A group of young men try to break into a valley home, now one suspect is dead, another is in jail, and at least one is still on the loose. Police say the group tried to break in a back window of the home and that's when the homeowner started shooting.

The shooting happened late Sunday night on Night Breeze drive near Vegas and Buffalo. At this point police have not arrested the homeowner. The facts they have collected so far give no reason for him to be under arrest.

That could change, however, because the investigation will be forwarded on to the district attorney. And prosecutors will have to decide if there was any negligence on behalf of the homeowner.

It's a neighborhood where people definitely go above and beyond when it comes to security bars and alarm systems. According to police, around 9:30 Sunday night a group of young men rang the doorbell. When the homeowner wouldn't answer the men went around the back gate and attempted to break in through a window.

Police say the homeowner fired a gun several times through the window. One of the suspects, who we found out was a 15 year old boy, was shot and died at the scene. A second suspect, 20 year old Matthew Carpenter, was caught by police nearby. He was arrested on several counts, including attempted burglary.

News 3 talked to district attorney David Roger and he said situations like this are reviewed on a case by case basis. When looking at whether a homeowner will be charged in a case like this they take into consideration whether there was reasonable fear that his life was in danger.

According to the coroner, the boy who died was 15-year-old Damien Clary. He died from a gunshot wound to the head.

The worst part of this is somehow this kids family will try and make it seem like he was the victim.  I am a firm believer in if you are breaking into a house and the homeowner shoots you, oh well, thems the breaks.

Exactly..The homeowner had every right to do what he did..And maybe its cold, but I have no sympathy for the kid no matter how young he was. He was old enough to know you cant just go break into someones house & have no consequences

Seriously. If you break into someone's house, they have NO IDEA what you have planned to do to them, or their family.
You put your life at risk when you step onto someone's property!

Yeah, I know where my gun is, and if you are attempting to come in, best believe you might get shot.
