Caitlin Rosales sentenced in sex crime cases

Caitlin Rosales, 19, Belle Fourche, was sentenced last week for contributing to the abuse or neglect of a minor and witness tampering for threatening the girl involved in the case.

In a plea bargain arrangement, Rosales had pleaded guilty to witness tampering and contributing to abuse, neglect or delinquency of a minor.

On the witness tampering charge, she received a four-year probation and a "suspended imposition of sentence" that means successful completion would remove the conviction from her record.

One condition is completion of a psychological evaluation and completing required programs.

On the contribution to abuse charge, she received a 20-day jail term and a year's probation concurrent with the witness tampering sentence.

Along with the sentence, she is ordered to pay fines and fees incurred in the criminal proceedings.

Rosales had been accused of encouraging a 15-year-old girl to send nude pictures to Rosales' father, and engage in sexual activity with him.

Belle Fourche man sentenced on child porn, solicitation

BELLE FOURCHE | A Belle Fourche man was sentenced to five years in the state penitentiary Wednesday on charges of child pornography and solicitation of a 15-year-old girl.

Butte County Circuit Judge Michael Day ordered that the two sentences of Jeremy Jon Rosales, 42, be served concurrently.

The sentences on each charge technically were for seven years in prison with two years suspended on condition of paying costs, complying with treatment programs and parole requirements during the suspended portion of the prison sentence, and registration as a sex offender.

Both sentences had been agreed to in a plea agreement. The potential maximum penalty on each Class 4 felony count is 10 years in prison and a fine of up to $20,000.

Day told Rosales in introducing the sentence that the pre-sentence investigation "did not indicate you are a safety risk."

But, he said, Rosales had test scores indicating a high level of "adult anti-social behavior."

"You were grooming her to have sex with her," Day told Rosales, who admitted he had enlisted his daughter, Caitlin, to help in that effort. Caitlin Rosales was sentenced to 20 days plus probation in a plea agreement in October.

Rosales told the court before sentencing, "I would like to apologize, first of all to the victim."

Speaking of his communication with the victim that resulted in a photo of her nude upper body and his photo of himself nude, he said, "It was a disgusting act.

"I just want to be a better citizen and role model" to his children and grandchildren.

Assistant state Attorney General Robert Haivala said before sentencing, "This is one of the most shocking cases I have seen."

He added that a solid prison sentence is called for, not only for punishment, but also because "we need to protect our kids."

Defense attorney Matthew Kinney of Spearfish noted a relatively clean record and honorable Navy service for Rosales, and that he was doing sex offender therapy through the Department of Veterans Affairs.

"There is no contact involved," Kinney argued. "His failure to stop himself is his biggest mistake."
