He has now been charged with melesting one other girl back then and Illegal sex with another minor after Alycia went missing before he moved to LA and has a child with her, (he kid part is what I heard around town, but 95% sure it is valid). I have to live in the community where these horible crimes accused took place. I also have to endure reading in our local newspaper how our county jail still feeds and houses a sick monster like this. Terrible what he did to his daughter and he got away with harming others. Is he definitely still unable to get the death penalty? Just seems like a large range of heinous crimes to not warrant the possibility.

A potential conflict of interest prompted a judge on Monday to remove a defense attorney from a capital murder case for a man accused of murdering his teenage daughter and burying her body in the back yard of their Ceres home.
Mark Edward Mesiti, 45, is charged with first-degree murder in the death of his 14-year-old daughter, Alycia Mesiti. He also faces 44 counts of sexually abusing his daughter, including rape, committing lewd acts upon a child, sexual penetration with a foreign object, sodomy, oral copulation and using a minor to pose or model sexual conduct.
Defense attorney Robert Chase told the judge he had a potential conflict of interest that would prevent him from representing Mesiti. He was serving as the defendant's "Keenan counsel," a second defense attorney who would handle the penalty phase if Mesiti was convicted as charged.
Stanislaus County Superior Court Judge John Freeland agreed to relieve Chase and scheduled Mesiti to return to court Feb. 4 for another pretrial hearing. The court will have to appoint a new Keenan counsel.
Robert Orenstein will remain as Mesiti's defense attorney handling the trial phase. In July, Freeland denied Mesiti's motion to have the court remove Orenstein from the case.
The judge heard Mesiti's reasons for the request of a new court-appointed attorney in a closed courtroom. These hearings are closed to all but the judge, defendant, defense attorney, bailiff and court reporter.
Prosecutors are seeking the death penalty. A special enhancement has been added to Mesiti's charges, alleging that he committed murder before or during rape, sodomy, oral copulation or rape by an instrument, according to a criminal complaint. The enhancement makes the case eligible for the death penalty.

Alycia's body was unearthed March 25, 2009, from the back yard of the Alexis Court home. In the meantime, Mesiti and Walker-Welborn had moved to Los Angeles.
Days after the gruesome discovery, Los Angeles police arrested Mesiti, who was convicted March 18, 2011, of manufacturing meth. He was returned to Stanislaus County in June 2011.
The prosecutor has filed additional sex abuse charges against Mesiti involving two other girls. One girl was 8 years old when she was sexually assaulted, authorities said, and the other was 16 and 17 years old when she was assaulted. The victims are identified as Jane Doe 1 and Jane Doe 2 in court documents, and authorities are not disclosing their relationship to Mesiti.

This case has always bothered me for several reasons. Modesto is my hometown and Ceres is actually the last place I lived before I moved to the East coast so I have been keeping up with the case (or the little bits that have been released).

A former Ceres man facing the death penalty in the death of his teenage daughter will represent himself in court, giving him the ability to cross-examine prosecution witnesses and argue in front of a jury.
Along with the capital murder charge, Mark Edward Mesiti is charged with more than 40 counts of sexually abusing his 14-year-old daughter, Alycia Mesiti. Her body was found buried in a Ceres home's backyard six years ago.

Mesiti, 47, unexpectedly asked to represent himself Tuesday morning, moments before a crucial hearing was supposed to start. His attorneys were expected to challenge the charges against their client, arguing there wasn't sufficient evidence to support allegations that Mesiti killed his daughter while engaged in or trying to commit sexual abuse on the girl.
Defense attorneys Martin Baker and Doug Maner were expected to ask the court to drop the murder charge, along with the sexual abuse enhancements. But the defense requested that the hearing be postponed, which was denied by Stanislaus Superior Court Judge Thomas Zeff. The defense also asked the judge to close the courtroom to the public for the duration of the hearing, which the judge also denied.
That's when Mesiti told the judge he wanted to legally represent himself. Judge Zeff then asked Mesiti whether he was ready to proceed with Tuesday's hearing. Mesiti said he was not, because he had read only a rough draft of the motion to dismiss the murder charge and enhancements.
The case was then sent to Judge Dawna Reeves, who will preside over the capital murder trial.
"I have some grave concerns that this is being done for the wrong reasons," Reeves told Mesiti about his request to represent himself. "I'm hoping that's not true."
The judge asked the defendant whether he understood well all 52 criminal charges against him and the enhancements. Mesiti told her he understood all the allegations listed in the "voluminous" indictment. "I'm fully aware of it, your honor," he said.

Reeves warned him about what's involved when a defendant acts as his own attorney. She told him there will be no special help for him from the court, and that there will not be any extra assistance from the prosecutor assigned to the case.
The judge told Mesiti that he will be responsible for all the duties his attorneys would handle. She also warned the defendant that he can't later appeal a ruling or verdict, claiming he wasn't capable of acting as his own attorney. She advised Mesiti that a defendant asking for self-representation is "almost always unwise, especially in a case of this magnitude."
The defendant said he completed high school and has some community college education. Mesiti, who remains in custody at the county jail, told the judge that he has access to a law library and some help from consulting attorneys, so he will be capable of handling the case. "I intend on putting things together," he said in court.

Chief Deputy District Attorney Annette Rees argued that she was worried about the court giving Mesiti access to photos that she said depict sexual abuse of the girl. The prosecutor suggested that a prosecution investigator could meet with Mesiti and show him the photos, instead of leaving the photos with Mesiti to keep while in jail.
The prosecution argues that the girl was drugged, and that Mesiti photographed himself sexually abusing his daughter while she was unconscious.

After just a few days of testimony in his murder trial, Mark Edward Mesiti on Tuesday pleaded guilty to all charges involved in the drugging, sexual abuse and killing of his teenage daughter, Alycia Mesiti.
The jury had already been shown about 100 child pornographic images found on the defendant's computer. Those illicit images included 54 pornographic photos in which Mesiti's ex-girlfriend, Shelly Walker, identified the defendant with his daughter. The jurors also had watched a video in which the defendant was setting a hidden camera in Jane Doe 2's bedroom.
In the coming days of the trial, Ceres police Detective Arthur Hively was expected to show the jury the rest of about 1,700 child pornographic images and videos investigators found on Mesiti's computer files.
Judge Reeves recited in court each of the charges listed on Mesiti's criminal indictment, along with every enhancement added to the charges. Each time the judge recited a criminal charge, Reeves asked the defendant for his plea. Mesiti pleaded guilty 49 times; the process took about 45 minutes.
The District Attorney's Office also wrote an allocution statement listing in explicit detail every act of sexual abuse he committed on his daughter and the two other girls. Prosecutors required Mesiti to read this statement in court admitting he committed these acts of abuse in order to get his deal to avoid trial and a possible death sentence

The judge said Mesiti took the childhood and innocence from his victims, using intoxicants to sexually assault these girls while they were unconscious.
The proceedings included two more emotional victim impact statements, and there also was an outburst from a woman claiming to be Mesiti's sister who was ushered out of the courtroom.
"The defendant took advantage repeatedly of the most sacred position of trust," Reeves said in court. "He molested his daughter to death, wrapped her in a bag and buried her."
Mesiti on Oct. 17 pleaded guilty to more than 40 criminal charges stemming from his daughter's death. His plea deal would result in a sentence of life in prison without parole. Prosecutors had been seeking the death penalty.
