    A man has been charged with killing his girlfriend's six-month-old baby after mistaking him for a spider while asleep.

    Dwayne Lindsey, 35, claimed he awoke from a nap with Chayse Dearing on his chest.

    Lindsey, who had allegedly been smoking a drug known as ice, said he became startled and mistook the child for a spider, before Chayse rolled to the floor and smashed his head against a heater.

    Medical examinations of Chayse show he suffered severe and traumatic injuries to his brain and spinal chord.

    Mum Michelle Dearing had left her son alone with Lindsey in their Glenroy home in Victoria, Australia.

    She had visited a local supermarket with two friends in the early hours of June 26, 2016.

    The Supreme Court in Melbourne heard how Michelle had left her son content in the hands of Lindsey, who had proposed just days before Chayse was found dead.

    Hours later, he frantically called Michelle claiming Chayse had stopped breathing, reports The Age.

    Michelle said: "He wouldn't tell me what was wrong, he wouldn't say anything. He just kept saying, 'hurry up, hurry up'."

    The distraught mum also told the court she noticed her son had been changed into a different outfit from the blue jumpsuit she had left him in.

    The court also heard how neighbour Brian Woods said he heard a baby crying between 1am and 3am, along with an argument between a man and woman.

    At 8am, he then heard a man desperately trying to wake a baby.

    Mr Woods said: "He kept saying, 'hey you. hey you'. He said it about 60 times.

    "He swore once or twice and stamped his foot a couple of times."

    He later told the court he heard the man shout "f*****g c**t" along with what sounded like a distressed phone call.

    If you're gonna try to use the drug as an excuse for you're behavior than you obviously think this drug is capable of making you have delusions and act this way and yet you still take it while being the sole responsible person for a child and that child dies at your hands. Sounds like premeditated first degree murder.

    Smashing this prick's head into a heater until would be too nice a punishment for him.

    I'm from Australia and never have i come across a spider that would weigh the same as a 6 month old baby. Not even my cat as a kitten weighed as much. Not to mention apparently changing the childs clothing...total bull! Even if this was a accident the fact he was 'caring for a child' while under the influence makes him guilty regardless. Poor chayse taken so young. May he rest in peace.

    WHY did the mother of a six month old baby leave him with some man she was sleeping with who was NOT the father? Why did she even feel the need to BE with a different guy? Isn't being a single mom of a baby enough to keep her busy?

    Well, in this case she was engaged to this guy. It sounds like the real father wasn't in the picture. But to a degree, I agree with you, a lot of single moms let their boyfriends watch their kids and a lot of times it turns out badly. We have hundreds of little dead kids on this site that prove that. I don't think the issue is leaving the baby with someone who isn't his father, it's more choosing a good man. Obviously this guy was on drugs, etc. She knew this, and left the baby with him, and that is what the issue was. Most of the time in these cases there are large red flags like that.

    On the flip side, I was pregnant when I met my now husband. I left the disinterested baby daddy in another state, and moved back to my home state. We became friends, and didn't start officially dating until after my daughter was born, but he sent her flowers in the hospital when she was born. I don't think he ever watched her alone until she was probably 2 or 3 years old, but she is almost 7 now and he has been her dad since day one, and he loves her probably more than he loves me. So it does work sometimes to enter a relationship with a brand new kid from another man. But you MUST carefully scrutinize the person before they are allowed to care for the child alone.

    When I saw the headline my first thought was 'bullshit unless he lives in Australia'. Even then you can't mistake a white baby for a brown fuzzy spider. Maybe a brown baby.... I just can't live in a country with toddler size spiders.

    I have a friend who's been living there for about a year now, after he married an Australian girl he met while there for work. Over this past year their Instagram has gone from happy new couple buying a home in the suburbs to some kind of national geographic nightmare lol. All this dudes family and friends went from being all excited to come visit them to being like "hell no!", "Fuck that!", "do you live in the jungle?", "don't have kids!", etc. it's hilarious. He's like this is the fucking suburbs!

    I get upset when I see deers. I can't imagine kangaroos or wombats, or toddler size spiders.

    Are kangaroos nice? They don't look nice on TV, but maybe in the suburbs they're friendly. They look like they would kick the shit out of you.

    I'm not one to ever say that I'll live in another country. Fuck that, I love America... Because even poor, I own a flat screen, internet, and a computer... I saw that joke on the new One Day at a Time.

    No kangaroos except for once when he was on a golf course. I'm sure he'd prefer them by his house! Besides the many pics and vids of giant spiders and these crazy flocks of bats that fly over his house every night his biggest problem is snakes. He regularly posts vids of this giant snake that hangs out in these rocks by his front door, they have to look out the windows every morning before they go out, it's nuts. One time in his attic he found this giant shedded snake skin and never found the snake. Fuck that.

    Man claim spider scare caused baby's injuries



    The man on trial for murdering a baby claims he never intended to kill the six-month-old.

    The Melbourne man accused of murdering a six-month-old baby has blamed a spider scare for the little boy?s fatal injuries.

    Dwayne Lindsey had been left in charge of baby Chayse while the baby?s mother, Michelle Dearing, went on a late-night trip to Kmart in June 2016.

    But when Ms Dearing returned home, she found her baby dying.

    Lindsey, who has denied he intended to kill the six-month-old boy, is on trial in the Supreme Court of Victoria for murder.


    The court was told on Friday the baby had severe traumatic brain and spinal cord injuries, marks on his neck, bruising and abrasions on his groin and retinal bleeding.

    Prosecutor Nicholas Papas QC said Lindsey claimed he fell asleep with the child on his chest, then woke and jumped when he thought a spider was crawling on him.

    He claimed the baby rolled off his chest and hit his head against a wall heater.

    But Mr Papas said Lindsey?s explanation was incongruent with medical reports, which showed Chayse?s death from a head injury was unlikely to have been accidental.

    Ms Dearing and two of her friends had gone to Kmart after 4am. At 8.21am, she got a call from Lindsey saying something was wrong with Chayse, that he wasn?t breathing and that he had blood coming from his nose.

    ?It was an emotional, chaotic scene when Ms Deary and the others got back,? Mr Papas said. ?She (Ms Deary) was overcome with emotion and collapsed.?

    Ms Deary noted Chayse had been changed from his blue Ralph Lauren onesie into a white fluffy onesie with bear ears on the hood, Mr Papas said.

    It is also alleged Lindsey later told a witness he had, in fact, struck and kicked the baby.

    Defence barrister Scott Johns said Lindsey did not intend to kill the child.

    ?Whatever you think of Dwayne Lindsey, he?s not a murderer,? he said.

    ?None of his actions came from an intention to cause any harm at all.?

    Lindsey?s trial is expected to run for a week.

    A Melbourne man found guilty of murdering his girlfriend's six-month-old baby can "rot in hell", a family member says.

    Chayse suffered severe traumatic brain and spinal cord injuries, marks on his neck, bruising and abrasions on his groin, and retinal bleeding.

    The jury returned its verdict in the Supreme Court of Victoria early on Sunday afternoon, after starting its deliberations on Thursday.

    Before he was escorted from the court, Lindsey blew a kiss to Mariah Strahan, Michelle's foster mother.

    Speaking outside court, Ms Strahan said the trial had been difficult for family members to hear the details of how Chayse died.

    "It's been torture. It's been very hard to sit in court and listen to the injuries that Chayse had," she told reporters.

    She said she hoped Lindsey was reminded of what he did to the baby every day he spent in prison.

    "You can't explain what he did. None of us know why he did it ? it's just obviously the evil in him," Ms Strahan said.

    "What I honestly think of him is he can rot in hell.

    "I hope the rest of his days are lived in torture, like he did to Chayse."

    She also said the guilty verdict brought relief to the family.

    "The people of Victoria have spoken that they are no longer going to put up with harming kids and children."

    The court was previously told that Ms Dearing and her friends had gone shopping at a 24-hour Kmart just after 4:00am on the day of Chayse's death.

    When Ms Dearing returned home to find paramedics working on her baby, she became "overcome with emotion and collapsed".

    Lindsey had initially claimed he had been asleep with the baby on his chest but had been woken by what he thought was a spider.

    He said he jumped and the baby fell off his chest, hitting his head on a wall heater.

    However, prosecutor Nicholas Papas QC said those claims were inconsistent with medical reports, which showed Chayse's death from a head injury was unlikely to have been accidental.

    Defence barrister Scott Johns conceded Lindsey caused the injuries, but argued he did not intend to harm or kill Chayse.

    Lindsey will return to the Supreme Court of Victoria on May 3 for a plea hearing ahead of sentencing.

    It can now be revealed a Melbourne man was jailed for 34 years last May for murdering his girlfriend's six-month-old baby in an ice-fuelled "act of total and unmitigated evil".

    Dwayne Lindsey, 35, murdered Chayse Dearing at a flat in Glenroy while the baby's mother was out shopping in June 2016.

    The baby suffered severe traumatic brain and spinal cord injuries as well as bruising to his neck, head, groin and genitals.

    In sentencing, Supreme Court Justice Stephen Kaye said it was a "vicious, brutal and sickening attack on a defenceless and helpless infant for no reason".

    "While the whole incident might have taken place over a relatively brief time, it was of a sufficient duration that enabled you to inflict a number of separate bruises to Chayse's head, to vigorously shake Chayse, to cause ligature marks to his neck, and to inflict severe injuries to his groin and genital area," he said.

    "Those injuries ? bear the hallmarks of a ferocious, brutal and sickening attack, inflicted by you on a defenceless, harmless and innocent baby."

    The baby's mother, Michelle Dearing, and one of her friends had gone shopping at a 24-hour Kmart just after 4:00am on the day of the murder.

    She returned home to find paramedics working on Chayse, who was taken to hospital and later died after life support was withdrawn.

    Lindsey initially claimed he had been asleep with the baby on his chest when he was woken by a spider before Chayse fell off him and hit his head on a wall heater.

    That was inconsistent with the medical reports.

    'Vicious and sickening violence'


    Justice Kaye found Lindsey had subjected Chayse to a series of "brutal acts of cruel, vicious and sickening violence".

    The sentencing was suppressed as Dwayne Lindsey faced further charges in the Victorian County Court.


    But prosecutors withdrew those charges this morning, prompting the suppression order on his sentencing in the Supreme Court last May to be lifted.

    Lindsey was high on the drug ice and hadn't slept for several days when he launched the attack.

    Justice Kaye said although Lindsey's drug use went some way to explaining his "ferocious, brutal and sickening attack", it was no excuse and wouldn't lessen his sentence.

    "It does appear that your murderous assault on Chayse was out of character with the attitude you had displayed to him.

    "However, that evidence, while relevant, does not in any way ? diminish your culpability for the appalling brutality with which you inflicted the injuries on Chayse," he said.

    Lindsey has never explained the attack or shown any remorse.

    Justice Kaye said it was "so contrary to the fundamental values of our society as to defy any comprehensible explanation".

    "What you did to Chayse was an act of total and unmitigated evil."

    Justice Kaye said he had decided against sentencing Lindsey to life imprisonment as there was no evidence his murderous attack was pre-meditated and accepted he had been trying to seriously nurture the baby, not kill him.

    The court heard Lindsey, a regular ice-user, had a long history of drug abuse which began when he was 12.

    Lindsey will serve a minimum 27 years jail before becoming eligible for parole.

    It's expected he will need to be detained in protective custody due to the nature of his crime.

    'Rot in hell'


    A jury found Lindsey guilty in March, with a family member saying after the verdict that "he can rot in hell".

    "You can't explain what he did," Michelle's foster mother, Mariah Strahan, said outside the court at the time.

    "None of us know why he did it ? it's just obviously the evil in him.

    "I hope the rest of his days are lived in torture, like he did to Chayse."

    I don't know wtf the judge was thinking because given the bub's injuries & the arguing the neighbour heard, it's seems a lot more like he was livid that his girlfriend left him watching her baby for hours so she could go shopping at 4am.

    I think he took his anger out on her baby & then made up an excuse to try & hide what he'd done. & I guess the excuse worked on some people
