    I would like to clarify circumstances
    regarding Misty's disappearance. In
    my opinion the media has spun an
    inaccurate perspective. So far articles
    read: Actress stressed over money
    and career, Father fears suicide.
    Police reports suggest the Misty
    packed her bags and left to on her
    own. The truth is Misty is not stressed
    over money or career. Her career is
    going great. As her father I do not fear
    she committed suicide. I feel that she
    has been hurt by accident or someone
    has put her in harms way. I didn't
    appreciate the press release from
    Auburn PD that she simply packed a
    bag and left. Now they have the
    general public thinking that Misty just
    decided to leave home for awhile.
    Misty left in a psychodic state of mind
    with the clothes she had on and her
    shoulder bag. All if her clothes and
    other belonging are still here. This is
    the first time in 32 years we have lost
    contact with her and she stopped
    contact with everyone. This raises a
    serious red flag for me but apparently
    law enforcement officials disagree. I
    guess high profile individuals
    disappear without a trace every day of
    the week around here. Some of the
    people that met her or worked with her
    for a few months are weighing in with
    their own conclusions and people are
    accepting it as the gospel.They don't
    really know her. TMZ called her sister
    try to get a story and the first thing
    they ask is "do you think she is dead?,
    did she commit suicide?" How
    insensitive can you be at a time like
    this. We are heart broken and very
    frightening that we may never see her
    again. We are not getting much rest
    and everyday we have to look at her
    belonging, the food she cooked still in
    the fridge, her pets and unanswered
    social media post just waiting for her
    to come back and resume where she
    left off. I invited the media to cover the
    story for one purpose only, to help get
    the word out that she is missing and
    let people know we need help in
    finding her. We, her family, have
    limited resources and we tried to start
    a fund campaign to generate financial
    help. We are finding out that process
    of finding a missing person is both
    costly and time consuming. But some
    have ridiculed us for using this tragic
    event for profit so we pulled the online
    request. If I had the money I would
    have hired a private investigator,
    organize a search team and search
    dogs on the day she disappeared.
    Now we have to write another press
    release and share personal
    information that Misty would like to
    keep personal.
    Here are the facts:
    Misty has suffered from mental illness
    most of her life. With the help of her
    medical team and family support she
    is able to manage it well. She is not a
    nut case. She is an advocate and
    supporter for several organizations
    such as: PETA, Domestic Worker's
    Rights, Women's Rights, LGBT
    Community and she is a proponent of
    economic development and self-determination among Native
    American communities. Her
    professional accomplishments are a
    testament to her business
    sofistication and intellect. When I, her
    father, suffered a stroke earlier this
    year Misty moved to Seattle with both
    her parents to help manage after care
    and be close to family. We are
    planning to return to Los Angeles,
    after I complete my post-stroke
    treatment, sometime after the new
    year. When Misty left California state
    her medical team stopped her
    treatment and told her to re-establish
    treatment and medication in
    Washington State. This has not been a
    smooth transition. She cannot get her
    meds here and was give alternative
    medication that wasn't effective
    enough to deal with her bipolar
    anxiety disorder. She started to slip
    into bouts of depression and panic
    attacks. She tried to compensate by
    drinking wine to combat the anxiety
    and I believe that these meds mixed
    with alcohol would cause psychodic
    behavior episodes. She would always
    recover and not remember what
    happened. She would sometimes
    threaten to take her own life but would
    never go through with any if the
    threats. She has serveral scars on her
    wrists where she cut but never
    enough to cause death or serious
    injury. Misty believes that suicide is a
    sin and in her darker moments she
    would tell me "Dad, I would never take
    my own life. But sometimes when I get
    depressed I feel that death would be
    better than life. My greatest fear is
    that you and mom will die before me
    and I will be all alone in this world. I
    don't know how I could face that. I
    pray that God will take me peacefully
    in my sleep one day before you and
    mom take the journey." Misty has
    developed a phobia of throwing up.
    She gets panic attacks whenever she
    feel nausa. She never wants to be left
    alone over this, even for a few
    minutes. She tells me that she wants
    to overcome this and become
    independant again. But this unusual
    fear keeps her close to home and in
    constant contact with her parents.
    Now we have lost contact. Since her
    disappearance she has not made
    contact with any of her family, friends
    or business constituents. We have
    requested help from the Muckleshoot
    tribe for search teams but they do not
    have funding for that. We are
    petitioning Auburn PD to implement
    the ENDANGERED MISSING PERSONS
    PLAN. This will allow law enforcement
    to search for her and bring her into
    medical care when they find her. But
    they feel she does not fit the profile at
    this time. The detective on the case
    assured our family that Auburn PD is
    doing everything they can to find
    Misty. But then they release a press
    statement and say they are not
    looking for her. These mixed
    messages are confusing. I think Misty
    may have walked into nearby woods
    and got hurt and can't reach help or I
    think she may have had an encounter
    with someone who may have caused
    her harm. I believe she would contact
    us if she could. I feel that if she is
    found soon she may have a chance to
    survive. But time is slipping away.
    Message to Misty:
    Misty, if you can see this message, we
    love you and your family will continue
    to search for you until you are found.
    Come home please.
    We thank all her concerned friends
    and family for all the kind words,
    prayers and suggestions.
    Misty was last wearing a purple
    sweater, black t-shirt, grey sweat
    pants, silver tennis shoes. She has cut
    her hair short. She has cut scars on
    both arms and a birth mark on the
    back near her neck. She was carrying
    a white cell phone and a California ID.

    Police responded to a suicide call from her apartment but she had left by the time they arrived. It was the fourth suicide call this year.

    Actress Misty Upham, who played a housekeeper in the movie adaption of "August: Osage County," has been missing in Washington state for six days, police said on Friday.

    The acclaimed Native American actress was last seen walking by herself from an apartment on Sunday around Auburn, some 20 miles south of Seattle, and was reported missing by her father on Oct. 6, Auburn Police Commander Steve Stocker said.

    Police responded to a suicide call from the apartment but the 32-year-old Upham had already left by the time officers arrived, Stocker said.

    There were no suspects or leads in her disappearance and she is believed to have left on her own free will, Stocker said.

    Police had responded to suicide calls four times in the past year at the same apartment, Stocker said, and Upham's parents have told police she is on medications for mental health issues.

    Upham, who was nominated for an Independent Spirit Award for her supporting role in the 2008 crime drama, "Frozen River," has not been in contact with friends or family since her disappearance, police said.

    First and foremost, the City of Auburn, its employees and citizens want to offer their sincere condolences to the Upham family in the passing of Misty.

    To refute or prevent misunderstandings, the Auburn Police Department would like to provide the following information as it relates to the Misty Upham investigation. The men and women of the Auburn Police Department are highly professional Law Enforcement officials who take pride in every investigation to ensure that a thorough and comprehensive investigation is completed. Since July of 2013, the Auburn Police Department has responded to five separate incidents involving Ms. Upham. On four of those incidents, she was contacted by officers and she did not object to being transported by private ambulance for further evaluation. On the 5th incident, Misty had already left the residence and officers were unable to locate her. Each contact was handled professionally and with compassion, with the goal of getting Ms. Upham the attention and care she needed.

    There have been no mistreatment complaints received by the Auburn Police Department from Ms. Upham, her family, MultiCare Auburn Medical Center, King County Sheriff’s Office, Muckleshoot Indian Tribe or elected officials at the City of Auburn. It has been inferred that she may have suffered a black eye at the hands of police, but that is not correct. Rather, included in a related written report, Ms. Upham stated that she had sustained a sprained ankle and black eye when she jumped out a two-story window. Also, the police did not ignore Ms. Upham’s disappearance in this most recent episode. On October 6, 2014, Ms. Upham was reported missing, and her name and information were entered into the WACIC Missing Persons data base. An active search and investigation commenced. On Oct. 6, area checks were done in and around the home where she was last seen.

    She was reported to have taken her purse that contained her EBT Card, cell phone, bus pass and other miscellaneous items. Auburn police officers were told by family and friends that she may have traveled to the cities of White Center, Federal Way or Seattle to visit friends or her close childhood friend, or that she could possibly have gone to other specific locations in Auburn. Officers immediately followed up on all reports of her possible whereabouts. In the course of the investigation, the detective assigned to the case spoke with friends and family, to assist us in locating Ms. Upham. The Seattle Police Department also checked an address provided by family, that Ms. Upham and members of her family were known to frequent, all with no success.

    Officers made three attempts to ping her cellphone, and gain historical data from the cell phone provider that could potentially help us locate her, but this was to no avail as her service had been disconnected prior to her disappearance.

    The Auburn Police Department, along with the King County Medical Examiner’s Office, will continue to search for answers to unravel the mystery behind her passing. We are issuing a call to anyone who may have any additional information related to her death, to please contact the Auburn Police Department at 253-288-2121. We intend to find the information that will help bring closure to the people who loved and cared for Ms. Upham.

    That's sad. I know her family thinks she was running from the police and fell, but it appears to me that she wad suicidal. She had a lot of financial problems. No cell phone, on ebt, all while being a somewhat known actress.*

    RIP Misty.

    I have never heard of her before this. Nor do I remember her in Django Unchained.

    The statement from her father has a lot if holes in it and lacks evidence. One person cried out that the inclusion that she had a EBT card on her only perpetuated the stereotype of Native Americans being poor. I don't think that at all, I think it shows she had access to food so she had means to sustain life.

    There's other stuff. I know this department and have had interactions with many of the officers on the force. I don't believe the claims being made for a second. Especially given that the Tribal Police also could've been involved. I think they're just trying to bandwagon hop and are straight assholes for it.

    My comment about her having an EBT card had nothing to do with her being native American. I'm not hip to the native American stereotypes. I don't know what someone could say to a native American other than we stole your land and gave you small pocks.

    i don't know why they would include ebt card instead of just saying 'credit cards' or including it in miscellaneous items. take it from me, where i work, people jump on statements like that in a hot second to perpetuate the idea that people of color are lesser than white folks. i can see the issue people have with that description.

    the native american community has had continuing issues with poverty and addiction. the conditions on the reservations are pretty bad.

    Because EBT card is specific for food. She also had a bus pass, which indicates transportation means. Im guessing here, but I don't think she had credit cards. And factual reporting is key. If they said credit cards and she doesn't have credit cards it opens the door to "you lied in your statement" from the family or others trying to make a point.

    Personally I didn't go "oh she's poor because she's native American.". Its a stretch to think that's why they included it.

    Also, I don't think she was living in the Reservation. If she was then the Tribal police/Sheriff would've been the one responding to the 5150(s) not the APD.

    oh, i see what you are saying, but i still see where that other person is coming from. i don't think it is necessary to specify ebt card instead of just saying her purse, phone and other personal belongings. when a person takes their purse, one would assume that meant any money and cards as well. i assume most people who have ebt carry it in their purse.

    Not always. And having your purse doesn't always equate means of food and transportation. Could they have said she had means of transportation and eating? Yes. But I genuinely do not think this was a slight against native Americans. We literally have reservation land parceled within our city limits and the reservation is right next to us. The city has a good relationship with the tribe from what I've seen. I mean, the casino has off duty police as part of its security. I really think these people don't want to accept this was a suicide or an accident and are laying blame hoping to get a fat pay out.

They know because family were there and saw it, without police realizing. Uhhh, first our cops don't work in pairs and having personally been out on what was almost a 5150 with an officer, I doubt back up was called. Second, an ambulance would've taken her. Third, if they saw it eyy didn't they say something *then* to stop it!

    Official Upham Family Press
    Release:
    We would like to provide the
    following infomation to all of
    Misty's friends and family. We
    believe that Misty's death was
    accidental. She did not commit
    suicide. We believe she ran into the
    wooded area behind her apartment
    to hide from the police. The area in
    question has a hidden drop off and
    evidence suggests that she slipped
    and fell off of the steep
    embankment when she tried to get
    out of a view from the road. She
    simply did not see the drop off. We
    searched near that area that
    evening she disappeared and
    missed seeing her purse by 25 feet.
    I , Charles, went there after Fire
    Department officials recovered her
    body and you just can't see the
    steep drop until it's to late. Misty
    was afraid of the Auburn PD
    officiers with good reason. In an
    incident prior to her disappearance,
    the Auburn PD came to pick up
    Misty on an involuntary transport to
    the ER. She was cuffed and placed
    in a police car. Some of the officiers
    began to taunt and tease her while
    she was in the car. Because it was
    dark they couldn't see that we, her
    family, were outside our apartment
    just across the street witnessing
    this behavior. They were tapping on
    the window making faces at her.
    Misty was crying and she told them
    you can't treat me like this I'm a
    movie actress and I will use my
    connections to expose you. Then
    another officer walked up to her
    asked "are you a movie star?, then
    why don't complain to George
    Clooney!" After Misty arrived at the
    ER we went to see her and she has
    a swollen jaw, black eye and
    scratches and bruises on her
    shoulder. I asked the ER staff what
    happened and they said Misty was
    brought in like that. Misty said she
    couldn't remember what happened
    but thats why she feared the police.
    I asked Misty to call the Auburn PD
    and ask to speak to the
    commander. When she was
    connected to, whom we believe was
    Commander Stocker she made a
    verbal complaint. The official asked
    her "what are you going to do about
    it?" She replied I'm doing it, I'm
    telling you so you do something
    about it." The APD official told her
    unless she wanted to file a formal
    complaint the matter would not be
    pursued. The day the APD was
    called to do another Involuntary
    transport Misty left the apartment
    where she was staying. When we
    tried to follow her Auburn PD
    officiers told us they wanted to
    check for inside. We told them that
    Misty may have walked around the
    side of the apartment but they
    made us to go back inside. They
    asked if we were hiding her and
    took time to search the apartment
    and get a description of what she
    was wearing. By the time they
    finished Misty was gone. We
    believe that if we were not
    otherwise occupied we may have
    found Misty before she got hurt. It
    is a tragic that Misty slipped and
    fell to her death trying avoid the
    police, it's tragic that she did not
    get the proper medication to treat
    her mental illness from her mental
    health care givers at Valley Cities
    Mental Health, it is tragic that the
    Auburn PD refused to help offer to
    find or at least change her Missing
    status to "Endangered" to allow
    other agencies to get involved. But
    the real tragedy is this could have
    been prevented on a lot of levels.
    We pleaded with the Auburn Police
    to help us find Misty but
    Commander Stocker made the
    decision that Misty did not fit the
    criteria of the Washington State
    Endangered Missing Persons Plan.
    This became a point of contention
    between us and the Auburn PD. In a
    statement he gave to the press he
    said Auburn PD doesn't have any
    evidence that Misty is actually
    missing. He went to say that Misty
    packed her belonging and left her
    apartment. This was an inaccurate
    statement. We believe that
    Commander Stocker had animosity
    against Misty due to a previous
    encounter. Why else would he
    refuse to allow common sense to
    prevail? Imagine a 32 year old
    woman with mental illness, without
    her medication, imagine she left in
    an unstable mental state, imagine
    for the first time in 32 years she lost
    contact with everyone for 11 days.
    Now imagine she is Commander
    Stocker's daughter. Do you think
    this case would have been handled
    differently? Misty loved life, she had
    ambition, vision and a desire to
    make a difference in the world she
    lived in. She tried to use her
    celebrity status to influence
    positive change and she became a
    living example of that endeavor.
    Now press reports are saying that
    Auburn police department found
    Misty. The truth is the Native
    American community formed a
    search party and found her after
    several days of searching without
    the help of the Auburn PD. We
    would like to thank the
    Muckleshoot Tribe and other Tribal
    volunteers for all their support in
    our time of desperation. We would
    like thank all the wonderful
    supporters who could not be here
    but offered kind words and prayers.
    A special thank you to Pastors
    Kenny and Charolette Williams for
    opening up the Pentecostal Church
    for a rescue command Center and
    providing food, supplies to the
    volunteers. We will let the family
    and friends know about her funeral
    arrangement once medical
    examiner concludes his
    investigation.

    A Seattle-area medical examiner has ruled that actress Misty Upham, known for her roles in August: Osage County and Django Unchained, died from blunt-force injuries to her head and torso.

    The King County medical examiner's office updated its investigation of the October 5 death Wednesday, but the manner of death remains undetermined.

    The 32-year-old actress died in the Seattle suburb of Auburn on the same day her family told police she was suicidal. Relatives reported her missing the next day.

    Auburn police say they believe the trauma was caused by a fall and there is no indication of foul play, but they do not know exactly what happened.

    Upham's father, Charles Upham, has said he does not believe his daughter committed suicide.

    'She has said suicidal things in the past but never followed through,' he said at the time. 'She doesn't believe in killing herself. She believes that is a sin and she would never do that.'

    In the days after the discovery of Misty's body, her family came out with claims that the 32-year-old woman fell to her death by accident while running away from police.

    Upham's parents alleged that the Native American actress had been mistreated, and that the Auburn Police Department did not take her disappearance seriously.

    The local police has denied the Upham family's allegations.

    In a statement posted on Facebook in mid-October, relatives say she fled her apartment when officers from Auburn PD came knocking.

    She then plummeted to her death while trying to get out of view from the road.

    Prior to this incident they allege that she was 'taunted and teased' by law enforcement officials picked when picked her up from her apartment and placed her in an 'involuntary transport to ER' while handcuffed.

    Before she went missing she is believed to have struggled with bipolar disorder and had stopped taking anxiety medication.

    Part of the lengthy social media post read: 'Misty was afraid of the Auburn PD officers with good reason. In an incident prior to her disappearance, the Auburn PD came to pick up Misty on an involuntary transport to the ER.

    I know a guy who is super religious.

    Yeah, he thinks it's a sin, too. Hasn't stopped him once from trying.

    They just don't want to accept the circumstances, and that's fine, but she was *not* running from the cops and died from a slip and fall.
