    You all know, doncha, that late today, Wednesday, Jan. 14, 2015, Judge Stephens dismissed all of the defense motions to dismiss the charges against Arias or, at the least, take the death penalty 'off the table.' The allegations of Prosecutorial Misconduct regarding the porno on the computer, etc., etc., didn't fly. No matter! The stinking red herring has been dragged through this courtroom and will be even more pungent when it appears in other courtrooms throughout the years of the appeal process. Nurmi and Wilmott made their 'record.' This phase is expected to continue through February. Will Jodi re-take the stand and submit to open cross-examination from the Prosecutor on her 'secret' testimony? If her previous reasoning holds true, she won't. She says she can't tell her story to the Jury if people who wish her harm are able to see or hear. Well, I don't think the people of the State of Arizona in the form of the Prosecutor wish her well! Just the opposite! He's the guy who wants to see her finished off for what she did on June 4, 2008. To quote, "stabbed, shot and butchered Mr. Alexander!" And he's not just some anonymous weirdo! Time to get back to basics!!

    Angie! I think Animosity was reacting to the previous post from the newcomer SherryZ who was recommending the subscription blog recently started by Beth Karas, called "Karas On Crime." We all know Beth Karas from her previous role as a trial commentator and legal analyst on HLN. That job recently disappeared. Coincidentally, I exchanged a few words with Karas outside the Maricopa County Courthouse on Monday and she told me she had started up this new venture. I think it costs $5.99 per month to access. Would I do it? Probably not. Karas is a smart and knowledgeable woman who has the legal background to explain the more intricate stuff that takes place during a trial. She's a great mechanic who understands how the machine works, but not so great at communicating the thrill of the ride. Wish her well. She does have a following. I don't have any opinion on whether SherryZ was shilling for Beth or being genuinely sincere. It was her first post to this forum.

    Was in Court today--all day! (Jan. 20, 2015). The only witness was Dr. Robert Geffner. He's the guy the defense called in at the end of the Guilt Phase trial to try to counter the testimony of Dr. Janine DeMarte. He also testified at the beginning of this Penalty phase but his testimony was suspended for the 'secret witness' testimony. Today, he continued and took up where he left off. He's still on Direct Examination being conducted by the supremely irritating Jennifer Wilmott. However, she did tone it down a bit today. Martinez has not yet had a crack at the good Doctor. Cross-examination will be an event. It should start tomorrow afternoon.

    I listened carefully. There was a lot to listen for. When I got back home, I checked some news reports on what transpired. It would be an exaggeration to say that the media types must have been in a different courtroom than myself. Leave it at this. They missed a lot or else they chose to ignore it.

    There were exactly eight people in the public gallery; four regulars and four others including me. In addition, Mrs. Arias and two other ladies, family or friends, were there. Their mood was anything but sombre. Some levity during endless 'Bench Conferences!' (So my daughter murdered somebody? Life goes on.) Not so on the Alexander family side. Interest in their tragedy is definitely waning: and it shows in that room.

    If anyone wants to hear my views on what the testimony of Dr. Geffner was all about, let me know. It's gonna take some work that's not worth doing if people have all gone somewhere else. We miss Bermstalker.

    I'm not playing at being coy, friends. I was just tired. It was a mind-numbing day as Dr. Geffner's testimony droned on and on in response to Wilmott's urging, but there were some significant strategy moves by the defense. The powerful operative words were, "manipulation, domestic abuse, (even though Travis and Jodi were never in a domestic relationship) rape, make babies--and others I've forgotten.

    This time Geffner came prepared. He and his staff were commissioned by the defense to prepare a chronologically sequenced spread-sheet, or flow-chart, going back to the first contact between Alexander and Arias right up to the end. It also included notations about contact Travis had with other women during that period and even seven years before. The source information was the Journals Jodi kept, her subsequent allegations, (kiddie-porn) text messages, instant chats, etc., and statements made in affidavits gathered from some of those 'reluctant' witnesses who have refused to testify in court. Wilmott led Geffner through it all as though she was asking him to describe scenes from the movie of Travis's life as a sexually obsessed deviant and master manipulator of women and deceiver of his friends and associates. All of this was done with the disclaimer that they were trying to slander Alexander. They were just 'laying out the materials' in an organized fashion to detect the 'Pattern' of behavior over time that supports their contention that it conformed to abusive relationships. In brief, 'Travis was an abuser who wouldn't let Jodi go and Jodi was a gullible victim whose history of parental abuse and her own emotions rendered her susceptible to Travis's 'manipulation' and made it impossible for her to just stay in Yreka after she left Mesa in April 2008. Geffner contrasted Jodi to Chatayana Lee and Travis's 19-year old former girlfriend, Lisa Andrews. Geffner said that they were strong women who, when Travis tried to manipulate them, told him to 'just stop.' Jodi had to use a knife and a gun to sever the cord because Travis's hold on her was so strong!! Make sense??

    For example. At one point, (I think it was March, 2008 around 1 a.m.) Travis was online, carrying on simultaneous text messages with three women. All of them were loaded with sexual banter. One of them was Chatayana Lee (?) who he knew and two others he had only met online. A woman in Sweden was somewhere in the mix. Statements like, "do you want me to rape you, (or you me), do you wanna make babies? My head between your legs; I'm a virgin," were threaded through the exchanges as Travis switched from one woman to the other. Of course, none of them knew that he was talking to anyone else. Somewhere at the end of this hour of 'play' Jodi came online and thanked Travis for something he had done for her that day. Geffner concluded that this event was part of a pattern common to manipulators and Travis was a Master. There was lots more all laid out in columns in chronological order with the related 'incidents' connected by lines and highlighted by arrows. The biggest arrow was reserved for the 'incident' Jodi reported of catching Travis masturbating to pictures of young boys.

    Next, we had statements from affidavits of the reluctant witnesses. The affidavits were gathered by the Mitigation Specialist, De La Rosa, and the witnesses were identified by number only. There was lots of irrelevant stuff in them, so before Geffner was allowed to testify about anything in the Affidavits, Martinez went through them pointing out what was inadmissable, (vouching,etc.). After a long, long bench conference where parts of the affidavits were redacted, the Judge printed up the edited copies and they flashed on the screen. Apparently, Geffner had spoken to some of the people. At this point, we have learned of three. Defense claims there are fourteen. One person stated he did not want to get involved in this matter because he did not want to risk the possible consequences of a public reaction. Nurmi rose to press his allegation that this proves his claim that a full mitigation case can't be presented for Jodi. It also proved that reluctant witnesses' testimony could be presented through another witnesses like Geffner. Nurmi just won't let that go.

    Another affidavit went back to an incident that the witness observed back in 2001. He swore that he and his wife visited friends in January 2001, and when they entered the residence, they saw Travis pinning his girlfriend Deanna Reid on the couch with his knee on her stomach, both her wrists in his hands. Travis was saying, (not sure of the exact words), "Get over it! There is no fucking way I am going to marry you." Witness than said that Travis left and witness's wife applied cool cloths to Deanna's wrists. The only problem was that Deanna Reid was away on a mission in January, 2001. Witness backed off the date and said it may have been later in the year, November or December, 2001, a few days after Deanna returned, but he remembers the incident clearly and stuck to his story.

    The last of the day was an affidavit about an incident going way, way, back. Apparently, there was a time when a Mormon Bishop offered up a computer in his home as a community resource. Travis was one of the persons who had access. This witness swore that when he went onto the computer at one point, child-porn popped up. He claims it was identified as belonging to Travis's files. He also claims it was infected with a virus causing the computer to crash and requiring service to get it back into working order. Witness further claimed that when he spoke to Travis about, Travis offered up an explanation that he had been "molested" by an older adolescent when he was a young boy. (The Press report that I read used the word "abused" but I'm certain that the word read by Geffner was "molested."

    Wilmott asked Geffner if the purpose of the testimony was to diagnose or harm Travis Alexander. "Of course not," Geffner responds. "We, (my staff and I who worked on this), are just looking for Patterns."

    Ingenuous? You decide.

    I haven't read the book "Fifty Shades of Grey." But, compared to that and from what I heard and saw yesterday, a book about Travis's sex life would be titled, "Fifty Shades of Beige." For a "Player," as Beth Karas described him, Travis wasn't having much success when always available Jodi wasn't around. All he seems to have had in those wee hours of the morning was his computer, the ladies on the other end of the chat line and his imagination. Despite his potty mouth, it was all tickle and no *****. (Did I just stray into the area of porno?) Sorry!

    Let's see what the Prosecutor does today. Cheers all! I'm not going to edit this right now. There's too much.

    Other little autobiographical details about Travis that were read into evidence yesterday by Dr. Gefner was a part of the naughty online conversations Travis was simultaneously juggling with the three ladies. Here's a quote as I remember it. "I've read the book of Mormon twenty-seven times; I've spoken in front of twenty-thousand people; I've been in seven vehicle wrecks; I've been trapped underwater for three minutes; and, I'm the only male member of my family who has never been in jail."

    Now! How this adds to the double theme of the day--manipulation and abuse--escapes me and I can't imagine what message it's going to get through to the Jury. For a locally admired motivational speaker, it didn't have much of an effect on the ladies he was talking to. He didn't succesfully manipulate anybody. They didn't rush right over. He seems to have spent the rest of the night night in his "more comfortable 4,000 sq. ft. home" alone. (yes he promoted the size of his home too.)None of the ladies were moved enough to drive over to 'cuddle' with him. I don't know if the woman in Sweden was part of this exchange/event and I don't know why the Jury or anybody else for that matter, had to hear about it from the witness box.

    Well, this was a pleasant surprise. We're in the middle of a blizzard here in Bailey, CO, so I plopped down in front of the fire and the dog,opened up MDS, and what should I be greeted by but your presentation of Spike Jones! Way long ago, when I was a child, my Gramps was a huge Spikes Jones fan and (along with John Philips Sousa marches), my first memories of phonograph music was Spike Jones. So, until I refined my taste (but only a little!), my reality bore the musical accompaniment of roughly the last half of the above and "Cocktails for Two." I think it explains a lot.

    P.S.: Much appreciation for your explanations of wtf is going on in AZ and also for your cogent comments. There's little sense to be made of what's going on, but you make the most of it!

    Here goes. It's gonna be a quickie.

    I went back to Trial today. Court start was delayed to 12:45 on account of scheduling problems. It ran to 5 p.m. Lots of things happened.

    Dr. Geffner continued on the witness stand under Willmott's direct examination and went on and on about how he and his staff gathered the results of all the tests that had been done on Jodi since 2010, all the historic details, (text messages, phone calls, Jodi's assertions, her observed behavior over time, the witness affidavits, etc.) and applied their summary retroactively to their time-line of events I spoke about yesterday. Geffner came up with a retroactive diagnosis of Arias psychological condition at the time the events took place. Blessedly, by three o'clock, Wilmott was ready to ask her final questions. The answers were, (I can't be bothered typing the obvious questions put by Willmott.)

    1. Yes. Jodi suffers and has suffered from Traumatic Stress Disorder since her adolesence.

    2. Jodi was a victim of domestic abuse, (at the hands of Travis).

    3. Jodi is probably bi-polar but that diagnosis must be made by a Psychiatrist. Geffen is not qualified to do the required bio-medical testing.

    Then the Prosecutor got up to carry-out his cross-examination of Psychologist Dr. Geffner. It was electric from the start. Martinez made it immediatelhy clear that he was hunting big game and was not going to get lost following the maze of rabbit tracks laid down by Geffner and the Defense team during the previous five days of incomprehensible psychobabble/analysis that had been served up.

    Martinez started with the two affidavits sworn by the unnamed witness, (Witness No. 1). The first affidavit was about the kiddie porn on the community computer in 2001 at Bishop Parker's House that the witness 'found' and blamed Travis for putting there. The second affidavit was the one wherein he swore that he saw Travis assault Deanne Reid in either January or November,2001. (See my previous posts above.)

    The witness, (witness no.1) was the person who swore both affidavits. Travis did not admit to placing or viewing the child porn on the computer as claimed by the witness in his affidavit that came in through Geffner's Direct Testimony elicited by Willmott. In fact, Travis denied doing it when he was subsequently confronted by the Witness in a private conversation in a car parked outside of the house. That fact of Travis denial was communicated to Dr. Geffner and there was a note in Dr. Geffner's files from the witness saying so--in direct contradiction his sworn affidavit--which also included the alleged admission from Travis of being molested as a child. Furthermore, the witness sent a letter to Nurmi and Wilmott on Jan. 17, 2015, stating "I was not honest with the Bishop, (Bishop Parker.)" His reasons are lengthy. The wittness' mail-order bride was staying at the Bishop's house from Dec. 2000 to March 10, 2001--the day of their wedding. Shortly before the wedding day, the witness admitted to visiting his bride-to-be at the house and turning on the computer. He claimed the child-porn just 'popped up' on the screen. Nevertheless he viewed it and looked at it long enough to be able to describe, in detail, in a written statement just what he saw. Five children between the ages of eight and thirteen--two girls, three boys--some of whom were performing oral sex on another! The witness then said that if he had admitted to viewing the child porn to the extent he described (before the computer allegedly 'crashed'), he would not be permitted to marry his bride in the Temple on March 10, 2001. So, he then chose to deceive Bishop Parker. Why he chose to lay it on Travis is not yet revealed. The witness is beyond the reach of subpoenas from the Arizona courts.

    In his second affidavit, the witness swore he saw Travis assaulting Deanna Reid, again during a visit to his bride-to-be at the Bishop's house in January 2001 where she was living between Dec. 2000 and March 10, 2001, that being the day they married. He then changed the date of the visit from January to November or December 2001. By then, of course, he was already married and had set up residence with his new wife away from Bishop Parker's house. His bride was not living at the Bishop's house in November or December 2001 for him to visit. In fact, she was living with him somewhere else as his wife of a few months. Therefore, the revised date he attached to the Travis/Deanna incident story he swore to could not possibly be true. He was pinned to the January 2001 date. It is clear that Deanna Reid was continuously absent on an eighteen-month mission in Costa Rica from June 2000 to November 2001. Deanna wasn't anywhere near California so she couldn't have been at Bishop Parker's house in January 2001, the original date Witness No. 1 cited on his affidavit and the one he is now stuck with. Even if Deanna Reid and Travis were there at the Bishop's house in either November or December 2001, the witness and his by then temple married wife of eight or nine months were not. This all happened in California. It looks suspiciously like this guy was out to get Travis for something that happened way back then and The Defense Mitigation Specialist somehow found him (or he found her) and served him up. There's gonna be fireworks.

    Like I said, Witness No. 1, (Martinez let the name McGee slip out) is apparently beyond the reach of the Arizona Courts just now. The plot thickens. There is serious fuckery (thank you Faq) going on in the Defense Camp. Willmott was up and down like a toilet seat trying to block Martinez' cross examination of Geffner. Judge shot her down.

    There was also an issue raised about Arias's claims to having caught Travis, on his knees, on his bed, masturbating over photos of young boys. It contradicted another statement she gave Geffner's staff about it actually being computer images. That's not finished yet.
