    The 10-year-old Jean Paul Lacombe Diaz school bus video has been released by his mother, Berenice Diaz. Jean Paul Lacombe Diaz appeared scared, frantic, as he warns the investigator not to lead him into the hands of a man that calls himself father. We must warn you, this video is not easy to view.     What does Jean Paul Lacombe Diaz say to the investigator on the school bus?

    "He's not my dad. No, no, he's not my dad. Please help me he's not my dad. I don't want to live with him."

    The investigator questions the young boy's claims.

    Jean Paul Lacombe Diaz responded, "Because he hits me lots of times."

    Then the investigator suggests that they will not allow anything to happen to the child as they escort him off of the bus to continue his good byes to his mother and younger brother before carting him away in police vehicles towards Jean Philippe Lacombe's location.

    The mother, Berenice Diaz, was the legal guardian until on October 16, 2009 Jean Philippe Lacombe presented Texas District Judge Sol Casseb manipulated documents from the Mexican judicial authorities. The Judge decided to grant Jean Philippe Lacombe legal guardianship of Jean Paul Lacombe despite the fact that Jean Philippe Lacombe has illegally abducted his son a couple of years ago. It took Diaz up to two years to get her son back.

    Bexar County authorities are investigating as felony charges await Mr. Lacombe once in custody.

    San Antonio Attorney Miquel Ortiz represents the mother as he calls this a "government-assisted kidnapping."

    When Diaz and Lacombe's marriage dissolved in Mexico in 2005 Lacombe was given custody of his son until he fell short after taking Jean Paul Lacombe to France against the rules surrounding the guardianship. Custody was then given to Diaz.

    On October 15, 2009, one day before the Judge granted him custody, attorneys for Lacombe claimed that Jean Paul Lacombe was abducted by him. International Child Abduction Remedies Act once allowed the mother to gain custody of her son, but it is the same angle Lacombe used the Child Abduction Remedies Act against the Texas judicial system in regaining Jean Paul Lacombe, a double-edged low blow by attorneys. Now both prominent San Antonio attorneys for Lacombe have an attorney of their own.

    James Monnig and John Mead's attorney is H.E. Mendez who claims that they did nothing wrong.

    After the bus incident Berenice Diaz was sent her son's cell phone postmarked from San Antonio, Texas. Diaz admits that Jean Philippe Lacombe was now married to a Russian woman, but could be returning to either Mexico, France or even Russia. She stated that she thought her and her children would be together and safe in America as this latest kidnapping proved her wrong.

    Its so hard to see that boy so clearly distressed, how could the police not listen to that, court order or not...

    There is no reason that this should have happened. If a child is making this much of a fuss you listen. I agree with you even if there is a court order you need to take the child somewhere else. Go to the police station and sort it out there. I hope that he is found soon.

    Berenice Diaz Reunites With 11-Year-Old Son Early Monday Morning

    SAN ANTONIO -- Jean Paul LaCombe, 11, and his mother, Berenice Diaz, were reunited early Monday morning in France.

    A French judge granted custody of the 11-year-old Friday to his mother after an international custody battle that dated back to October 2009.

    Miguel Ortiz, an attorney representing Diaz, told KSAT by telephone in France, it was a very emotional reunion.

    Ortiz also said Jean Paul and his mother were driving back to Marseille.

    An attorney for Jean Philippe LaCombe, the boy's father, told KSAT Friday that LaCombe had planned to appeal the judge's decision.

    In October 2009, Bexar County constables took the boy off a school bus on a forged court order after the Bexar County District Attorney's Office said that LaCombe tricked a judge into giving him custody by presenting some forged documents. LaCombe then took his son to France.

    At one point, the pair was located by French police, but they were released after LaCombe convinced them that he had legal custody of his son.

    In June, a grand jury indicted LaCombe on charges of kidnapping, aggravated perjury and interfering with child custody.

    There is no word whether LaCombe will be extradited to the United States, but district attorney Susan Reed is working with the state department to have warrants executed on Lacombe in France.

    It's been two years since deputy constables pulled a screaming Jean Paul Lacombe, then 10, from his school bus and handed him over to his millionaire father, who then disobeyed court orders and abducted the child. Despite numerous court rulings since then, the international custody battle is still on.

    A French court ordered Lacombe to be handed over to mother Berenice Diaz of San Antonio in August 2010 after authorities tracked down the father, Jean Philippe Lacombe, on the French Riviera.

    The father — a dual citizen of Mexico and France who still is wanted in Bexar County on felony charges of kidnapping and perjury — does not appear to have returned to the United States.

    But on Thursday, his attorneys went before the 4th Court of Appeals without him, arguing that all prior rulings by Texas judges — and by the French court, which they say relied on those rulings — should be voided.

    The father never was properly notified of the Texas court hearings, they argued.

    Justices Karen Angelini, Steven Hilbig and Marialyn Barnard asked pointed questions of both sides during an hour of oral arguments. The court is not likely to issue a ruling for weeks or months.

    “We're asking the courts of Texas to ... restore the status quo that existed before this conflict,” said Houston-based attorney Jeff Nobles, part of Jean Philippe Lacombe's legal team. “The child was with his father.”

    Both sides have produced conflicting documents and have heatedly disputed which parent the Mexican courts favored after their divorce in 2005.

    In August 2010, after Jean Philippe Lacombe and his son had been missing for 10 months, state District Judge Larry Noll allowed a hearing to take place without Lacombe or his lawyers present.

    Noll ruled that the Mexican court documents gave the mother custody. Weeks later, the French tribunal made a similar ruling.

    Beth Watkins, an attorney for Diaz, argued to the appellate panel Thursday that everything was done properly to serve notice to Lacombe, despite his being in hiding at the time. Under Mexican law, they were allowed to instead serve his attorney with notice, she said.

    “Just because they say, ‘Nanny-nanny-boo-boo, we're sending (the notice) back to you,' ... doesn't mean service was not completed,” she argued. “I think he received notice.”
