    Girl, 12, Taken Away in Handcuffs for Doodling on Her Desk

    A 12-year-old girl in New York City was not only suspended Monday, but taken in handcuffs to the police precinct across the street, for doodling on her desk with an erasable marker.

    Now, the New York City Department of Education has figured out that the punishment didn't fit the crime.

    "The principal made a mistake and the suspension has been lifted," Margie Feinberg, a spokeswoman for the New York City Department of Education, tells ParentDish in an official statement on Friday

    Feinberg adds the girl is back in her classroom and Principal Marilyn Grant is working to make amends with Gonzalez's family.

    Gonzalez was doodling her name on her desk at JHS 190 with an erasable marker when adults at the school caught her, slapped handcuffs on her and marched her to the police precinct directly across the street.

    Matthew Mittenthal, another spokesman for the Department of Education, confirmed the strange tale was true.

    The New York Daily News reported that police didn't know quite how to respond to the request to take the rogue scribbler into custody.

    "Even when we're asked to make an arrest, common sense should prevail, and discretion used in deciding whether an arrest or handcuffs are really necessary," police spokesman Paul Browne tells the Daily News.

    The trip to the police precinct and suspension were all for doodling "I love my friends Abby and Faith" and "Lex was here. 2/1/10" with a smiley face on her desk.

    Gonzalez tells the Daily News she spent several hours at the precinct.

    "I started crying, like, a lot," she tells the paper. "I made two little doodles. It could be easily erased. To put handcuffs on me is unnecessary."

    Her mother, Moraima Camacho, tells the Daily News her daughter's near-perfect attendance record has been marred by the suspension.

    "She's been throwing up," Camacho tells the paper. "The whole situation has been a nightmare."

    Gonzalez says she never thought doodling with a lime green marker would get her in so much trouble.

    "I just thought I'd get a detention," she adds. "I thought maybe I would have to clean [the desk]."

    Even though education officials are investigating, Department of Education spokesman David Cantor tells the Daily News the school's actions were clearly questionable.

    "Based on what we've seen so far, this shouldn't have happened," he says.

    Other New York students also have been handcuffed for minor infractions, according to the Daily News.

    Three years ago, a 13-year-old was arrested for writing "okay" on her desk at Intermediate School 201 in Brooklyn. Two years ago, the Daily News reports, a 5-year-old in Queens was cuffed and sent to a psychiatric ward after throwing a fit in his kindergarten class. Then, last year, a 12-year-old girl was arrested for doodling on her desk at the Hunts Point School in the Bronx.

    A class action lawsuit was filed by the New York Civil Liberties Union just weeks ago against New York City for using "excessive force" in middle and high schools.

    "This should be a wake-up call to the mayor, the city council and the Department of Education," Donna Lieberman, executive director of the NYCLU, says on the organization's Web site.

    "There is a crisis in our schools because they put the police in charge of routine discipline that ought to be handled by educators," she adds. "We all want safe schools, but that means that our children must be kept safe by those assigned to protect them."

    Even though she is no longer suspended, Gonzalez still went to family court Tuesday where she was assigned eight hours of community service and a book report. She also has to write an essay about she she learned through all this.

    "I definitely learned not to ever draw on a desk," she tells the Daily News.

    Honestly what a waste of tax payers money... The kid was arrested for drawing on the desk while someone out there who probably did commit a real rime is getting away.  You have to be kidding me.

    If I was a cop, and someone brought in a 12 year old on handcuffs and told me to jail them for writing on a desk...... I'd laugh, then arrest the teacher for false imprisonment. :lol:

    This is just like the recent news story of a kid that was nearly suspended from school for playing with a 2 inch gun that he attached to one of his Lego men. Never threatened anybody and was just playing a game with it during lunchtime.

    I am currently studying to become a teacher and I am appalled of the anxiety that each teacher and principal has over every little thing that goes on in the schoolroom. Being wary of violence, guns, and the such are much needed, but there are times like this that schools are becoming institutions solely of safety and not education.

    I hope things haven't changed too much in the seven years I have been out of high school in my area. I have enough anxiety in my life.  :-o :-P

    I was going to make a joke about you tripping the girl but it wasn't funny.

    Anyway, to make this thread more about me, my older son got in massive trouble in the fourth grade for writing, "Erick Yanez will die" on his desk in pencil.  The teacher and principal wanted to suspend him for "threatening the life of another student."  I pointed out that all my son did was write the truth, unless Erick Yanez was, in fact, immortal.  The charges were reduced to "defacing school property."  :lol: :lol:

    My ex-stepsister's son got in a fight with another kid at the bus stop.  Apparently the kid kept fucking with him for days.  Austin finally had enough and turned around and socked the kid.  He's 14 and now has a record for assault.

    Can't fight in school anymore without getting a record.  I would've been a repeat offender if those laws were implemented 15 years ago.

    I can understand the authorities getting involved if the child was constantly beating on other kids, or using weapons.  But what kid hasnt/doesnt get involved in a schoolyard or hallway scuffle? Or defended themselves from a bully by knocking them on their ass in front of their friends?  It was enough when I was in school to have to deal with my parents taking away my Playstation or my TV for fighting and getting suspended.  Why give kids a record on something that typical kids will do?  :|

    I have worked with some spiecal ed kids that needed handcuffs.  this young girl was a problem child.  The cold steel cuffs probably did her some good, place that fear in her heart about being arrested.

    Really? Emotionally traumatizing a child for doodling with an ERASABLE marker  is a good thing ? How was she a problem child? I used to scribble on desks when I was that age and I was an honor roll student. I turned out just fine.

    Lets keep it simple, this little girl probably has grown up watching death, violence and killing.  I have seen and been attack by seven year olds with knifes.  Handcuffs good idea.

    Spare the spanking and the child will be a problem all the years of her/his life.

    So you've known what this girl has seen huh? How do you know she has been subjected to that, perhaps she has lived a pleasant existence til now. This girl has no mental issues, is a good student, and by all accounts has outstanding character. She did something all kids have done at least once in their lives. Were you a perfect child?

    What is next, locking up three year olds when they take crayons to their bedroom walls?

    Oh! Or toddlers for throwing food.

    It's reprehensible that you were ever allowed to work around handicapped children.

    IDK about you guys, but I got suspended a lot for fighting in Jr. High.  Once, in high school, the school police officer attempted to "arrest" me for yelling at some girl how I was going to beat the shit out of her and she ran into a classroom. He didn't when I called his bluff. He was just trying to scare me but I was like MEH. I had straight A's, teachers loved me, I just didn't like people talking about me or to me, for that matter. :lol:

    It went well with my little 13 year old chola make up.

    Please confirm to me that not everyone in the NYC school system is this big a blundering moron???  Handcuffed??  REALLY?  Nowhere in the article said that she was a difficult child, so why the overreaction?  And to something so stupid but easily correctable?  Being on this site confirms my suspicion that far too many people in "charge" of things in this country (or world for that matter) are almost too stupid to breathe.

    Lol. Listen, this was excessive. I agree with all of you out there but holy fuck, you won't believe the bullshit we teachers have to put up with.
    Kids curse and doodle and refuse to do work all fucking day. They think that they can get away with any bullshit and if you don't like it you can suck it. That is their attitude. I don't get a whole lot of it bc I do get some respect but I have kids pulling some shit in my classroom almost daily that makes me want to pull my fucking hair out.
    Just today there was a kid arguing with another kid about closing the window, the kid just didn't want to close it. I asked him nicely to leave it open a crack to circulate the air a little but it was too cold to leave it open as much as he wanted it to be open. Would you believe the kid lost his shit on me and said I was attacking him and I had no right to ask him to close the window. I sent his disrespectful ass out of my classroom. He then proceded to slam the door. Like really, imagine years of that shit... You'll want to throw kids in handcuffs too.
    The secret is to have patience and hopefully a good dose of those moments where kids remind how good it is to be a teacher.
    Middle school kids are the worst. All you parents out there sometimes just want your kid out of your face on occation, imagine day in and out with 100 of them.  It's tough man. Really tough.
