Court overturns NYC man’s double murder conviction
https://nypost.com/2020/12/03/court-...er-conviction/
A state appellate court on Thursday overturned the conviction of a schizophrenic Staten Island man found guilty of murdering his parents.
Eric Bellucci, 40, now has a chance at a new trial after the ruling that found the Staten Island Supreme Court judge presiding over his first trial should not have ordered his counsel to present an insanity defense.
In August 2016, Bellucci was convicted of two counts of first-degree murder for the 2010 slayings and sentenced to life in prison.
He was deemed unfit to stand trial four times before a June 2015 examination determined he was competent as long as he continued to take his prescribed Lithium.
The panel of appellate judges also wrote that the state Supreme Court justice should have considered granting a second competency examination for Bellucci — who refused to take his medicine at Rikers Island while awaiting trial. He was also not speaking rationally to his lawyer, the ruling said.
Bellucci’s defense attorney and prosecutors had requested a new examination before the trial was set to begin, which the judge denied.
“We note that, while it is for the court to decide whether to order a competency examination, when both the defense and the People agree that a competency examination is warranted, the court should hesitate before disagreeing,” the ruling said.
According to the ruling, the court wrongly ordered Bellucci’s attorney to present an insanity defense, to which the defendant *objected.
The case is now back in the hands of the Staten Island Supreme Court “for further proceedings on the indictment,” according to the ruling.
Bellucci was convicted of fatally stabbing his parents, Arthur Bellucci, 61, and Marian Bellucci, 56, on Oct. 13, 2010, inside their home on Poillon Avenue in the affluent Annadale section.
He fled to Israel after the slaying but was soon captured.
Prior to a September 2011 court appearance, he likened himself to the city’s most notorious serial killing, yelling, “I’m the Son of Sam!”
I can't even begin to image how the poor family feels about this.
The article refers more than once to the "Staten Island Supreme Court." NY has Supreme Courts at the county level?
ETA: Eric Bellucci is batshit crazy, but the appeals court was right to overturn the verdict, IMHO.
You are talking to a woman who has laughed in the face of death, sneered at doom and chuckled at catastrophe.
