Michelle Lee Parker missing since 11/17/11

Mother disappears ... hours after her People's Court dispute with 'violent' ex-fiance airs on TV

Hours after Michelle Parker aired her violent, tumultuous relationship with her ex-fiance on a dramatic episode of 'The People's Court,' she captured national attention again. This time, it's because the 33-year-old mother of three had disappeared from her Orlando, Florida, home without a trace.

Ms Parker and Dale Smith fought it out over a $5,000 engagement ring on the popular courtroom reality show. Mr Smith sued his former fiance and claimed she lost the ring when she threw it at him in a fight at a Hilton Hotel during a science fiction convention.

Police said Ms Parker has a 'violent' history with Mr Smith, though he is not named as a suspect. In the 'People's Court' episode, Ms Parker described being grabbed by Mr Smith and having to call police after a fight.

On the show, Judge Marilyn Milian tells the couple: 'You're like drugs to each other. You're addicted to each other.'

She decried their volatile relationship, saying that each of them needs to move on from their on-again-off again romance that has lasted since 2006. She added that the pair needs to 'grow up' and 'move on' for the sake of the 3-year-old twins they have together.

Ms Parker's family reported her missing Thursday night when she didn't show up for work at 8 p.m. at The Barn restaurant, where she is a bartender.

She was last seen by friends at 2 p.m. Thursday, not long after her episode of 'The People's Court' aired on TV.

'She's an amazing person and we just want to see her home,' Lauren Erikson, Michelle's sister, told WKMG in Orlando.

Ms Parker is 5-foot-6 with short, dark brown hair. Her black Humvee was also reported reported missing, though investigators found it empty.

Perhaps most mysteriously, she sent a text message to her brother about 4:30 p.m. saying she was in the Waterford Lakes area of Orlando. But when investigators tracked her cell phone, they found she was never near there.

'They searched the towers, that was a decoy,' Ms Parker's mother Yvonne Stewart said.

Ms Parker is the mother of an 11-year-old son and two 3-year-old twins, who she had with Mr Smith.

The couple went through a custody battle over the children in 2009, according to court documents.

Ms Parker accused her ex-boyfriend of domestic violence that same year, saying he hurled profanities at her while holding one of the couple's twins. He also threw their child car seats and broke the window out of her car, she alleged.

Despite the link to a volatile lover, family members told the Orlando Sentinel they don't think Mr. Smith was involved and that he is working with police.

'He's been completely cooperative,' Ms Erickson said.

Rather, it seems likely she was carjacked, they said.

'There's no one focus. There's no tunnel vision. All information is welcome,' Ms Erickson said.

I just watched an episode of 48 Hours:Missing, where it looked like the roommate of the victim really had done something with her. All the surveillance tapes of the apartment complex during that week had been stolen, she wasn't reported missing for 2 weeks, SSI check money used, roommate acting strange...then she turned up alive and safe.

My point is that sometimes it can sure seem like someone is responsible for doing something shady when they have not. It just seems strange that she goes missing the same day that it airs on t.v? And it sure seems like that was a red herring of a text?

Just from reading a few articles on this, im not sure the ex had anything to do with it.

The decoy text that was sent is super odd though. It shows that whoever killed her knew her somewhat

Michelle Parker: Search continues for missing mother of 3
Volunteers asked to help search on foot south of downtown

A well-known non-profit search and recovery team has joined the search for a missing Orlando mother of three, who disappeared Thursday.

Volunteers from Texas Equusearch, which garnered fame in its role in the search for Caylee Anthony, arrived in Orlando Saturday night, linking up with dozens of Michelle Loree Parker's friends and family already engaged in looking for her south of downtown, family said.

More than 100 people gathered at the former Jesse Black's Saloon on 333 E. Oak Ridge Road both Saturday and Sunday, where a donated camper serves as headquarters for the search effort.

"I got good hope she's alive," said Parker's father Brad Erickson, who said his daughter once worked at the now-closed business in west Orlando.

"It's going well, and we've got a lot of volunteers," said Orlando police Sgt. Rich Lane.

Parker, 33, was last heard from late Thursday afternoon, when a text message indicated she was in the Waterford Lakes area. Her Hummer sport utility vehicle was recovered Friday on the west side of Orlando, police said.

Parker's brother Dustin Erickson said Sunday that detectives are trying to determine where the Hummer SUV was traveling between 4 p.m. Thursday and 12 a.m. Friday, before it was dumped. The vehicle did have an On Star system but it was not activated, he said.

The search has organized around the old saloon because police learned that Parker's phone was powered off in that area Thursday night, family members said.

Officers are looking for Parker's iPhone, which may be in the area.

Volunteers were collected into groups and told where to focus their foot search. Maps in the camper helped organizers keep track of what areas have been searched.

Police detectives accompanied the volunteers on their walks. Orange County sheriff's dogs in their handlers also joined the effort, as did volunteers who brought their own all-terrain vehicles.

Parker is 5-feet-5 with short brown hair. A Geneva resident, she was last seen wearing a blue Florida Gators hoodie and jeans.

On Thursday, she appeared on an episode of "The People's Court" TV show — taped months ago — with an ex-boyfriend who is the father of her 3-year-old twins. The couple had a tumultuous relationship that was at times violent. Family members think Parker was carjacked and do not think her ex-boyfriend was involved in her disappearance.

"He's been completely cooperative [with the investigation]," Lauren Erickson, Michelle's sister, said of the ex-boyfriend.

"There's no one focus [to the search]," Erickson said. "There's no tunnel vision. All information is welcome."

Searchers are well stocked for the time being with food and water, but other donations are welcome. There's a particular need for gasoline, ice, coolers and trash cans.

"I'm extremely thankful for all the generous donations," said Parker's brother. The response "has been more than I could have asked for."

Anyone with information about the case is asked to call Orlando police or Crimeline at 1-800-423-8477.

Police name ex-fianc? as suspect in search for missing mom

    ORLANDO --

In a press conference Monday afternoon, Orlando Police Chief Paul Rooney said Michelle Parkers ex-fianc? is a primary suspect in the case.

Parker's mother pleaded for help in finding her missing daughter.

Officials said Smith was offered a polygraph, but refused.

Midnight came and went, but as Sunday turned into Monday, still no one has come forward to claim a $50,000 reward to find Michelle Parker.

Orlando police said they received dozens of tips, but not the one they wanted that would lead them to the missing mother of three.

The $50,000 reward has since expired, leaving Parker's family with a decision to make on what to do next with that donated money. That could include extending the deadline, or even increasing the reward amount.

Any anonymous tips that came in before the midnight deadline Monday morning are still eligible for the reward.

Parker, 33, was last seen November 17, the same day a taped episode of "The People's Court" aired featuring Parker and her ex-fiance, Dale Smith.

Family members have said they don't believe Smith had anything to do with Parker's disappearance, but Saturday, a SWAT team raided a home where Smith was said to frequently stay.

It remains unclear what exactly led to that SWAT raid, or what police were looking for, but police said Smith has been cooperating since day one, and is not a person of interest at this point.

Volunteers have handed out more than 70,000 fliers throughout the Orlando area as the family pleads with the community for any tips leading to the missing mother.

Parker's family members said they understand people have to work during the day, and might not be able to volunteer, but asked everyone watching and reading online to be vigilant.

"We need to keep Michelle's face in people's minds, and keep them looking for her," said Dustin Erickson, Parker's brother.

Erickson said this experience has made him wish he would have paid closer attention to other missing person cases he has seen in the past.

"I wish that I had not been so indifferent," he said. "It actually, really kind of made my stomach hurt when I thought about it. I really can't urge enough for people, if they see anything that doesn't look like it should be there, look into it a little bit more, and if it appears to be anything, please call CrimeLine."

CrimeLine is still offering its own reward of $5,000 for information leading to Michelle Parker. If you know anything, call (800) 423-TIPS (8477). You are allowed to remain anonymous.

Michelle Parker is still missing. And now her ex-fiance — Dale Smith II — is officially a suspect in her disappearance.

Those grim facts loomed over Parker's family and friends as they gathered in Orlando again this morning to look for the missing mother of three from Geneva.

Today marks the first day of searching since Orlando Police Chief Paul Rooney announced Monday that Smith "is our primary focus."

Smith, 40, the father of Parker's 3-year-old twins, is the last person known to have seen her. The couple have a violent past.

Parker, 33, was last seen Nov. 17 driving the twins to Smith's townhouse in Carter Glen Condominiums off Goldenrod Road.

Rooney revealed Monday that Smith would not take a lie-detector test as requested.

"We had to look at every aspect of the case before we could come out publicly and state that Mr. Smith is our primary focus," Rooney said Monday.

"He is our primary suspect," Rooney added. "There are no other suspects that I am aware of as Orlando police chief."

Orlando lawyer Mark NeJame and his partner, Rajan Joshi, are representing Smith, NeJame told the Orlando Sentinel late Monday. Those attorneys are expected to hold a news briefing today.

Earlier today, reporters spotted Smith has he left the home of his parents on Rose Boulevard. It appears he had spent the night there and parked his truck in the family's backyard.

He did not comment as he left. It's unclear where he was headed.

Earlier today, no one answered the door at the home.

On Monday, after Smith was named the prime suspect in Parker's disappearance, Parker's mother, Yvonne Stewart, encouraged volunteers to continue to help search for her daughter.

"This is a sad day, really, but I think it was inevitable," Stewart said Monday.

Parker and Smith appeared on an episode of "The People's Court" that aired shortly before she vanished. They argued about a $5,000 engagement ring that got lost after she threw it at him during an argument. Smith in May sued Parker in civil court, about the time the episode was taped.

In August 2009, Parker requested a domestic-violence injunction against Smith. She said in court papers that he was holding their then-15-month-old daughter when he cursed at her and broke the passenger-side window on her truck during an argument over the children.

Parker told the court that Smith previously had been violent with her and had threatened to kidnap their children. She also said Smith had problems with drugs and alcohol.

The injunction was dismissed Sept. 1, 2009. It is not clear why.

Smith was arrested several times during the 1990s. He pleaded no contest in 1990 to trespassing on school grounds and in 1992 to attempted aggravated battery. He entered a pretrial diversion in 1992 after being arrested on a charge of marijuana possession. He pleaded guilty in 1997 to battery.

In June 1996, Smith joined the U.S. Marine Corps. He was court-martialed in 2001 and found guilty of drug and domestic-battery charges, the military agency said. Smith was dishonorably discharged as a private in 2003.

Parker, a Winter Park High School graduate, was scheduled to work the night of her disappearance at a bartending job at The Barn in Sanford, but she never showed up.

Her abandoned Hummer was found Nov. 18 at an apartment complex near Conroy and Vineland roads. Decals for her mobile-tanning business had been removed from the windows.

On Saturday, officers served a search warrant at Smith's parents' home on Rose Boulevard in Orlando, said Sgt. Vincent Ogburn, a police spokesman. He would not reveal what, if anything was found.

Parker's twins are being cared for by Smith's parents, authorities said. She has an 11-year-old son from a previous relationship.

Investigators from the state Department of Children and Families interviewed the children Monday and are conducting a child-protection investigation because the DCF hotline received reports of past domestic violence between the couple, a spokeswoman said.

Family, friends and volunteers — some strangers to Parker — have been passing out and posting thousands of missing-persons fliers throughout Central Florida. They fan out daily from a command post at Oak Ridge Road near Orange Avenue in south Orlando, near a tower that sent the last transmission from Parker's cellphone.

A Facebook group dedicated to helping locate Parker has gained more than 9,300 followers.

Police urge anyone with information about the case to call Crimeline at 1-800-423-8477.

Parker's Children Taken From Suspect, Missing Mom's Ex
    Parker Now Missing 12 Days

ORLANDO, Fla. -- The Department of Children and Families has taken missing mom Michelle Parker's children away from the man police say is their primary suspect in her disappearance, Dale Smith Jr.

An emergency custody hearing has been scheduled for Wednesday morning. Parker's mother, Yvonne Stewart, was given access to see the children Tuesday afternoon, DCF said.

Investigators with the Orlando Police Department said on Monday that Smith, who is Parker's ex-fiance and the father of their twins, may have something to do with her disappearance. Orlando Police Chief Paul Rooney said Smith was his department's primary suspect.

On the day of Parker's disappearance, Smith posted, "The police just came by and searched my whole house ... this isn't good. My kids need their mother."

Smith also posted that he was praying for Parker's safe return. Soon after his ex-fiancee's disappearance, Smith denied any involvement in it.

"I'm not that type of person. If you know me, then you know the truth," Smith wrote.

Meanwhile, a $50,000 reward to help find the missing mother of three who disappeared 11 days ago is now off the table.

NeJame held a news conference Tuesday afternoon and said Smith wouldn't be taking a polygraph test and has been unfairly targeted.

"Not one single court in the United States of America accepts polygraphs as scientifically reliable and admissible," NeJame said.

NeJame said Smith has provided voluntary statements to investigators on three occasions and has helped to get Texas EquuSearch to help find Parker.

"Mr. Smith wants Michelle found," NeJame said. "What guilty person is asking for a search to be conducted?"

A Florida judge ruled Wednesday that a missing woman's 3-year-old twins must be returned to their father, saying there is not enough evidence for state child welfare officials to keep them.

Missing FL mom's ex charged with domestic battery, wife dies of brain injury

ORLANDO, Florida (Isabelle Zehnder reporting) -- In 2001 two significant events took place in the life of Dale Wayne Smith II, the ex-fianc? of missing Florida mom Michelle Parker: He was court martialed on charges of drug possession and domestic battery and his then-wife died of a brain injury.

The Orlando Sentinel showed that on April 10, 2001, Shannon Kathleen Collins-Smith, 26, died of a brain injury. She was married to Smith at the time.

Shannon was a personal trainer at the Orlando Regional Wellness Center. Shannon was born in Springfield, Mass., and moved to Central Florida in 2000. A Community Home and Cremation Service was held at Pine Castle Chapel in Orlando. The Wilmington Morning Star provides another obituary.

Dale Smith has a long criminal history dating back to 1990 that includes misdemeanor charges of trespassing on school grounds and refusing to leave, controlled substance, and traffic infractions; and felony charges of criminal burglary, aggravated battery for kicking a man while he was beaten and stabbed to death by his friends, and court martials while he was in the military, including the drug possession and domestic battery charges.

Under normal circumstances a person?s criminal history is public record. One exception is a person who committed crimes when he or she was in the military because the public does not have access to those records.

Therefore, during the years of 1996 to 2003 all of his criminal records are hidden from the public because he was in the US Marines, except the information (above) that was recently provided to and released by the media.

    Smith's criminal history

Smith?s sordid criminal history dates from 1990. Smith enlisted in the US Marines for about seven years from 1996 to 2003 when he was dishonorably discharged.

Before enrolling he was involved in a string of misdemeanor and felony charges during 1990 to 1992.

In 1990, at the age of 19, he was charged with criminal felony burglary and trespassing school grounds/refusing to leave.

In early 1992 he was charged with a misdemeanor controlled substance charge.

Online court records show Smith was arrested on June 8, 1992, in connection to the murder of 22-year-old lifeguard Bryan Tiletson.

The murder took place in downtown Orlando and involved seven young men, including Smith. Phillip Murandanes, 23, was sentenced to 22 years in prison and served 11 years, 8 months.

Smith served six months in jail for kicking the victim during the attack.

The Orlando Sentinel reported in Oct. 1992, that prosecutor Jeff Ashton said the seven teens were out looking to beat someone for fun, and happened upon Tiletson and his friend.

When the two fought back, Muradanes took out a pocketknife and stabled Tiletson in the chest.

To this day, Tiletson?s brother says he believes Smith was the leader of the gang.

Following the 1992 murder Smith had a felony battery charge in Nov. 1996.

Smith then joined the US Marines in 1996 and married to Amanda J. Pernice in 1997. She filed for divorce on Dec. 17, 1999, it was final on Jan. 27, 2000.

On Feb. 7, 2000, Smith married Shannon Kathleen Collins-Smith who tragically died of a brain injury on April 10, 2001.

Also in 2001, Smith was court martialed on charges of drug possession and domestic battery.

Some recent reports claim Shannon's death was classified an accident, and that she died of a drug overdose when she fell and accidently hit her head causing the brain injury.

In 2003, around the time Smith was dishonorably discharged from the military, he filed a repeat violence case against a woman named Jill Van Mechelen. It is unknown what their relationship was.

In Sept. 2003 Smith apparently filed for a temporary injunction, and in Oct. 2003, Jill filed a motion to dismiss the injunction. In Nov. 2003 an order dismissing the final injunction was recorded.

In 2009, Michelle sought but was not granted a restraining order against Smith citing he?d thrown their children?s car seats on the ground, smashed out her passenger ?side window, cussed at her while she was holding her then 15-month-old daughter, and yelled, ?Your day is coming.?
It is unknown why a judge would not grant a restraining order under such conditions when others are granted on lesser claims.

    SWAT team swarms Smith?s home

On Saturday night 12 SWAT team officers in two armored trucks who were fully armed and loaded using their trained, skilled, tactical maneuvers in high-risk and life-threatening situations, descended on Smith's parents' residence, where has reportedly has been living.

Were the children in the home at the time? The officers knocked on the door and when no one answered they stormed into the home, reportedly broke down the door, and initiated the use of pepper spray.

They took Smith's father, Dale Smith, Sr., into custody. He was later released.

And yet a judge finds it in the children's best interest Wednesday to return the children to the only suspect in their missing mother's case.

Intimate Partner Violence Specialist Susan Murphy-Milano said that based on everything going in Smith?s life at the moment it makes sense that in looking out for the best interest of the children, they would be better placed in a neutral environment away from the lead suspect in their missing mother?s case, and away from his family who apparently supports him.

"They're better off being placed in a foster home in the state, and I hardly ever say this," Murphy-Milano said Wednesday.

The children were placed into the care of Michelle's parents Tuesday evening. Michelle's mom, Yvonne Stewart, was seen crying as the children were returned to their father, who has now been named the primary suspect in her missing daughter's case.

It is rare that police name a person a "suspect" in a missing persons' case, meaning they likely had good reason to do so.

DCF tries, but fails to remove children from Smith's custody

The Florida Department of Children and Family Services removed Michelle and Smith's 3-year-old twins from Smith's custody and placed the in the temporary custody of Michelle's mother, where the children had reportedly been living with Michelle for the past three years.

MSNBC reports that during a hearing Wednesday morning, Orlando County Court Judge Thomas W. Turner denied DCF?s request to keep the children with Yvonne Stewart and returned them to their father's custody saying, ?I don?t think incidents that happened years ago constitute a pattern.?

Tunrer said that though Smith does have all of this in his background, there is no evidence he has abused their 3-year-old twin boy and girl.

    Michelle's disappearance

Michelle Parker, 33, went missing Thur., Nov. 17, 2011. Her Hummer was seen on surveillance video at 3:18 p.m. in an east Orange County neighborhood, driving to her ex-fianc?, Dale Wayne Smith II?s home to drop off their 3-year-old twins.

Michelle is described as a white female with short brown hair. She is 5?6? tall and was last seen wearing blue jeans, a Florida Gator?s zip-up hoodie, and a silver cross necklace.

Several hours before Michelle arrived at Dale?s house, the two had appeared in a previously taped episode of The People?s Court. The show centered on who would be responsible to pay for a $5,000 engagement ring that Michelle admittedly threw at Dale at a hotel, and that went over a balcony.

According to a Facebook page created to provide updates and support in Michelle?s case, she was officially last seen around 4 p.m. at the intersection of Goldenrod and Leevista in the Carter Glen Townhomes near Orlando Florida. Her last text was at 4:26 p.m. on Nov. 17, and said ?Waterford.? The text was in response to her brother asking what she was up to.

By 8 p.m. Michelle?s iPhone pinged in the area of Oakridge Road near Belle Isle, more than seven miles from where she was last seen. Her phone was powered down in that area and has not been recovered.

The next day police found her black H3 Hummer license plate AWG-M26 in the parking lot of Walden Palms Apartments, 4700 Walden Circle, The Orlando Sentinel reports. Decals for her Glow mobile-tanning business had been removed from the windows. From there the trail went cold.

A $5,000 reward is being offered in the case.

Police are urging anyone with information about the case to call Crimeline at 1-800-423-8477.

Michelle Parker missing: Cops release photo of recovered iPhone

Orlando police confirmed today they recovered Michelle Parker's iPhone in good condition but did not say how or where it was located.

Police spokesman Sgt. Vincent Ogburn said the phone is being tested for physical evidence that may lead to new clues in the missing mother's disappearance.

Investigators identified the phone's serial number and family confirmed that the device belongs to Parker. Police released photos of the phone in its black, white and pink cover.

They also released a photo of her found in the iPhone but provided no information about.

Encouraged by the break in the case, Parker's family and friends have resumed their search this morning.

Yvonne Stewart, Parker's mother, said detectives did not tell her where or when the phone was found or what information they may have obtained from it.

Investigators called Parker's family to Orlando police headquarters Wednesday evening to identify the phone, Stewart said.

Earlier Wednesday, Dale Smith Sr., the father of Parker's ex-fiance, was questioned under oath after being subpoenaed in the case.

It was the second consecutive day that Dale Smith II's family members have been questioned about the case.

Tamara Smith, his mother, was questioned Tuesday at the Orange-Osceola State Attorney's Office. Her attorney, Richard Hornsby, said she cooperated with investigators.

Orlando police Chief Paul Rooney has called Smith, 40, the prime suspect in the disappearance of Parker, the mother of Smith's 3-year-old twins. He has not been charged.

Parker, 33, of Geneva vanished Nov. 17 after dropping off the twins at Smith's home.

Just before her disappearance, an episode aired of The People's Court that featured Parker and Smith arguing about her lost engagement ring.

    It was taped in June.

Meanwhile, family members are coordinating their search from a command post in the parking lot at The Barn, where Parker has been tending bar. They have been handing out fliers in Seminole and Volusia counties in hopes of generating tips as to Parker's whereabouts.

Parker was last seen wearing jeans, a Florida Gators hooded sweat shirt and a silver cross necklace.

Anyone with information about her disappearance can call Crimeline at 1-800-423-8477. Tipsters can remain anonymous and can earn a reward of up to $5,000.

The mother of missing Florida mom Michelle Parker has filed a wrongful death lawsuit against Parker's ex-fiance, who is the father of two of her children.

Parker, 33, of Orlando, Fla., has been missing since Nov. 17, 2011, the same day her appearance on "The People's Court" television show aired. She and Smith appeared in the episode to resolve a dispute over a $5,000 engagement ring.

Parker was last seen dropping off the couple's twins at Smith's home.

Police named Parker's ex-fiance Dale Smith as the prime suspect in the case, but no charges have been filed and no arrest has been made. He still has custody of the children. But the attorney for Parker's family claims he has evidence against Smith, including text messages.

The lawsuit, which seeks damages in excess of $15,000, claims that Dale Smith was "negligent or otherwise committed a wrongful act and caused the death of Michelle L. Parker."

Parker's Hummer was found after her disappearance as was her battered iPhone, at the bottom of a lake. Though the cell phone was found about 40 minutes from Parker's home, the lake is only five minutes from Smith's home.

Parker's body has not been found, but the lawsuit claims that Parker "died on or about November 17, 2011 as a direct and proximate result of the negligence of the Defendant."

"That's the day we believe it happened," Parker estate attorney John Morgan told ABCNews.com. Parker's mother Yvonne Stewart represents her daughter's estate, which includes her three children.

"[Yvonne Stewart] doesn't want to believe it happened, but everyone knows what happened and when it happened," Morgan said. "We think she was killed."

Morgan said the legal team is not ready to elaborate on the details of what they believe happened to the mother of three, but said he will let the lawsuit speak for itself for now.

"If the said Defendant had not been negligent or otherwise committed a wrongful act, and if said Defendant had acted appropriately in accordance with the prevailing standard care of the Defendant, there would not have been any injuries or damages sustained by Michelle L. Parker," the filing states.

More than a year after Parker's disappearance, detectives are still investigating her case.

"It's still an open investigation," Orlando Police Sgt. Jim Young told ABCNews.com today. He spoke to the case's lead detective on Thursday who said there are no updates in the case and Smith is still listed as a suspect.

Morgan claims he has evidence against Smith, including text messages between Parker and Smith.

"We just think that we have some pieces that when taken with testimony may tell a more full story and that testimony has to come from Dale and his parents."

Asked if he could elaborate on the content of the messages, Morgan said, "I don't want to say. I don't want him to be ready for that."

"We'll be most interested when we get a chance to depose him," Morgan said. "Will he take the fifth or tell the truth?"

Smith could opt out of answering most questions by pleading the fifth in the civil case to prevent incriminating himself in any possible future criminal case.

Smith's attorney Mark Nejame refutes the claims made by the Parker estate's attorney.

"They're barking up the wrong tree," Nejame said. "They've been frustrated for a long time because law enforcement hasn't found a scintilla of evidence that ties him to her disappearance or murder...Just because everyone thinks he did it doesn't mean he did it.

Nejame said that Smith voluntarily spoke to law enforcement four times and let them into his house for a full inspection within hours of Parker's reported disappearance.

"They've tailed him," Nejame said. "They've spoken to every person who has basically known him and there's nothing to link him to her disappearance or death."

"Our hearts go out to Michelle Parker's family, truly, but sadly a lawsuit against Dale Smith is not going to bring them any closer to finding out what happened to Michelle Parker," he said.

Nejame said that Smith is working in Tennessee and is a good father. He has custody of he and Parker's twin 4-year-olds. Parker's 10-year-old son is living in Pennsylvania with his father.

Parker's mother Yvonne Stewart used to be "very involved" with her grandchildren's lives, Morgan said, but has not been able to see them. He said Stewart has been "instrumental" in working on a bill to guarantee grandparents' rights.

The bill is backed by Florida House Representative Darryl Rouson and it is expected to come into legislature this session, Morgan said.

"She's been doing well, but I think that when we filed she kind of broke down because it was like, here it is. This is real. This is today. And she's also very grateful to us for championing this cause. There was a lot of emotion."

Orlando police used a department training exercise Friday to search for a mother of three who went missing the same day she appeared in an episode of The People's Court in 2011.
Michelle Parker, 33, of Orlando was last seen November 17 dropping her three-year-old twins off at the home of ex-fianc? Dale Smith, whose legal quarrel over a $5,000 engagement ring featured in an episode of the show recorded earlier that year.
WOFL reported about 100 officers searched an area of Belle Isle about two miles south of Orlando International Airport without finding any trace of Parker, whose cell phone last pinged nearby.

Police have searched the area before, and though the three-hour investigation of the grounds did not turn up any new evidence, it was heartening for Parker's parents.
'I don?t like it. It makes me angry that we have to go through this all the type because it?s really painful and hard but I?m happy,' Parker's mother Yvonne Stewart said according to News 13.
Parker's Hummer had been found the day after she disappeared at an apartment complex in Orlando with the decals for her tanning business peeled from the windows.
Her family has continuously pushed for answers about her disappearance.
'It's agony not knowing what happened to your child,' Stewart told ABC. 'They thought they should go back and take a look at these woods.'
Stewart says authorities told her one piece of evidence police hoped to find was the missing decal that might have been taken from the Hummer.

'I don't want to find her dead. I want to find her alive,' said Parker's father, Brad.
On the episode of courtroom series 'The People's Court,' recorded the summer before her disappearance, Parker and Smith squared off over a $5,000 engagement ring.
The show revealed a 'violent' history of her relationship with Smith, who had been dishonorably discharged from the Marines in 2003 following a reported court martial and military convictions for drug possession and domestic battery.

Smith was charged with domestic battery during their relationship, after which Parker filed a request for a restraining order in 2009, which was denied,
In her filing she said he 'smashed the passenger side window in my SUV' and 'took car seats out and threw them in the road'. She also alleged that he yelled to her: 'Your day is coming.'
'He gets pretty malicious and vindictive,' she said of him on The People's Court, 'and he's a mean person especially when he's been drinking.'
Smith had sued Parker, claiming she lost the engagement ring when she threw it at him in a fight at a Hilton hotel during a science fiction convention.
People's Court judge Marilyn Milian found in favor of Smith on the episode and ordered Parker to pay $2,500.
A friend, Angela Launer, told ABC around the time of the disappearance that Smith was known to abandon Parker in out of the way places.
'I know he hurt her many times - dropped her off in areas with no shoes. Took off and left her in Georgia by herself,' Ms Launer, 34, said, describing the relationship as 'rocky' and 'tense'.
Police have not charged Smith in relation to his ex-fianc?e's disappearance, but he is currently being considered a person of interest in the investigation.
Smith currently has custody of the couple's twin children. Parker also had a son from a previous relationship who was 10 years old at the time of her disappearance.
An attorney for Smith told ABC that Smith had not committed any crime.

The family revealed after her disappearance that Parker left a short message the day before she went missing in which she sounded normal and asked her father to make plans to call her.
?Hey Dad, it's about 8:40. This is Michelle on Wednesday morning,? she said. ?I know that you're at work, but call me when you have lunch or you have break or the end of your day.?
The family spent Thanksgiving with about 50 volunteers, searing within a two-mile radius from a cell tower that had last pinged her location, reported the Orlando Sentinel.
?I'm thankful that my sister has not been found in a bad way, because every day that doesn't happen, I still have hope that she's still out there somewhere,? her sister Lauren Erickson told ABC at the time.

Her friend Angela Launer told ABC Mr Smith was known to abandon her in out of the way places.
'I know he hurt her many times - dropped her off in areas with no shoes. Took off and left her in Georgia by herself,' Ms Launer, 34, said, describing their relationship as 'rocky' and 'tense'.
Parker's mother, Yvonne Stewart, has maintained that Smith is not responsible for her daughter's disappearance.
'Who would want to hurt the mother of their children?' she told ABC. 'I don't see how in any way he would benefit from it. I know in my heart of heart that she's been carjacked.?
'That the people saw an expensive car and a girl who looks like she has money and I know they've made a mistake and I know that they want to fix this and I forgive them.?

The friend described their relationship as "rocky" or "tense"? No, you describe the relationship as "he's a total and complete asshole". Guess you can't say that on the news.

And someone needs to torture this motherfucker, Dale Smith, too. Whether he did it or not, he needs one hell of a beatdown.

She was very pretty. I remember seeing this case on Nancy Grace. This woman worked like 3 jobs to support herself and was in school.

I think it's obvious the ex did it. I'm pretty sure her bad mouthing him on national television was a breaking point from him. I had no idea he killed another wife. He probably thought his mistake with the first one was not getting rid of the body. This man should be in jail, he's dangerous.

Because a judge decided that involvement in a murder and a long history of domestic violence and other charges happened “years ago” even though he was just named as the main suspect in their mother’s disappearance after she tried to get a restraining order against him.
