Wow. I don't think the brother did it.
Uugh so Dad probably isn?t very bright, & was convinced by the police that his son did it, so he tried to get the truth out of his kid...very sad, my son is 12, I would never doubt him in a situation like this

I missed the update about his overturned conviction & started to have some hope there'd be answers in this case when I saw it just now.

Then I looked for updates & nope, kid's still fucked.

Last time I posted I forgot to mention this, but that knife found in the home that police said was used by Isaiah - the forensic pathologist ruled it out as the murder weapon as soon as it was shown to him.

The bent knife from the home that supposedly had a small amount of her blood under the handle is a serrated knife.

The pathologist said she was definitely murdered with a straight bladed knife.

So was the real murder weapon ever located?

Because if not, that's yet another thing this kid supposedly successfully concealed within an incredibly short period of time - on top of disposing of bloodied clothes, washing himself up, cleaning the bathroom (& then presumably getting rid of bloodied water in the shower/sink/drains + bloodied towels so no-one realised he'd washed up) & then having the foresight to redirty his bare feet so it looked like he hadn't showered at all.

& keep in mind that he called for help so soon after the attack that even with all those stab wounds, emergency services still tried to save her when they arrived. He really didn't have time to do anything between the stabbing & the arrival of police & paramedics - yet he's supposed to have cleaned up & hidden multiple items, including showering & completely drying himself. All those stab wounds too, yet at 12 yrs of age he also supposedly did a better job of handling a wet, slippery knife than most adult killers - no cuts to his hands either.

This case is going to bother me for years because there's a possibility that not only has Leila never received justice, but her brother hasn't either. If that is the case he's become a secondary victim of the same crime.

Change in law could extend Fowler's sentence

Isiah Fowler judged guilty in sister?s death

By Crystal Carson Jun 27, 2018

Isiah Fowler has been found guilty in his retrial for the murder of his sister, Leila Fowler, in 2013.

The third and final day of the retrial commenced Wednesday at the Calaveras County Superior Court with Judge Susan Harlan presiding.

Mark Reichel was present as Fowler?s defense attorney. Assistant District Attorney Dana Pfeil and District Attorney Barbara Yook were present for the prosecution.

The day began with Crystal and Barney Fowler being recalled to the stand as witnesses. District Attorney Investigator Michael Whitney was called to the stand to testify about the pictures he had taken of the previous Fowler residence a week prior.

Closing statements were given by both the prosecution and defense teams before the court took a recess for lunch.

After the lunch recess, Yook spoke for the prosecution and rebutted line-by-line each of the defense team?s statements.

After closing statements concluded, Harlan confirmed that the court had read all four volumes of the transcripts and previous testimony from the first trial that were approved to be submitted in the retrial. Harlan found Isiah Fowler, 17, guilty of both allegations: 1) second-degree murder and, 2) use of a knife.

    Edit :

There's a few articles & details in this thread that we missed - like apparently they claimed luminol reacted in the bathroom & this proved he attempted to clean up the scene - even though he didn't have time to shower, clean up the bathroom & dispose of bloody clothing & towels so successfully that they still haven't ever been located. Plus luminol is widely known to react with cleaning products like bleach so it didn't mean shit to begin with

Bit more info on the evidence presented at the retrial. Paramedics testified her skin was warm to the touch when they arrived. Which surely further indicates he didn't have to do all the staging, showering & cleaning up the prosecution alleged he did

Isiah Fowler retrial: sister?s death scene recounted by defense witnesses

Family photo / Crystal Fowler This photo from Christmas 2012 shows Isiah Fowler, age 12, his stepbrother Gabriel, age 11, Isiah's sister Leila, age 8, and his half-brother Christopher, age 4, about four months before Leila Fowler was found fatally stabbed more than 20 times at the Fowler home in Valley Springs. 7564655

Barney Fowler testified Friday about the day more than five years ago when was holding his 8-year-old daughter Leila in his arms, he could see wounds on her chest, he lifted her shirt up, and he saw blood seeping out of her chest.

He leaned over to give her a kiss but he wasn?t sure at that moment if she was alive or dead, Fowler said on the witness stand in San Andreas. It was the second day in Calaveras County Superior Court for the retrial of his son, Isiah Fowler, who is accused of fatally stabbing Leila at their Valley Springs home in April 2013.

?One of her arms dangled down and I had to pull it back up,? Barney Fowler said. ?She felt light. It was adrenaline.?

Evidence would later show Leila Fowler was stabbed more than 20 times. She was taken by ambulance to Mark Twain Hospital in San Andreas, where she was pronounced dead.

Isiah was 12 when the murder of his sister occurred. He and Leila were home alone while their parents and siblings were at a ballfield nearby. He?s maintained ever since that he was in a hallway bathroom when he heard a ruckus from his sister?s bedroom, cracked the door, and saw an intruder striking Leila before the 6-foot-tall man with a muscular build and shoulder-length gray hair ran out a back door.

?He yelled ?He?s hitting her!?? Isiah?s stepmother, Crystal Fowler, testified Friday, recounting one of the cell phone calls she received from Isiah on the day Leila was killed.

?His voice was shaky and broken,? Crystal Fowler said from the witness stand. ?He was crying. I yelled to Barney ?We have to go!? We were speeding driving home. Isiah was talking to the 911 operator. He was still trembling.?

No one ever found that 6-foot-tall muscular intruder with gray hair. Isiah?s been held in secure juvenile facilities since his arrest by the Calaveras County Sheriff?s Office in May 2013. His second-degree murder conviction was overturned by three appeals court judges in February this year.

Isiah Fowler, now 17, appeared Friday in San Andreas before Judge Susan C. Harlan. He came into court in a blue short-sleeved shirt, dark pants and white shoes, with his hair in a ponytail, escorted by an officer wearing a black vest with the yellow words ?Probation? on the front and back. He sat between his defense attorney and a defense investigator, with his back to family members and supporters who sat directly behind him in the courtroom.

Dana Pfeil, the prosecutor, Mark Reichel, the defense attorney, have submitted most of the testimony from Isiah?s first trial to Harlan.

Pfeil, flanked throughout proceedings Friday and Wednesday earlier this week by District Attorney Barbara Yook, has not publicly brought out a motive for why young Isiah would suddenly kill his younger sister.

There was speculation Friday among the defense team that prosecutors may focus on a broken picture frame found on the floor in the Fowler home as evidence of a dispute between Isiah and Leila on the day of the murder. Yook said Wednesday Pfeil cannot comment on a pending case.

On Friday, Reichel called three witnesses: a paramedic, Crystal Fowler and Barney Fowler.

The paramedic, Aaron J. Adams, testified he is employed by Cal Fire in Belmont. Back in April 2013, he was employed by American Legion Ambulance as a paramedic intern and stationed off Mountain Ranch Road when he and a partner were called to the Fowler home in Valley Springs.

According to a three-page patient care report, Adams and his partner arrived at the crime scene to find Leila on the front porch of the house with multiple stab wounds and cardiopulmonary resuscitation in progress by fire personnel. A deputy said he had carried Leila outside to start CPR before firefighters arrived.

Adams testified he had to initiate advanced life support steps while CPR efforts continued on Leila, including an intraosseous infusion injection needle into her right leg below the knee.

Touching, grabbing and gripping Leila?s extremities as he tried to help save her life, Adams said Leila?s skin was warm to the touch but he did not believe her life could be saved. At 8 years old, she likely had a total blood volume of 2.5 liters and it appeared she had already lost too much blood to survive.

?I had the opinion this would not be a viable save,? Adams said. ?I did not think I?d be able to bring her back. . . . Any child does not have much blood volume, not like an adult.?

Adams and his partner rushed Leila to Mark Twain Hospital minutes later.

Crystal Fowler testified Isiah was holding a phone in one hand and a bat in the other when she and Barney Fowler arrived in a frantic rush at their home, responding to Isiah?s earlier call about an intruder in the home hurting Leila.

?Isiah was shaking in his body,? Crystal Fowler said. ?He was sobbing and shaking. He was terrified. He looked like he didn?t understand what we were saying. I?d never seen him like that.?

Barney Fowler was yelling and Crystal Fowler said she had an arm on Isiah in comfort, she hugged him several times, and she didn?t notice any blood on Isiah?s hands or arms, or the phone that he used to speak to the 911 operator.

Crystal Fowler said she went to get Leila?s favorite teddy bear so she would have it at the hospital. She went toward Leila?s room and saw blood on a bed and turned around and walked out.

Later, Crystal Fowler said she had blood on her hands from touching Barney Fowler, who had blood on himself from carrying Leila.

?We arrived at the hospital, told them our daughter had come in an ambulance,? Crystal Fowler said, her voice cracking. ?They sent us to a triage area and a doctor and two nurses told us she didn?t make it.?

Crystal Fowler said she and Barney Fowler and other family members see Isiah every week at the California Youth Authority facility where he is held. Before Isiah?s conviction in October 2015 they visited him twice a week at an El Dorado juvenile facility.

Over time, Crystal Fowler said, she and other family members never saw or felt any indication Isiah killed his sister.

?We?ve asked him,? Crystal Fowler said. ?We?ve asked him what he remembers.?

Later outside the courtroom, when Friday?s proceedings were finished, Barney Fowler said he believes Isiah is innocent.

?If my son did it, prove it,? Barney Fowler said. ?What I want is clarity.?

All the Fowler family wants is the truth, Crystal Fowler said outside the courthouse on Government Center Drive.

?If you took our 12-year-old son and you believe he?s guilty, prove it because we don?t believe it,? Crystal Fowler said. ?The proof is not there.?

Barney Fowler said as he and Crystal walked away, ?There?s too many holes in their story.?

The retrial of Isiah Fowler resumes Wednesday in San Andreas.

SAN ANDREAS — Teenager Isiah Fowler’s year began with a successful appeal overturning his initial conviction for the gruesome killing in 2013 of his sister, Leila, when he was 12 and she was 8.

But the news has worsened ever since.

One month ago, Judge Susan Harlan, presiding over Fowler’s retrial, reached the same conclusion of guilt as Judge Thomas Smith, who oversaw Fowler’s first trial.

Tuesday, at a sentencing hearing, Fowler’s situation became even more complicated.

At the time of Fowler’s first conviction as a minor being tried as an adult, state law required he be released on his 23rd birthday. But on July 1 the law changed, and Fowler now faces the prospect of being incarcerated until he is 25.

“He’d have been better off if we’d never done (the appeal),” his stepmother, Crystal Fowler, said following Tuesday’s hearing.

For his part, defense attorney Mark Reichel said he plans to file a second appeal on Isiah Fowler’s behalf.

But first, Fowler will return to court one more time, on Aug. 2, when Reichel and Calaveras County prosecutor Dana Pfeil will argue before the judge whether Fowler should be released at 23 or at 25.

Harlan found Fowler guilty on June 27, just before the new law took effect. Tuesday afternoon, Humphreys University Law School Dean Patrick Piggott said Fowler’s release should be based on the law as it stood before July 1.

“The day he’s found guilty should be the guideline,” Piggott said. “The day he was found guilty, the punishment for that crime is the punishment in effect that day.”

Isiah Fowler was 12 years old when he allegedly stabbed Leila more than 20 times on April 27, 2013, while the rest of the family was away from their Valley Springs home. He has always maintained his sister was killed by an unknown intruder.

Family members hold fast to the fact that Isiah Fowler never admitted to the crime, even when he stood to benefit from confessing to killing Leila.

“They offered him a plea deal and he refused it,” Crystal Fowler said.

Barney Fowler, Isiah’s father, said, “He refuses to admit to it because he didn’t do it.”

In the courtroom Tuesday, the judge directly addressed Isiah Fowler.

“The big question for the court is, ‘Who is Isiah Fowler?’ ” Harlan asked. ” ‘Who is he?’ You’re going to get some time to think about that and I hope you do.

“It takes courage to face the bad in life before goodness can flow through. Isiah is a beautiful name. You have the ability to make a beautiful life and I hope you do.”

Harlan reiterated her certainty that Fowler is guilty.

“There’s no doubt you took the life of your sister,” Harlan said. “You did so viciously and used thought and planning. The victim was 8 years old and would have expected her big brother to protect her and not take her life.”

Whether Fowler is released at 23 or 25, Harlan technically sentenced him to 16 years to life in prison, with the early release allowed because of his age at the time of the crime. Fowler already is credited with 1,900 days served. His first appeal succeeded because the court determined that certain statements should not have been admitted in the first trial.

Reichel said in the second appeal he will seek the help of the Innocence Project, a nonprofit legal organization that works to exonerate wrongfully convicted people through the use of DNA testing. The attorney said “insufficiency of the evidence” will be a major factor in the second appeal.
