    Authorities are waiting for the results of an autopsy to decide on what the suspects will be charged with - and this could take at least a month, so the investigation will probably stretch into December.

    Defense: Homicide charges in Utah teen’s death a month away
    Ogden • An attorney for a person of interest in the death of 16-year-old Alexis Rasmussen said Wednesday that charges — anything from manslaughter to capital murder — will be filed in a month against Dea Millerberg and her husband, Eric.

    Michael Bouwhuis made the prediction shortly after he was assigned to represent Dea Millerberg on prescription fraud charges that are unrelated to the September death of the teen.

    Dea Millerberg, 38, of North Ogden, was scheduled for a preliminary hearing in 2nd District Court on Wednesday. But the hearing was continued until Nov. 16 because Bouwhuis was newly appointed as Millerberg’s attorney.

    On Tuesday, Millerberg’s husband, Eric Millerberg, 36, of North Ogden, was sent to prison for violating his probation in a 2010 credit card fraud case.

    Weber County Attorney Dee Smith has called the Millerbergs "persons of interest" in Rasmussen’s September death.

    But during questioning from news reporters on Wednesday, Smith backed away from calling the couple either persons of interest or "suspects."

    Smith confined his remarks to saying: "They’re being investigated."

    Rasmussen was baby-sitting for the Millerbergs the night of Sept. 10, when she disappeared, North Ogden police have said.

    Smith said that the girl died in a house on Sept. 11 or shortly thereafter— not from natural causes — and that her body was then transported to where it was buried near Interstate 84 in Morgan County.

    On Oct. 18, Alexis’ body was found within two miles of I-84 and about 35 to 50 yards from a road along the Weber River, according to Smith. Police have said they were directed to the location by a confidential source.

    Because the body was moved, desecration of a corpse is one of the charges prosecutors are considering, Smith has said.

    At some point on Sept. 10, Rasmussen’s mother had given her permission to stay over at the Millerbergs’ because it was late and the couple had not returned home, police have said. The Millerbergs have told police that between 11 p.m. and midnight, Alexis told them she was leaving to meet a friend at a nearby school.

    After the girl’s disappearance, the Millerbergs were each arrested on unrelated charges. Eric Millerberg was arrested Oct. 3 for violating his probation, and Dea Millerberg was charged Oct. 7 with prescription fraud.

    Dea Millerberg remains at the Weber County jail in lieu of $10,000 bail. Judge W. Brent West appointed her a new attorney because her current lawyer was also representing her husband.

    According to a probable-cause statement filed with the court, Dea Millerberg was receiving controlled substances from one doctor, when she visited another doctor and failed to disclose the other doctor-patient relationship.

    Eric Millerberg was in and out of prison between 1997 and 2006 for convictions that include burglary, discharge of a firearm and failure to stop at the command of police, according to Department of Corrections records.

    Alexis’ family have scheduled a news conference for 2 p.m. Wednesday to thank the public for their "help and prayers."

    The girl’s funeral is scheduled for Saturday at 11 a.m. at the North Ogden Stake Center, 626 E. and 2600 North, in North Ogden.

    There will be a fundraiser for the family of Alexis Rasmussen on Nov. 1 from 6 p.m. to 9 p.m. at Ben Lomond High School, 1080 9th St. in Ogden. Dinner is $10 and there will be a silent auction and baked goods sale.

    Dea Millerberg was charged Oct. 7 with two counts of third-degree felony prescription fraud.

    According to a probable cause statement filed with court, Dea Millerberg was receiving controlled substances from one doctor, when she visited another doctor and failed to disclose the other doctor/patient relationship.

    Smith also said Monday that investigators had enough evidence to charge unnamed suspects with some crimes, but were awaiting autopsy results to finalize the scope and degree of the charges. The medical examiner’s report may not be finished for a month or more, he said.

    Well, now that I've read that there was doctor shopping involved, and she went along to the pharmacy after telling her Mom she would spend the night...I can see an O.D as one scenario.

    After she babysat, she went to the pharmacy at 10:30 pm with the "Mother of the kids" she sat for, and then back to their house. (Her own Mom on the phone had said to just spend the night there since it was so late.) Why they didn't just drive her back to her own house is unknown.

    Because she was supposed to get something at the pharmacy for the mom, mom does have problems with prescription drugs. I am seeing motive here..

    Perhaps went to the pharmacy with the mom so that she could get some pills, got wasted, they raped her or something, ended up killing her to keep her quiet?

    Mother still struggling to cope with daughter’s death

    North Ogden • Dawn Miera knew her 16-year-old daughter had not run away.

    "I let people convince me [she had run away], that’s how I got through the last month and a half," Miera said of her daughter, Alexis Rasmussen, whose body was discovered last week buried near Interstate 84 in Morgan County.

    Surrounded by family members and her LDS bishop, Miera on Wednesday said she is still struggling to cope with her daughter’s death, possibly at the hands of Eric and Dea Millerberg, who are being investigated in what now appears to be a homicide.

    Alexis was reported missing after she didn’t return home from baby-sitting for the Millerbergs at their North Ogden home the night of Sept. 10.

    On Oct. 18, police — directed by a confidential source — found the girl’s body near a road along the Weber River.

    On Wednesday, Dea Millerberg’s defense attorney said he expects homicide charges to be filed against his client and her husband in a month.

    Miera said of Dea Millerberg: "My biggest mistake was probably expecting her to be like me or like the moms I know. ... I had no idea that [the Millerbergs] would be capable of doing anything like this."

    Miera said she never met Eric Millerberg prior to her daughter’s disappearance. But if she had, that might have been a sign for her, she told news reporters.

    The mother of three said she suspected the Millerbergs only after meeting Eric one evening after the disappearance when she went to their North Ogden home.

    "I had the most horrible feeling in the world," she added, declining to elaborate.

    She also recalled running into Dea Millerberg at a store two weeks after Alexis disappeared. Millerberg didn’t ask a single question about the missing girl, Miera said.

    Asked about the Millerbergs being named persons of interest in the case, Miera said, "It makes me sick to my stomach."

    Miera said that over the course of her daughter’s disappearance, she had a lot of bad thoughts and feelings about what could have happened to her daughter. "I really don’t want to say because one of them may actually be a reality. It may actually be what happened," Miera said.

    Alexis’ family organized Wednesday’s gathering, they said, to thank the community for their prayers and support, and for their help in trying to find Alexis while she was missing.

    Family members described "Lexi" as a funny, vivacious and brilliant — a quick-witted force in their family.

    She was "as smart as she was beautiful," Miera said.

    Eric Millerberg, named as a 'person of interest' in the murder of teenage babysitter Alexis Rasmussen, asked friends to 'bring a car and don't ask any questions' on the night the girl went missing, police say.

    Alexis, 16, had been babysitting for Millerberg and his wife Dea when she disappeared seven weeks ago. Her body was found in a shallow grave by an interstate in Ogden, Utah on October 18.

    The schoolgirl had last been seen on September 10 when she was babysitting the Millerbergs' two young daughters.

    Two friends of Millerberg told investigators he called them the night Miss Rasmussen went missing and asked about a car and help to get rid of something.

    There were also claims by the same witness that a 16-year-old girl had requested that Millerberg 'shoot her up' with drugs and that she wanted to have a threesome with the couple.

    There were also claims by the newspaper that Miss Rasmussen was 'partying with the Millerbergs' and had been paid for her baby-sitting services with drugs.


    Dea Millerberg, accompanied by Alexis, also allegedly sold some prescription drugs to one of the girl's friends for $100 and 'a small amount of marijuana'.

    CCTV tapes allegedly showed Alexis and Dea Millerberg at a Walgreen's pharmacy at around 10.30pm that night picking up a prescription.

    It was first thought Alexis had runaway when she failed to come home on the night of September 10.

    At 11.30pm the girl texted her mother Dawn Miera and told her the Millerbergs were not home yet, so her mother told her to stay the night as it was so late. That was the last she heard from her.

    The Millerbergs told police she left at midnight to meet a friend, though the boy she was supposed to have met said she had just text him but they did not meet.

    One search warrant which was released by the Ogden court stated that human blood was found in the Millerbergs' home in an area where the carpet and padding had been removed.

    Investigators also found a car sold by Eric Millerberg to someone in Utah County where carpet had apparently been removed from the trunk.

    Search warrants containing the grim details surrounding the case were temporarily released to the media before being sealed by a judge in Weber County.

    Neighbours of the Millerbergs have previously said they believe the couple may have paid some babysitters with drugs.

    Both Eric and Dea Millerberg were arrested and charged with drug-related violations around the time Miss Rasmussen was reported missing.

    Mrs Millerberg is facing two felony counts of falsely obtaining a prescription. Eric Millerberg violated parole by using drugs and was sentenced for up to five years in prison on October 25.

    The couple have yet to be charged in connection with the 16-year-old's death. Prosecutors were waiting on autopsy results.

    Dea Millerberg’s defense attorney said he expects homicide charges to be filed against his client and her husband this month.

    Alexis Rasmussen was buried October 29. A memorial service was held in her home town of Ogden with mourners releasing hundreds of balloons into the sky in her memory.

    Tammy Reed, the aunt of Alexis Rasmussen, told The Salt Lake Tribune that the new developments surrounding the case are 'just sad'.

    Eric Millerberg was repeatedly in prison from 1997 to 2006 for burglary, discharge of a firearm and failure to stop at the command of police, according to Department of Corrections records.

    The Salt Lake Tribune also reported he was affiliated with Silent Aryan Warriors, a white supremacist prison gang group.

    She "wanted" to have a threesome with the couple. I knew it! Also, who has a babysitter watch their kids that's content in being paid with drugs. I'm far from perfect, but I cannot wrap my head around the logic some people use to guide their lives.
