    CALGARY ? The man accused of murdering a young Calgary boy and his grandparents made a brief appearance in court on Thursday.

    Douglas Garland is charged with two counts of first-degree murder in relation to the deaths of Kathryn and Alvin Liknes, and one count of second-degree murder in the death of Nathan O?Brien.


    He has been under suicide watch at the Calgary Remand Centre since his first court appearance in mid-July.

    The 54-year-old?s case has been put over until September 17th to allow the defence more time to go through a substantial amount of disclosure.

    The Crown says it?s confident in its case against Garland, even though police have not yet been able to locate the bodies of the victims.

    ?Police have done a great job getting a fair amount of disclosure ready for defence,? says Crown prosecutor Shane Parker. ?We just have to go through our final checks to make sure it?s appropriate for it to go to them.?

    He says the information should be exchanged by Thursday or Friday.

    ?Right now it?s on a hard drive. There?s a fair bit of materials for [the defence] to go through.?

    Garland?s appearance on Thursday lasted only a few minutes, and was via CCTV.

    Nathan?s father Rod O?Brien was in court for a short period of time, as was Alvin Liknes? son Allen. However, both men left before Garland?s appearance began.



    Friends of the victims have started a trust fund to help support the children of Alvin and Kathy Liknes, and the parents of Nathan O?Brien.

    Money from the trust fund will help the family pay for a number of expenses they have incurred, including memorial services and legal fees.

    ?The family is in pieces,? explains close friend Cherri Hodgins. ?Nobody is working and nobody can get back to normalcy, whatever normalcy means to us at this point.
    ?This is a young family that didn?t deserve this, but does deserve our help and our support,? Hodgins adds.

    Investigators probing the disappearance of the missing family recently revealed they had traveled to Mexico to follow up on leads.

    Nathan O?Brien and his grandparents, Kathryn and Alvin Liknes, haven?t been seen since June 29th, after what police say was a violent incident in the Liknes home.

    The couple had been having an estate sale and were downsizing ahead of a move to a home in Edmonton and then on to Mexico.

    Police are also trying to determine if Garland could have connections to any other unsolved, violent crimes.

    Grieving family says final farewell to ?superhero? Nathan O?Brien

    CALGARY- More than two months after the shocking murders of a Calgary boy and his grandparents, friends and family gathered to say a final farewell to little Nathan O?Brien.

    The five-year-old hasn?t been seen since he vanished on June 30, along with his grandparents Alvin and Kathryn Liknes. While their bodies have not been found, Douglas Garland has since been charged with three counts of murder in the case.

    On Thursday morning, mourners gathered at a southwest Calgary church, dressed in Spiderman T-shirts and costumes in honour of the boy his parents fondly remember as ?their superhero.?

    ?Nathan?s family would like to express their heartfelt thanks and gratitude for all the thoughtful expressions of love and kindness by relatives and friends, during their time of loss and bereavement,? the funeral program read.

    O?Brien was remembered as an active boy who loved life, enjoying every day to the fullest. His parents Jen and Rod O?Brien bravely gave an emotional tribute to their young son, and several songs were performed in the boy?s honour.

    A separate memorial for the Liknes? will be held in the coming weeks.

    Members of the O?Brien family seemed surprised that Garland showed up in person for Wednesday?s hearing, rather than through closed-circuit television as in the past.

    There were gasps as a sheriff escorted the accused into the courtroom.

    Garland silent in court

    Garland hung his head as he entered. He never spoke and didn't look at the victims' family members seated in the gallery.

    CBC News earlier learned there were soured business dealings between Garland and Alvin Liknes, including a patent dispute.

    Garland, whose sister is in a common-law relationship with Alvin Liknes?s son, was arrested on July 14 following an extensive search of a property north of Calgary that is owned by Garland's parents.

    During Garland?s last court appearance in August, Crown lawyers said there was still a substantial amount of evidence to be disclosed to defence counsel, prompting the judge to put over the case until this month.

    The Crown expects to have all case files ready by the end of the year, and should have all lab results from evidence collected by police at that point.

    "We've been through a large bulk of it, but I understand there's still a lot more that's going to come. I understand that we won't have full disclosure until sometime later in November, early December," said defence lawyer Kim Ross.

    Preliminary trial set for May

    The evidence against Garland will include statements from civilians and police officers, and the forensic evidence that led to the charges.



    At Wednesday's hearing, a provincial court docket judge set a preliminary trial date for May next year.

    "I like the idea of a preliminary inquiry, it gives us a chance to test drive some of the evidence ? make sure where we're at in terms of some of the behind-the-scenes work," said Crown prosecutor Shane Parker. "It gives us more time to make sure we're ready once the jury trial is slated to go."

    The Crown won't say when an actual trial could take place or how long it would run.

    Bail application possible, says lawyer

    Calgary police aren't commenting on the investigation or efforts to locate the victims' bodies because, they say, the matter is before the courts. But Parker said the search should still be on.

    "We always want the investigation to continue on an ongoing basis, all the way through, in any case," he said.

    Garland will remain in custody, but his lawyer is not ruling out a possible bail application.

    "I'm still going through the disclosure, we'll make decisions once I get through all that and get instructions from my client," said Ross.

    CALGARY ? The search of a rural property near Airdrie connected to the murder of Nathan O?Brien and his grandparents Alvin and Kathy Liknes intensified Tuesday, with about 20 investigators raking the grounds on their hands and knees.

    The property belongs to the parents of Douglas Garland, who?s been charged with two counts of first-degree murder in relation to the deaths of the Liknes? and one count of second-degree murder in the death of O?Brien. The bodies have not been recovered.

    Investigators are looking for evidence to support the upcoming court case, with the preliminary inquiry set to begin May 19.

    Police have been on scene since Sunday, with RCMP officers guarding the entrance Tuesday morning. There were rakes against the house and a grid laid out by police tape as of Tuesday afternoon.

    Global News contacted the spokesperson for O?Brien?s parents, who had no comments to make on their behalf at this time.

    Fifty-four-year-old Garland was living on the acreage just northeast of Airdrie that was meticulously searched by police last summer. He has been the sole person of interest in the case.

    The trio vanished from the Liknes home last June while Nathan was sleeping over ? hours after his grandparents held a sale at their house in advance of a move to Mexico.

    On Tuesday, Garland appeared in court wearing a blue prison jumpsuit.

    Details discussed during the inquiry are under a publication ban and cannot be reported in any form, including Facebook posts or tweets.

    CALGARY ? Gruesome details of blood stains and drag marks found at the home of Alberta grandparents Alvin and Kathy Liknes on June 30, 2014 were released to the public for the first time this week. An affidavit filed by police states officers believed the couple and their five-year-old grandson, Nathan O?Brien, were ?likely murdered? within hours of the investigation.

    The disappearance of O?Brien sparked the longest Amber Alert in Canadian history. Calgary police referred to the case as a ?missing persons investigation? until July 15, when then-54-year-old Douglas Garland was charged with murdering the couple. Garland was eventually charged with three counts of first-degree murder in all three deaths. No bodies were ever found.
    The affidavit is from the day Jennifer O?Brien returned to her parents home to pick up her son from a sleepover. According to the affidavit, O?Brien called police and said there was ?blood everywhere? and that she believed her mom, dad and son had been murdered.

    Homicide unit Det. Dave Sweet filed the affidavit. It contains details he received from Const. Trevor Matthes and Const. Tim Callaghan, two officers who were part of the first response to O?Brien?s call.

    Officers noticed blood on the stairs leading up to second floor, including blood in both upstairs bedrooms. The document said there were drag marks in blood ?consistent with a person(s) being dragged out the side door of the home and then north along the residences sidewalk.?

    ?Officers also located a dumbbell with blood staining on it located in a corner of the garage and bloody footprints leading into the garage,? reads the report.

    Sweet?s affidavit concludes by saying he believes ?on reasonable grounds that the Liknes and five-year-old Nathan O?Brien have been victims of a violent attack, have been taken against their will and are likely murdered.?

    The significant amounts of blood, drag marks, dumbbell with blood on it were listed as reasons for the conclusion. In addition, Sweet noted none of the victims had yet been located or had checked into hospital.

    The man accused of killing a Calgary couple and their five-year-old grandson was motivated by a "petty grudge" over a patent dispute and burned their bodies in a barrel after killing them, court heard Monday as the triple-murder trial of Douglas Garland began.

    In her opening statement, Crown prosecutor Vicki Faulkner said Douglas Garland was angry with Alvin Liknes over a dispute relating to a patent for a pump that dated back years.

    She told the jury that when Garland learned through internet searches that Alvin and his wife, Kathy Liknes, were planning to leave Calgary, Garland finally decided to act on his grudge.

    Five-year-old Nathan O'Brien was at his grandparents' home, having an impromptu sleepover, when the trio were taken.

    Forensic analysis of Garland's computer hard drive will be presented as evidence, said Faulkner, showing research on murder, "how to kill without emotion," torture and autopsies.

    Garland, 56, is charged with three counts of first-degree murder in connection with the missing family members who were last seen June 29, 2014.

    Evidence 'all over' rural property

    He said "not guilty" in a loud, clear voice when asked for a plea at the outset of his trial.

    The trio's disappearance made national headlines as Canadians held out hope for two weeks that they would be found alive.

    Following a massive search and investigation involving hundreds of police officers, that hope was dashed on July 15, 2014, when Garland was arrested and charged with murder.

    Jurors heard evidence was later found "all over" a rural property just north of Calgary, where Garland lived with his parents.

    The Crown said DNA evidence from the missing family members was found on a saw and meat hooks, and bones and a tiny tooth were discovered in a large burn barrel.

    A mapping plane that flew over the property also took photographs that show three bodies in the grass, according to the Crown's opening statement.

    Alvin and Kathy were lying face down, according to the prosecution.

    "You will also see a small figure curled up on the grass," said Faulkner. "The Crown says this is Nathan."

    Jennifer O'Brien was the first witness called at the trial.

    She testified that on his last day alive, Nathan was given the option to visit the zoo or his grandparents, and he chose his grandparents ? who were planning to move to Edmonton and spend much of their time in Mexico.

    Once at their home, Nathan's "proud" grandfather, Alvin, took the boy to the playground.

    "He was just truly a kind, loving, happy, happy boy," Jennifer said of Nathan.

    About 30 people attended an estate sale the family held that day and, once everyone cleared out, the family ordered Chinese food and watched a movie together.

    "We just sat there and enjoyed each other's company," said Jennifer, who described her mother as her best friend.

    Nathan asked if he could stay for a sleepover that night at his grandparents' house, and Jennifer and her youngest also decided to stay, according to her evidence. But when the one-year-old woke up in the middle of the night, she scooped him up and drove home, leaving Nathan sleeping with his grandmother.

    The next day

    On the morning of June 30, Jennifer woke up, got the baby ready and called her mother, but Kathy didn't answer.

    When Jennifer walked into her parents' home with her one-year-old son perched on her hip, she said she knew right away what happened.

    "My family's been murdered and he's taken the bodies," she told her husband as she walked around the bloodied home.

    She said it was a "bloody scene" inside, with blood on the beds, walls and in the kitchen.

    "I immediately saw pools of blood and hand marks of blood on the wall."

    Alvin Liknes' son, Allen Liknes, was the prosecution's second witness. He was married to Douglas Garland's sister Patti at the time the family disappeared.

    Both Allen and Patti were instrumental in alerting police to information that caused Garland to become a suspect the day the trio was discovered missing, according to the Crown's opening statement.

    Allen testified that he, Alvin and Garland had worked together around 2006-2007, when his father hired Garland to do some wiring for a pump the father and son were developing.

    The relationship between Alvin and Garland disintegrated beginning in 2007 when Garland became upset that he had been let go from the business after he stopped answering the phone, Liknes testified. By 2010, Allen testified that he and his father stopped talking to Garland because Alvin had had enough.

    Allen told officers about the long-standing grudge Garland held against Alvin on June 30, 2014.

    The same day, Patti Garland recognized a photo of a green truck released by police as similar to the one driven almost exclusively by her brother, Douglas Garland. The image had been captured by a surveillance camera on the Liknes's street the night the family disappeared.

    She sent a photo to Allen who forwarded it on to police, according to the Crown's opening statement.

    In cross examination, Allen Liknes told defence lawyer Kim Ross that Garland never threatened his father.

    "He's not confrontational at all," said Allen Liknes. "If anything he's sneaky."

    “DNA of Kathryn is found on meat hooks,” Faulkner said. “In the residence and in the outbuildings weapons were found, multiple knives, guns, black jacks and restraints of all types, including handcuffs and leather restraints.”

    Faulkner said investigators also found evidence of Garland conducting “meticulous, pain-staking research.

    “Research about murder and how to kill without emotion,” she said.

    The prosecutor said it’s the Crown’s theory all three victims were removed from the Liknes’ Parkhill residence in southwest Calgary and taken to the Garland farm.

    “The three individuals were violently removed from their beds and taken to the Garland farm and killed,” she said.

    The patent never went anywhere. Grandpa never even made any money off it.

    Two teeth, bloody footprints, children's pyjamas, a lock with drill marks in it and bloodstained bedding — these were just some of the items photographed and sent for testing by a Calgary officer during the investigation into the deaths of a five-year-old boy and his grandparents.
    Inside, Alexon swabbed what was believed to be blood from droplets, smears and drag marks and sent the samples to the RCMP lab for testing.

    The suspected blood-covered bedrooms and bedding, dumbbells in the garage, linoleum in the kitchen and carpeting in the hallways.

    A photo of pink pyjama bottoms lying beside the pull-out sofa in the Liknes's basement was displayed for the jury. On Monday, Nathan's mother testified that when she left her parents' home, her son was wearing a pair of his female cousin's pink pyjamas.

    Inside a black purse that was discovered in a hallway was a Superman cape believed to have been given to Nathan on the last day he was seen alive.

    This has to be one of the most horrific stories I've ever read. I can't even begin to imagine what went through that poor mother's mind as she turned up to pick up Nathan and found that scene.
