    Cherish Lily Perrywinkle- 8 year old murdered by registered sex offender

    he body of 8-year-old Cherish Lily Perrywinkle was discovered near a church in Jacksonville, Fla. around 10 a.m. Saturday, Jacksonville.com reported.

    UPDATE: Initial reports suggested that Cherish Perrywinkle's mother allowed her daughter to go to McDonald's with Donald James Smith. The mother has now told Action News Jax that she did not realize Smith left with the girl.

    Perrywinkle was abducted from a Walmart in Jacksonville at around 11 p.m. Friday.

    Donald James Smith, a registered sex offender, has been arrested and charged with murder, according to Action News Jax.

    Police have not commented on the cause of Perrywinkle's death.

    The girl's mother, Rayne Perrywinkle, told Action News Jax that she and her daughter met Smith Friday evening at a dollar store. Her two other children, ages 4 and 5, were also with her, according to Jacksonville.com.

    Smith overheard the mother saying she couldn't afford to buy her daughter a dress, and offered to help her out. She says Smith told her his wife had a Walmart gift card, and could meet them at Walmart and use the card to buy items for the family.

    They headed to the Walmart in Smith's van. Once there, Perrywinkle says Smith kept insisting they were waiting for his wife. At one point, he said he was heading to the store's McDonald's. The mother says she did not realize her daughter was going with him.

    "He asked if I wanted anything and I heard Cherish say 'cheeseburger.' I thought she stayed near me. I didn't realize she went with him. I didn't let her go with him like people think," the mother told the station.

    She also noted that at first she thought the man was "creepy and annoying," but he seemed like he truly wanted to help her. "Part of me wanted to believe this was a blessing for my children," she said.

    Smith, 56, was previously convicted of attempted kidnapping and lewd and lascivious assault on children. Police tracked down Smith's van driving on I-95 in Jacksonville at around 9 a.m. Saturday. They have not said whether or not Smith led them to the girl's body.

    Rayne Perrywinkle's two younger children were unharmed and remain in her custody.

    Jacksonville, Florida, police found the body of a missing 8-year-old girl on Saturday, a day after she was abducted from a Walmart.

    Authorities say Charish Lilly Perriwinkle and her mother met Donald James Smith, a registered sex offender, at a store on Friday, where he offered to take them to Walmart to buy clothes.

    While at Walmart, Smith offered to take the girl to get food but instead they left in his van, according to police. The girl's mother notified authorities that her daughter was missing and an Amber Alert was issued.

    Police stopped Smith on Saturday and detained him without incident. Authorities said they followed a lead that led them to Perriwinkle's body near a church.

    Smith, 56, was taken into custody and held without bond Saturday night. He faces kidnapping and murder charges.

    According to records from the Duval County Clerk of Courts, Smith's most recent conviction occurred last year on charges from 2009 for unlawful impersonation of a public employee and aggravated child abuse by willful torture. He was sentenced to a year in county jail. He was just released on May 31.

    Donald James Smith, Charged In Cherish Perrywinkle's Kidnapping, Murder, Has Long Criminal History



    The Florida man accused of kidnapping and murdering an 8-year-old has a criminal history of child abuse that goes back decades.

    Donald James Smith, 56, allegedly abducted Cherish Perrywinkle from a Jacksonville Walmart Friday night. The girl's body was found the next day in a wooded area in the same city.

    In 2009, Smith was convicted of attempting to take another young girl. On Sunday, Stephanie Thornton told Action News JAX about the incident, in which he tried to kidnap her own daughter.

    Smith called the girl's grandmother, pretending to be a Department of Children and Families employee. He claimed that the 9-year-old had been raped and that he needed to meet her at McDonald's "to pick her up to take her to be checked," Thornton told the station.

    Suspecting he was a fake, Thornton contacted police and Smith was arrested. In 2012, he pleaded guilty to attempted impersonation of a public employee and attempted child abuse. He was released from jail on May 31, just 21 days before he allegedly kidnapped Perrywinkle.

    The morning of the day Perrywinkle vanished, Jacksonville deputies conducted a monthly address check at Smith's home, as is required for registered sex offenders, News 13 reported.

    Thornton did not know Smith had been released, and is incensed that he had the opportunity to harm another child.

    "He needs to be electrocuted. He should never be able to get back out, never," she told Action News JAX.

    The 2009 incident was not the first time Smith broke the law. Smith has been a registered sex offender since 1993, when he tried to lure three young girls into his pornography-filled van, Fox 30 WAWS reported. He spent five years in prison on an attempted kidnapping conviction.

    Before that, Smith was convicted in 1977 for lewd and lascivious behavior on a child under 16.

    Smith is currently being held without bail for Cherish Perrywinkle's abduction and murder. He allegedly befriended Perrywinkle's mother, Rayne Perrywinkle, Friday evening when she had trouble affording a new dress for Cherish at a Dollar General store.

    The mother and her three children, including Cherish, went with Smith to the Jacksonville Walmart, where he said he would buy the family food and clothing. After spending a couple of hours at Walmart, Smith disappeared with Cherish. Her mother called police after realizing her daughter was missing.

    Smith pleaded not guilty on Sunday. His next court date is July 16.

    It's because you're male. I found a missing child at an aquarium once. I picked him up and carried him to security. I was a nanny and my male boss at the time commented that he'd never have been able to do that without being a suspect at that point.

    Sisters of Cherish Perrywinkle removed from mother's home

    (July 10, 2013) Less than a month after 8-year-old Cherish Perrywinkle was abducted and slain, the state removed her two younger sisters from their mother's care.

    Spokesman John Harrell of the Department of Children and Families could not discuss details of the case involving 5-year-old Destiny and 4-year-old Nevaeh, but he said in these cases the first concern is the safety of the children.

    "It is not about punishing the parent," he said.

    He said the department provides help to parents like Rayne Perrywinkle.

    "In cases like these, we would work to get the parents and the children reunited when it is safe to do so," he said.

    The department's assistance focuses on the concerns that led to the decision to remove children from each home.

    Cherish Perrywinkle was found dead after she was abducted from a Jacksonville Walmart on June 21.

    Donald James Smith, a 56-year-old sex offender, was arrested and charged with first-degree murder, kidnapping and sexual battery. Cherish died of strangulation, according to the indictment.

    Smith was with Perrywinkle and her three daughters at the Walmart. While shopping, he offered to buy food at the McDonald's in the front of the store. He took Cherish with him. Perrywinkle said that was the last time she saw her daughter.

    Perrywinkle had shared custody with Cherish's father, Billy Jarreau, who lives in San Diego. The arrangement granted by the court in 2010 gave Perrywinkle primary custody during a custody dispute.

    The younger sisters' father is Aharon Pearson, who was living with Perrywinkle at least until the Wednesday after Cherish died. He was not at the viewing or the funeral.

    Robert H. Wood, the custody evaluator in that case, had called it "the hardest case I have had to date." He ultimately said Cherish's father should have primary custody because "I fear for the child?s future living with Ms. Perrywinkle."

    Two weeks ago, Wood said he was saddened when he heard the news about Cherish, but he wasn't completely surprised.

    "People are going to say, 'How come nobody saw this?'" he said. "The answer is: Some people did."

    Donald James Smith pleads not guilty in death of Cherish Perrywinkle

    (July 16, 2013) Donald James Smith pleaded not guilty Tuesday morning in the kidnapping, sexual battery and slaying of 8-year-old Cherish Perrywinkle.

    Smith, 56, appeared for less than five minutes for his arraignment before Circuit Judge Mallory Cooper. He said nothing as his public defender entered the not guilty plea.

    The first pre-trial hearing will be Sept. 4. He is being held without bail.

    Smith is accused of kidnapping Cherish from a North Jacksonville Walmart and dumping her body near a church. He was arrested driving a white van about 10 hours later.

    DCF to review criteria for sexually violent offenders program after Cherish Perrywinkle death

    (July 19, 2013) The Florida Department of Children and Families will review its criteria for which sex offenders should be held in civil commitment, almost a month after a Jacksonville man was charged with the kidnapping and murder of 8-year-old Cherish Perrywinkle.

    Dan Montaldi, administrator of the state's sexually violent predator program, said procedures are reviewed when it is learned that someone evaluated in the program has been re-arrested. Donald James Smith's arrest on June 22 was a high-profile example, he said, and studies published in the last year have also raised questions about the effectiveness of the psychological assessment tool used in evaluating offenders for continued confinement as they are scheduled to be released from prison.

    "It's important for us to look at all our programs to make sure we're keeping everyone safe, particularly children in our state," Montaldi said.

    The department will convene a team of experts to review the tools it uses to determine whether a sex offender leaving prison should be held under the Sexually Violent Predator Program, better known as the Jimmy Ryce Act, DCF press secretary Whitney Ray said in a statement.

    Professional journals have discussed the evaluation tools used by the state to decide whether a person with a criminal history of sexual offenses is likely to be dangerous, according to the statement. The review team will deliver findings on the Static-99R tool by Sept. 23.

    Montaldi said the evaluation tool is just one part of a comprehensive review, and different studies have found varied recidivism rates in cases where the predictive tool was used.

    REFUSED TREATMENT

    Records provided to the Times-Union Friday show that Smith declined treatment several times before he was released from prison ? apparently even during his time in the Florida Civil Commitment Center in Arcadia.

    Smith's first evaluation under the Jimmy Ryce Act stemmed from 1992, when police said Smith tried to lure a 13-year-old girl into his van in Jacksonville. He chased her into a park, and later that day showed pornography to children. He served almost five years before getting paroled in 1997, but returned to prison on a parole violation.

    He was held in civil commitment for three years. Clinical records were not released due to medical privacy laws, but Smith refused to attend a meeting or sign a consent form to receive treatment at the commitment center two weeks before prosecutors dropped the civil case in 2002. He was never taken to trial. The court ordered him to seek his own treatment.

    Cherish Perrywinkle's older sister reacts to custody loss

    (July 11, 2013) JACKSONVILLE, Fla.-- Now 26 years old, Lindsay Hoy hasn't seen her mother Rayne Perrywinkle, since she was 5. She hasn't spoken to her in more than a decade, when Rayne, then Kimberly, left her home in Australia for the U.S., then changed her name.

    "I just haven't had a relationship with her since," she said

    Through a Skype audio interview from Australia, Hoy told Action News' Noel McLaren she's devastated over the kidnapping and tragic death of her little sister, Cherish Perrywinkle.

    "I just burst into tears, I thought I'm not going to ever see my sister again or ever. I never met her before in my life and I'll never get that chance. It's been taken from me. It's horrible," she said.

    Hoy says she now fears the worst for her two remaining siblings. Rayne's daughters are now in the custody of the Department of Children and Families.

    She says her family in Australia plans to seek permanent custody, and that they weren't shocked when they found out the two little girls were taken away.

    "I knew it was going to happen and I think we all prepared ourselves for it," said Hoy.

    "We just want the best for those little girls and we want them to be safe and even though they don't know us we love them and we care about them," said Cathy Hoy, Cherish Perrywinkle's aunt and Rayne's sister.

    The Hoy family in Australia says they want to make arrangements to come to the U.S. and meet Cherish's sisters.

    I kinda guessed maybe there were some mental issues. There is no way I would let a strange man talk to my kids much less then take them off. I once was in Wal-Mart and this lady walks off looking at clothes in another department and just leaves this baby sitting in a buggy. I sat there and timed her. After 10 minutes I wheeled the buggy over to the booth where there was a worker checks you in to try on clothes and we started watching the clock together. 10 minutes later this lady comes up to the counter with a bunch of clothes to try on and didn't even acknowledge that I moved her baby. I finally say, HELLO!!! Are ya missin' sumthin'? She goes oh! Then looks at Wal-mart lady and points at the basket with the baby in it and says, "Can I leave that there while I try these on?" Me and the worker just kinda looked at each other in shock. My son is 11 and if we are shopping and he gets out of my sight I get panicked. Losing one of my children is my deepest fear out of anything.
