I'm just not getting the vibe that this guy is responsible for it. I can't explain it, but it's just a feeling I have. He's doing it wrong right now though. It's definitely making him look guilty. Unless they have undeniable proof, I hope they don't get tunnel vision.

If they issued a warrant, they would have to have compelling truth. You can interview suspects without solid evidence but judges won't issue warrants without one, because if you catch the right guy but the warrant doesn't stand up, he's gone.
I wish I knew what the evidence was. It's just not sitting well with me. Meh. If he did it, he did it. The jury is still out with me. I think there's a possibility that they're pressured to come up with a suspect and he fit the bill.

What does "intent to defile" mean?

Thanks. That's what I thought but wasn't sure. Never heard the term "intent to defile" as a cause for arrest, usually I hear the word "rape" more than "defile." Not saying it's never been used, just not in anything I've heard of so far.

This is what is rubbing me the wrong way. There's no body, no alive girl yet they some how have proof that he kidnapped her and tried to rape her? Short of him videotaping himself doing these things, how do they know he tried to rape her? I don't get it.
ETA: Kidnap, not so hard to prove if they found something belonging to her at his place. But he TRIED to rape her. How do you prove that?

Well, the nasty fucker who killed Alexis Murphy (http://mydeathspace.com/vb/showthrea...alexis+murphy) was convicted of murder and abduction with intent to defile even though her body was never found.
After serving the second search warrant Tuesday, LE said they found some clothes that would be quickly tested for evidence, and the arrest warrant for abduction with intent to defile came shortly thereafter. I think we can use our imaginations as to what was likely found on the clothes that would indicate this dude "defiled" Hannah in some way.

Rape, sexual assault, attempted rape and attempted sexual assault are separate charges from abduction with intent to defile and are often added in addition to abduction with intent to defile. But it is complicated, and I'm not a legal expert. If you want answers, read the code yourself.
My wild guess would be that they found his semen mixed with her blood, or her vaginal secretions mixed with her blood, but they can't charge him with rape without a body or without some other evidence. Again, that's just a guess.
I was flipping channels and happened to hear the Jinkasarus talking about this last night. "Abduction with intent to defile" is kind of a rare charge and it can mean a variety of things from molestation to rape and even forced prostitution. She pointed out too that, so far, no one is saying this is a homicide.

It was a valid question. Sorry I used "Attempt" instead of "Intent". To me they still say that he didn't quite get there and if there's semen or her fluids present, to me that spells completion of the act.

Jesse Matthew does not have a closely shaved head and in the video released showing him walking the mall he isn't wearing black jeans.Police described the man as a black male in his late 20s to early 30s, about 5 feet 10 inches to 5 feet 11 inches tall and weighing between 250-285 pounds. Um ... I totally said I'm no legal expert and that I'm taking wild guesses on stuff. When following a case, I seek to understand laws because they differ so much from state to state, but I never try to represent myself as having a law degree. So, suck it.
And you can go with someone willingly, but if they do not let you leave or they take you somewhere for some nefarious purpose, that's abduction.

A person commits the crime of abduction if s/he by force, intimidation or deception, and without legal justification or excuse, seizes, takes, transports, detains or secretes another person with the intent to:

- withhold or conceal him from any person, authority or institution lawfully entitled to his charge, or
- subject him to forced labor or services.
For all I know, the guy did do it. But without knowing what evidence they have, it's hard to say either way. I just feel like a guilty guy wouldn't speed away in a huff after questioning. A guy who is annoyed and feeling railroaded might though. I also don't see the leap from traffic violations being your sole criminal history to kidnapping, rape and murder. I could be wrong, but I'm not sold on it.

And to clarify for all those not ignoring my posts (that means you, too, BB), dude didn't speed away from the station in a huff. The cops were tailing him when he left the station. When he realized they were tailing him, he (allegedly) pulled some stunt moves to lose them. And it worked. They lost him.
