    An Update

    The attorney for a Sandy Hook parent suing conspiracy theorist Alex Jones in a Travis County court is seeking to have the controversial radio host’s lawyer removed from the case for making incendiary statements about him on Jones’ show InfoWars, which he fears could provoke reprisals from an audience he characterized as dangerous.

    Houston attorney Mark Bankston, who represents parents of children killed in the 2012 Sandy Hook Elementary School massacre in three different lawsuits against Jones for claiming on InfoWars that their children’s murder was a hoax, said in a motion filed this week that comments made by Los Angeles-based attorney Robert Barnes on Jones’ show had placed Bankston and his wife at risk. The couple have already been victims of harassment, Bankston said.

    Explaining his concerns, Bankston said in the motion that he has reviewed tens of thousands of emails sent to InfoWars and he “was stunned at the number of disturbed and mentally ill individuals that have fixated on InfoWars and the narratives pushed in their videos. There have been numerous harassing and indeed violent confrontations between unhinged InfoWars fans and the targets of Mr. Jones’ conspiracy theories.”

    Bankston and Barnes were back in state District Judge Scott Jenkins’ courtroom Thursday for a hearing on Barnes’ motion to dismiss a suit brought against Jones by Scarlett Lewis, the mother of a Sandy Hook victim, for intentional infliction of emotional distress on the grounds that Lewis cannot bring an emotional distress claim against Jones because the radio host never mentioned her by name.

    After the hearing, Barnes, who earlier this year took over the Sandy Hook cases as the new chief legal counsel for InfoWars, brushed off Bankston’s motion to revoke his pro hac vice permission to represent Jones in the Austin courtroom. The permission allows Barnes to work as Jones’ out-of-state lawyer.

    “This is not my first rodeo,” said Barnes, who said he had received pro hac vice privileges more than 50 times in more than 30 courtrooms over his career.

    “When you’re effective the opposing side tries to keep you out of the case, and when you’re effective the opposing side tries to gag you,” Barnes said.

    Of Bankston’s concerns about Jones’ audience, Barnes said: “That’s an eye of the beholder kind of thing. Most conservatives think the MSNBC Rachel Maddow audience is crazy. Even some liberals do, at least on some matters.”

    Barnes said the Jones case is precisely the kind of line-defining, free speech case the Supreme Court is likely to eventually take – lawsuits featuring sympathetic plaintiffs, a reviled defendant and outrageous speech.


    Whether it’s Nazis, the Ku Klux Klan or the Westboro Baptist Church — all of which were defendants in landmark cases — “it’s the more unpopular speech that needs the protection,” Barnes said.

    “This case poses a unique threat,” said Barnes. “It will lead to massive self-censorship.”

    Under existing First Amendment law, Barnes said, “as long as you don’t lie about a specific individual, you’re protected.”

    Bankston said that even though Lewis was not mentioned by name, Jones and InfoWars “intended to hurt her and once they knew she was hurting, they kept doing it.”

    “I don’t think anyone looking at what Mr. Jones did would not find the foreseeable harm” in what he was doing, Bankston said.

    In his new motion to take Barnes off the case, Bankston cited a 40-minute Feb. 23 episode Barnes co-hosted with Jones in which he said the Sandy Hook lawsuits are “a coordinated plan, orchestrated plan, by people like Media Matters, people like David Brock, people like the Clinton family, people like George Soros, and other individuals who believe that speech should not be allowed.”

    Barnes claimed that the suits were intended to terrorize the InfoWars audience.


    A week later, in a solo appearance on InfoWars, according to Bankston’s motion, Barnes warned the cases were part of a “coordinated strategy to end the First Amendment for your rights and liberties in America.”

    “If judges can remove and revoke a person’s First Amendment rights, a person’s First Amendment liberties, then no one is safe. Because they will continue to do so, and create law cases for the sole and whole excuse to try to silence and shut up individuals from speaking publicly,” Barnes said on the show. “Much as the libel cases that have been brought against Alex Jones and InfoWars appear to be intended by various political and media actors to silence Alex Jones, to censor Alex Jones, to censor and shame the very independent media that helped elect the revolutionary presidency of Donald Trump.”

    Jenkins has 30 days to rule on the motion to dismiss Lewis’ case. A hearing date has yet to be set on the motion by Bankston to remove Barnes from the case. If it is not heard before Jenkins rules in the case, it could be moot.

    New York (CNN Business)A Connecticut judge on Tuesday sanctioned right-wing conspiracy theorist Alex Jones for suggesting that a lawyer for the Sandy Hook families, who are suing the InfoWars founder for his past claims that the 2012 shooting was staged, tried to frame him with child pornography.

    The ruling, handed down from Bridgeport Superior Court Judge Barbara Bellis, came after attorneys representing several Sandy Hook families in their lawsuit against Jones filed a motion on Monday asking the judge to review footage of Jones lambasting one of the attorneys in a Friday segment.
    Bellis called Jones' behavior on the broadcast "indefensible," "unconscionable," and "possibly criminal behavior."
    Bellis sanctioned Jones by denying the defense the opportunity to pursue special motions to dismiss moving forward in the lawsuit. The court will also award attorneys fees and filing fees to the Sandy Hook families' lawyers related to the issue that Jones went off about in his broadcast: child pornography that Jones' team inadvertently turned over to the plaintiffs.
    Jones is being sued by families of Sandy Hook victims in both Texas and Connecticut courts over his past claims that the 2012 shooting was staged. He has since acknowledged that the shooting was real. At the hearing, a proposed trial date of November 2020 was settled on by both sides and agreed to by the judge.

    A Dane County judge on Monday found that a longtime conspiracy theorist living in the village of Oregon, along with his co-defendant, defamed the father of a victim of the Sandy Hook massacre and allowed a trial for damages against the men to move ahead.

    James Fetzer, of Oregon, and Mike Palecek, of Saginaw, Michigan, edited the 2016 edition of the book “Nobody Died at Sandy Hook,” which alleges Leonard Pozner circulated a fraudulent copy of his son Noah Pozner’s death certificate. Fetzer also co-authored a chapter in the book and has repeated in his blog the claim that Leonard Pozner circulated a fake death certificate for his son.

    Noah Pozner, at age 6, was the youngest victim of the 2012 Sandy Hook Elementary School shootings, which left 27 people dead. Fetzer, a professor emeritus of philosophy from the University of Minnesota-Duluth, claims the massacre never happened but was instead an event staged by the Federal Emergency Management Agency as part of an Obama administration effort to enact tighter gun restrictions.


    During a four-hour hearing before Circuit Judge Frank Remington, Pozner’s attorney Jacob Zimmerman offered evidence to counter Fetzer’s contention that a death certificate for Noah Pozner, an image of which was reprinted in Fetzer’s book, is a fake.

    Among other things, Zimmerman pointed to separate state and local processes for issuing death certificates to explain why a state file number didn’t appear on the document. And he explained the process for listing a time of death on the document, which Fetzer claimed doesn’t match the time of the shooting.

    Zimmerman also submitted an official copy of the death certificate, with the required embossed seal, to the court and argued that Fetzer and Palecek had not asked for the original but had instead relied on “copies of copies of copies that they found somewhere out on the internet.”

    Fetzer later acknowledged that the original reasons he called the death certificate a fake were mistaken but claimed other deficiencies with the document proved it was fabricated. He said Pozner’s lawsuit was an attempt to silence him and other Sandy Hook “truthers.”


    “This entire case is as fabricated as the death certificate,” he said. “They want more grist for their mill.”

    Remington, though, said he found Pozner’s explanations for the alleged deficiencies on the death certificate “legitimate and plausible and persuasive.”

    If there are differences among official copies of a document, “that does not alone indicate that any of them are false,” he said. “It only demonstrates a difference.”

    Neither Fetzer nor Palecek was represented by an attorney. “Nobody wants to touch” their case, Fetzer said.

    Fetzer has also advanced conspiracy theories about the Sept. 11 attacks, John F. Kennedy’s assassination, the shootings in Parkland, Florida, and other events.

    Zimmerman said a trial to award his client damages is to be set for October. Pozner is asking for $1 million.

    The families of six people killed in the Sandy Hook Elementary School mass shooting have filed a defamation lawsuit against internet and radio personality Alex Jones.

    Two Minnesota companies also are named as defendants, with the plaintiffs claiming the companies syndicated and profited from Jones' messages about the 2012 school shooting in Connecticut that claimed the lives of 20 children and six educators.

    Jones is a popular conspiracy theorist who runs the website Infowars. He has repeatedly called the shooting fake.

    An attorney for the plaintiffs, Matt Blumenthal of Connecticut-based Koskoff, Koskoff & Bieder, told MPR News the harrowing journey continues for the victims' families — as well as a first responder who was at the shooting scene — because Jones and others associated with him have repeatedly called the shooting fake, on shows that are distributed to millions of listeners.

    Blumenthal said his clients continue to endure threats and harassment from people who believe Jones.

    "They face people following them, coming to their town, videotaping them and their children, defacing memorials to their children, contacting them demanding they exhume their children," he said. "It is really some of the most outrageous harassment and abuse you can imagine."

    The lawsuit, filed Wednesday in Connecticut state court, lists Jones and Infowars as defendants, along with a handful of other people and businesses Blumenthal claimed syndicated and profited from Jones' statements about the shooting.

    Two of those companies are Burnsville, Minn.-based Genesis Communications Network Inc. and Midas Resources Inc. — both privately owned by Ted Anderson.

    The lawsuit alleges Anderson, the head of Genesis — a talk radio syndicator — appeared many times on Jones' show to promote his other business, Midas Resources, which has sold precious metals and dietary supplements over the years.

    Blumenthal said his clients hope suing Jones and the other defendants will finally put the conspiracy theory to rest, and free them from any further harassment.

    "It's about accountability for the actions of these defendants who have waged this campaign of outrageous and malicious lies against people who have suffered a really fathomless loss, and they've done it in order to profit off of the audience that they increase through spreading these conspiracy theories," he said.

    Messages left for Anderson by phone and at his office by MPR News were not returned as of Thursday evening.

    According to the Minnesota Secretary of State's website, Anderson's businesses were started in the mid-1990s and appear to be in good standing with the state of Minnesota.

    WATERBURY, Conn. (AP) — A Connecticut judge overseeing lawsuits by families of Sandy Hook shooting victims against conspiracy theorist Alex Jones says she has been threatened by people posting on Jones’ Infowars website.

    Judge Barbara Bellis wrote in a court filing Friday that the FBI contacted Connecticut State Police about the threats, and that state police notified her. Bellis did not release details.

    Twenty first-graders and six educators were killed in the 2012 shooting at Sandy Hook Elementary School in Newtown.

    Eight victims’ families and an FBI agent who responded to the shooting are suing Jones for defamation over comments made on his show about the shooting being a hoax.

    A lawyer for Jones says that the threats don’t appear to be serious, but that a review of the website was being conducted.

    SOUTHINGTON ? Two people face charges after police said they spray painted a mural honoring victims of the Sandy Hook shooting along the Farmington Canal Heritage Trail.

    Lorenzo Cavallo, 20, of 28 Hemingway St., Plainville, and Gina Lombardi, 21, of 211 Morningside Dr., Bristol, were charged Tuesday with first-degree criminal mischief and conspiracy to commit first-degree criminal mischief.

    Police responded to a report of vandalism at the detached garages at 245 Summer St., on Nov. 28, 2020 about 9:30 a.m., Lt. Keith Egan said in a statement. The owner previously donated the back of the building for a mural painted in remembrance of the 26 victims of the Sandy Hook School shooting in 2012. The owner of the building said he was extremely bothered and upset by the incident.

    ?Although there have been incidents in the past, vandals in this incident were the first to deface the actual memorial mural,? Egan said.

    Egan said the vandals, later identified as Cavallo and Lombardi, used spray paint to cover the mural, including butterflies that represent the victims. The phrases ?who do the police help but themselves? and and ?not safe? were spray painted on the mural. On the side of the building, phrases including ?(Expletive) the police,? and ?repaint this? were spray painted, according to a police report.

    Police noted there were names mentioned in some of the phrases that provided a connection to Cavallo and Lombardi.

    During an interview with police, Lombardi was apologetic, saying she didn?t know the significance of the mural and did not intentionally deface it. She was ?frustrated with law enforcement over an incident in Plainville, felt helpless and had a bad knee jerk reaction,? Egan said.

    She told police she partially vandalized the mural and said Cavallo was responsible for the additional graffiti. Police made several attempts to contact Cavallo during the investigation, but were unsuccessful.

    Lombardi offered to clean the spray paint from the mural, but the owner told police he wanted to check with the Southington Art Council. The owner said the estimated cost to repair the mural would be about $2,500, in addition to another couple hundred dollars to remove the graffiti on the side of the building.

    The internationally recognized artist who helped create the mural, Ryan Christenson, known as Arcy, returned last month to restore the artwork.

    Cavallo and Lombardi were arraigned in New Britain Superior Court on Tuesday. Both were released on a promise to appear in court.

    Sad, but defacing memorials with graffiti seems to be the knee-jerk response to feelings of injustice nowadays. It was bound to happen to one we actually care about.

    The parents of children killed in the Sandy Hook Elementary School shooting, who are suing Infowars host Alex Jones for defamation for saying the massacre was a "giant hoax," were given a green light to move ahead with their lawsuits against him, the Texas Supreme Court ruled Friday.

    Twenty first-graders and 6 educators at Sandy Hook Elementary School in Newtown, Conn., were killed on Dec. 14, 2012, in one of the 5 worst shootings by a single gunman in U.S. history.

    After the shooting, Jones took to his popular web talk show on Infowars.com, which has trafficked in various conspiracy theories, to spread baseless and inflammatory statements about the massacre.

    Calling the mass shooting "a giant hoax," he told the millions who watch his show and visit his site that it was a "false flag" operation staged by crisis actors posing as grieving parents to strengthen gun control laws.

    The lawsuits were filed in April 2018 in Texas, where Jones and the site are based, by Neil Heslin, whose 6-year-old son Jesse Lewis was killed in the shooting, as well as Leonard Pozner and Veronique De La Rosa, who lost their 6-year-old son Noah Pozner.

    The suits "seek to address specific accusations made by Mr. Jones and Infowars in 2017 that our clients were participants in a sinister cover-up at Sandy Hook," Mark D. Bankston, an attorney with Kaster, Lynch, Farrar and Ball, in Houston, told PEOPLE at the time.

    They are seeking in excess of $1 million in damages.

    They say that Jones' statements defamed them, caused them emotional distress, and led people to harass them.

    Over the past two years, Jones and his legal team tried to get two lower courts to dismiss the lawsuits against him and Infowars but failed.

    Jones and his attorneys maintain that his comments are protected by the First Amendment.

    He's changed his tune a bit since the suits were filed.

    In March 2019, he said in videotaped depositions for the case that he now believes the shooting did take place and that his conspiracy theories about the massacre were caused by "psychosis," the Washington Post reported.

    "I, myself, have almost had like a form of psychosis back in the past where I basically thought everything was staged, even though I'm now learning a lot of times things aren't staged," he said.

    On Friday, the state's highest civil court rejected Jones' request to dismiss the lawsuits, without comment, the Austin American-Statesman reports.

    Heslin tells PEOPLE he's glad the cases are moving forward.

    "I'm looking forward to a resolution and my day in court," he says.

    Among the falsehoods purported by Jones and Infowars were that Heslin never held his son in his arms after the shooting and that his son's body was never released to him.

    Heslin says he can never erase the image of his son's body after the shooting. "I held my son," he says. "He had a bullet hole through his forehead. The bullet exited through the back of his head, where the wound was the size of a softball."
    At Jesse's funeral, "he was in an open casket" that 5,000 mourners saw, he says. "The comments and the remarks themselves are harmful and damaging enough. They damage your credibility and reputation, not just on a local level but when they're broadcast and rebroadcast around the world."

    The shocking comments led Heslin to be "targeted" by Jones fans who believed what they heard on Infowars and harassed him, he says.


    De La Rosa, whose son, Noah, was the youngest child killed in the shooting, says of the win on appeal, "We are on the path to accountability and justice."
    Noah's father tells PEOPLE, "Noah's mother and I live with a grief that will never heal, the loss of our son who had just turned 6 at the time of the shooting. Alex Jones, who profited off of defaming us and inciting others to harass and terrorize my family, continues to use legal wrangling to avoid being held accountable. The Texas Supreme Court's ruling moves us one step closer to justice."

    Mark Bankston, an attorney representing the families, did not immediately respond to PEOPLE's request for comment.

    Bankston has told PEOPLE in the past, "In all our years of helping families who have lost loved ones under horrific circumstances, we have never seen victims subjected to this kind of malicious cruelty. Their pain is unfathomable."

    He told the Statesman, "We are pleased Mr. Jones is learning that his frivolous efforts to delay this case will not spare him from the reckoning to come."

    Asked to comment on the case via email, an assistant for Jones' attorney replied, "Attorney Jay Wolman states in response to your inquiry that Mr. Jones is not trying this case in the press."
