Yeah, it was a fine example of a straw man argument.
The prosecution lied about the computer. Judge Sherry agrees.
I think the conviction is going to be overturned on appeal. Evidence tampering. Martinez disbarred.
http://www.examiner.com/article/jodi...s-center-stage
You might want to read this article before you get too excited. Here's a little tidbit:
Also, the State provided evidence of inproper tweeting my Maria "cougarluscious" De La Rosa. It seems she has been leaking info to Michael Keiffer viia twitter....among other things." An incinerator folder was found in the recycle bin. A folder that could not have existed on the original hard drive BECAUSE IT DID NOT EXIST at that time. Willmott the tool is objecting like her life depends on it. Or somebody?s. Sometimes Judge Stephens however seems to be seeing the light and is NOT THE ONE today. She basically told Jenny to sit the *bleep* down and shut the *bleep* up. Someone actually went into the computer and attempted to delete the incinerator program manually. ON OCTOBER 22 2014 AT 10:16 PM TO BE EXACT."
This trial is such a mess. This could have gone so much smoother with a different judge. I won't even be surprised at this point if JSS over turns her conviction.
I don't think Juan should have pursued the death penalty, even though I know it's what the family wants. It's just dragging out now and creating more opportunities for appeals and I can't even imagine a whole jury giving her death. And I really feel like so much more has come out this time that makes Jodi look more credible (I don't like it but it's true). Not to say she didn't premeditate the murder, I believe juans theory and think it's was proven but it also seems like he went above and beyond to make her look like a liar (which she is and there's lots of solid proof) even with things that perhaps she was truthful about (like the spidies).
The computer porn stuff is just confusing at this point, but it does worry me that it could be in Jodi's favour.
doesn't matter, really - if a dude is totally into teen porn, you can pretty much bet on it that he is not art all into wanking to young boys. if his computer was stocked to the brim with teen porn, i would see that as more proof that jodi is a fucking liar. about everything.
also, if you want to call out every guy who is into teen porn, you are going to spend a whole lot of time writing down names. what are they supposed to look up, 'middle aged housewife porn'?
Read my above link. That computer stuff proven wrong. When Jodi fired her lawyers the last time and went pro se, she requested Travis's computer for examination. She hired neumeister for that task. When doing a forensic examination of a computer, you never work directly on the computer. You first use a write block, so you don't contaminate the contents of the drive. You then make a image of the contents of the drive and it is mounted on a blank hard drive. This is called a clone and that is what they examine. They made 2 images of this drive and eventually gave one to the prosecution. On this image files were found that were not found on the first set of images that the prosecution made. They tried to say that the prosecution manipulated the images they had made and were used for Jodi's first trial. When the prosecution examined the clone from neumeister, a program was found in the recycling bin. This program did not exist during Travis's lifetime. This proves that the original was tampered with. It was also found that someone tried to manually remove this item from the recycling bin and the computer made a time stamp of this action. It was during the time that Neumeister had Travis's computer. Proving that Tampering was done and that it was the defense and not the prosecution. Neumeister then broke the original Travis harddrive making impossible to ever make another copy of the original. I suspect he did this to destroy evidence of his manipulations.
Juan did not take lightly to being accused of misconduct. Those kinds of accusations can ruin a career and overturn convictions. It's a very serious accusation. Neumeister will probably never work in the field of computing ever again. Nurmi and Wilmont could not participate in such misconduct and that is the reason they were fired for that short time. This is something Jodi would have had to initiate. Juan then went after DeLaRosa. She leaked sealed information to the media and illegally recorded a 3 way conversation with Jodi and went beyond the scope of her job (which is not allowed) by being involved with Jodi's finances from her art sales. I expect paypal will be turning over financial records that will have DeLaRosa's name all over it.
It was a huge day in court. Juan is cleared of any wrong doing and the defense has had all sort of misconduct proven on them. JSS told Wilmont to sit down and shut up during the hearing and court watchers said she was angry. There is no way this porn stuff will come before the jury.
I mostly agree with you. There isn't a direct link between pedophilia and guys who jerk off to teen porn. They can be totally unrelated. But hypothetically (although it seems moot cause it seems like the porn is another foiled Jodi plan) say a guy.said things like "you moan like a 12 year old girl" and also preferred porn where the girls look young that those things could be related.
But, I thought he liked little boys in their spiderman undies. He probably could find porn to suit that fantasy if he tried. Instead he is searching for sluts when he should have been searching twinks. The searches don't make sense when you closely. It's like after the murder, she looked at what she did have to fabricate a story. She had a audio of phone sex, that she worked hard at developing each and every nuance to make Travis evil. They lead us to believe he desired little boys by all the anal sex, tossed salads and little boys underwear. That's why Jodi went along with his need for anal, she was saving the little boys of the world. When he is alone with his computer, he searches for females. That's what happens when you lie, things just don't add up.
Does anyone know what Matt the ex does for a living? Is it computer related? I would love to see him implicated in all this
regardless, the link would be between teen porn and young girls, not young boys. pedos tend to prefer one or the other, not both. the appeal of teen porn, i would assume is that a girl is young enough not to have been sullied by tons of dudes, but old enough to have knockers and a defined waist. if his is the case, young boys would not be a turn on because the teen girls actually have womanly features.
My personal favorite "busted" moment was when Martinez called her out on sneaking coded messages in a magazine to a potential witness. The look on Nurmi's face when Juan hands over the magazine is priceless.
She probably won't get the death penalty, even though she deserves it. I think a juror who votes for life based solely on the evidence presented this time around would be devastated once the extent of all this fuckery comes out, assuming they are truly willing to consider the death penalty. Kinda like how the Casey Anthony jurors were traumatized when they had to find her not guilty of murder. The ones who haven't followed her case are just getting a condensed version, none of the subtle crazy, hateful details we heard in the first trial like this one.
12/15/14
Court is back in session.
We have Bob Geffner up for the defense. (Remember, he was the guy that spilled his water the during the first trial) Juan wants notes because he says that last night he received over 100 pages and now he wants interviews because Geffner changed some of his stuff. Then they talk more about the computer hard drive.
Geffner will be on the stand all week. Geffner will probably speak on BP, DV, and PTSD. Geffner is a licensed psychologist and a licensed marriage therapist.
I am not listing all this guy's credentials. He thinks highly of himself. Geffner gets $250 an hour. (There are several people linking other cases on twitter where this guy was discredited)
Willmont- Has an ethics committee ever reprimanded you or cited you?
Geffner- No
Willmot- Has your testimony been criticized?
Geffner- Well by appellate courts I never knew about. This was a child case and we were asked to evaluate the child and mother and the judge wasn't happy with our findings.
Juan- Objects to judge wasn't happy
Geffner then says that the judge called him a "hired gun" in that other case.
10 minute recess. Geffner is getting questioned outside of the jury.Juan says the Court of Appeals didn't take issue with this judge. This judge did end up resigning.
Now Geffner is fixing to testify to all of Jodi's issues. During the first trial he never met Jodi. It's different this time.
Let's talk about the validity scale. Geffner says a person has to know what they are doing to give these test.
MMPI-2- This looks at some body's personality. Jodi only took it once. (This is the one Dr. Demarte gave her in 2011) Jodi reported a lot of symptoms. Trauma. Jodi's chart had a peak at bizarre thoughts. Jodi had body issues. Jodi thought people were out to get her. (he brings up Juan as one example) Jodi had demoralization and depression.
FRS scale (measures some body's fears) Jodi's was just a little above normal. It didn't show that Jodi was obsessed or angry. Jodi showed average for following the law (LOL I guess murder is okay then)
Lunch
Geffner is back up. He says Jodi had elevated partner or relationship distress. She has adjustment stress and PTSD. Geffner had to rule out if Jodi had an addiction problem or addictive behavior because it was a little above the main line on chart. Jodi had a very low result for ego strength, meaning her self esteem was low. Dominance was very low. Hostility was below average
Jodi is showing she's introverted and still has bizarre thoughts showing up on the scales. Geffner says Jodi doesn't act out socially but she feels alienated by others and herself. Jodi has high paranoia.
Schizophrenia Scales- Hers were high on emotions. She has no control on them and feels alienated by herself and others. She's not shy.
Geffner- Scales indicate significant mental issues with Jodi but no definitive answer yet. It requires additional testing. This test he's talking about now shows Jodi was trying to look good on this test but it wasn't anything out of the ordinary. Based on this test it doesn't indicate she has a personality disorder but there are red flags.
Next is the trauma test.
Geffner- Jodi has significant trauma symptoms that are more than incarceration related-her PTSD was elevated.
In 2010 Jodi didn't think her sexual behaviors were dysfunctional but when she retook test in 2011 it was very elevated.
Recess
Geffner wanted to retest Jodi on her symptoms and so he gave her a general timeline to test by. Geffner didn't ask her to go back to 2008 at time of murder -he just wanted a general feel.
Jodi has high levels of suicidal thoughts, intrusive experiences and dissociation. Other symptoms have dropped in levels.
TSI-2 test- Jodi's trauma and PTSD are still there. He says the DSM says Paranoia and Narcissistic.
Willmont asks if these are mental issues? Yes.
Jodi's new test show -anxiety, low energy and suicidal thoughts, and no support system.Jodi tested below average for aggressive behaviors, hostility, physical aggressiveness, verbal aggressiveness. Jodi is a pleaser. Jodi got a suicide specific test and it showed she doesn't feel like that now. It was at time of murder and after arrest.
Court is over for the day.
Jodi Arias update: Court reveals why Arias wanted testimony private
Suuuuure that's the reason she can't show remorse. Suuuure. An appeals court on Tuesday revealed some of the reasons Jodi Arias refused to testify in an open courtroom during the penalty phase of her trial, including purported death threats she is getting in jail.
In an opinion released Tuesday about its decision, the Arizona Court of Appeals said Arias and her lawyers told the judge she was receiving threatening mail and death threats, and an open courtroom would affect her ability to think and answer questions in a manner "she truly means."
The court ordered transcripts of Arias' secret testimony be released, but it's not immediately clear when that would happen. They had earlier overruled the trial judge's surprising and highly unusual move to close the courtroom to the public as a jury decided whether Arias should get the death penalty in the murder of her on-again-off-again lover.
When Judge Sherry Stephens closed the courtroom, it wasn't even clear who the secret witness was; she simply said an unnamed witness would not testify if the proceeding was open to the public. News organizations went to court, and the appeals court agreed.
The opinion said Arias did not feel she would be "able to fully communicate what she wants to say, communicate her remorse and go through all the mitigating factors and get them out there in front of the jury with the public here," her lawyers told the judge.
The judge suggested that the public and press be moved to an overflow room, and Arias objected to that alternative despite the judge expressing concern that she was being manipulative. She objected "because of the pressure that I would feel because of these threats," according to the opinion
Despite her reservations during the penalty phase, Arias has actively courted the spotlight since she was arrested in the death of Travis Alexander in 2008. She did interviews on "48 Hours" and "Inside Edition" after her arrest and was on the witness stand for several weeks during her original trial.
She also did a series of media interviews after the jury convicted her of murder. Alexander was shot and repeatedly stabbed in his Mesa home in June 2008. Arias says it was self-defense after the relationship turned abusive.
The opinion was released as the trial moved ahead Tuesday with testimony from a defense expert.
12/16/14
Court starts in a sidebar. Juan has a piece of paper and all the attorneys went back to discuss it. Trial was moved to 10:30.
Geffner is back on the stand. (He's probably going to spend the day talking about how Jodi had such a terrible childhood. Too bad we can't play the violin while they spin this BS story)
Jodi took a test dealing with trauma. Travis was the most traumatic thing that happened in Jodi's life. Jodi has a lot of aniexty and it goes back to 2008. The poor thing has PTSD. This test was taken 10/2013. Jodi doesn't have clear memories of the murder. It's that damn old fog that rolls in.
Now Geffner is talking about DV. He's trying to explain how parents that whip their children end up making bad kids. Now they show a PowerPoint (oh goody)
Twitter says that jurors are listening very closely and one juror is taking notes.
Geffner says anal sex is interesting. BUT after talking with Jodi about it, it became uncomfortable.
Lunch
(There is some other court stuff that is going on besides this. Juan and Nurmi are still going back and forth over the computer porn. Juan brings up that Nurmi has not supplied the witnesses he was supposed to for Juan to question. The judge tells Nurmi to call them)
New chart is shown in court. It's the Phase one and Phase two of DV. Geffner is now explaining how Travis slowly started to abuse Jodi. (eyeroll) Geffner starts using a stupid example of dogs in cages and how they get shocked over and over but still won't leave the cage when the door is open. He's basically comparing Jodi to a dog.
Geffner brings up how Travis would tell Jodi "it's your fault" for things. Geffner is using Jodi's diary and messages as a point of referrence. Jodi was depressed. Jodi was scared of what would happen if she left Travis. Jodi always was the one that said "I'm sorry" and she knew the fight was over when they had sex. Today Jodi realizes she was dumb and should have just left Travis.
Geffner is explaining how insults can damage somebody. Geffner sees humiliation and Juan objects.
Sidebar
Travis embarrased her in public. He called her a skank and wouldn't hold her hand. Jodi felt guilty because she was such a good christian girl (ha- That really wasn't said, but something about her religion made her feel guilty)
Geffner- Jodi was a monogamous person and before she got involved with Travis she broke it off with Darryl. Travis was cheating on her and it broke her heart when she found out.
Sidebar over text messages
Travis talked sexual with Jodi, but then would talk the same way with other girls. Geffner says this is abusive.
Now on to the child abuse Jodi suffered. There's another chart put up on child abuse. Abused children can be bullies. Geffner and 2 others drs interviewed Jodi. He interviewed Jodi 3 times. He says when he met Jodi he really didn't know that much about the case.
15 minute break
Now the fog is rolling in.
Jodi has flashback and gaps. She doesn't remember much from age 12-14. She remembers a boy attacked her with a knife and she got her period. She spaced out in 4th grade. Jodi was happy until age 7. Dad got sick and wooden spoon (her mom) was abusive. Jodi was hit with a wooden spoon. Dad whipped her and her brother with a belt.
Carl was interviewed in Feb of this year. Carl confirmed Jodi was hit with a wooden spoon. Something happened to Jodi between 12-14, but Jodi doesn't remember. Dad would beat them with a WWF belt. The dad had paddles with the kids name on them. Neither kid could remember being hit by it. (foggy brain) Carl put a note under dad's door that said "if you loved me, you wouldn't spank me"
Geffner says the kids lived in fear. A boy held a knife on Jodi when she was 13. She thought she was going to be raped, but she wasn't. Geffner says Jodi smoked pot, but that it isn't unusual when somebody is depressed.
Sidebar over interview with a family friend named "Faith"
The friend says Jodi was popular and well liked, but she didn't get along with her mom. Jodi kicked a hole in the wall because she was mad at her mom. Geffner doesn't see that as violent because it's a wall and not a person. (hard hard eyeroll)
Jodi always spent more money than she had- to max out to go on trips.
Jury is out of the room. Willmont had to pull Geffner aside to talk to him.
Geffner says he remembers an interview with Lora, and the judge says "Okay, bring the jury back"
Darryl's sister Lora said that Jodi spent more money than she had. She would go overboard on men. Geffner is trying to say that proves Jodi was abused.
Willmott- Because of Jodi's past would she seek a stable relationship?
Geffner- Yes but they don't know how to form a healthy one so they find someone with like experiences
Bobby is bought up (the vampire hunter) and Geffner says that was an abusive relationship all the way around. Geffner "Jodi moved in with Bobby to get away from home" and Juan objects. Geffer says "oh"
Court is finished for the day.
Jen's Trial Diaries @TrialDiariesJ
Carl confronted Bobby to scare him & tell him to stop but Bobby came out of house w/ a sword & tried to attack him so Carl left. #jodiarias
The best detail of the penalty trial so far.
12/17/14
Court starts off with Geffner still on the stand and the defense is up.
They want to talk about Vampire Bobby again. (Remember this all comes from Geffner and what Jodi or Carl told him)
Bobby was abusive to Jodi. Bobby's a big guy and liked martial arts. He put Jodi in a choke hold and twisted her arm.
Carl confronted Bobby to scare him and tell him to stop, but Bobby came out of the house with a sword and tried to attack him so Carl left. (LOL)
People warned Jodi not to go back but she did. Willmont brings out the PowerPoint again.
Eventually Jodi and Vampire break up and now Jodi is with Matt. Matt cheated on Jodi. Jodi confronted Bianca. Geffner looks at an interview with Matt in 2009.
Juan objects due to foundation.
Sidebar
Interview with Matt- Matt says that Jodi drove to Ashland to confront Bianca, but Bianca was not there. She was in Carter Lake- so Jodi drove there. Bianca was very level headed, but Jodi was crying and she was very emotional. Matt thought Jodi was bipolar. Matt and Jodi dated for 2 years. He thought Jodi was very kind and loving. Matt said Jodi needs exact communication so she could understand.
Sidebar. Juan wants some foundation on the stuff they are bringing up
Another sidebar. Another friend thinks Jodi is bipolar and Juan objects.
Carl thinks Jodi has rapid mood changes. When Matt described Jodi he said she wasn't manipulative, didn't get angry, wasn't aggressive. Jodi feels like she loses control when a break up happens. Jodi moves to Big Sur after the breakup and works at Ventana. She starts dating Darryl (of course they say after he was no longer the boss..RIGHT) Darryl is 20 years older. They were a family. Darryl says Jodi was a kind person. In Sept 06, he started to think the relationship wasn't that good for his son (I wonder why?) Jodi met Travis in Oct 06 and broke up with Darryl.
Recess
Geffner says he used all these interviews plus the testing with Jodi to come to his conclusions.
Going back to Darryl- Darryl slowing introduced his son to Jodi. Darryl didn't want to get remarried and he thought Jodi was bipolar. Jodi changed her hair and got a breast job to please him, but he never asked her to.
5 minute break
Darryl's sister said that Jodi had so much energy. She would change everything to adapt to a man.
A coworker at Ventana thought of Jodi like a little sister. After breakup with Darryl, Jodi became withdrawn, more depressed, less responsible. Coworker thought Jodi was brainwashed by Travis.
Another coworker at Ventana said Jodi never hit on him and he is a good looking guy. Coworkers loved Jodi. They all thought she was super awesome.
Geffner created a timeline of Jodi and Travis
Lunch break
Sidebar
Now Geffner is going over the timeline he made of Jodi and Travis. (I'm not going to repeat all the in and outs of their hookups)
They meet, they talk, they have lots of sex.
Travis is important in the Mormon church and he wants anal sex, so Jodi goes along with it. She stopped when it hurt.
Geffner is saying that Travis was in complete control of Jodi and their relationship. Now he's bringing up that stupid f'ing email from the Hughes.
Geffner starts nitpicking parts of email and texts- and he's using those details to show how controlling Travis was and how whipped Jodi was. Then they look at the email from Jodi to Abe. HA. It also shows how the email was forwarded to Travis too.
Geffner says there were 5 physical DV events.
15 minute break. The judge wants to see lawyers and Geffner in the hall.
Cont...
Approach
Now they have moved on to the oral sex. Geffner is bringing up the fact that Travis is doing stuff to Jodi while she was asleep. It wasn't mutual.
Coworkers noticed that Jodi was sad.
Jodi's diary shows up
Geffner says that Jodi hoped Travis would propose.
June 5th 2007 journal entry- "I felt so close to him today. It was a spiritual closeness we don't often experience"
"He's so wonderful in every way he takes my breath away no joke"
June 20th 2007- "how do I go on knowing Travis is cheating"
I need to focus on the end result. Hard knowing what I know but I just need to think about the love in my heart"
Jodi breaks up with Travis and meets up with Darryl to have dinner. He offers her a shoulder to cry on and wants her to succeed.
July 20, 2007 Jodi sends Travis her flight itinerary.
"I'm so excited to see Travis. If we aren't physical that OK I just want to wrap my arms around him and my love for him has grown so much over the months"
Jodi is talking about how she doesn't trust Travis and she has called and he didn't call back. Why does she have to compete with other girls and why does he continue to talk to other girls? "Should I hold on or should i let go?
Aug 3, 2007
Geffner- Jodi's brain was arguing with her heart
Aug 5th 2007
"Life is so interesting. I'm having a mellow yet positive day. What I liked best about our day was we didn't argue, or fight, we just had a great time. At the end of the night we treaded lightly into forbidden territory.
Geffner says that Travis pushes then pulls Jodi back is abuse.
8/15/07- List of Affirmations in Jodi's journal
1) I am not in love with Travis
2) Travis is a great friend
3) Travis is not a great boyfriend
Jodi talks about having sex in the mall parking lot then having to drop Travis off around the corner from his house.
"It's not Travis at all. He was merely the distraction. The void in my soul has been there for years, maybe millennial, perhaps since I was born"
"I just wish I could die. I wish suicide was a way out"
Oh crap...now we are at the Havasuapi trip UGH
"Travis apologized to me for this morning and said it was 90% his fault. It meant so much to me."
"I want to be the shining light I once was. I walk around like it's all OK. but I'm a shadow of what I use to be"
Oct 6th- "Over course of last 9 months I have felt the need to pray for Deanna Reed. She's a nice girl. It's a different dynamic now, and not one that I like by any means.
10/23- "I think this will be a long entry..."
10/29- Travis insisted that I tear out a page I wrote a few days ago listing some of the hateful words he'd spoken.
Jodi keeps mentioning in her diary that she is depressed.
Jodi says that she tried to leave but Travis wouldn't let her.
Court is finished.
