    SCOTTSVILLE, Ky. ?A Scottsville man accused of raping and murdering 7-year-old Gabbi Doolin said he didn't do it.

    Timothy Madden was in court Wednesday afternoon in Allen County.

    Madden said nothing in the courtroom. His attorney entered a not guilty plea, but that same attorney couldn't answer WLKY's Carolyn Callahan when she asked if he thought Gabbi's killer was still on the streets.

    "I don't know the answer to that. I'm not going to comment on that," defense attorney Travis Lock said

    In a courtroom filled with family of both Gabbi and Madden.

    Police said Madden raped and murdered Gabbi in November during a youth football game at Allen County-Scottsville High School.

    "As all of you have been advised, there are no cameras or other recording devices allowed in the courtroom," Judge Janet Crocker said.

    Media was not allowed to record Madden's arraignment. Video was provided from the court.

    The attorney for the commonwealth told the judge some DNA evidence in the case is not back yet.

    Once it is in, the defense must see it.

    "Under our rules of criminal procedure the Commonwealth must produce everything it has, so that obviously is a good thing for the defendant because there will be no trial by ambush, so to speak. The Commonwealth must reveal its hand and show what evidence it possesses," Lock said

    Lock said he has new evidence on his end.

    "I was able to obtain a video before the crime was committed that does show me Madden. I have not yet been able to obtain the video that I believe exists after this crime was committed," Lock said.

    The case is eligible for the death penalty.

    The commonwealth will make that decision by the end of March.

    As for Locke, he said his client's demeanor hasn't changed throughout the process.

    "I have met with him. I've talked with him. His mindset is as well as can be expected. He's as positive as he can be," Lock said.

    There is no bail for Madden and since it could be a death penalty case, which can't have bail, his attorney decided not to request a bail amount.

    Madden is scheduled to be back in court for a pre-trial conference in July.

    His attorney has not yet decided if he will request for the trial to be moved out of Allen County.

    I'm assuming that DNA was pretty much conclusive then. Still, pretty poorly worded response from his lawyer - way to tell the world you think he's guilty but you're just politely avoiding the question.


    On second thought, I hope that ^ is actually what he was doing vs just being completely inept & flustered when confronted by media

    Timothy Madden's attorney, Travis Lock, issued us this statement:

    "I am disappointed that the Kentucky State Police detectives seem to want to try this case in the court of public opinion by repeatedly orchestrating maneuvers that are clearly intended to inflame the passions of the public, including any and all potential future participants in the jury trial process.

    It is hard to imagine any other possible motive that KSP could have for filing these documents in the record, other than to poison the prospective jury pool panel. The timing of these affidavits is further suspect give then initial information forming their basis was presented to KSP nearly three months prior. These same detectives unequivocally told me they had no interest in obtaining or reviewing video recordings that show Timothy Madden immediately prior to the crime and directly thereafter.

    It is difficult to comprehend why KSP would have no interest in gathering admissible evidence less than a mile from the scene of the crime, but go out of their way to investigate an allegation from West Virginia that is highly unlikely to have any relevance to or bearing on this case. Suffice it to say there are aspects of this investigation that will likely be subject to scrutiny in future court proceedings.


    Timothy Madden has the right to a fair trial, which is undoubtedly being jeopardized by KSP's decisions to conjure as much negative information as possible and schematically put it in the court file. Ultimately, this case should be tried in the courtroom rather than the news."

    KSP would not comment, but did confirm that the investigation is ongoing.

    A Kentucky State Police affidavit says Timothy Madden, charged in the killing of 7-year-old Gabbi Doolin, was identified by a West Virginia boy as someone who allegedly tried to lure him into a vehicle a month before Doolin's death.

    A KSP detective filed the affidavit for a search warrant last month in the case of Timothy Madden of Scottsville.

    Madden has pleaded not guilty to murder, kidnapping, rape and sodomy charges in the November death of Gabriella Doolin.

    The affidavit says a boy watching a television account of Madden's arrest told his father that the suspect was the same man who allegedly asked him and another boy to get into his vehicle Oct. 9 at a gas station in Mason, West Virginia.

    Timothy Madden's wife says accusations of her husband trying to lure boys into an RV in West Virginia are false.

    Instead, she told WBKO in an exclusive interview on Monday that she was at physical rehabilitation facility in Bowling Green with her husband.

    "He was with me October 9 at SKY Rehab. There's a picture to prove it. I raised my arm for the first time. Timmy sent that to my sister-in-law. He took it and sent it," said Jodi Madden.

    Madden had complications during a pregnancy in August 2015 that caused her to suffer three strokes. During recovery she was diagnosed with a rare disease that's caused her to lose mobility and eyesight.

    Documents filed in Allen Circuit Court during the month of February details an incident in Mason, West Virginia where a man with an RV asked to boys to take a ride with him in a Wal-Mart parking lot.

    The documents state the two boys ran from the scene back to Wahama High School. The incident was reported to local police when it happened in October 2015.

    A month later when Timothy Madden was arrested for the murder of Gabbi Doolin, a news report in West Virginia caught the attention of one of the boys who said Madden may have been the man with the RV.

    Kentucky State Police opened an investigation after getting a call from the family in West Virginia.

    Court documents show KSP is looking into cell phone tower data from October 8 through October 11, 2015. Those same documents also detail a cell phone taken to Bluegrass Wireless in Scottsville. An employee with the company told police Madden gave them a phone that was having trouble getting service. The worker states that she transferred all information from that phone to a new one. Police are now looking into that new phone.

    Police also collected two computer towers and 18 CDs according to the court documents. All of those were taken from the Madden home shortly after he was arrested in November 2015.

    Madden's wife said the entire situation has been rough on not only her, but also her children. She said she wasn't there the night Gabbi Doolin was killed. She didn't want to talk about the situation at all, but said her husband has never been violent around her or her kids in the ten years they've been married.

    "If we got into he would go to one end of the trailer and I would go to the other. We would sleep in separate beds. He would sleep on the couch. I've never seen that side of him. I never raised a hand to me. He never put his hands on me."

    Kentucky State Police released a statement regarding the investigation in West Virginia Monday.

    "We have not released any further statement nor are we going to make any other public statement at this time regarding this investigation. And, as always, if the Kentucky State Police receives a report or allegation of a crime, it is our duty to investigate those allegations."

    Madden will face his charges of Murder, Rape, Sodomy, and Kidnapping in the death of Gabbi Doolin again this Summer. He's not scheduled to be in court again until July.

    Timothy Madden makes first court appearance in 6 months

    Since Gabbi Doolin was raped and murdered on November 14, the search for justice has focused on evidence.

    Wednesday, the defense in the case received that mountain of paperwork stretching hundreds of pages.

    Setting the tone in court Wednesday afternoon during Timothy Madden's first court appearance in six months was the woman tasked with presiding over the proceedings, Judge Janet Crocker.

    "This case is of course the most difficult case any of us will ever have to deal with in our careers."

    No cameras or cell phones allowed in the courtroom, Timothy Madden strolled by his family with a slight smile before sitting in a chair he's becoming all too familiar with.

    "Mr. Madden has not changed anything he has said," said Madden's attorney, Travis Lock.

    Two motions were discussed in court, one to limit pre-trial publicity, and another to test remaining evidence in the case.

    A computer and a cell phone are finishing being tested, but both sides in the case are asking for the rest of the DNA at the KSP crime lab to be run.

    "We're all not happy with how slow it's going, but we understand that, that's the process. We just want justice served," said Lori Doolin Wilson.

    Wilson is a representative of the family to the media Wednesday. Gabbi Doolin's cousin described the lack of healing and the intensity of their pain.

    "It's sadness, it's overcast all the time. She was a bubbly child and a wonderful child. Always made people laugh. There's something missing."

    Timothy Madden's attorney received all of the evidence including DNA, interviews, and police reports for the first time Tuesday. He said that evidence is going to take a long to go through.

    "If a trial date is scheduled, I would anticipate that being in the summer of next year."

    Both sides in the case will be back in court on September 7 for another pre-trial hearing.

    Long days only getting longer for parents awaiting justice.

    "For Brian and Amy, everyday is long. I don't think the court has anything to do with that," said Wilson.

    That court hearing on September 7 will discuss the progress of the rest of the DNA set to be tested, and also the possibility of publicity limitations before a trial.

    The motion filed by the commonwealth to limit publicity, cited the possibility of a venue change in the case as the reason they are asking for it. They're worried news stories could alter potential jury pools in counties where the trial could end up taking place.

    Madden's attorney said he hadn't made his mind up yet, if a change of venue is something he plans to ask for.

    Gabbi Doolin was killed on November 14 in a creek on the campus of Allen County-Scottsville High School during her brother's little league football game.

    Her cause of death was listed as strangulation and drowning.

    Timothy Madden was arrested on November 20 where he shouted his innocence while being escorted to a police cruiser.

    Madden is charged with rape, sodomy, kidnapping, and murder. The commonwealth is seeking the death penalty.

    Bradley Wayne Madden, whose father is accused of the murder, kidnapping and rape of a 7-year-old girl in Scottsville, is charged with four counts of statutory rape in Tennessee.

    Madden, 20, who is lodged in the Simpson County Detention Center on charges of intimidating a participant in the legal process and third-degree terroristic threatening, was served at 11 a.m. Wednesday with a statutory rape capias issued in Macon County, Tenn., Simpson County Sheriff's Sgt. Eddie Lawson said.

    The capias is a bench warrant issued to detain Madden to answer to the charges in Lafayette, Tenn. The bond listed on the capias is $15,000. Lawson did not have any details about the Tennessee case.

    "We had an investigation started through children's services here back in November, and I interviewed everybody involved, and I went and interviewed Madden and he confessed," Macon County (Tenn.) Sheriff's Lt. Darrell Taylor said. "I took it to the grand jury Monday and he's been charged with four counts of statutory rape."

    In Tennessee, statutory rape is a felony, Taylor said. It is not forcible rape. It is defined as an adult engaging in sexual penetration with someone who is at least 13 years old but is also four or more years younger than the adult charged with the offense.

    At the point that Madden is released from custody in Kentucky, he will be held on the Tennessee charges. Madden can either sign a waiver of extradition or the state of Tennessee will start extradition proceedings to bring him back to Macon County to answer to the charges against him there, Taylor said.

    Madden, 21, was indicted in November on four counts of harassing communications, a Class B misdemeanor.

    He was arrested Nov. 24, 2015, in Macon County, Tenn., and charged initially with 16 counts of intimidating a participant in the legal process and 16 counts of third-degree terroristic threatening, one count for each sworn law enforcement officer employed by the Scottsville Police Department.



    Each of the 16 intimidating counts was a Class D felony.

    The grand jury returned a no true bill on 12 of the 16 counts of intimidation and amended the other four down to the misdemeanor charge of harassing communications, remanding the case to Allen District Court.

    The grand jury also declined to indict Madden on any of the terroristic threatening counts, which were misdemeanors.

    Madden appeared before Allen District Judge Martha Harrison on Wednesday, but his court-appointed attorney, Tim Hendrix, was not present.

    Harrison asked Madden whether his attorney was aware of the indictment or the court date, and Madden said he did not know.

    "I don't have his number, I don't have his e-mail, I have no way to contact him," Madden said of Hendrix.

    Harrison continued the case and ordered Madden to return to court on Jan. 25.

    Madden is accused of sending four harassing messages to the Scottsville Police Department Facebook page between Nov. 21-23, 2015, following the arrest of his father, Timothy Madden, on charges of murder, kidnapping, first-degree rape and first-degree sodomy in connection with Gabbi Doolin's death on Nov. 14, 2015.

    Timothy Madden, who has pleaded not guilty to all counts, faces the death penalty if he is convicted. The case is pending in Allen Circuit Court.


    An arrest warrant for Bradley Madden states that he sent a private message on Nov. 21, 2015, that said police "got the wrong man" and that if his father "does life u will do life watching ur back." A second message sent four minutes later claimed the arrest was a "set up from hell" and included threats to sue for slander and "false arrest."

    According to testimony from a 2015 preliminary hearing, SPD Chief Jeff Pearson made contact with Bradley Madden the following day and said that, while he understood that Madden was upset about his father's arrest, he could not threaten law enforcement.

    On. Nov. 23, 2015, the SPD's Facebook page received two more message from Bradley Madden's account five minutes apart, according to court records. The first message stated "I coming for you," and the next message contained similar language, according to Bradley Madden's arrest warrant.

    The SPD was not involved in the death investigation and Timothy Madden was arrested by the Kentucky State Police.

    Hendrix argued at the 2015 preliminary hearing that the messages were meant to communicate that, rather than inflicting bodily harm, Bradley Madden planned to hold police accountable in court if there was any alleged police wrongdoing involving Timothy Madden's arrest.

    The maximum penalty for harassing communications is 90 days in jail or a $250 fine.

    Defense attorney Travis Lock claims police, desperate to solve a horrific, high-profile case quickly as possible, focused on Timothy Madden ? a former construction worker with no history of violence or sexual misconduct -- at the exclusion of more likely suspects.

    SCOTTSVILLE, Ky. (WDRB) ? From the time 7-year-old Gabriella ?Gabbi? Doolin?s body was found -- raped, strangled, left face down in a creek behind a high school -- it took Kentucky State Police only about four hours to arrive at Timothy Madden?s front door.

    And it looked like police had the right suspect.

    Several items of clothing he wore that night to his son?s youth football game appeared to be stained with blood. State police also said ?several people? at the game either gave a description of Madden or identified him by name as looking suspicious.

    And just six days after the Nov. 14, 2015 murder, tests results showed Madden?s DNA was on Gabbi?s body, and her DNA on Madden?s clothing.

    Indeed, Madden?s guilt seems a foregone conclusion in the small western Kentucky town of Scottsville. A telephone survey showed 75 percent of the residents of Allen County think he committed the murder, prompting a judge to move the trial.

    But, five months before Madden is scheduled to face a jury and a potential death penalty, his attorney said the case is not as open-and-shut as it might appear.

    Defense attorney Travis Lock claims police, desperate to solve a horrific, high-profile case quickly as possible, focused on Madden ? a former construction worker with no history of violence or sexual misconduct -- at the exclusion of more likely suspects.

    For starters, Lock said in a court hearing that, despite what police said, there is no evidence that Madden?s jeans, jacket, belt and boots were stained with blood.

    In addition, Lock said in an interview, the clothing Madden wore that night did not appear dirty or damp even though Gabbi?s body was found in a creek, in a wooded area wet with mud and leaves.

    ?Whoever committed this crime was on the forest floor, in November at night, committing heinous acts on a child,? Lock said in an interview.

    No witnesses say they saw Madden with Gabbi and some people identified a different man with a long beard and brown coat as acting suspicious and being ?out of place.?

    Some of the children with Gabbi that night described seeing the same man, according to a court document.

    One child told police she saw a little girl wearing pink being carried off by the man, according to the document.

    Some of these witnesses were shown a photo of Madden but did not identify him as being the man they saw, Lock said.

    And during part of the time Gabbi was missing, Madden sent several text messages with pictures of the game to his wife and the mother of his child who was playing, Lock said. He also made a phone call during that time.

    The evidence in Allen County cases is not made available to the public or media.

    Madden, whose criminal record does not extend beyond some minor theft cases, has denied any wrongdoing from the start, telling police they were mistaken when they arrived at his home.

    ?You guys are at the wrong place,? Madden, 40, told police, according to a transcript of the interview read aloud in court last month. ?You need to talk to somebody else.?

    In his only interview after his arrest, Madden told WDRB News in November 2015 that the charges were ?bogus? and he is an ?innocent man. You can ask anybody that knows me.?

    But what about the damning DNA evidence?

    Lock said police had a two-page DNA report in less than a week incriminating Madden, but have yet to turn over the comprehensive electronic data that his experts can review ? an analysis he said that could take several months.

    ?Almost two years into this case, we still don?t have the basic DNA evidence, materials that we need in order to prepare and complete a meaningful defense,? Lock told Allen Circuit Court Judge Janet Crocker at an Aug. 31 hearing.

    A forensic scientist retained by the defense told Lock she has done numerous DNA reviews of KSP lab electronic evidence generated from the police analysis, and this is the first time the state has not turned that information over, Lock said in court.

    Lock argued he has made repeated request for the DNA evidence in the last year or so and the prosecution has consistently ignored him.

    ?It?s certainly odd to me,? Lock said in an interview.

    Allen County Commonwealth?s Attorney Clint Willis told the judge prosecutors have asked the KSP lab for all their reports and materials and he is not sure the data the defense is asking for exists.

    Willis did not return a phone message seeking comment.

    But he said in court that, if there is more comprehensive DNA evidence, it will be turned over to the defense.

    ?If Mr. Lock says they (the KSP lab) have it, then it shouldn?t be a problem,? Willis told the judge last month.

    At the hearing, Judge Crocker said if there was important evidence not yet turned over, she should have been made aware of it months ago and called it ?ridiculous? to expect the trial to be delayed for another year.

    Crocker ordered prosecutors to address Lock?s complaints about the allegedly missing lab information.

    The electronic data should show the defense how strong the DNA evidence is and whether it was properly handled in the lab, Lock said.

    It could also sink his case.

    ?Until I get the electronic data, I cannot say what our thoughts are on the strength of the DNA results,? Lock said.

    "Horrendous crime"

    During one court hearing, Judge Crocker called this case ?the most horrendous crime that has ever occurred in Allen County.?

    Dressed in all pink, towheaded Gabbi was last seen playing hide-and-seek around the bleachers with friends while her older brother played nearby in a youth football game at Allen County-Scottsville High School.

    ?Her little friend came down there and said, ?Amy, have you seen Gabbi? I can?t find her,?? Amy Doolin, Gabbi?s mother, told Bowling Green TV station WBKO in December 2015.

    When her mother reported the child could not be found, the game was stopped and police and spectators combed the area.

    The second-grader?s body was discovered 18 minutes later, around 8 p.m. She had been raped, strangled and left face-down in a creek.

    Police asked everyone to go to the high school gym and provide any information they may have about the crime.

    Madden?s name, or description, was mentioned several times, police have said. Video shows Madden was in the gym, but it is unclear if police talked with him at that time.

    State police arrived at his house about 12:30 a.m.

    There is no indication that Madden was under the influence of alcohol or drugs that evening ? a nonissue in the case.

    ?He was very compliant,? state police Capt. Steve Adams testified in the Aug. 31 court hearing.

    Madden, the officer said, agreed to an interview and to provide the clothing he had been wearing earlier that night. He also allowed police to take DNA buccal swabs from him.

    ?He never gave any backlash whatsoever,? Adams testified, according to a video of the hearing.

    After Madden retrieved the clothing, Adams testified he told him there appeared to be blood ?around your genital area on your zipper and pants? and underwear.

    Madden, according to police, grew agitated at the accusation ? at one point telling officers they were ?crazy? -- and said he didn?t know what was on his clothes.

    ?He denied there was any blood on his clothing,? Lt. Jeremy Smith testified at the hearing. State police have not offered specifics on the DNA evidence.

    Madden, a former construction worker and father of five, maintained his innocence in an interview that night with state police.

    Immediately after his arrest, he told WDRB News he knows the Doolin family and cooperated with police ?every way they wanted me to cooperate.?

    He said he saw Gabbi that night playing with a couple of other girls who ran by him while he was smoking a cigarette near the bleachers, about 30 minutes before she disappeared.

    ?That?s all I know,? he told WDRB.

    If state police have DNA, ?it ain?t mine,? Madden said in the interview.

    Madden faces charges of murder, kidnapping, first-degree sodomy and first-degree rape, with prosecutors seeking the death penalty.

    The location of his trial, scheduled for Feb. 26, has not yet been determined.

    Judge Crocker ruled last month that the trial should be moved out of the county, based on the survey showing that most of the 256 residents polled thought Madden was ?definitely? guilty, according to court records.

    Prosecutors argue for a neighboring county, but Lock wants the trial held farther away to find non-biased jurors.

    The Doolin family did not respond to a request for comment.

    Gabbi?s mother, Amy, told WBKO in 2015 that her child was on a cheerleading team with Madden?s daughter and ?she would?ve trusted him just enough. She was around him at all the practices and the games.?

    Lock declined to let WDRB interview Madden again. But in the 2015 interview, Madden said the Doolin family is mistaken about him.

    ?I feel sorry for them, but it wasn?t me,? he said.

    Timothy Madden murder trial moved to Hardin County


    SCOTTSVILLE, Ky. (WBKO) -- The man accused of killing 7-year-old Gabbi Doolin in November, 2015 will have both a change of venue and a new trial date.

    Timothy Madden's murder trial will be moved to Hardin County.

    The Feb. 26 trial date will also be changed.

    A scheduling conference for trial will be held at noon on Feb. 13.

    All proceedings will be held in Allen County until trial.

    Judge Janet Crocker said this is the most important case she will ever preside over, suggesting it will be most important case anyone involved on either side will preside over. She hopes nothing like what happened two years ago ever happens again.

    Judge Crocker said, "I appreciate both families' desire for closure," but that in a death penalty case, "everybody needs to be prepared."

    Doolin family spokesperson, Lori Wilson, said they're happy to see a step forward in the case, although disappointed the trial will be moved back. She said the family will look to Jesus Christ to see to it that the trial is completed and justice is brought.

    Commonwealth Attorney Clint Willis said he and his team would have been ready for trial in February, and having to explain to the Doolin family why the trial won't happen is hard, although he understands the legal process behind it.


    Timothy Madden is facing charges of murder, rape first degree (victim less than 12 years of age), sodomy first degree (victim less than 12 years of age), and kidnapping (victim death).

    A new trial date has been set for the Allen County man charged in the brutal death of a young girl more than two years ago. Timothy Madden returned to court on Wednesday for a pre-trial hearing.

    The capital murder case against the 40-year-old Madden will now go to trial on July 23. Madden's Attorney Travis Lock questioned whether he could be ready to present his case by then. The defense attorney said he’s still working to collect mitigation evidence in the event that Madden is found guilty.

    "Should there be a penalty phase in any capital case, the purpose of mitigation is to give the jury, whose task is to sentence the defendant, a detailed look at the defendant's entire life," Lock told WKU Public Radio.

    Allen Circuit Court Judge Janet Crocker said she didn’t want either family to go through another anniversary without a resolution. The trial was originally set for February 26 before the judge granted a defense motion to delay the trial.

    "The commonwealth and this victim's family cannot simply continue to be held hostage while you get your case ready to try," Crocker stated in court.

    Allen County Commonwealth’s Attorney Clint Willis said the prosecution is ready and thinks the judge made the right decision to set a trial date.


    Timothy Madden will stand trial on July 23 in the death of Gabbi Doolin.
    "I think, emotionally, you have to take into account the feelings and emotions of the victims' family in every case, and this one, there's obviously it's very intense feelings," commented Willis.

    Madden is charged in the November 2015 kidnapping and murder of Gabbi Doolin whose body was found behind Allen County-Scottsville High School. The seven-year-old had been raped, strangled, and drowned.

    The death penalty case will be tried in Hardin County due to pre-trial publicity in Allen and surrounding counties.



    I wonder who the "more likely suspects" are that his lawyer referred to, I don't remember hearing anyone else suggested - besides the accusations on Topix about Madden's own kids

    Timothy Madden appointed public defender; Travis Lock will assist in transition

    SCOTTSVILLE, Ky. (WBKO) - Timothy Madden, the man charged with murder, kidnapping, rape, and sodomy in the death of Gabbi Doolin, appeared in Allen Circuit Court.


    His attorney, Travis Lock, was disqualified in order for Madden to receive state funding for special services. A court-appointed public defender, Tom Griffiths, will be Madden’s defense attorney from this point forward.

    Lock will no longer be on the defense team, but will assist in the transition of attorneys, per the court’s request.

    “It is my strong hope that we are not starting from square one.” That’s what Judge Crocker said after recognizing Griffiths. She said she hopes to set a realistic date for the trial that has already been delayed twice.

    A status hearing in the case was set for 1:30 p.m. on Tuesday, July 31.

    A motion by the Commonwealth to set a trial date is scheduled to be heard at that hearing.

    Since it's been nine months since the attorney was complaining about not receiving the DNA evidence, I think it's safe to assume he has now received it. Because he more recently asked for additional time to gather mitigation evidence in case of a conviction, it sounds like he's concerned about what he learned from that DNA evidence.

    I think this is going to be an easy win for the prosecution.

    If the evidence samples were to match 95% or 80% or 10% or whatever it would be termed only one thing by LE. And that term is "NOT A MATCH". And no arrest would have been made.

    What your DNA math web link is explaining is the odds of more than one person having the same DNA fingerprint. Which is astronomical, and even more astronomical when the suspect was at the scene. And beyond astronomical when victim and suspect have each other's DNA on them.
