The direction your eyes/head shifts toward is very real. It's just misunderstood, I think.

When a person is asked a question and they answer truthfully, their eyes and head shift in one direction. (i.e. "What places did you and Travis travel to?" - maybe you tilt your head up, your eyes shift right - when you are trying to remember something that actually happened.)

However, when a person is lying, they shift their eyes and body in a DIFFERENT direction. (i.e. "Jodi, did you stab your bf in the face?" - her eyes shift down, can't keep eye contact, etc.)

So it's not like "Oh well if you're lying you look left." You have to ask the person a few control questions first that they'd have no reason to lie about, to get a feel for how they move/react when they are being honest. Then when you pop the big question, it's extremely noticeable that they're uncomfortable and not being truthful. You'd never even know you did it unless you actually saw yourself on a TV screen trying to lie. It's actually really cool.

It's a part of NLP (Neuro-Linguistic Programming) that cops use when they interrogate - it's called "Kinesic Interviewing."

just a little tid bit - there is no such thing as an innocent verdict - it's not guilty.  So although you are innocent until proven guilty, you are not found innocent in the end, just not guilty.

I don't think she will be able to submit any surprise evidence or anything that will be disclosed only when shes in court. I don't know about murder cases but usually you have to give up everything you know/have before court. Even with witnesses, you have to tell the courts why you want that person as a witness and what they are testifying to.

The abuse shit wont stick, the only way the judge will even consider it is if she has police records showing he has a history of abuse or a therapist who has diagnosed jodi as an abused woman.

yeah I know. Still, my child custody trial started almost a year ago. It still doesn't seem like a long time for a murder trial.

Or do you have to go in say like once every 3 months, then the your case gets adjourned for reports to be made etc..then back in to court etc?

Because if you are counting from when legal proceedings started, then hers started in the summer, so I suppose by the time hers is done it will probably be June/July 2010 and taken a good couple of years.

They reckon it will be about 4 months for all the evidence to be presented and then the defence case, then will there be a gap between her being found guilty(/not guilty) and her sentencing.

I'm probably just being dozy,  Hotsauce. But I'm not sure what you mean?

Your trial didn't start over a year ago.  A trial begins when the jury is seated or with opening statements in the case of a bench trial.  A case begins with the filing of a petition/complaint/indictment etc., then there is a discovery period, then pre-trial, and then trial, verdict/ruling/finding etc., then post trial motions, and then appeal.

My trial started in August 2008, the case started in March 2008. It keeps getting continued because there are so many witnesses and the schedules are so backed up we can't get everyone in at once.. I've had 4 solid days of trial. My last one will be on May 12th. It was supposed to be April 2nd but one of the lawyers mom died and we didn't protest their request for a continuance.

my witnesses are expert witnesses, therapists, child and family investigator, psychiatrists, as well as teachers and the school principal. Some family members like my aunt and my sister.

Her witnesses are one of her daughters, her lawyers wife, a couple people she baby sits for, her daughters boyfriend, and her own therapist.

I was on the stand for over 3 hours and I'm still not finished. the child investigator was on for 3 hours as well.

the criminal trial will not be like that.  They will meet everyday until it is over.  There may some occasional breaks but the witnesses will have to be there when they are subpoenaed.

yeah, that's why I said "I don't know about a murder trial". I just know that when it comes to court shit it usually takes a long time. I can see how this would take 4 months. Unless they have a lot of info that hasn't been publicly disclosed, There is a lot to cover.

I understand testimony taking a long time.  I don't understand why your trial is all together.  I guess it depends on the judge and what he will allow, but I've never seen a trial start in one month and then witnesses come back in another month.  I've seen different stages of a court case require testimony, but not the trial itself.
