    The man accused of killing college student Kristin Smart in 1996 will stand trial for her death

    The man accused of killing 19-year-old college student Kristin Smart in 1996 will stand trial for her death, according to the San Luis Obispo County District Attorney's office.

    Paul Flores, 44, faces a first-degree murder charge for allegedly killing Smart in his Cal Poly San Luis Obispo dorm room. Prosecutors say Flores raped or attempted to rape Smart, who was then a freshman at the university. His father, Ruben Flores, 80, is charged as an accessory to the murder, and prosecutors say he helped hide Smart's body.

    The preliminary hearing for the pair lasted weeks and wrapped up on Monday. The DA's office tweeted Wednesday that a "judge has determined sufficient evidence was presented for the two to be tried."

    "We continue to support the family of Kristin Smart as we work toward justice," District Attorney Dan Dow said in the tweet.

    The trial for the father and son charged in the murder of Cal Poly student Kristin Smart will begin April 25, 2022, a judge announced Wednesday morning.

    Prosecutors in San Luis Obispo charged Paul Flores with murder in the 1996 disappearance of Smart. His father, Ruben, is accused of being an accomplice for allegedly helping bury her body.

    The men pleaded not guilty Wednesday morning.
    I can't wait to see these guys get what they deserve.

    Defense attorneys file motion to dismiss Kristin Smart murder case. Here’s what both sides say

    An 85-page court motion to dismiss the murder case against Paul Flores was filed last month in San Luis Obispo Superior Court, contending that the allegation he murdered missing Cal Poly student Kristin Smart lacks credible evidence. The motion calls into question the reliability of witnesses, cadaver dog alerts and alleges an “orchestrated” series of moves by law enforcement leading up to his arrest for the murder of Smart, whose body has never been recovered. The motion, filed Dec. 17 by Flores’ attorneys Robert and Sarah Sanger, also cites the influence of the popular “Your Own Backyard” podcast and a social media campaign that has unjustly “convicted” Flores of Smart’s murder.

    The San Luis Obispo County District Attorney’s Office fired back with a 47-page opposition Monday — contending there is a rational basis for trying Flores based on the collective witness statements and physical evidence. Deputy District Attorney Christopher Peuvrelle wrote that Flores lied about a black eye when police questioned him after Smart went missing and that cadaver dog alerts were reliable resources to gather evidence in locations such as Flores’ dorm room and at his father’s property in Arroyo Grande.

    Peuvrelle cited Judge Craig Van Rooyen’s September ruling of sufficient evidence to proceed to trial after a 22-day preliminary hearing of evidence and arguments. The trial is scheduled to begin in April.

    Agree. I hope they allow cameras because I will be watching.
