A HOMELESS man whose act of kindness saw him gifted $545,000 is suing the couple who set up the fund for him, saying they have spent more than half of the money on themselves.

Homeless man receives life changing donations

THE homeless veteran who helped a stranded motorist has filed a lawsuit against the woman and her boyfriend to stop them from spending what remains from a $US400,000 ($A545,000) GoFundMe campaign they created for him.

Johnny Bobbitt, who spent his last $US20 to help Kate McClure when she ran out of gas in a rough neighbourhood in Philadelphia last Thanksgiving, claims she and Mark D?Amico used the money for themselves, Philly.com reported.

Ms McClure, 28, and Mr D?Amico, 39, both of New Jersey, have claimed they?ve spent half the funds on housing and other expenses for Mr Bobbitt, who has been living under a bridge, saying they were holding the rest until he?s off drugs.

An injunction application filed on Tuesday in Superior Court in Mount Holly claims the couple mismanaged the funds and committed fraud and conspiracy.

The lawsuit alleges they deposited ?substantial portions of the money raised? into personal accounts and did not allow Bobbitt to access them to get off the streets.

?The defendants have expended more than half of the monies raised, and they continue to deprive (Bobbitt) access to the funds that were raised for him,? according to the suit filed by his lawyers Cozen O?Connor in Philadelphia, according to NJ.com.

The New York Post reports that Christopher C. Fallon, one of Bobbitt?s lawyers, said the suit was filed after D?Amico ignored several requests for a full accounting of the GoFundMe funds raised.

?He?s really left us with no choice but to go forward,? Mr Fallon said, Philly.com reported.

They ?conspired to utilise (Bobbitt?s) money to enjoy a lifestyle that they could not afford. Defendants admitted to commingling the funds raised for (Bobbitt) in their own personal accounts and have denied (Bobbitt) access to the account,? according to the court documents.

The filing alleges that D?Amico and McClure have considered the ?GoFundMe account as their personal piggy bank.?

The couple appeared on Megyn Kelly Today on Monday and denied allegations they pocketed a large portion of the funds meant to get Bobbitt back on his feet.

They said they were protecting the interests of Bobbitt and the more than 14,000 donors by depositing the money into their own accounts to prevent him from doing drugs after he admitted to doing so in an article on Philly.com.

Bobbitt once blew through $US25,000 cash in under two weeks, the couple claimed to Philly.com.

?Giving him all that money, it?s never going to happen. I?ll burn it in front of him,? D?Amico recently told the paper.

The couple now claim they are receiving death threats.

?It?s so hard to deal with when we know we did a good thing,? McClure said, tearing up, on the show.

?I would do it all over again. I would do it all over again for him.?

Messages left for McClure and D?Amico by Philly.com seeking comment on the lawsuit were not immediately returned.

So they're claiming they spent half that money on his accommodation & expenses?

They only got it about 9 mths ago & for at least part of the time he's been living under a fucking bridge?!

There's some people who could use the help, but a lot of panhandlers are just doing it now because they know they'll make a lot of money. A few years ago a company put up a sign behind one around here stating that he turned down a good job from them and even told them it was because he would make even more if he kept doing it. Those people put the people who really need it in a bad light.

We have pan handlers on every corner in Dayton. Not a single one looks like they are doing well. I think assuming people enjoy it and are banking is sketchy thinking. I sincerely doubt that a lot of pan handlers are doing it by choice. Being homeless and begging for change isn't a decision someone makes over night. So thinking that if you offer them a job and they don't accept means they somehow are enjoying their lifestyle is dumb. Do people really think a person that has been living on the streets for years, most likely is addicted to drugs, a good chance of untreated mental illness, and no access to a shower, clean clothes, etc. can simply transition into regular employment?

I think it's weird that a company would put up a sign like that, IF that scenario were true, what do they have to gain by putting up a sign basically calling someone a shitty person? It's petty and I would boycott that business.

There is a guy who always sits on the corner with a sign that reads "veteran, homeless, anything helps, god bless" near my house and one day a sign appeared in a neighbors yard that read "DO NOT GIVE THAT MAN MONEY HE IS LYING ABOUT BEING A VETERAN!" The dude is always in a wheelchair and has NO LEGS, who gives a fuck if he is a liar? Either give him money or don't, that's all you have to do. The sign posting shit is fucked. Get over yourselves.

The attitude that people have of "I don't give homeless people money because they should just get jobs like me" is fucking gross. I'm sure I sound like I'm being a dick to you, but I assure I am not. I am just passionate about this particular topic.

And once again, if you make a GFM and say "all monies raised will go to this homeless guy!" and then keep the money? Fuck you, there is no reason not to do what you said you were going to do. No matter how he is going to spend the money. People shit on those weaker and less fortunate than them. Let's pick on the homeless, the poor, the unfortunate, and ignore these jack-hole bajillionaires spending our money to make more money for themselves. AKA elected government officials.

A judge ordered a New Jersey couple Thursday to give a homeless Philadelphia man whatever's left of the $400,000 they raised for him.

Katie McClure and her boyfriend, Mark D'Amico, were told by the Burlington, New Jersey, judge to turn over the remaining money they raised through a GoFundMe campaign for Johnny Bobbitt, according to NBC Philadelphia.

The judge also demanded that McClure and D'Amico provide a full accounting of each dollar they collected, the station reported.
D'Amico told the Philadelphia Inquirer that he withheld the cash because the veteran allegedly has a drug problem. The couple initially purchased a camper for Bobbit to live in and placed it on property controlled by McClure's family. But Bobbitt was kicked out in June, making him homeless again, according to NBC Philadelphia.

During an appearance Monday on NBC's "Megyn Kelly Today" show, D'Amico said more than $150,000 of the money remained.

He denied misusing the funds but admitted to the Inquirer that he spent $500 of it at a casino.

Jacqueline Promislo, an attorney for Bobbitt, said by email that she's "very concerned" that much of the money will be gone by the time it's accounted for.

Asked if Bobbitt might sue to seize some of the couple's personal assets, she said, "We will represent our client to the best of our abilities to recover all of the money raised for him."

nothing this guy spent money on is misusing the funds... it's his freaking money. i hope this couple gets busted big time for spending the money on themselves. they bought him an RV, a car and gave him 25,000 and there is only 150,000 left? it was around .5 million. there is like 250,000 unaccounted for.

The $400,000 raised for a homeless veteran by a New Jersey couple through a highly-publicized GoFundMe campaign last year is gone, the man's attorney said Tuesday.

Johnny Bobbitt filed suit against the couple alleging they were withholding the money raised to get him back on his feet. The revelation that no money was left came during a conference call between attorneys in the case Tuesday morning, Bobbitt's attorney Christopher C. Fallon, Jr. said.

"There is no money left," Fallon said, adding that Bobbitt was "completely devastated" by the news. "Where the money went, I have no idea."
Fallon said he'd only heard the $150,000 amount when the couple appeared on Megyn Kelly Today show last week.

Before that, Fallon claimed the couple told the Philadelphia Inquirer that there was $200,000 left.

Today he learned that number is zero.

"That's a lot of money to go through to in just a short period of time," Fallon said.

Badway, the couple's attorney, said they spent around $200,000 of the money on Bobbitt, including a $25,000 deposit for a bank account they helped him open. The couple said Bobbitt blew through that money in just 13 days.

Now after learning there is no money left to turn over, Fallon said they are making requests to review the couple's financial records. Fallon said he is unsure when the next court date will be after hearing this new development.

WTF, I wasn't keeping up to date with this, the way they worded the earlier articles, they made it sound like the guy sold the camper for drugs.

But now we learn that when they purchased it for him they insisted it be placed it on property owned by their relatives & then they evicted him & kept it??!!

This also means the rent/living expenses they were claiming was all being funnelled back to them & their family too.

    Fuck these people SO HARD.

Edit : also, I'm awaiting news of a second GoFundMe to replace the stolen funds

Police raided the home Thursday of a New Jersey couple who have been ordered by a judge to appear in court to explain what happened to the $400,000 they raised online for a homeless Good Samaritan.

Footage taken from the scene showed a shiny, black BMW car being towed away from the Bordentown property owned by Katie McClure and Mark D’Amico. Other videos showed D’Amico hitting golf balls off the lawn surrounding the home and ABC6 reported bags of items being loaded into a law enforcement vehicle.

Burlington County said a "search warrant was executed early this morning by the Burlington County Prosecutor’s Office and the Florence Township Police Department at the residence of D'Amico and McClure in connection with a criminal investigation into the Johnny Bobbitt matter."

"As of this time, there have been no charges filed," Burlington County Prosecutor Scott A. Coffina said in a statement.

Superior Court Judge Paula Dow said the day before that McClure and D’Amico must show up in court next week for a deposition in a suit filed by Bobbitt over the whereabouts of the hundreds of thousands of dollars raised for him via GoFundMe

GoFundMe has promised homeless veteran Johnny Bobbitt Jr. he will receive the rest of $400,000 in donations owed to him after the couple who raised the money allegedly spent the cash on luxury goods and holidays. Bobbitt became a nationwide story after he gave his last $20 to Katelyn McClure, a woman who had run out of gas on the freeway ramp outside Philadelphia.

"Johnny will be made whole and we're committing that he'll receive the balance of the unspent funds raised on his behalf," it said in a statement. "GoFundMe's goal has always been to ensure Johnny gets support he deserves."

The website said it was assisting with the police investigation. It said its commitment to Bobbitt was based on its "GoFundMe Guarantee," which covers beneficiaries when funds have been misused.

"We're fulfilling that commitment today and we will continue to work with Johnny's team to make sure he's receiving all donated amounts," it said.

The lawyer for a homeless man in Philadelphia whose selflessness led to donations of over $400,000 through an online fundraising page reportedly said the couple who set up the fund spent the money on amassing a shoe collection and pricey vacations.

Johnny Bobbitt’s attorney, Jacqueline Promislo, told The New York Post that the couple started to spend the money right after depositing it into their bank account.

“They went on shopping sprees,” she told the paper. “[Bobbitt] tells me they had a Louis Vuitton bag and Chanel sunglasses, a new iPhone 10.”

She said that a forensic accountant will sift through the account and verify the allegations. “But now that they say there is no money, where did it go?”

The Burlington County couple accused of misusing the $400,000 they raised via a Gofundme campaign to help homeless veteran Johnny Bobbitt may soon find themselves indicted and without legal representation, according to a motion from their own attorney.

Ernest E. Badway, the attorney for the couple, asked a judge Friday to stay Bobbitt's civil suit against his clients, Kate McClure, 28, and Mark D'Amico, 39, pending the outcome of a possible criminal case. Burlington County Superior Court Judge Paula Dow granted the stay Monday.

Badway wrote in Friday's motion, "...since it is expected that one or both of the Defendants will likely be indicted, my firm and I will no longer be able to continue our representation of them in this matter."

Judge Dow granted the stay through Dec. 7.

The New Jersey couple who raised hundreds of thousands of dollars in a viral charity campaign for a homeless man were allegedly working with the vagrant as part of an elaborate ruse, according to a new report.

Prosecutors believe that Mark D’Amico and Kate McClure conspired with homeless man Johnny Bobbitt to create their get-rich-quick scheme in 2017, NBC’s Philadelphia affiliate reported Wednesday.

The couple turned themselves in to authorities Wednesday, but Bobbitt was still at large, the news station said.

According a source who spoke to the news outlet, which said it had a copy of a criminal complaint, all three are expected to face charges of conspiracy and theft by deception for working together to create the ruse. The Burlington County Prosecutor’s Office is expected to make an announcement in the case Thursday, according to multiple reports.

Prosecutors did not immediately return a call for comment, and reps for the couple and Bobbitt were not available.
