stand trial in the slaying of a woman on an Oakland subway platform in 2018.

The judge said Tuesday that John Lee Cowell would face trial starting in January for the unprovoked stabbing death of 18-year-old Nia Wilson in July 2018.

Cowell has been charged with murder and attempted murder for the attack on Wilson and her sister, who survived.

Prosecutors have said they will seek a life sentence against Cowell and are investigating if he was motivated by racial hate when he killed Wilson.

Cowell came up behind Wilson and quickly stabbed her twice before doing the same to her sister as they were getting off the train, BART police said.

He was found and arrested the next day.

While in custody, Cowell began displaying behavior that indicated he may not be able to understand the proceedings against him, his attorney said.

He was later found to be competent to stand trial and criminal proceedings were reinstated after a monthslong evaluation by court-appointed psychiatrists.

Cowell pleaded not guilty by reason of insanity at a hearing in November and his trial was set for Jan. 6.

Nia Wilson’s killer is refusing to attend his own trial.

On Day 2 of the murder trial, defense attorney Christina Moore sat alone on her side of the counsel table. The defendant, John Lee Cowell, remained in a separate room in the Oakland courthouse. Deputies tasked with guarding him tried to coax Cowell to walk downstairs to the courtroom, but he declined.

The 29-year-old man suffers from schizophrenia, and he has pleaded not guilty by reason of insanity. Cowell stabbed Wilson, 18, and her sister in the summer of 2018 while the sisters were trying to return home on BART from a family gathering. Cowell had never met the women. Prosecutor Butch Ford said surveillance cameras recorded Cowell watching and following the sisters from Concord to Oakland before he lunged at Wilson from behind and slit her throat.

Cowell was equally unpredictable on Day 1 of the trial. He was quiet for about 30 minutes as the judge gave instructions to the jury. and the gallery was filled with the victim’s supporters, news reporters and court employees. He remained composed as Ford began opening statements by declaring him as “evil.”

“Evil exists in this world and cause terrible things to happen to innocent people. All of those things came together at the MacArthur BART station. Evil in this case has a name, and its name is John Lee Cowell,” Ford said.

Cowell showed his first signs of agitation when Ford played BART surveillance video for the jury. The video showed Cowell arriving at the Concord BART station just before Wilson and two of her sisters arrived. Cowell tried to use that evidence to say it showed he wasn’t following the Wilson sisters. Judge Allan Hymer warned Cowell to remain silent, but he continued objecting and deputies escorted him out of the room.

Cowell has resided in an Alameda County jail in Dublin since his arrest. KRON4 spoke with Alameda County Sheriff’s Sgt. Ray Kelly to find out if Cowell’s courtroom behavior matches the behavior he has shown as a jail inmate.

Kelly said there have been no major incidents caused by Cowell during his time behind bars.

“He really has not been problematic for us. He seems to go along with the program,” Kelly said.

The man accused of murdering Nia Wilson on a BART station platform in 2018 admitted to the brazen double stabbing in court Tuesday, but he said he believed Wilson and her sisters were aliens and part of a gang that had kidnapped his grandmother.

“I stabbed both of the females in the crew, because I believed they would not give my grandmother back,” John Lee Cowell said from the witness stand in Alameda County court.

The 29-year-old’s testimony ranged from incoherent — at one point, he launched into a tangent about aliens, radios and “fake skin” — to confusion over how to answer his attorney’s questions. Cowell said he has a history of mental illness and heard voices in his head, but he could not remember what those voices told him.

He has pleaded not guilty by reason of insanity.

The sister of BART stabbing victim Nia Wilson doesn't buy that Nia's alleged killer testifying in his own defense is mentally ill.

"It's just an act to me. What I've seen? Manipulation," said Letifah Wilson, who was also injured the night of July 22, 2018 at the MacArthur BART station, but survived her stab wounds. "He wants to project his feelings on to others, so we won't get an answer."

John Lee Cowell lasted just 15 minutes on the witness stand. During cross examination by Alameda County prosecutor Butch Ford, Cowell became combative, saying he recognized the knife held up before him but not the July 2018 stabbing, even as he identified himself in a surveillance video.

"I don't remember anything like that. What is this that we're watching?" said Cowell, pointing to a large video screen next to him.

As the prosecutor tried to show a slow-motion video, Cowell kept interrupting, finally yelling "Back the f*%# down." When he was ordered to leave the witness stand, "Now they can't force me to say sh** if I'm f*#*ing leaving."

Cowell was escorted out of the coutroom by two deputies and was not present when his aunt testified that he had exhibited paranoia and symptoms of mental illness since childhood, claiming to see aliens and "fake skins."

Testimony in the Nia Wilson trial concluded on Monday after prosecutors called their last rebuttal witness to the stand, but jurors won’t hear closing statements for another two weeks because of a pre-scheduled break.

Deputy District Attorney Butch Ford finished questioning of his final witness, a psychiatrist who met with defendant John Lee Cowell while he was at Santa Rita Jail after fatally stabbing Wilson on a BART station platform two years ago.

Judge Allan Hymer reminded the jury about the court’s planned break for a recess from Wednesday until March 9, when closing arguments are expected to be heard.

He urged jurors not to discuss the case with anybody or read about it in the time being.

“You are to remain objective fact finders,” Hymer said.

Nearly half of an Oakland courtroom erupted with tears of joy, hugs and crumbled tissues Tuesday afternoon, as the small army of slain 18-year-old Nia Wilson’s family absorbed the words they’d waited nearly two years to hear.

John Lee Cowell, the 29-year-old transient accused of murdering Wilson and attempting to murder her sister in a shocking double stabbing on a BART platform, was officially guilty of both counts.

The verdict, which came just hours after jurors began deliberations, came as an exhilarating win for a family unit that has attended every courtroom hearing following Wilson’s July 22, 2018 killing. The news sparked an impromptu chant of “Nia! Nia!” outside the courthouse just afterwards, but family also acknowledged that the victory was measured.

Because pleaded not guilty by reason of insanity, the guilty verdicts touch off a second, mental-health phase of the trial that begins Wednesday.

The judge overseeing the Nia Wilson murder trial took an extraordinary step Monday by halting what would have been the third day of jury deliberations and rendering a verdict himself: John Lee Cowell was sane when he fatally stabbed the 18-year-old woman at an Oakland BART station in 2018.

Judge Allan Hymer’s verdict was announced in a closed Alameda County courtroom a day after Gov. Gavin Newsom directed people 65 and older to isolate themselves at home due to the coronavirus pandemic. Several of the 12 jurors — as well as Hymer — are over 65.

While Wilson’s family and prosecutor Butch Ford cheered the judge’s swift action, the circumstances of the ruling almost certainly set the case up for an appeal by defense attorneys. Ford said prior to Hymer’s verdict that jurors were leaning 11 to 1 toward a sanity finding.

Alicia Grayson, Wilson’s mother, said she was “ecstatic” about the judge’s ruling.

“I know Nia’s smiling down on her family, her sisters, her friends,” Grayson said. “I know she can rest in peace now.”

Hymer’s decision came less than a week after a jury found Cowell guilty of first-degree murder for Wilson’s death and guilty of attempted murder for the nonfatal stabbing of Wilson’s older sister, Letifah Wilson, on July 22, 2018.

Cowell will face mandatory life in prison without parole, Ford said. His sentencing is scheduled for April 14.

Defense attorney Christina Moore said she was “really disappointed” in the decision.

“I’m aware of no legal authority that allows a judge to take this from jurors after three days of deliberations,” she said.

The jury of eight women and four men deliberated less than four hours March 10 before finding Cowell guilty on both counts, and it also upheld a special circumstance enhancement of lying in wait. The jurors did not uphold an enhancement of inflicting great bodily injury upon Letifah Wilson, whom Cowell stabbed in the neck.
