Family seeks damages after autistic 8 year old is arrested

SANDPOINT, Idaho -- The family of an 8-year-old girl with an autism disorder who was arrested at school in January has filed a tort claim asking Bonner County officials to pay damages for the incident.

In their claim, Charles and Spring Towry ask for more than $500,000 in damages. The school district and county have 180 days to settle or reject the claim and risk a lawsuit.


The Ponderay couple's third-grade daughter, Evelyn, has Asperger syndrome, an autism spectrum disorder. She was arrested on suspicion of battery at Kootenai Elementary School Jan. 9 after staffers said she spit on and inappropriately touched two instructors.

The child was handcuffed and taken to the county's juvenile lockup, where she was released to her parents. The county prosecutor later dropped the charge against the girl.

You've got to be kidding me. This girl is only eight.
I worked with autistic children for two years and that shit happens sometimes, you have to learn to deal with it.
You don't go calling the police when you could just sit them in time out for five minutes.

Seriously. If they already knew she was autistic, this is definately the wrong way to deal with this kind of situation. From what I understand misunderstandings happen all the time and they don't understand the social rules, or do naughty things when they get angry. When I was a child, even as a non-autistic child, if you spat at a teacher or misbehaved you would be sent to the principle's office and your parents would be called. Not to jail.

Good luck to them in thier damages claim, they deserve it!

I have Asperger's.  Never touched or spit on a teacher though.  But I did kick one in kindergarten when they tried to grab my hand and lead me inside once.

I have a friend, who's boy is autistic, she said he kicks out a car window at least once per month :( He's 8. Once she looked away from him for a few seconds. He got into the van, spilled and smashed popcorn everywhere. Got out of the van and got into the sprinkler fully clothed (she said thank GOD fully clothed) You must have great patience to work with these kids. Poor little girl.

They sound... vicious at times but when you have them relaxed they are the most affectionate children. I remember I worked with this little boy, he'd throw fits but as soon as you sat him on your lap and read him a story he'd cuddle up to you and couldn't be happier.
