    There are lots of questions about what happened that night.

    "It gets to trial and all of sudden it's like, wow, there's a lot talk about here," says Greg Hembree, the former 15th Circuit Solicitor.

    The police have made arrests, but a valuable piece of evidence is still missing.

    "It's really uncommon, that's one of the things that you almost always have, it's a critical part of a crime scene," Hembree says.

    Heather Elvis search warrant appeal back in court Nov. 13

    Attorneys for the Carolina Forest Chronicle and other Myrtle Beach area newspapers are scheduled to appear in court next week to argue for the release of search warrants in the Heather Elvis case. A hearing has been scheduled for Thursday, Nov. 13 at the Horry County Government & Justice Center in Conway. Circuit Court Judge Steven John is expected to preside. Horry County Magistrate Aaron Butler refused previous Waccamaw Publishers' requests for the search warrants, prompting the newspaper group to challenge Butler's refusal in Horry County Circuit Court.

    Waccamaw Publishers is the parent company of the Carolina Forest Chronicle, Horry Independent, Myrtle Beach Herald, Loris Scene, The News & Shopper, Visit!, and the websites MyHorryNews.com and myrtlebeachvisit.com. The Sun News has joined in the Waccamaw Publishers appeal, and is being represented by local attorney George Redman. "It is the newspapers' belief the magistrate applied the wrong standard to deny access," said Jay Bender, a Columbia media law attorney representing Waccamaw Publishers and also the S.C. Press Association, of which the Chronicle is a member.

    Circuit Court Judge Larry Hyman presided at a hearing to resolve the matter in June, but deferred making a ruling. Hyman said at the June hearing that Judge John should decide the issue because of a gag order he issued in the Heather Elvis case.

    Butler's attorneys have said the gag order applies to the release of the search warrants. "This involves an interpretation of his [John's] order and he wants the matter brought before him," Hyman said. "He understands this issue."

    Releasing search warrants is not unprecedented in South Carolina. In June, a Georgetown County magistrate released a search warrant that was filed in 2010 in the disappearance of Brittanee Drexel, another high-profile missing persons case.

    "I don't mind you having this," Isaac Pyatt, chief magistrate for Georgetown County, said to a Chronicle reporter.

    And in 2006, a York County (S.C.) circuit court judge overturned a magistrate's decision to withhold search warrants issued when a former coroner was charged with possessing cocaine. "The Constitution guarantees the public the right of access to court records," Bender said. "The position the newspaper is taking here is consistent with the right of court access." Waccamaw Publishers sought search warrants and warrant findings in the Heather Elvis case shortly after the arrest of Sidney Moorer, 38, and Tammy Moorer, 42, on Feb. 21. The Moorers are charged with murder, kidnapping, indecent exposure and obstruction of justice in connection with Elvis' disappearance.

    Elvis, 21, was 20 years old when she was last seen Dec. 17, 2013 and heard from on Dec. 18, 2013. She has not been found. A cause of death has not been released and no known forensic evidence has been collected. Police have not said why they filed murder charges.

    Initially, Butler said in court records that he refused to release the search warrants because of the "ongoing investigation". Butler later claimed judicial immunity in court documents filed April 29 in response to the Waccamaw Publishers appeal filed April 3. "We filed the motion because the appeal supposedly filed by Waccamaw Publishers is certainly not legal because what they're doing is they're appealing from a letter," Myrtle Beach attorney Henrietta Golding, who?s representing Butler, said at the time. "You have to have a lawsuit, a summons and complaint," Golding said. "That certainly has not occurred in this matter."

    In June, an attorney from Golding's firm who represented Butler at the hearing, argued the magistrate can?t release the warrants because of a gag order Judge John signed on March 21. "These orders made March 21 may govern the request by Waccamaw Publishers," Jim Gilliam, an attorney for Butler, said during the hearing.

    Bender said the gag order has "no influence" over access to court records filed in the Heather Elvis case.
    "I reject out of hand that even a judge presiding over a murder case can issue an order that tells everyone in the world you can't talk about it," Bender said. "The absurdity of that notion was on display in the WMBF case when the [police] wanted to argue that Judge John's order had some connection with a trespassing case."

    WMBF anchor Michael Maely was found not guilty on trespassing charges during a trial in October. He was charged after Moorer family members filed a complaint with Horry County police. Horry County police Det. Marcus Rhodes, who represented the Moorers in that trial, wanted the media excluded from the proceedings on the grounds it would violate the gag order. Bradley Mayers, the presiding magistrate, denied Rhodes' request and allowed the media to remain.

    Judge John's gag order prohibits trial participants from making extrajudicial comments in the Heather Elvis case. It covers prosecuting attorneys, defense attorneys, employees of the solicitor's office, police officers investigating the case and the Moorers themselves. Magistrates are not mentioned in the gag order. "He [Judge John] is providing political cover for those who want to be gagged," Bender said.

    Human remains found in Florida and at first thought to be linked to the investigation of the disappearance of Heather Elvis are not from her, authorities said.

    Horry County police contacted the Volusia County Sheriff?s Office in March after the remains were discovered there, Horry County police Lt. Robert Kegler said at the time.

    Heather Elvis was last seen the night of Dec. 17 and last heard from early Dec. 18, according to authorities. She was reported missing Dec. 19 after Horry County police found her car, which was registered to her father, parked at the Peachtree boat landing. Elvis? keys, cellphone and purse were not found in the locked car and she is still missing.

    On Friday, Gary Davidson, a public information officer for the Volusia County Sheriff?s Office, confirmed that officials ruled the remains were not Heather Elvis.

    ?Yes, we?ve pretty well concluded it?s not her,? Davidson said. ?Heather Elvis went missing approximately three months before the remains were found here. The experts who?ve examined the remains are confident that they?re older than three months.?

    Judge to reconsider bond for couple charged with murder of Heather Elvis

    (Jan. 22, 2015) A bond reconsideration hearing has been set for Sidney and Tammy Moorer, according to Horry County Solicitor Jimmy Richardson.

    The hearing will be held Jan. 30 at the Charleston County Judicial Center in front of Judge R. Markley Dennis, according to a news release.

    According to the motion filed by Sidney Moorer's attorney in December, Moorer was arrested on Feb. 21 and has been incarcerated without bond for more than 10 months.

    The motion states, "The defense counsel has had the opportunity to review the discovery provided. The discovery provided not only contradicts the State's representation at the initial bond hearing, but further establishes that Sidney Moorer could not be legally convicted of the crimes charged."

    According to the Solicitor's Office, Tammy Moorer's attorney filed a similar motion, and the bond reconsideration hearing will be for both of them.

    They are charged with Murder, Kidnapping, Obstruction of Justice and Indecent Exposure in connection with the disappearance of Heather Elvis.

    Elvis has been missing since Dec. 18, 2013. Her car was found at Peachtree Landing the following day.

    Investigators determined the 20-year-old from Horry County was killed at Peachtree Landing in Socastee.

    Her body has still not been found.

    A trial date has been set for Sidney and Tammy Moorer for the week of May 11.

    Tammy Moorer 'looking forward' to murder trial, her attorney says

    (Jan, 22, 2015) MYRTLE BEACH, S.C. - A Horry County wife charged in the death and disappearance of a young woman who had a relationship with her husband is "looking forward to appearing in court," her attorney told News13 Thursday.

    Tammy Moorer, age 42, and her husband Sidney Moorer, age 38, are both charged with the death of Heather Elvis, a Myrtle Beach 20-year-old who disappeared in December 2013.

    Elvis has still not been found, although detectives closed a road near the Moorer's house just last week for a search.

    Tammy Moorer's attorney, Greg McCollum, spoke Thursday after news came that a new bond hearing would be held for the pair next Friday in Charleston.

    McCollum told News13 that his client is prepared for the trial, which is scheduled to begin May 11.

    " ... we're ready to go," McCollum said. "She's looking forward to having her defense heard and all the things that happen in a trial. So we are anxious and ready and willing to begin the trial."

    McCollum said that the legal preparation for a trial -- in which 800 possible jurors are expected to be called -- is also well underway.

    "With the exception of just a very few minor things, we're ready. We know what the case is. We know what the evidence is. We know what the state's position will be."

    McCollum talked to WBTW after 15th Solicitor Jerry Richardson announced Thursday that a new bond hearing is planned for Jan. 30 in Charleston.

    McCollum welcomes the idea as both Tammy and her husband Sidney Moorer are held without bond.

    "Certainly we want to take every opportunity possible to see certainly from our point of view that we would like for Tammy to be released on bond. And so any opportunity we have to do that, we're certainly going to take advantage of that."

    The original bond hearing revealed many details about the case that police alleged -- including unflattering texts and emails between the married couple to and about Heather Elvis.

    One message, allegedly from Tammy Moorer, confronted Heather Elvis: "To Heather.. someone's about to get their a-- beat down ..." was part of one of many messages presented by officials in the last hearing in March 2014.

    "In the initial bond hearing, the case had just begun, and the judge denied the bond," McCollum said. "And he specifically left a provision in there that we would be able to come back -- after everyone had a chance to review the evidence, prepare the case and look at it, and that option was available."

    During next Friday's bond hearing appearance, McCollum also wants to have a judge remove the gag order that severely limits information about the case from being discussed by officials to the public.

    McCollum told WBTW he would file paperwork in the coming days about the lifting of the order.

    "I can't say a whole lot about it because it exists. And that's the irony of it. I can't talk about really the reasons we'd like it to be lifted because the gag order is in place to keep us from talking about the evidence. That creates some issues for us and we would prefer to be able to speak more freely about the case."

    Man charged with murder of Heather Elvis released from jail


    Both people charged with killing Heather Elvis of Socastee are now out of jail.

    Sidney Moorer bonded out of J. Reuben Long Detention Center about 2 p.m. Monday.

    His wife, Tammy Moorer, was released on bond Friday, after Judge R. Markley Dennis set bond at $100,000 for each of the Moorers.

    Tammy Moorer's mother put her home up as collateral for both of them.

    Some additional legal paperwork was required for Sidney Moorer's bond and his attorney, Kirk Truslow, says he didn't have time to get it filed by close of business Friday.

    Once the papers were signed, Moorer walked out of jail without comment.

    Elvis, who was 20 years old when she went missing, has not been seen since December 18, 2013.

    Though her body has not been found, the Moorers were charged with her murder last February.

    Tammy Moorer's attorney, Greg McCollum, will not say where Tammyh is staying now, but says she's happy to be reunited with her family and ready to go to trial.

    "Anybody in that situation is usually anxious to go to court and seek vindication of those charges," said McCollum.

    Sidney Moorer's attorney Kirk Truslow would also not say where Sidney will be living now that he's been released, but says Moorer is ready to get back with his family.

    "He's excited to be out. He's waited a long time, he's been in for a long time. He deserves to be out," said Truslow.

    The court has ordered the Moorers to stay outside a 5-mile radius of the home of Elvis's family, but they have no other restrictions of movement as long as they don't leave the state.

    Wherever they end up going until the trial, attorneys say it's likely the Moorers will be living together.

    "They're husband and wife, they're married, they have three children, there's no stipulation or conditions that would require them to be apart, so I would think that yes, they would be very happy to be together," said McCollum.

    McCollum says some 800 potential jurors in Horry county have received questionaires about the case.

    He says when attorneys see some of the responses from those jurors is when they'll decide whether to ask for a change of venue.

    The trial for the Moorers is set for May 11.

    (March 11, 2016) The murder charges against a South Carolina couple in connection with the 2013 disappearance of Heather Elvis have been dismissed. Today, both sides are speaking out about the latest development in a case that's gained national attention.

    Court records show the murder charges against Sidney and Tammy Moorer, 39 and 43, have officially been dropped, along with charges of indecent exposure. An obstruction of justice charge has also been dismissed for Tammy, but one remains against Sidney. However, according to the Horry County Public Index, both still face charges of kidnapping in connection with the Elvis case. The couple has pleaded not guilty to all charges.

    "I feel good about it [the dismissal]. I feel we're moving in the right direction," Sidney Moorer told Dateline exclusively. "We didn't do anything that we were charged with. I'm glad we're moving forward, that the state - the solicitor - had the courage to do the right thing."

    Sidney added that he believes all the charges against him and Tammy will be dropped sometime in the future. "We are 100% innocent on all charges," he said.

    Dateline also spoke with Debbie Elvis, Heather's mother, who says that although the family is disappointed in the development, they are confident the Moorers will be held accountable on the kidnapping charges.

    "We want the focus to stay on Heather, that's where our focus still lies," Debbie told Dateline. "This is all about Heather."

    The Moorers were taken into custody in February 2014 and charged with kidnapping and murder in connection with the December 2013 disappearance of Elvis, who was 20 at the time. They spent 11 months in jail before being released on bond in early 2015. Last September, the judge modified their bond to allow the couple to move out of state for work.

    Dateline spoke exclusively with Kirk Truslow, Sidney Moorer's defense attorney, regarding the new developments. "We are thrilled, though not surprised, that the murder charge has been dismissed. We are anxious to get to trial, currently set for June 20, to completely resolve all issues in this case," said Truslow.

    Heather Elvis was last seen on December 18, 2013, when she was dropped off at her apartment near Myrtle Beach, South Carolina after a date. She was reported missing the following day. Heather's car was later found abandoned at the Peachtree boat landing on the outskirts of town. Investigators say Elvis had a relationship with Sidney Moorer prior to her disappearance.

    Dateline NBC has been following Heather's story since January 2014. Our producers spoke with Heather's parents and investigators prior to the Moorers' arrests.

    First witnesses testify they believed Heather Elvis was pregnant

    (June 21, 2016) CONWAY, SC (WMBF) ? Witness testimony began around 4 p.m., Monday in the Sidney Moorer trial, with both saying they believed Heather Elvis was pregnant.

    The two witnesses, Jessica Cooke and Jody Davenport, testified they worked with Elvis at the former Tilted Kilt location at Broadway at the Beach in Myrtle Beach.

    From there, they talked about a relationship that began between Elvis and Moorer, who also worked at the Titled Kilt as a maintenance employee.

    During the relationship, the witnesses said Moorer would come in to the restaurant to see Elvis and bring her coffee and bagels.

    The witnesses testified the relationship ended in October 2013.

    Cooke, who said she was Elvis' supervisor, testified she noticed Elvis was gaining weight, which led to Elvis eventually taking a pregnancy test. That test, the witness added, came up as an error.

    The jury was excused for a short recess just before 5 p.m., before testimony resumed. A third Titled Kilt employee, Megan Bonfert, reiterated a lot of the testimony as the previous witnesses. She also discussed Elvis arriving to work with bruises at some point after the relationship with Moorer ended.

    After almost five hours of shrinking hundreds of potential jurors down, a jury panel of 12 and two alternates was seated before 2 p.m. Monday on the first day of the trial.

    The panel is comprised of 10 men and four women. Judge Markley Dennis told the jurors not to research any details about the case as long as they were served on the jury. He then told them to break for lunch and be back at 3:30 p.m.

    One of the jurors is a friend of Moorer's attorney, Kirk Truslow. While the state requested that he be dismissed, the judge said no, because the man said his relationship would not compromise his decisions.

    During opening statements, Martin Spratlin with the solicitor's office said the heart of the case was the affair between Elvis and Moorer, which ended after the defendant's wife, Tammy Moorer, found out.

    According to the prosecution, Elvis went on a date and was dropped off around 1:30 a.m. on Dec. 18, 2013. Five minutes later, she got a call from a payphone off Seaboard Street in Myrtle Beach that lasted four minutes. The call was allegedly made by Sidney Moorer.

    A second call, Spratlin told the jurors, was placed by Elvis to the Sidney Moorer's cellphone. It was after that call, the prosecution alleged, that the two met at the Peachtree Boat Landing in the Socastee area and Elvis has not been seen or heard from since.

    In his opening statement, Kirk Truslow, Sidney Moorer's attorney, said the defense has an answer for everything because the defendant did not commit the crime he is accused of.

    The defense attorney said Moorer has been, "put in a position to fight for his life." He added police did enough in the case to get it off of their plate and made an arrest to solve a case, instead of solving a case and making an arrest.

    Truslow asked the jury to keep an open mind while the testimony continued.

    The opening statements were preceded by the nearly five-hour-long jury selection process.

    When the process first began, there was not an empty seat in courtroom 3B of the Horry County Government and Justice Center.

    The potential jurors were asked questions by the court clerk during the roll call, such as how far they had to travel to get to the justice center, their occupation, whether or not they are married and their spouse's occupation if they are married.

    A large number of the potential jurors told the clerk their marital status was either single, separated or divorced.

    Their occupations ran the gamut from administrative assistant to librarian, and restaurant manager to human resources director.

    A number also said they were retired.

    There were a few moments of levity during the nearly 50-minute roll call. One potential juror drew a laugh when he announced he was, "happily divorced."

    Another said he was a minister and asked the crowd if they loved Jesus Christ, which evoked a few to say, "Amen."

    The process was set to continue following a 20-minute break.

    Eight hundred jury summons and and questionnaires were sent out May 2, and were all due back to the court by June 2. This was in an effort to get an unbiased jury ? something critical to both sides for such a well-known case.

    Last Friday was the deadline for the attorneys to provide their witness lists to the court. One of the witnesses, a video analysis expert, was being questioned at one point as to whether or not his testimony is admissible.

    Dennis, a circuit court judge from Charleston, is presiding over the trial. This whole trial could potentially last five days or more.

    Sidney also faces obstruction of justice charges related to this case, but he will not be on trial for that charge this week. During a pre-trial hearing last Monday, Moorer's attorney argued to try the charges separately, saying it's because the two cases are separate and distinct. Sidney's attorney argued the two charges were not properly joined by the prosecution.

    On the other side, the prosecution argued Moorer committed obstruction of justice in order to elude detection for the kidnapping charge.

    The next day, the judge granted the motion to separate the charges and trials.

    A date for the trial on obstruction of justice charges is not set.

    Sidney Moorer and his wife, Tammy Moorer were both originally charged with murdering Heather Elvis. But those charges were dropped in March.

    Tammy Moorer is also charged with kidnapping. A trial date for Tammy Moorer has not yet been set.

    The Moorers were arrested in February 2014 in connection with the disappearance of Horry County woman Heather Elvis, who was 20 years old when she went missing in December 2013.

    A mistrial was declared Friday afternoon in the four-day kidnapping trial for Sidney Moorer, charged in the disappearance of Heather Elvis. A deadlocked jury was unable to reach a verdict after about nine hours of deliberation that spanned two days.

    The mainly-male jury was split, with 10 believing Moorer was guilty and two determining he was innocent.

    The jury was handed the case by Judge R. Markley Dennis Jr. about 4:45 p.m. Thursday, but the group requested that they break for the evening about 7:20 p.m., and the jury reconvened at 9 a.m. Friday.

    They reviewed pieces of evidence and asked for the definitions of circumstantial evidence, reasonable doubt and to hear the charge of kidnapping, but came to the judge about 2:40 p.m. Friday and said they were deadlocked.

    ?A mistrial would be an unfortunate thing,? said Dennis to the jury when he delivered an Allen charge to them, stating no other jury would be more qualified than they are to determine the case?s outcome and requested they deliberate further.


    However, the jury returned to the courtroom a little more than an hour later, saying they could not reach an agreement and Dennis declared a mistrial.

    The judge turned the case over to the jury despite a motion from defense attorney Kirk Truslow on Thursday, who asked the judge to determine the case himself in a directed verdict, because Truslow said the state did not provide substantial circumstantial evidence for the jury, who shouldn?t have to ?engage in guesswork and speculation.?

    The jury was excused while the motion was heard, and Dennis told Truslow it was clear to him that Elvis, who remains missing, left Peachtree Landing, where her locked and abandoned car was discovered by police about 4 a.m. Dec. 18, 2013, with someone she knew, and that it was inconsistent for a young woman who was excited about her life to suddenly vanish.

    Elvis, who was 20 years old when she disappeared, met Moorer, 40, at the former Broadway at the Beach restaurant Tilted Kilt, where she was a hostess and he worked as a maintenance man. The two were involved from July 2013 to October 2013, according to testimony.


    ?I think it would have been really great if it could have been resolved. ? When this happens it?s a little disappointing when you spend all this time and effort,? said Truslow.

    One of the jurors identified himself as a friend of Truslow?s during the jury qualification process Monday and told the judge he felt he could still be fair and impartial. After the mistrial, Truslow described his relationship with the juror as being between an acquaintance and friend and said he believed the juror would be impartial.


    Truslow said he will continue to represent Moorer and said it was possible for the state to decide not to hold another trial for Moorer if they choose and said he didn?t know when Moorer may be retried.

    ?If they?re [the state] going to do it, I?m sure they?re going to do it as quickly as they can,? said Truslow.

    Jimmy Richardson, 15th Circuit Solicitor, declined to comment on the case, citing the gag order signed by Judge Steven John in March 2014 that prevents discussion from involved parties and still stands.

    Moorer declined to speak with media outlets just after the mistrial was declared, but said he felt confident he would be found not guilty while the jury was still deliberating.

    ?I?m going home. I?m going home tonight. I think it will work out,? Moorer said before the mistrial was declared. ?I?m innocent.?

    However, Moorer said he did discuss with his family how they would handle things if he did go to jail on the kidnapping charge.

    ?That?s a rough conversation. Preparing for the worst,? Moorer said.

    Moorer?s wife, Tammy, is also charged with kidnapping Elvis, and her trial date has not been set. Tammy Moorer was mainly absent from the trial, but did come to court at the end of the day Thursday with the couple?s three children, and was present with them in court Friday.

    Polly Caison, Tammy Moorer?s mother, said the couple was breathing a little easier, but not feeling completely relieved.

    ?It?s heartbreaking to have to go through it all again. ? A lot of stuff has been hid and hadn?t come out, and they need to drop the gag order where things can come out,? said Caison. She said she was frustrated by the gag order and that some details have not been brought to light in the case.

    The Elvis family couldn?t be reached for comment after the mistrial was declared. The family said during the trial, however, that it was ?traumatizing? for them to listen to the details and see the evidence. They also emphasized that they are still seeking tips about their missing daughter.

    Assistant Solicitor Nancy Livesay and Assistant Solicitor Martin Spratlin laid out their case, built upon cellphone records, GPS data that tracked Elvis? cellphone?s last movements, surveillance footage and witness testimony.

    Witnesses who were friends of Elvis testified she may have been pregnant. Elvis took a pregnancy test, but it read ?error? and was ultimately inconclusive.

    The state argued that Moorer had a motive in the case because of the possible pregnancy, which would not have allowed for a clean break between Elvis and Moorer. The state asserted Moorer lured Elvis to Peachtree Landing and kidnapped her.

    ?If you want to believe Sidney Moorer kidnapped Heather Elvis because he thought she might be pregnant, then you have to believe I?ve been sitting next to the devil himself this whole trial,? said Truslow during his closing argument Thursday.

    Cellphone records showed Elvis was at her White River Drive apartment from about 1:13-2:31 a.m. on Dec. 18, 2013. She received a call from Sidney Moorer about 1:35 a.m. from a Seaboard Street payphone after Moorer bought a pregnancy test and cigar at a nearby Wal-Mart, according to testimony.

    Caison said the test he purchased was for her daughter, Tammy Moorer.

    Before the state rested Thursday, Elvis? former roommate, Brianna Warrelmann, who was out of town on Dec. 18, 2013, poured out an emotional testimony of the last phone call she received from Elvis, about 1:45 a.m. Dec. 18, 2013.

    She testified that Elvis told her Moorer said he had left his wife and wanted to be with her. Warrelmann said she was angry Moorer reached out to Elvis after Elvis was starting to bounce back from their October 2013 breakup and advised her to just sleep on it before making any decisions.

    Cellphone records showed Elvis tried calling the payphone back nine times, and drove to Longbeard?s Bar and Grill in Carolina Forest, was in the parking lot briefly, drove home, then talked to someone on Moorer?s cellphone for about four minutes before heading to Peachtree Landing.

    All of Elvis? cellphone activity stopped there at 3:42 a.m. Video surveillance from a business off Mill Pond Road and a home off S.C. 814 showed a truck, which the state said was Moorer?s, heading to and from the area of the landing about 3:38 a.m. Dec. 18, 2013, according to testimony.

    ?There?s a fine thin line between circumstantial evidence and looking suspicious,? said Truslow during his closing argument Thursday.

    The defense called no witnesses and Sidney Moorer did not testify.

    Truslow argued that other suspects loomed in the background, such as an abusive ex-boyfriend of Elvis? and a man she had just returned from a first date with, but that Horry County police did not investigate them. And Truslow also pointed to Tammy Moorer, who sent Elvis threatening messages and harassing phone calls, according to testimony.

    Sidney and Tammy Moorer were charged with murder in Feb. 2014 in Elvis disappearance, but the charges, along with indecent exposure charges, were dismissed for the couple in March. An obstruction of justice charge was also dismissed for Tammy Moorer.

    Moorer is still charged with obstruction of justice, but a trial date has not been set for that charge.

    I agree, I'm sure they will retry and maybe next time no friends of the defense attorney on the jury! I feel like the friend was 1 of the 2 for innocent.

    Also regarding the speculation of her being pregnant... It did seem odd to me that in the recent pic of her she did look bigger. She was tiny in all the memorial pics of her that Ive seen. I know people can just gain weight but i think it makes a lot of sense why things might have recently escalated between her and the MRS as Tammy called herself.

    I hope they find her. Somehow. I hope these fuckers rot.

    So this week, Sidney's obstruction of justice trial started and ended in a guilty verdict. He was sentenced to 10 years for lying to cops and obstructing the investigation!

    Tammy Moorer is currently on trial for kidnapping and conspiracy to kidnap. In have been glued to it for almost 2 weeks. Yesterday she took the stand in her own defence. Wild About Trials is covering it if anyone want to check it out.

    The couple found guilty in a high-profile kidnapping case in Horry County lost their appeals to overturn their convictions.

    The South Carolina Court of Appeals issued opinions on Wednesday for Sidney and Tammy Moorer who were convicted of kidnapping Heather Elvis.

    The appeals court ruled that the trial court didn’t abuse its discretion in denying Sidney Moorer’s motion. The documents show that the jury pool was carefully examined and that prejudice from pretrial publicity can’t be proven.

    In both of Tammy and Sidney Moorer’s appeals, they argued the trial court erred by not granting a motion for a directed verdict. The couple’s defense teams argued that there was no direct or substantial circumstantial evidence that the two kidnapped or conspired to kidnap Elvis.

    The appeals court disagreed, stating that prosecutors presented evidence that Sidney Moorer had the motive to kidnap and harm Elvis in order to “appease Tammy’s anger about the affair and avoid any negative consequences of Victim’s possible pregnancy.”

    The appeals court also said that the State presented sufficient evidence including cellphone location data of the Moorer’s whereabouts on the morning of Dec. 18, 2013, surveillance video showing what appeared to be the Moorer’s truck going to and from Peachtree Landing, and also video showing the Moorer’s cleaning out their truck and burning rags two days after Elvis’ disappearance.

    Tammy and Sidney Moorer’s defense teams also argued that Grant Fredericks should not have been used as a forensic video analyst expert.

    Fredericks testified that the headlight pattern and characteristics of the truck seen on surveillance video going to and from Peachtree Landing led him to conclude that it was the Moorer’s truck.

    The defense argued that Fredericks’ report and analysis on headlight patterns was unreliable.

    In Tammy Moorer’s appeal, her team also argued that the trial court allowed the admission of sexually-explicit text messages during her trial which were “unduly prejudicial” and improper character evidence.

    The state argued that the messages and phone data showed that Tammy Moorer had control of Sidney Moorer’s phone and also showed a motive in the case.
