    Diana Alvares (9) was murdered and her body was found almost 4 years after she went missing

    Family members of a 9-year-old south Lee County girl missing since Sunday morning are upset with the scope of the search and said they are not being allowed to contact the girl's parents.

    The search was continuing late Sunday for the 9-year-old girl missing from her mobile home park since 2 a.m.

    The Lee County Sheriff's Office issued a request Sunday morning asking for the public's help locating Diana Alvares. Later on Sunday the Florida Department of Law Enforcement also issued a missing child alert on Alvares.

    Nancy Martinez said her cousin Uribe Jiminez was married to the girl's mother, Rita Alvarez.

    The girl's biological father is not in the picture and Martinez said he is out of the country. "We've exhausted that option," she said of a possible abduction by the biological father.

    Diana Alvarez is Hispanic, 4 feet, 4 inches, 95 pounds, with dark hair, brown eyes, and has two scars on one of her legs.

    She was last seen wearing a unknown color shirt, blue bottoms, unknown shoes, and may be carrying a green blanket with flower print.

    She was last seen at 2 a.m. at her residence, 3540 Unique Circle at the Sheltering Pines mobile home park, in the San Carlos Park area of south Lee County.

    About a dozen of the manufactured homes were behind crime scene tape that cut off an entire section of Unique Circle.

    Detectives with the Lee County Sheriff's Office at the scene declined to comment about the progress of the case. A K-9 search team was seen earlier in the day and around 10:30 p.m. Sunday a sheriff's officer helicopter was circling the community placing a spotlight in an area behind and west of the missing girl's home..

    Shortly after 11:25 p.m. two tow trucks rolled up and through the crime scene tape, proceeding to the home of the missing girl. The trucks loaded and carried off a black sedan and a tan pickup.

    Shortly thereafter a deputy removed crime scene tape, said the case was ongoing and left the scene. A cruiser remained at the girl's home, which remained cordoned off by crime tape.

    Martinez returned to the development around 10 p.m. Sunday and talked with a deputy. She and about a dozen other family members were not allowed to go past the crime scene tape or to contact the girl's parents, she said.

    "We are not being told why they are holding the parents," she said. She has not even been allowed to make phone contact, she said..

    Martinez said Diana Alvarez was last seen by a sister when the sister went to the bathroom Sunday morning.

    "She's 9, she wouldn't leave her bed at 2 a.m.," she said.

    No search was allowed as well, Martinez said, because of sheriff's office "procedure," she said she was told.

    'We have 80 people willing to search, we just have to call them," she said.

    Additionally, she said, the sheriff's office told her that an Amber Alert is not warranted in this case because the little girl does not meet the qualifications.

    Specifically, Martinez said, she said she was told that the Amber Alert was not issued because a car was not involved and it was not known if the girl was in danger.

    Absent the search, Martinez said family members have distributed fliers from Fort Myers to Naples.

    Scott Behrenwald's girlfriend and her mother live in one of the homes near the crime scene and he was sitting with friends in a home inside the cordoned off area.

    "The search this morning was done just by us," he said. "I got here about 8:30 and saw all the cop cars around. We went walking around. Some of us went out and knocked on doors."

    He added that deputies went around checking on homes where nobody was home.

    Behrenwald said his girlfriend's kids play with the little girl all the time.

    "She's a little sweet girl," he said of Alvarez. "I see her all the time."

    Fliers with the girl's photos have been distributed around the south Lee County community where the mobile home park is located, off U.S. 41 near Sanibel Boulevard.

    Lynda Van Bibber came to the crime scene around 9:30 p.m. after she said a family member called her.

    "The family asked for a few people to come out but I want to talk to the deputies first," she said. After a few minute discussion with the deputies Van Bibber said they told her that the time was not right for a search.

    "They said they were not at (that) point," she said, adding that the sheriff's office representatives told her that for a search they would call in cadets from the local safety academy.

    Ryan Boone, who lives with his wife Kassie and their 4-year-old son at the front of the community about a half-block from the crime scene, said a deputy came to their home early Sunday and asked about the little girl.

    "They searched my garage," he said.

    Boone, who said he remembers seeing the little girl walking around from time to time, said the deputy issued no warning to him or told him to take any precautions..

    "I want to know, have they looked at the cameras at Walgreens," he asked. "That's the only way they can see someone coming and going here."

    He said he hasn't heard anything about what happened.

    "I dealt with it this morning and then we went fishing," he said. "And it's still going on. It's still kind of scary."

    Boone said it worries him that there's no information being released.

    "If it was an abduction it could have been us," he said. "I hope they find her."

    Diana Alvares search continues; Family suspects they know kidnapper

    SAN CARLOS PARK, Fla. - It’s a fight for Uribe Jimenez to hold back tears knowing his 9 year-old daughter is still missing.

    Diana Alvares was last seen in her home on Sunday, May 29th. Her family says she went to bed around 10 pm; Around 2 am her mother woke up to bottle feed one of her younger children.

    “I can’t describe it. They don’t know how we feel right now,” Diana’s step-father said.

    Diana’s mother woke up again a little before 7 am, this time to get the kids ready for church. This is when she noticed a strange smell coming from their kitchen and saw someone left the stove top on and a pan filled with oil sitting there.

    “My wife when she woke up she found all the stoves on,” he said. “She asked me if I did it and I said, ‘what are you talking about?’ I had no idea what happened.”

    The couple speculates the person who took Diana purposely left the stove top on and may have been planning to set their home on fire.

    “After my wife say that she went straight to Diana’s room and that’s the point where she tells me Diana’s not here.”

    A suspect has not been named by detectives in this case, yet.

    Four In Your Corner found 45 sex offenders and registered predators live within a 5 mile radius of their home. There are seven offenders listed within a mile radius, and one sex offender lives on her street.

    The Lee County Sheriff’s Office tells FOX 4 their investigation includes taking into consideration the sex offenders that live near by. They did not confirm, however, if one of the sex offenders are being considered a suspect.

    Diana’s parents Uribe and Rita Jimenez tell Four In Your Corner they weren’t aware so many sex offenders lived near their home. Despite the alarming number, they say they don’t think it’s likely an offender took their daughter. They believe an old roommate may have kidnapped her.

    “He left like a month ago before this thing happened,” Diana’s stepfather says. “He said, ‘I’m going to move. I don’t have no more job here.”

    Jimenez says they believe the man is about 25 or 26 years old. He lived with their family for a short period of time while he searched for work. They never noticed anything strange about him. The mom tells Four In Your Corner the last time they saw him was a week ago when he came back to the house to pick up some of his belongings.

    When Diana mysteriously disappeared, her parents tried reaching out to the roommate. They say originally he didn’t answer their calls right away. When they finally got in touch with him he said he was in Orlando looking for work and didn’t know about Diana’s whereabouts.

    Diana’s mother tells Four In Your Corner off-camera that her daughter started acting strange a few weeks leading up to her 9th birthday earlier this month. She says Diana started focusing on her appearance much more and out of no where started wanting to wear makeup.

    She also said her daughter was close to the roommate who practically became like family during his stay.

    They say they thought it was odd their full-grown pitbull didn’t bark throughout the night Diana disappeared, adding, if it would have been someone they didn’t know, the whole neighborhood would have heard their guard dog trying to scare them off.

    “The pitbull barks at every little thing,” he said. “He barks at his waterbowl.”

    The vehicle mentioned in the Amber Alert for missing 9-year-old ‪Diana Alvares‬ has been located, according to the Florida Department of Law Enforcement.

    No further details were immediately available.

    FORT MYERS, Fla.- A Florida Amber Alert has been issued for 9-year-old Diana Alvares, who was last seen early Sunday morning at her home on the 3500 block of Unique Circle near the San Carlos Park area of Lee County.

    Alvares may be in the company of 28-year-old Jorge Guerrero, who authorities say has ties to Orange and Okeechobee counties.

    Alvares and Guerrero may be traveling in a tan Chevrolet Malibu, Florida tag 78NHD.

    Guerrero is described as 5 feet 5 inches tall, weighing approximately 145 pounds with black hair and brown eyes.

    Family members say Alvares was very attached to Guerrero, who at one time rented a room in their home at the Sheltering Pines Mobile Home Village.

    Alvares’ mother, Rita Hernandez, said she was uncomfortable with the relationship between Guerrero and her daughter.

    “He’d say things like ‘The girl’s gotten really cute’ or beautiful and that she’s so big,” Hernandez said. “To me, that’s not something a grown man can say about a 9-year-old girl.”

    Hernandez said she confronted the man and he moved out on May 2. The 9-year-old was visibly upset when Guerrero returned to the home to move his van, according to Hernandez.

    “Diana noticed that the van wasn’t here. So she comes to me and says ‘Mom, did Jorge come to take his van?’ I said yes. Then she starts to cry. She then says ‘But why didn’t Jorge wait for me?’” Hernandez said.

    The Lee County Sheriff’s Office said Wednesday they believed there was no evidence to suggest Alvares was still in the area and it was actively pursuing a number of leads.

    The sheriff’s office requested the Florida Department of Law Enforcement to issue an Amber Alert for Alvares’ disappearance on Thursday, an FDLE spokesperson said.

    Authorities capture man accused of abducting Diana Alvares

    OKEECHOBEE, Fla. - Authorities have captured a man believed to have abducted 9-year-old Diana Alvares from her home on 3540 Unique Circle in San Carlos Park, WINK News has confirmed.

    Jorge Guerrero, 28, is in jail after having been taken into custody early Saturday morning in Okeechobee County. However, the child is still missing.

    Uribe Jimenez, the girl's stepfather, said he received a call from police Saturday telling him Guerrero had been arrested, but they had no news on Alvares. The family said they?ve been told authorities are questioning Guerrero in jail Saturday morning.

    An initial court appearance should take place Sunday morning at the Okeechobee County Courthouse, jail officials said.

    A Florida Amber Alert has been issued for the girl, who was last seen Sunday at 2 a.m.

    Family members have expressed concern about a strong attachment Alvares felt toward Guerrero, who at one time rented a room in their home at the Sheltering Pines Mobile Home Village.

    Alvares' mother, Rita Hernandez, said she was uncomfortable with the relationship between Guerrero and her daughter.

    "He'd say things like 'The girl's gotten really cute' or beautiful and that she's so big," Hernandez said. "To me, that's not something a grown man can say about a 9-year-old girl."

    Hernandez said she confronted him, and he moved out May 2. Alvares was visibly upset when Guerrero returned to the home to move his van.

    The statewide search zeroed in on Okeechobee and Orange counties, places where authorities believe Guerrero has ties.

    A $6,000 reward is being offered for information leading to missing Diana. If anyone knows the whereabouts of the 9-year-old or spots her, call 239-477-1000 or 911 immediately so authorities can dispatch a deputy to that location, the Lee County sheriff?s office said.

    Suspect in Alvarez case charged with having child pornography

    Jorge Guerrero, a person of interest in the disappearance of 9-year-old Diana Alvarez, was charged in federal court Monday for possession of child pornography.

    The criminal complaint also outlined a number of details including tracking a phone Guerrero used and later threw away to the vicinity of Diana's San Carlos Park home the night she disappeared.

    Guerrero is being held in the Lee County Sheriff’s Office jail without bond. He was transferred to the jail Monday from Okeechobee, where he was picked up by police on Saturday.

    The charges include allegations that a phone that had been in Guerrero's possession contained multiple images of child pornography. The photographs show intimate parts of a young girl's body, but authorities said in the complaint that the child has not been identified and that some of the images were taken in December 2015.

    The phone with the photographs had been thrown away, Guerrero said. It eventually turned up in another man's possession.

    Guerrero gave investigators the code to unlock the phone, after he was apprehended

    Authorities tracked the phone using the assigned phone number and traced it from Orlando to Fort Myers the night before Diana disappeared and placed it in the area of her San Carlos Park home between midnight and 3 a.m. May 29, the morning she disappeared, the complaint said.

    Records confirm there were calls from the cellphone used by Guerrero to a cellphone in the home used by those who lived their, including Diana, the complaint said. "It appeared the content of the message was deleted from the cellular telephone."

    After leaving Lee County early on May 29, the phone was traced to Okeechobee, Yee-Haw Junction, back to Okeechobee and then back to Orlando, the complaint outlined.

    Investigators tracked the Samsung smartphone to Daytona where a landscaper told detectives he found the phone in high grass in Orange County.

    While the phone was locked the landscaper said a man who said his name was Jorge called the phone and told him to keep it, court documents said. He was never able to unlock the phone and never used it, the man told investigators.

    In Guerrero's statement he confirmed the phone was his, that he had possession of it when Diana went missing but said he never set foot in Lee County at that time. He told investigators he was traveling between Okeechobee and Orlando and that his vehicle, a black Chevy Malibu, broke down during the trip and had to be towed.

    His detainment on June 3 was the result of "his lack of lawful immigration status in the United States" court documents said.

    The investigation remains active, the Lee sheriff's office said, as many tips and leads have been generated throughout the investigation.

    Guerrero, a friend of Rita Hernandez, Diana's mother, may be responsible for Diana's disappearance, authorities said.

    A few hours after the Florida Department of Law Enforcement issued an Amber Alert on Thursday, authorities found the Chevrolet Malibu believed to be driven by Guerrero. Diana was not with him.

    Hernandez said she is worried that the man who may have taken her daughter was charged with possessing child pornography.

    "As a mother, I am concerned," she said in Spanish on Monday.

    Hernandez said while Guerrero was living at their mobile home, he didn?t have a computer, but he did have a cellphone. She said she never had any indication that Guerrero viewed child pornography.

    Hernandez said that, as far as she knows, Guerrero hasn?t told anything to law enforcement about Diana.

    "What I want is that he speaks and says where he has the girl," she said. "It?s been nine days, it?s a long time."

    Hernandez said she cannot be sure that it was Guerrero who took the girl, but she is suspicious about him not telling anything to law enforcement.

    "If he doesn?t want to speak, he will have to hide something," she said.

    Hernandez met Guerrero when she picked cabbage in a Florida field about three years ago. Guerrero asked Hernandez for a place to stay when he found a construction job in Southwest Florida. He moved in with a brother to Hernandez's trailer on the 3500 block of Unique Circle.

    He left the home about a month ago after Hernandez and her live-in partner Uribe Jimenez noticed Diana often followed Guerrero around and sat next to him to watch TV. They were concerned by the behavior.

    Pleads not guilty to child porn charges

    The family of 9-year-old Diana Alvarez came face to face Monday with the man suspected of taking her.

    Jorge Guerrero was in a federal courtroom, where he pleaded "not guilty" to unrelated child pornography charges.

    Diana's mother and stepfather shared their frustration after court.

    The man they believe took their daughter never looked back at them where they sat in the front row, and nothing in court revealed new information about where the little girl is.

    The family said they received the most recent update on the case Friday, but they still don't know what happened to Diana.

    "Naturally, you know, it's an active investigation. Law enforcement can't reveal everything to the mother, father, even their attorney," said Tom Busatta, the family's attorney.

    "He got something ... something to do with all this," said Diana's stepfather, Uribe Jimenez.

    While in court, Guerrero looked straight ahead, never making eye contact with the family who once shared their home with him.

    "I feel like he has something to do with this because he wouldn't look at my face," said Diana's mother, Rita Hernandez.

    "She has questions for him; she'd like them answered," Busatta said.

    The Lee County Sheriff's Office worked with the Department of Homeland Security and the FBI, but they refuse to comment on the case.

    The family believes the investigation could reveal new answers any day.

    "They are looking into other areas, interviewing additional people, new names that they mentioned on Friday that we didn't know before," Busatta said.

    Busatta said law enforcement said there could be additional charges filed against Guerrero, or even charges against those new individuals.

    For now, Guerrero remains in the Lee County Jail under custody of the U.S. Marshals.

    Officials with the Lee County Sheriff’s Office announced Saturday that remains found in Osceola County are those of a 9-year-old girl who had last been seen in 2016.
