    Charges filed in death of Evelyn Rodriguez, mother of MS-13 victim killed at daughter's memorial site

    BRENTWOOD, Long Island (WABC) -- An indictment has been filed against the driver of an SUV who struck and killed a Long Island mother who led a crusade against MS-13 gang violence after her daughter was slain.

    The driver, Annmarie Drago, is facing charges of criminally negligent homicide, petit larceny, and criminal mischief.

    Rodriguez was struck and killed on September 14 while setting up a memorial in Brentwood to mark the second anniversary of the death of her 16-year-old daughter, Kayla Cuevas, and her 15-year-old friend Nisa Mickens, who were killed in gang-related violence.

    "Our goal in the Suffolk County District Attorney's Office is to seek justice," District Attorney Tim Sini said. "And that's what we've done here today. We've begun the process of justice."

    Prosecutors allege that Drago stole some items in the memorial and then intentionally destroyed another part of it. Drago was reportedly trying to sell her mother's home, which is located near the memorial.

    They say Rodriguez confronted Drago about it, which is when she was allegedly run over.

    "Despite the fact that Evelyn was in front of the vehicle with her hands on the car...despite warnings, the defendant abruptly accelerated," Sini said.

    Drago pleaded not guilty and was released without bail.

    "All I can do is just pray and hope my mother, she gets justice," daughter Kelsey Cuevas said.

    When asked why Drago was released without bail, Sini pointed out that the defendant did not leave the scene of the crime, had no criminal history, did not attempt to leave the country and voluntarily surrendered to police.

    "I really hope that justice prevails and she pays," friend Vanessa Lopez said. "And she goes to jail for this."

    A grand jury heard evidence, including testimony from Kayla's father, Freddy Cuevas, who witnessed the crash.

    Rodriguez' death came two years to the day after her daughter's body was found. Kayla Cuevas and Mickens were walking when police say they were ambushed by MS-13 gang members and slaughtered.

    Their deaths brought sudden attention to a string of killings of teenagers in the Long Island suburbs that had largely gone unnoticed, and in some cases, uninvestigated by police. After he became president, Donald Trump visited Brentwood and vowed a national crackdown on MS-13.

    He recognized Rodriguez, Cuevas and Mickens' parents at the State of the Union address in January.

    "Her roar was deafening, from the streets of Brentwood to the halls of Congress to the ears of the president himself," Suffolk County District Attorney Timothy Sini said at her funeral.

    In El Salvador the place where MS-13 was born they have to deal with a rival group called La Sombra Negra. This group is filled with Police officers and members of the military in El Salvador and their aim is to have summary execution against MS-13 but the ended up killing judges they accuse of being corrupt.

    This happened too close to us. I think one of the suspect's brother was convicted in the MS murder of a 15 year old girl a couple years ago too

    A member of Long Island’s bloodthirsty MS-13 will face the death penalty — along with his older brother, a gangbanger commander — when the pair go to trial for their alleged roles in a string of ruthless slayings, federal prosecutors said Friday.

    Jairo Saenz, 24, is accused of seven killings committed while he was second-in-command of the MS-13 crew known as the Brentwood Sailors, prosecutors charged. His big brother, Alexi Saenz, 25, who headed the crew, also faces death in the stunning slaughters, federal prosecutors announced in July.

    Included in the blood-lust hits were a pair of defenseless Brentwood High School girls, best friends Kayla Cuevas, 16, and Nisa Mickens, 15, who were killed in September 2016.

    The Saenz brothers are also charged, along with other alleged gangbangers, in the slayings of five men: Javier Castillo, Dewann Stacks, Esteban Alvarado-Bonilla, Oscar Acosta and Michael Johnson.

    According to federal prosecutors, the brothers conducted the hits over a 13-month period, a sickening average of more than a killing every two months.

    In addition to their alleged roles in the carnage, Jairo Saenz also took part in the attempted murders of two men in 2016 and torched two cars, federal prosecutors charged.

    The brothers are two of 22 men already arrested in a wide-ranging, 89-count federal case — including an attempted 2019 murder and numerous assaults inside Brooklyn’s federal jail.

    Twelve others named in indictments are awaiting a decision from the Attorney General on whether the Department of Justice will seek the death penalty in their cases, authorities said.

    No trial date has been set for the Saenz brothers or their alleged co-conspirators.
